A regular meeting of the Southold Town Planning Board was held
November 8, 1982, 7 :30 p.m. at the Town Hall, Main Road, Southold,
New York. Present were:
Chairman Henry E. Raynor, Jr.
Member G. Ritchie Latham, Jr.

7 :30 p.m. Public Hearing on 'the question of the approval of the
preliminary map known as Homestead Acres, located at Greenport. This
hearing was adjourned at the previous Planning Board meeting at the
request of Counsel.
Mr. Raynor: As this was held over at request of counsel, I will
briefly review the file . We are in receipt from the Town Clerk' s
Office the filing fee, correspondence from the applicant' s attorney,
correspondence dated the 18th of October, from the Department of
Public Works : I have reviewed the map and find the layout and grades
of the -roads to be satisfactory with the Town specifications, I feel
that a subdivision this size warrants two entrances and exits, as all
the traffic will be concentrated at one site. I, therefore, suggest
at additional entrance and exit should be made onto Route 48 from
Homestead Acres ; signed by Raymond C. Dean. There is a metes and
bounds description of the property in question which has been reviewed.
Correspondence from the Town Engineer: I have reviewed the subdivision
entitled Homestead Acres and make the following comments and recomen-
dations . -1 . That since there is .only one entrace to Middle Road,
County Route 48, from Eastern Shores, Section 2 that there be a second
road provided by this subdivision for the safety and welfare of the
two subdivisions . 2 . That curves be provided in place of bends in
the road adjacent to lots number 1 and 16 . Inspection reports with
regard to to this. There is correspondence in the file from the
Suffolk County Department of Planning which questions the undersized
lots. This was on a preliminary review. Also a map indicated by
them as to their suggestions and comments . Copies of legal notices
and description of properties. and the rest goes back to sketch approval
pertinent to this subdivision.

Mr. Raynor: As is the procedure with this board we .will ask if
there is anyone present .this evening who would like to speak in
opposition to this proposed subdivision of property entitle Homestead
Acres? (negative) Hearing none, is there anyone present this evening
who would like to speak in favor of this proposed subdivision?
Mr. Bruer: Yes, Rudolph Bruer, on behalf of the applicant. I believe
you have before you gentlemen revised maps for the purpose of which
was to conform to the recommendations of the county and the Town
Engineer, wherein the map now shows there is a entrance way from the
subdivision to Middle Road going down past what is now known as
presently lots four, three, two and one. The open space has been
changed slightly in the sense that where there was a lot known as lot
number one, formerly lot number one, we have it as open space some
24 , OOO square feet. The open area as set forth orininally was slightly
changed, was made up by this area which was required to comply with the
request by the engineer to get access to Middle Road, . in that also
requested by Mr.. Dean. Now with respect to Mr. Dean, I called him with
respect to his letter and what he meant, he was talking about one road
into Eastern Shores, and as you can actually see there are two entrance
ways and what he meant by .that letter was the access to Middle Road.
That' s what he was referring to. I think we complied with it and we
do respectfully request that the Board grant approval of the map. If
you have any questions, I ' ll be glad to answer them if I can. Mrs .
Coyn, one of the owners , is here.
Mr. Raynor: Alright, let' s see if there is anyone else that would like
to speak for you, or with you. Is there anyone else present this
evening who would like to speak in favor of this proposed subdivision?
(negative) Hearing none, is there anyone that has some information
that should come before this board at this time concerning this sub-
division that may be neither pro nor con but. .should be information to
help this board in making a decision? (negative) Hearing none, ques-
tions from the board members? Mr. Latham?
Mr. Latham: I guess these lots on Middle Road, that' s all we could do
with them?
Mr. Bruer: These are two existing buildings. There.' s really nothing
much that . really. could have been done. There were a couple of suggestions
but they either run the road down this way. If you did it that way the
person stepping off their porch would be right in the middle of the
road on that one house. It' s just if we did it any other way, it would
break up the lot so this spectacular driveway here that really goes
with this house really wouldn' t belong to it.
Mr. Latham: You' re really not giving too much up here.
Mr. Bruer: Well, we did the best we could.
Mr. Raynor: . Mr. Orlowski? (negative) Mr. Mullen? (negative)

Mr. Raynor: Rudy, how does this application stand with regard to
the Department of Health Services Article 6?
Mr. Bruer: The whole subdivision is put together with the idea that
we would be hooked up to the Greenport Water System.
Mr. Raynor: Have you got. a contract or letter of intent from those
people?
Mr. Bruer: I do not at this time. We started it on a couple of
occasions but have been unable to make the appointment due to the
unavailability of the parties .
Mr. Raynor: OK on that premise we would like to see some type of
stipulation between your clients and the .Village of Greenport with
regard to that.
Mr. Bruer: That is our next move. .
Mr. Raynor: I noted in the county's recommendations they question
the access as you've indicated now between lots one and two which
were lots three and two. That' s still going to create some type of
contention. That-is. s.omething::I-:.think`-the .board _.should look at
again in the field.
Mr. Bruer: Between where?
Mr. Raynor: The road access, well .between one and two on the revised
maps . The access of the driveway between those two parcels . It' s
something we' re taking into consideration.
Mr. Bruer: You mean because there are two out there already?
Mr. Raynor: Yeah; we ' re trying to alleviate as much as possible the
driveway . . .

