Mullen, Jr. A regular meeting of the Southold Town Planning Board was held at 7 :30 p.m. , Monday, May 10, 1982 at the Town Hall, Main Road, Southold, New York. Present were: Chairman Henry E. Raynor, Jr. Member William F. Mullen, Jr. Member George Ritchie Latham, Jr. Member Bennett Orlowski, Jr. Member James Wall 7 :30 p.m. Public Hearing on the question of approval of the prelimin- ary map of the major subdivision known as Hill Crest Estates , located at Orient. Mr. Raynor read the legal notice and presented proof of publication in the Suffolk Weekly Times and Mattituck Traveler-Watchman. Mr. Raynor: In review of the file we have from Suffolk County Depart- ment of Planning the following correspondence: In accordance with your request the staff has examined the proposed subdivision layout for a 66 .65 acre tract reputedly owned by Harold Reese and offer the following comments on the map. for your use. The staff is of the opinion that while the layout of this proposed subdivision relative to Main State Road apprears to be satisfactory the Commission may question other aspects of the layout. 1 . It has been the policy .of . the Commission to discourage the use of cross streets within a subdivision. There are two such' streets within this proposed subdivision. 2 . A street should enter another street at or closely to a right angle. The -angle that Sound View Drive makes with Hill Crest Road is entirely unsatisfactory as it exceeds the rec- ommendations of the Institute of Traffic Engineers . pg. (2) 5/10/82 3 . The need for Sound View Drive between Brown' s Hill Road and .Hill Crest Drive is questioned. 4 . While the map indicates that there will be a 100 foot setback from the top of the bluff there area areas where this setback appears to be less than 100 feet. . 5 . The termination of Hill Crest Drive at Brown' s Hill Road should be reconsidered. Again the road intersects another road at an unsatisfactory angle. Consideration should be given to the relationship of this proposed ktreet to the ex- isting street pattern in the adjoining subdivision. If pos- sible a cross intersection should not be created. If the proposed connection is solely for. emergency access then the cross street intersection is not objectionable provided there is some kind of. control placed on Hill Crest Drive such as a gate or chain across the road. 6 . Aesthetics is an important consideration in subdivision design. Planners in this office favor the use of curves to modify the bends in the road alignment. Where possible large radius curves should be used. Street lengths should be mini- mized to discourage speeding. We feel that a large radius curve at Lots 15-17 , inclusive, would be preferable. The staff suggests that consideration be given to requesting a revised layout. They go on to say that it does not constitute a review and it is signed by Charles G. Lind. Correspondence from the Highway. Department, Town of Southold: Gentlemen: The roads in this subdivision are acceptable, if all the drainage is satisfactory. Very truly yours, Raymond C. Dean. Location in correspondence, correspondence from this office to the applicant, correspondence from the Town Engineer with regard .to design and this dates back into October which has been accredited into it. Correspondence from the Orient Fire District with regard to design, we are requesting submersible pumps to be accomodated in the bond for a hydrant in that particular subdivision. Correspondence from this board to the Suffolk County Department of Health Services , Department of Planning, correspondence from this board to the.-.New York-State Environ- mental Analysis Unit, New York State Department of Environmental Conser- vation with regard to the State Environmental Quality Review Act classi- fying this subdivision, resolution fro sketch approval, short environ- mental assessment from signed by the applicant, application for approval of plot in triplicate, other forms from our board to the county. This correspondence with regard to this subdivision from Dorothy L. Robertson, President of Brown' s Hills Estates: At a meeting of the Board of Directors of Brown' s Hills Estates Inc. on Sunday, October 11, 1981 we discussed your request for permission for people living in your sub- division to use our private road in case of emergency and the necessary hook-up of one of your roads with ours . We appreciate the concern of the Planning Board for the safety of all of us, but it was the unanimous decision to reject this offer, or request. pg. (3) 5/10/82 The Directors also expressed concern that you have chosen to call your northern east-west road "NOrth View Drive" same as ours, which has been in for years . We feel that this will lead to endless con- fusion and since we have to maintain our road ourselves , we do. not wish to have any unnecessary traffic on it. It seems very likely that people searching for a house on your North View Drive, will end up on our North View Drive by mistake . Correspondence to this board from the applicant with regard to our request that the applicant explore the possibility of tieing in for emergency use to the Brown' s Hill road. Metes and bounds of the property and correspondence back from both the engineers and the land surveyors . The amount of the filing fee has been paid to the Town Clerk and correspondence and computation with regard to the drainage area. That pretty well completes the file on this proposed major subdivision. As is the policy of this board we will ask if there is anyone