GORDON 765-1938 JAMES WALL BENNETT ORLOWSKI, Jr. GEORGE RITCHIE LATHAM, Jr. A regular meeting .of the Southold Town Planning Board was held at 7:30 p.m. , Monday, January 5, 1981, at the Town Hall, Main Road, Southold, New York. Present were: . Chairman Henry E. Raynor, Jr. Vice-Chairman Frederick E. Gordon Member Bennett Orlowski, Jr. Member G. Ritchie Latham,, Jr. 7:30 p.m. Public Hearing on the question of the approval of the minor subdivision of James Wheeler located at Southold. Mr. Gordon made. a .motion, secondedUy--Mr. Orlowski and carried to dispense with. the reading of the metes. and bounds description. Mr. Raynor presented proof of publication in the Long Island Traveler-Watchman. Mr. Raynor: In reviewing the file I find the filing fee in the amount of $50 with receipt from the Town Clerk' s. Office. This is a referral from the Board of Appeals and has been forwarded to the Suffolk County Department of Health Services, short environmental assessment form, copy of the metes and bounds description and copies of the correspondence between the attorney and this board, copy of .the applicant' s application, etcetera. This is set off by the Board of Appeals. It has been .referred to us by them. I do not have a copy of the action of the Board of Appeals in the file. Is there anyone that wishes to be heard in opposition to this subdivision? Hearing none, is there anyone that wishes to be heard in favor? Hearing none, I will declare this hearing closed. (There was no one in attendance at the meeting. ) On motion made by Mr. Gordon, seconded by Mr. Latham, it was RESOLVED that whereas, a formal application for the approval of a subdivision plat entitled Minor Subdivision of James R. Wheeler Planning Board, -2- January 59 1981 was submitted to the Planning Board on December 5, 1980, and an application fee of $50 was paid on December 5, 1980, and WHEREAS, a public hearing was held on said subdivision application and plat at the Town Hall, Southold, New York, on January 5, 1981 at 7:30 p.m. , and WHEREAS, the requirements of the Subdivision Regulations of the Town of Southold have been met by said subdivision plat and application, Now, therefore, be it RESOLVED that the application of James R. Wheeler for approval of said subdivision plat prepared by Roderick Van Tuyl, P.C. dated November 24, 1980, be approved and the chairman be authorized to endorse approval on said subdivision plat. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham Mr. Gordon made a motion, seconded by Mr. Latham and carried to approve the minutes of the regular meeting of December 15, 1980. On motion made by Mr. Gordon, seconded by Mr. Latham, it was RESOLVED to recommend to the Southold Town Board that the bond for improvements in the subdivision known as "Greenbriar Acres" not be released. Vote of the Board: Ayes: Gordon, Latham, Orlowski Abstain: Raynor Mr. Raynor abstained from taking action regarding this subdivision as he has done in the past because his business partner, Alma Suter, is the owner of property immediately to the east of this property. 7:45 p.m. Public Hearing on the question of the approval of the minor subdivision of Dante and Helen .Catullo located at Mattituck. Mr. Latham made a motion, seconded by Mr. Orlowski and carried to dispense with the reading of the metes and bounds description. Mr. Raynor presented proof of publication in the Long Island Traveler-Watchman. Mr. Raynor: In the file we have a receipt for $50 and declaration of lead agency and approving sketch map. on November 18th. We have a waiver of subdivision requirements, letter to the Environ- mental Analysis Unit and the Suffolk County Department .of Health Services and New York State DEC regarding the SEQRA, short Planning Board J- -3- January 5, 1981 environmental assessment form and metes and bounds description, copy of application. As if the policy of this board, I will ask if there is anyone that would like to speak in opposition to this subdivision? Hearing none, is there anyone that would like to speak in favor? Hearing none is there anyone that would like to speak in any way? There being no one wishing to be heard we will deem this hearing closed. The following was introduced by Mr. Orlowski and seconded by Mr. Latham and carried. Pursuant to Article 8 of the Environmental Conservation Law State Environmental Quality, Review Act and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that Southold Town Planning Board as lead agency for the action described below has determined that the project will not have a significant effect on the environment. DESCRIPTION OF ACTION The minor subdivision of Carl J. Schmid is a three lot residential subdivision located at Fishers Island. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. Because there has been no response in the alloted time from the New York State Department of Environmental Conservation it is assumed that there is no objection nor comments by that agency. Because there has been no response in the alloted time from the Suffolk County Department of Health Services it is assumed that there is no objection nor comments by that agency. The project will meet all the requirements of the Code of the Town of Southold Subdivision of Land Regulations. Further information can be obtained by contacting Ms. Muriel Tolman, Secretary, Southold Town Planning Board, Main Road, Southold, New York 11971. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham Planning Board', -4- January 5, 1981 The Town Clerk. has requested that the Planning Board check with the Village of Greenport relative to their agreement with Mr. .Wilsberg for items contained in the bond estimate for improvements for Long Pond Estates. The secretary has been in contact with Superintendent of Utilities James I.. Monsell of the Village of Greenport. The hydrants, water mains and service lines will be owned and maintained by the Greenport Village Water Co. The hydrants are furnished by the Water Co. free of charge. Mr. Monsell stated that as of December 19, 1980 no agreement had been entered into with Mr. Wilsberg. He feels the amount being included in the bond is a control factor so that the work is completed. Greenport provides constant inspection during the laying of the pipe. This information will be transmitted to the Town Clerk. The Board discussed the East-West road in the Mattituck section of the town. The secretary was directed to send the map to the county for its comments after a meeting has been held with the entire committee which includes Councilman Nickles. Mr. Orlowski will arrange the meeting. The Board reviewed a report prepared by the secretary regarding the activities of the Board for the 1980 year. Included were the following: 51 minor subdivisions, 9 of which were ZBA referrals 9 referrals from the building inspector and ZBA regarding parking requirements 3 change of zone referrals from the Town Board 5 site plan reviews 10 pending major subdivisions 7 new major subdivisions 9 miscellaneous matters A letter will be sent to the Town Board and will include this report. Notation will be made of the upswing of minor subdivisions within the town and the pending major subdivisions. On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that whereas, a formal application for the approval of a subdivision plat entitled "Honeysuckle Hills" owned by Walter Gatz was submitted to the Planning Board on January 2, 1980, and an application fee of $155 was paid on January 2, 1980, and WHEREAS, a public hearing was held on said subdivision application and plat at the Town Hall, Southold, New York, on November 24, 1980 at 9:00 p.m. , and f .'" Planning Board' -5- January 5, 1981 WHEREAS, the requirements of the - Subdivision Regulations of the Town of Southold have been met ;by said subdivision plat and application, Now, therefore, be it RESOLVED that the application of Walter Gatz for approval of said subdivision plat prepared by Young & Young dated June 23, 1980, ;be approved and the chairman be authorized to endorse approval on said subdivision plat subject to the following: 1. Presentation of acceptable plans for the stairs to the beach. 2. Consideration of the conditions of the Suffolk County Planning Commission. 3. Presentation to the Town Clerk of a bond in the amount of $789000. 4. Presentation to the Town Clerk of the inspection fee in the amount of 4% of the approved bond. 5. A Homes Association acceptable to the Town Attorney and the Town Board. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham There being no further business to come before the Board, Mr. Orlowski made a motion, seconded by Mr. Latham and carried to adjourn the meeting.