Mr. Bruer: I kind of took their commenththat they might want some-
thing going out there to that road.
Mr. Raynor: I am sure they would have preference and I 'm sure the
Town would have preference to -see that access were, if possible, for
both those lots be made off your proposed road. I 'm not. .sure it' s
possible, it' s something we want to look at again.
Mr. Bruer: Alright, but you' re talking about an esisting two houses
there. All we're doing is really complying with an access requirement
with the rest of the subdivision. We have two existing buildings
that are serviced by Middle Road already.
Mr. .Raynor: Well, those access requirements come with the subdivision
of property.

Mr. Bruer: I understand that. No fighting with you on that.
Mr. Raynor: Alright, we' ll take a look at it. That' s what I 'm
saying.
Mr. Bruer: It just lends itself the way it is .
Mr. Raynor: Maybe we' ll do something as far as restrictive as far as,
I don' t know. Let's just leave it to say, we 're going to have another
look at it.
Mr. Bruer: Particularly as to lot two, the driveway is . . .
Mr. Raynor: I realize it is very well maintained and very well estab-
lished .driveway.
Mr. Bruer: Right.
Mr. Latham: We should really have the OK from the Greemport Water
Company before we .
Mr.. Raynor: We will have prior to completion,. absolutely. I agree
with you Mr. Latham, 100%. Any other board members have any questions
pertinent to this subdivision? (negative) If not we will deem the
hearing closed and thank .you for coming in.
Anthony & Helen Dris. - Mrs . Helen Dris met with the board to discuss
the lot configuration of this minor subdivision .and the future intent
of the lots . Mrs . Dris informed the board that construction of a
home and barn was presently underway on the parcel showing 9 .6 acres.
She advised the board that this property would be covenanted for no
futher subdivision in the future as it will be used for horses. The
other three lots are for her daughters if they should want to build
in the future. Mr. Raynor instructed the secretary to send Mrs :. Dris
a form regarding no further subdivision ' in the future. The Board will
field inspect this property prior to the next Planning Board meeting.
On motion made by Mr. Orlowski, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board declare itself lead
agency in regard to the State Environmental Quality Review Act in the
matter of the minor subdivision of Anthony & Helen Dris, located at
Mattituck. An initial determination of nonsignificance has been made.

John Fellinger/Ihar - Mr. and Mrs. Ihar met with the board requesting
a release of lot #21 on their major proposal.
On motion made by Mr. Orlowski, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board approve a set-off
(106-13) to the lot designated as lot #21 on the preliminary subdiv-
ision map of Woodbine Manor, owned by John & Olivia Fellinger/Ihar
subject to receipt of four copies of the final map.
Vote of the Board: Ayes : Raynor, Latham; Mullen, Orlowski
Cove Beach Associates- Mr. Richard Cron, Esq. met with the Board to
discuss the proposed covenants and restrictions for this property.
Mr. Raynor read correspondence to Mr. Richard Cron, .from the Town
Attorney, stating that after one-third of the lots within this sub-
division have been conveyed, title to the lots , drainage and park
areas will be conveyed to a property owners ' association, but the
proposed declaration fails to state whose responsibility it is to
organize the property owner' s association. Mr. Cron submitted to the
board a additional paragraph (g) regarding the organization of the
property owner' s association.
On motion made by Mr. Mullen, seconded by Mr. Orlowski, it was
RESOLVED that the Southold Town Planning Board declare itself lead
agency in regard to the State Environmental Quality Review Act in
the matter of the major subdivison known as Cove Beach Associates ,
located at East Marion.
Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski
On motion made by Mr. Latham, seconded by Mr. Orlowski, it was
RESOLVED that the Southold Town Planning Board approve the sketch map
of the major subdivison known as Cove Beach Associates , located at
East Marion, dated February 28, 1980 and amended October 23 , 1981
and proof of sanitary and potable water conditions to be submitted to
the Planning Board prior to preliminary hearing being scheduled.