present this evening who would like in oppisition to the proposed subdivision entitled Hill Crest Estates, located at Orient? (negative) Hearing none, Is there anyone present this evening who would like to speak in favor of this proposed subdiv- ision? (negative) Hearing none, Is there anyone present this evening that has some information that may be neither pro nor con with regard to this subdivision that would be advantageous to this board in trying to make a decision? (negative) Hearing none, Mr. Latham, do you have any questions? (negative) Mr. Orlowski? (negative) Mr. Wall? (negative) Mr. Mullen? (negative) . Alright there being no further questions from the board, we will deem this hearing closed and thank you for coming in. Mr. Harold Reese asked about creating an access road from route 25A. Mr. Raynor stated that such could be done provided that it falls within the subdivision regulations and jurisdiction; if such a road was placed in the wrong place, the town would not be liable and it would be up to Mr. Reese to correct it. 7 : 45 p.m. Public Hearing on the question of approval of the preliminary map of the major subdivision entitled Richmond Creek Farms , located at Peconic . Mr. Raynor read the legal notice and presented proof of pub- lication in the Suffolk Weekly Times . Mr. Raynor: In review of this file we are in receipt of the filing fee in the Town Clerk' s office . We have a short environmental assessment form that has been filled out but is missing a signature. Correspon- dence from the Suffolk County Department of Health Services with regard to the State Environmental Quality .Review Act:, We are in receipt of your letter of January 8 , 1980 . This Department has no objection to your designation as lead agency. A .precursory review of the above referenced project indicates that conditions are adequate for sewage disposal facilities ; however, problems may be encountered with obtaining potable water due to high nitrate concentrations in the area. signed by Royal R. Correspondence from the High- way Department in the Town of Southold: Gentlemen: I feel that Lot #42 in this subdivision is a terrible travesty against the property of Thomas Grattan having their property surrounded by this lot. (4) 5/10/82 Mr. Raynor con' t - Correspondence to the applicants surveyor from the Suffolk County Department of Health Services , cross road profiles , correspondence from this board to the applicant' s attorney concerning correspondence we are missing. Resolution setting Public Hearing date, copy of the metes and bounds description, copy of the deed, correspon- dence from this board to the applicants attorney; this was originally heard - in the preliminary .stage and the applicant had let the time elapse so that this was again brought forward at this time. There is approval and correspondence in the file dating back well into 71 and 80 . This board had requested the Suffolk County Soil and Water Conser- vation to review the drainage and propose this subdivision be considered as the applicant had for a swale system and we have correspondence from their office with regard to this , correspondence from the New York State DEC with regard to the State Environmental Quality. Review Act and a. detailed report from the United States Department of Agriculture with regard to this. This goes back to the previous submission and we have application for approval on this subdivision. Correspondence from the law office of Wickham, . Wickham, & Bressler with regard to ,this applica- tion and the matching of cross roads of a client of theirs to the east, correspondece to this board from the office of the Town Clerk, resolu- tion setting this particular parcel out as a cluster development by a motion of the Town Board, correspondence determining the lot yeild as proposed. As is the procedure of this board we will ask if there is anyone present this evening who would like to speak in opposition to the proposed major subdivision entitled Richmond Creek Farms? (negative) Hearing none, is there anyone present this evening who would like to speak in favor of this proposed subdivision? Mr. Nesci: Mr. Chairman, I am Pat Frank Nesci, attorney for the ap- plicants here and this map has been before you for some period of time. I think initially it goes back to a letter that I put before the board almost seven years ago with some of the first proposals . As you will recall we went through many alternative layouts , many of them with accession to your kind suggestions as to :the layout and it is the hope here that the map you see before you now as the final preliminary map is one which has taken into account years of hard work to developing this property, and that you have before you. Mr. Raynor: Thank you, is there anyone else present this evening who would like to speak in favor of this proposed subdivision? (negative) Is there anyone present this evening .that has some information that may be neither pro nor con but should come before this board. at this hearing so that we may be better able to make a determination on this proposed subdivision? Ruth Oliva - Henry, may I ask a couple of questions? Is that open space down here, is this all marsh? Mr. Raynor: No it is not. Ruth Oliva: It is not. Did the County Board of Health say anything about salt water, nothing about chlorides in the water at all? Pg• (5) 5/10/82 Mr. Raynor: Nothing. Ruth Oliva: Thank you. Mr. Raynor: I am not sure that they fulfilled as yet the requirements of the Suffolk County Department of