A regular meeting of the Southold Town Planning Board was
held at 2:00 p.m. , Monday, July 149 1980, at the Town Hall, Main
Road, Southold, New York.
Present were:
Chairman Henry E. Raynor, Jr.
Vice-Chairman .Frederick E. Gordon
Member Bennett Orlowski, Jr.
Member James Wall
Ernest Radford attended the meeting requesting information on
dividing a piece of property in a way which would make one lot
undersized. Mr. Raynor explained the procedure to him which
starts with bringing his proposal to the building inspector.
FIDCO open development was discussed briefly. A letter is to. be
written to Mr. Noyes, President of FIDCO, informing him that the
Planning Board would like to meet with him at 1:30 p.m. on the
day of the annual trip to Fishers Island to discuss with him all
future subdivisions and, sales .of property under. FIDC.O' s jurisdiction
on Fishers Island.
On motion .made by Mr. Orlowski, seconded by Mr. Wall, it was
RESOLVED, that whereas', a formal application for the approval
of a subdivision plat, entitled BaVview Woods Corporation was
submitted to the Planning Board on January 5, 1979, and an application
fee of $195.00 was paid on January 59 1979, and
WHEREAS, a public hearing was .held on the said subdivision
application and final map at the Town Hall in Southold, New York, on
June 2, 1980 at 8:30 p.m. , and
WHEREAS, the requirements of the Subdivision Regulations of
the Town of Southold have been met by said plat and application

with the exception of the pending report of the Superintendent of
Highways, receipt of the bond for the improvements and receipt of
the inspection fee by the Town Clerk,
Now, therefore, be it RESOLVED that the application of
Bavview Woods Corporation for approval of said subdivision plat
prepared by Howard Young dated December 12, 1979 and amended April
25, 1,980, be approved subject to receipt of the above items and
that the Chairman of the Planning Board be authorized to endorse
approval on said subdivision Plat.
Vote of the Board: Ayes : Raynor, Gordon, Wall, Orlowski
Mr. Raynor reported that on July loth he, along with Zoning Board
of Appeals Chairman Charles Grigonis, Sr. Building Inspector George
Fisher, met with Town Attorney Robert Tasker in relation to some
pending problems.
The matter of the bonds on which the time has expired to
perform the improvements was discussed. Mr. Tasker suggested that
a letter be written to the Town Board stating that these bonds have
run out, the extension times have run out, and the Planning Board
feels the Town Board is sitting on them and they should make the
decision on calling the bonds and making improvements. The Planning
Board has chosen not to give any further extension.
2:15 p.m. Public Hearing on the question of the approval of the
minor subdivision of Robert W. and Anita M. Feagles located at
Fishers Island. Mr. Raynor read the legal notice of hearing and
presented proof of publication in the Long Island Traveler-Watchman.
Mr. Raynor reviewed the file.
Mr. Raynor: Is there anyone that wishes to be heard in opposition
to this subdivision? Is there anyone that wishes to be heard in
favor? Is there anyone that wishes to be heard either way? (There
was no one in attendance at this meeting at this time with the
exception of the board. )
On motion -made by Mr. Wall, seconded by Mr. Orlowski, it was
RESOLVED, that whereas, a formal application for the approval
of a subdivision plat, entitled Minor Subdivision of Robert W. and
Anita M. Feagles was submitted to the Planning Board on June 16,
1980, and an application fee of $100.00 was paid on June 16, 1980,
and
WHEREAS, a public hearing was held on the said subdivision
application and final map at the Town Hall in Southold, New York,
on July 14, 1980 at 2:15 p.m. , and
WHEREAS, the requirements of the Subdivision Regulations of
the Town of Southold have been met by said plat and application,

Now, therefore, be it RESOLVED that the application of Robert
W. and Anita M. Feagles for approval of said subdivision plat
prepared by Chandler, Palmer & King dated June 12, 1980, be approved
subject to the following conditions of the Suffolk County Planning
Commission being placed on the map and that the Chairman of the
Planning Board be authorized to endorse approval on said subdivision
Plat upon compliance with same.
This subdivision is in close proximity to Elizabeth
Field and, therefore, may be subjected to noise
emanating from the facility and from aircraft taking
off and landing at the airport.
Vote of the Board: Ayes: Raynor, Gordon, Wall, Orlowski
It will be necessary to make a declaration on this matter in regard
to the State Environmental Quality Review Act upon receipt of
comments from the agencies involved.
The minor subdivisions referred from<%the Board of Appeals for
Irene Cardinale, Adeline Cardinale and Stanley Chase were tabled for
the proposed grandfathering of these actions.
This is another matter that was discussed with Town Attorney
Tasker at the above-mentioned meeting. It is proposed to include
in the subdivision regulations the 337 actions from 1971 to September
of 1979 of the Zoning Board of Appeals dividing property with
variances. The Town Attorney will make a draft of the proposal and
submit same to the Planning Board. Mr. Raynor will discuss the
matter with the Town Board upon receipt of the proposal.
Fanny Behlen Community Health Center presubmission conference on site
plan. Sherley Katz, Director, and Gordon Ahlers, Engineer, appeared
before the board. This will be an ambulatory center for primary health
care licensed by the State of New York. It will have 100% Federal
funding. This is not a poverty program. Health care will be available
to everyone. There will be two doctors, one dentist., and two nurses.
There will be services from Greenport utilities for sewer and water.
Ms. Katz will send a copy of the agreement with the Village of Greenport.
it will be open five and a half days a week with staggered hours.
There will be a mental health program and family planning. A lighting
schedule will be necessary along with the landscaping schedule for
screening the perimeter of the property. The zoning use is A Residential .
In regard to future expansion it may be in the far future. Mr. Raynor
mentioned that the Planning Board has always been favorable to -
colonial motif. Ms. Katz feels it is unnecessary for a medical facility
and feels it should look like one. It would also be more expensive.
This facility will serve Southold and Shelter Island towns.