Angel Shores - Mr. Richard Cron, Esq. inquired as to whether the
board was in receipt of correspondence from Lawrence Tuthill, Town
Engineer, regarding the drainage area within this subdivision. Mr.
Cron was informed that Mr. . Tuthill ' s letter would be submitted to the
office prior to November 19, 1982 for discussion at the November 29,
1982 Planning Board meeting.
Richard J. Cron - Mr. Richard Cron, attorney and applicant submitted
to the Board correspondence from Mr. James Monsell, Greenport Utility,
stating this minor subdivision would be supplied by Greenport water.
Constantine Georgiopoulos - Ms . Abigail Wickham, Esq. confirmed that
the sketch map to be considered isthe one previously given approval
by the Planning Board; this proposal has no park and playground area.
The Board requested that $10,000 be given to the town. in lieu of the
park and playground area. It was noted that the Board had already
declared lead agency .with regard to the State Environmental Quality
Review Act. Also noted was the filing fee for this proposal has not
been received. Ms. Wickham stated with regard to Article 6 , Mr.
Royal Reynolds stated he didn' t think water was a problem, but it
would have to go before the Board of Review. The board asked that
the proposed maps show a building envelope on lots two and eight. A
letter regarding money in lieu of park and playground will be forth-
coming from the attorney.
North Fork Bank& Trust Co. at Mattituck - Ms . .Abigail Wickham, Esq.
discussed this proposal with the Board. Because of the question in
alternate areas to be deleted as retail sales areas, the Chairman
instructed the building department to stop certification. Mr. Raynor
asked Ms . Wickham to supply the board with a profile of the building
plans and information regarding the curb cut from the State . Ms .
Wickham presented both items to the Board. The Board was in agree-
ment that this application did not have to go before the Suffolk
County Planning Commission.
On motion made by Mr. Mullgn, seconded by Mr. Latham, it was
RESOLVED that the site plan of North Fork Bank & Trust Co. to be lo-
cated at Mattituck, be referred to. the Building Inspector for certifica-
tion.

RESOLVED that the Southold Town Planning Board approve the .minutes
of the September 20, 1982 meeting as submitted.

Public Referendum - The Board discussed the question of creating a
public referendum for funding of farmland and open space preservation
within the town of Southold. The Board was in agreement that such
an action would enable the residents of Southold to voice their
opinion through a special ballot, as to whether the Town should sup-
plement money in .the acquisition cost in order tosa-t:i"sfy the seller
and would also allow the Town to negotiate in obtaining prime parcels
within the township.
On motion made by Mr. Orlowski, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board request a Public
Referendum to create a preservation trust fund for farmland and open
space preservation within the Town of Southold.
Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski
It was noted that the Phase. II is paying less in the acquisition cost
than was paid in Phase I . The Board stated they would like to have
this on the November ' 83 ballot, if not sooner.

RESOLVED that the Southold Town Planning Board declare itself lead
agency in regard to the State Environmental Quality Review Act in
the matter of the minor subdivision of William Burkhardt, located at
Laughing Water, Southold.

On motion made by Mr. Latham, seconded by Mr... O.rlowski, it was
RESOLVED that the Southold Town Planning Board approve a set-off (106-13)
as designated on the subdivison map of William Burkhardt, dated June 28 ,
1982, located at Laughing Water, Southold subject to the applicant re-
ceiving approval for a variance from the Zoning Board of Appeals .

State Environmental Quality Review Act and 6NYCRR Part 617 , Section
617 . 10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that Southold Town Planning Board as lead agency for
the action described below has determined that the project will not
have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Moebius Associates , Section II is a
three lot subdivision located at Cutchogue .
The project has been determined not to have a significant
effect on the environment for the following reasons :
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation it is assumed that there is no objection
nor comments by that agency.
The Suffolk County Department of Health Services has
indicated its- agreement with the lead agency designation.
A precursory review indicates conditions are suitable for
individual sewage disposal systems . However, a test well ..
is recommended prior to construction to verify the adequacy
of the water supply.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations .

be implemented as planned-. -
The Suffolk County Department has indicated they have
no objection with the lead agency designation. How-
ever, the water supply may be limited due to salt
water incursion.
Because there has been no response in the allotted
time from the New York State Department of Environ-
mental Conservation it is assumed., that there is no
objection nor comments by that agency: Applicant.

Because there has been no response in the allotted time
from the New York State. Department , of Environmental
Conservation it is assumed that there is no objection ,
nor comments by, that agency.
The Suffolk County Department of Health Services has
indicated its agreement with the lead agency designation.
The department does not recommend the creation of parcels
less than 40, 000 square feet in the area when private wells
and individual sewage disposal facilities are proposed.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations .

RESOLVED that the Southold Town Planning Board approve a set-off
(10.6-13) as designated on the subdivision map of Olga Lomaga, dated
July 9 , 1982 and amended August 25 , 1982 , located at Mattituck, sub-
ject to completion of the State Environmental Quality Review Act and
receipt of the filing fee in .the amount of $50.

On motion made by Mr. Orlowski, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board approve Inspector
John Davis ' report #.251 for the improvements on the right-of-way
designated on the filed subdivision map of Herodotus Damianos ,
located at Southold.
Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski
On motion made by Mr. Latham, seconded by Mr. Mullen, it was
RESOLVED that the Southold Town Planning Board approve the final
subdivision map of Peconic Bay Cove and the Chairman be authorized
to endorse approval on said map subject to compliance with the
Superintendent of Highways recommendation, dated October 27 , 1982
regarding no certificate of occupancy to be issued until installation
of the leaching pools have been completed.

RESOLVED that the Southold Town Planning Board declare itself lead
agency in regard to the State Environmental Quality Review- Act in
the matter of the minor subdivison of William& Joan Keinath, lo-
cated at Mattituck. An initial determination of nonsignificance has
been made.

On .motion made by Mr. Latham, seconded by Mr. Mullen, it was
RESOLVED. that whereas, a formal application for the approval of a
subdivision plat entitled "Allerton Cushman" located at
Fishers Island was submitted to the Planning Board on April 12, 1982
and, a filing fee in the amount of $50 was. paid August 26 , 1982, and
, WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, Southold, New York, on September 20, 1982 at
7 :45 p.m. , and
WHEREAS, the -requirements of the Subdivision Regulations of the Town
of Southold have been met by said subdivision plat and application,
NOW, therefore, be it RESOLVED that the application of "Allerton..
Cushman for approval of said subdivision plat prepared by
Chandler, Palmer & King dated March 11, 1982 , be approved and the
chairman be authorized to endorse approval on said subdivision plat
subject to the following conditions within six months from date of
resolution:
1. No lot shall be subdivided or .its lot lines changed in
any manner at any future date unless authorized by the
Southold Town Planning Board.
2 . No new residential structure of sanitary disposal facility
shall be constructed or otherwise located within 100 'feet
of the top edge of the bluff along the shoreline of Block
Island Sound. ,
3 . Clearing and cutting of vegetation within -50 feet of the
top edge of the. bluff shall be limited to that necessary
for. maintenance.

4 . No grading shall be permitted within 50 feet of the top
edge of the bluff except that that may be necessary to
control or remedy erosion or to prevent stormwater from
flowing over the edge of the bluff .
5 . No stormwater runoff resulting from the development and
improvement of the subdivision or any of its lots shall
be discharged down the face of the bluff in any manner.
6 . There shall not be any structure providing access to the
beach constructed on the face of the bluff as is shown
on the subdivision map. Access to the beach shall be

Kontokosta Change of Zone - Mr. David Kapell and Mr. Emanual Kontokosta
was present to discuss the revisions on .his change of zone application.
Mr. Raynor read the minutes of their meeting June 28 , 1982 and the
correspondence from the Town Clerk' s Office regarding the proposed
revisions on this application. Mr. Kontokosta stated that he would
covenant and restrict the middle section for open area upon approval
of the M-zone. The 18 acres of M-Zone should reflect 100 feet from
the bluff. 122 units are proposed providing water and sewerage come
from Greenport, if not consideration would be given to approximately
80 units . The Board noted one ingress and egress and the possibility
of using the Town property to .the west if emergency access was neces-
sary. The Board stated they would like additional information from
the Town Board under the State Environmental Quality Review Act as
they are lead agency. The Board stated they would like to field in-
spect the property again.
Richard J. Cron - The Board reviewed the petition referred to them by
the Town Clerk. Mr. Raynor, Chairman, refrained from discussion and
referred this proposal to Mr. Orlowski for discussion with the Board.
Mr. Orlowski stated that he would like clarification under the State
Environmental Quality Review Act from the Town Board as to their
status of lead agency and any pertinent information they might have
under this procedure. Mr.. Orlowski requested that the Board make an
on site field inspection of this property prior to the next meeting.

and purchased by the Town of Southold.
2 . The ingress and egress to be utilized for emergency
use
3 . If necessary, additional buffering on Cox' s Lane to
insure the residents on Matthews Lane from any harmful
effects.

Henry Taca, Etal - The Board noted two errors in the covenants and
restrictions that. were filed on this approved set-off. The location
of the property was stated as being in a different town and the
metes and bounds description of the property has a numeral error.
After discussion with the Town Attorney, he stated that this would
not void the covenants and restrictions in the future.
Being no further business to come before the Board Mr. Orlowski