Health standards so I would doubt very much if this would come up at this point, outside they noted that there is high concentration of nitrates in that particular area. Is there anyone else present this evening who has some information or questions concerning this proposed subdivision? (negative) Mr. Wall do you have any questions? (negative) Mr. Mullen ? (negative) Mr. Orlowski? (negative) Mr. Latham? (negative) . I find that there are several things that are delinquent in this file. There is no signature on your EAF. Mr. Nesci: I understand that you mentioned that, may I see that please? Mr. Raynor: Number one, right there, and number two, I find no cross profiles for swales for development of the roadways . Mr. Nesci: That should have been submitted to you. Mr. Raynor: Well if it was it was in hiding somewhere, we've been through the file several times . As the subdivision . . . Mr. Nesci: I can remedy this by signing it now. It was made up with the idea that it would be signed by us representing the owners , so I ' ll do .that now. (Mr. Nesci signed the short environmental assessment form) Mr. Raynor: OK, .to date we have not received back county recommendations , and whatever action this board may take, will be in consideration to those recommendations that may be forthcoming from the Suffolk County Planning Commission. Any other board member? (negative). Alright, there being no further input with regard to this proposed subdivision, we will deem this hearing closed and thank you for coming down. Southland Corp. 7-Eleven . - Mr. Raynor read correspondence from the Town Attorney, dated April 26 , 1982 , stating that the Planning Board had no jurisdiction to determine this proposed site in the B-1 General Business Zone. It also stated his legal opinion of the rear yard and front yard setbacks regarding the proposed building. Mr. Mullen questioned whether the planning board had jurisdiction and read from the Town Code 100-112 K ( 1) stating the Planning Board should approve screening and hedges along with, 100-112 G which states the Planning Board may reduce parking spaces within a site . The board also questioned whether the food prepared on the premises was consumed there. If so, the planning board would have jurisdiction. The board advised those present to communicate pg. (6) 5/10/82 with the Town Board their concerns regarding this proposal . On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the site plan (7-Eleven) submitted by Southland Corp. be forwarded to the Building Inspector, along with a copy of the Town Attorney' s letter for his determination. The board requests that they be advised of his decision one week prior to the next Planning Board meeting. Vote of the Board: Ayes : Raynor, Latham, Mullen, Orlowski, Wall * * * * * * * * * * * Georgiopoulos - Abigail Wickham, Esq. and the applicants met with the board to discuss this proposed major subdivision. This proposal consists of eight lots . Ms . Wickham stated a water test was done on lot #5 and was satisfactory. She stated that the DEC had no jurisdiction because the road separates this property with Great Pond. The board noted this property to be very low meadow land and requested a copy of the water report from the attorney. They also asked if .the applicants would con- sider money in lieu of park and playground. Ms . Wickham stated she would discuss this matter with them. Ms . Wickham stated there were no soil borings done on this property. The board will field inspect the property. On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED to refer the proposed 8-lot major subdivision entitled Constantine P. Georgiopoulos , to the Conservation Advisory Couns.il for any comments and/or recommendations they might have regarding the very low contours and its close proximity to Great Pond. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall D.J. Claus Enterprises - Abigail Wickham, Esq. inquired about a subdiv- ision on this property. The applicant requests to separate five stores . Mr. Raynor stated the lots on this area appear to be way to small and suggested 'the board to field inspect this property before making a deter- mination. Mr. Raynor stated that William Wickham, Esq. objected to the subdivision on the octogon building that was previously before the board. The board requested information regarding the parking. Mr. Mullen asked if the buildings were fire proof . Because the buildings are old and made of brick and cinderblock it was doubtful . PG. (7) 5/10/82 Hodor/Staller - Mr. Irving Price, Esq. met with the board to discuss this proposed major development in East Marion. Mr. Price stated that he had verbal approval from Raymond Dean and Lawrence Tuthill. The board requested that the 17 acres left out on the southern portion be labeled. Mr. Roderick Van Tyle stated there were two areas , one in the south and one on the north, for conventional drainage system. The board will field inspect this property prior to making a determination. Cove Beach Associates - The board reserved making a determination on this proposal as the attorney did not submit information to the board in ample time for the board to review it. Angel Shore Estates - The board reserved making a determination on this proposal as .the attorney did not submit information to the board in ample time for the board to review it. On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board request money in lieu of the Park and Playground area on the subdivision know as Greenbriar Acres, located at Mattituck. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall On motion made by Mr. Mullen, seconded by Mr. Wall , it was RESOLVED that the Southold Town Planning Board contact the Mattituck Fire Commissioners for their determination on the necessity of a fire- well within the subdivision known as Greenbriar Acres , located at Mattituck. (8) 5/10/82 On motion made by Mr. Wall, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board. declare itself lead agency in regard to the State Environmental Quality Review Act .in the matter of the minor subdivision of Herodotus Damianos , located at Southold. An initial determination of nonsignificance has been made. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall On motion made by Mr. Latham, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board approve the sketch map of the minor subdivision of Herodotus Damianos, dated -April 20, 1982 located at. Southold. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall On motion made by Mr. Mullen, seconded by Mr. Wall, it was RESOLVED that the Southold Town Planning Board accept the Soil and Water Conservation' s recommendations , dated May 3 , 1982 , regarding the existing conditions of lot #4 on the minor subdivision Baxter Properties , located at Mattituck, and compliance of said recommendations so as to alleviate the possibility of future erosion along the bluff. Vote of the Board: Ayes : Raynor, Latham, Mullen, Orlowski, Wall On motion made by Mr. Latham, seconded by Mr. Orlowski, it was RESOLVED that the Southold Town Planning Board accept John Davis ' in- spection report' #215 , dated April 20, 1982 , on the minor subdivision of Baxter Properties , located at Mattituck, and all improvements made on this right-of-way are to comply with said reprot. Vote of the Board: Ayes : Raynor, Latham, Mullen, Orlowski, Wall On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board approve the sketch map of the minor subdivision entitled Stanley & Louise Gould, dated April 22 , 1982 , and amended. April 27 , 1982 located at Nassau Point. .Vote of the Board: Ayes : Raynor, Latham, Mullen, Orlowski, Wall Pg- (9) _ 5/10/82 The following was introduced by Mr. Orlowski, seconded by Mr. Mullen, and carried: Pursuant to Article 8 of the Environmental Conservation Law State Environmental Quality Review Act -and 6NYCRR Part 617 , Section 617 . 10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that Southold Town Planning Board as lead agency for the action described below has determined that the project will not have a significant effect on the environment. DESCRIPTION OF ACTION The minor subdivision of Woodhollow Properties , Inc. is a four- lot subdivision, located at Orient. The project has been determined not to have a significant effect on the environment for the following reasons : An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. _ Because there has been no response, in the allotted time from the New York State Department of Environmental Conservation it is assumed that there is no objection nor comments by that agency. The Suffolk County Department of Health Services has indicated its agreement with the lead agency designation. This area has a history of a limited water supply and a test well is recommended and a test hole should be installed to insure adequate conditions for sewage disposal . Because there has been no response in the allotted time from the New York State Department of Environmental Conservation it is assumed that there is no objection nor comments by that agency. The project has been determined not to have a significant effect on the environment for the following reasons : An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. ' -- Because there has been no response in the allotted time from the New York State Department of Environmental Conservation, it is assumed that there is no objection nor comments by that agency. Applicant should be aware that a permit may be required because of the proximity to the wetlands . The Suffolk Countv Department of Health Services has indicated its agreement with the lead agency designation. Prior to commenting on the sewage disposal and water supply facilities, it would be necessary to . have a test hole and test well information. Clearance from the New York State Department of Environmental Conservation should be obtained by the applicant. An initial determination of nonsignificance has been made. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall On motion made by Mr. Latham, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board withdraw their resol- ution dated April 26 , 1982 regarding the minor subdivision of Eva & Armand Bartos , Jr. , located at East Marion. Vote of the Board: Ayes : Raynor, Latham, Mullen, Orlowski, Wall On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that. the Southold Town Planning Board grant a set-off ( 106-13) on the map entitled Eva & Armand Bartos , Jr. , dated July 14 , 1981, located at East Marion subject to the following conditions within six (6) months from date of resolution: 1 . The existing road in the 8 .25 right-of-way be upgraded with three inches of bankrun sand and gravel for a width of 8 .25 feet. 2 . Receipt of a copy of the Covenants and Restrictions filed with the County Clerk, stating no further sub- divisions on this property to be held in perpetuity. 