Planning Board -4- '.y 14, 1980
Mr. Molfetas and Mr. Luce appeared before the board in regard to the
Henry Tasker property at the intersection of Sound Road and North
Road at Greenport. Mr. Molfetas is interested in seeking a change of
zone for motel units with recreation and barbecue area and possibly
some sort of fast food restaurant and snack bar to accommodate people
at the motel and others. He will need a change of zone to multiple
for the motel area and business for the restaurant.
Prellwitz minor subdivision. The Planning Board Inspector, John W.
Davis, will be requested to give his recommendations and comments on
the right-of-way as it exists in this proposed minor subdivision.
Harbor Lights, Section IV. The report on this matter will be held
over until July 28th.
On motion made by Mr. Gordon, seconded by Mr. Wall, it was
RESOLVED to .approve the sketch map of the minor subdivision of
Ronald & Edith Reese located at Southold, said map dated July 9,
1980.

On motion made by Mr. Gordon, seconded by Mr. Orlowski, it was
RESOLVED, that whereas, a formal application for the approval of
a subdivision plat, entitled Minor Subdivision of Ruth Emerson Cooke
and Claire G. Emerson was submitted to the Planning Board on January
7, 1980, and an application fee of $20.00 was paid on January 7, 1980,
and
WHEREAS, a public hearing was held on the said subdivision
application and map at the Town Hall in Southold, New York, on June 2,
1980, at 7:30 p.m. , and
WHEREAS, the requirements of the Subdivision Regulations of
the Town of Southold have been met by said plat and application,
Now, therefore, be it RESOLVED that the application of Ruth
Emerson Cooke and Claire G. Emerson for approval of said subdivision
plat-prepared by Roderick Van Tuyl, P.C. , dated December 5, 1979
with amendments on March 28, 1980; April 11, 1980; and May 1, 1980
be approved and that the Chairman of the Planning Board be authorized
to endorse approval on said subdivision Plat. ,:.,(j '

On motion made by Mr. Orlowski, seconded by Mr. Gordon, it was
RESOLVED that the Southold Town Planning Board agrees with the
conditions of the Suffolk County Planning Commission as follows:
with reference to Whitcom Realty Company subdivision.
1. No sanitary disposal facility shall be located within 100
feet of the top edge of the bluff or within 100 feet of the
edge of the freshwater marsh.
2. No grading shall be permitted within 50 feet of the top edge
of the bluff except that that may be necessary to control or
remedy erosion or to divert stormwater from flowing over the
edge and down the face of the bluff.
3. Clearing and cutting of vegetation within 50 feet of the top
edge of the bluff shall be limited to that necessary for
maintenance and the removal of dead or diseased vegetation.
4. No stormwater resulting from the development of any lot shall
be discharged down the face of the bluff in any manner or
directly into the freshwater marsh area.
5. Access down the bluff to the beach shall be restricted to a
structure designed and constructed in such a manner as to result
in a minimum disturbance of the bluff. Access structures
shall be limited to one. for every two lots located on or near
the lot line common to two lots and shall be shared by the
owners of the two lots.
6. Adequate drainage structures shall be provided to contain within
the site all stormwater runoff resulting from the development
and improvement of the subdivision or any of its lots so that
the runoff will not flow into the state road.
7. Provision shall be made to widen the east-west leg of the
right-of-way to 60 feet and to reserve to the Town the right
to utilize this portion of the right-of-way for the collector
road shown in the Town' s Master Plan.
8. The right-of-way shall be extended to the easterly property
line to provide for the aforementioned proposed collector road.
9. A short radius curve of 20 feet shall be required where the
right-of-way makes a sharp bend.
These conditions are to be placed on the map before signature.

There being no further business to come before the Board, Mr.
Orlowski made a motion, seconded by Mr. Gordon and carried- to adjourn
the meeting. Meeting adjourned at 3:45 p.m.