3 . Receipt of six (6) final copies of the subdivision map. Vote of the Board: Ayes : Raynor, Latham, Mullen, Orlowski, Wall On motion made by Mr. Latham, seconded by Mr. Orlowski, it was RESOLVED that the Southold Town Planning Board declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the minor subdivision of Grace Golden located at Nassau Point. An initial determination of nonsignificance has been made. Vote of the Board: Ayes : Raynor, Latham, Mullen, Orlowski, Wall pg. ( 13) 5/10/82 On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the minor subdivision of Hubert & Catherine Harren located at Matt ituck. An initial determination of nonsignificance has been made. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall Senior Citizen Community - The board reviewed this site plan . located at Southold. It was noted that certain information was not included on the site plan. The secretary was instructed to advise Wilbur Fried to refer to Chapter 100-134 A-1 , 2 , 4 , 7 , &9 ; B-1; C-3 & 4 ; and D-3 , 4 , 5 , 6 , 7 , 8 , & 9 and to include information stated therein on the site plan before the board can make a determination. The Board stated they 'would like an emergency access on the western portion of this property. On motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the major subdivision East of Eden, located at Greenport. An initial determination of nonsignificance has been made. Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall Kontokosta Change of Zone - It was the concensus of the Board that prior to preparing an official report stating their recommendations , a field inspection will be made on this property. The Board will re- view this proposal at the May 24 , 1982 meeting. pg. Ward was submitted to the Planning Board on December 11, 1981 and an application fee of $50 was paid on April 15 , 1982 , and WHEREAS , a public hearing was held on the map of said subdivision at the Town Hall, Main Road, Southold, New York, on March 22 , 1982 at 7 : 45 p.m. , and WHEREAS , the requirements of the Subdivision Regulations of' the Town of Southold have been met by said subdivision plat and application, NOW, therefore, be it RESOLVED that the application of Charles E. & Beatrice T. Ward for approval of said subdivision plat prepared by Charles E. Ward be approved and the chairman be authorized to endorse approval on said subdivision plat subject to meeting the conditions numbered 1, 3 , 4 , 5 , 6 , and 7 of the Suffolk County Planning Depart- ment dated March 4 , 1982, and the construction of a dwelling to be no closer than 37 feet from the edge of th'e bank. ( 15) 5/10/82 On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board approve the streets known as Dolphin Drive, Albacore Drive, and Blue Marlin Drive located within the filed subdivision Southold Shores . Vote of the Board: Ayes : Raynor, Latham, Mullen, Orlowski, Wall On motion made by Mr. Orlowski, seconded by Mr.. Latham, it was RESOLVED that the Southold Town Planning Board instruct John Davis to inspect the street known as Tarpon Drive, located within the filed subdivision Southold Shores, and report his comments and/or recommenda- tions for improvements, and that no Building Permits are to be issued untils such time as said road meets the satisfaction of the Planning Board. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall The Planning Board inspected the above mentioned roads, noting Tarpon Drive to be in poor condition. The road was describes as rough, narrow, contained potholes, and vegetation near Pipes Cove . Bayview Ventures Ltd. David Saland met with the board to discuss this proposed major subdivision. Mr. Saland stated there would be grass waterways to channel water down to the drainage area, they propose to keep the roads private. Mr. Raynor. stated the cul-de-sac would require waivers and the proposal having more than 20 lots would need a waiver on the ingress and egress . The board questioned the drainage area with regard to lots 21 , 22 , 23 , 24 , & 25 . The board did not favor the flag lot configuration on lot #34 and questioned the bubble effect road on lots 24 , 23 , &. 22 . It was stated the proposed right-of-way is part of record. The board will field inspect this property prior to making a determination. Gertrude Reeves - The board reviewed this subdivision and stated they had no objections to this proposed set off. After a field inspection the board noted the area to have 40, 000 square feet and the property was suitable for building. It was the concensus of the board to re- quest an explanation from the Building Inspector as to why this pro- posal needs a varience for insufficient depth as stated in his notice of disapproval, dated February 10, 1982 . ( 16) 5/10/82 On motion made by Mr., Orlowski, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board declare itself lead agency in regard to the State Environmental Quality Review Act -in the matter of the minor subdivision of Raymond & Joan Young, located at Mattituck. An initial determination of nonsignificance has been made. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED taht the Southold Town Planning Board approve a set off ( 106-13) on the property of Raymond & Joan Young as designated on the minor subdivision map dated February 19, 1982 subject to receipt of six (6) copies of. the final map and the applicant receiving approval from the Zoning Board of Appeals within six months from date of resol- ution. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski, Wall Herbert Mandel - The board field inspected this property which will be submitted to the board as a major subdivision in two sections . The board requested an emergency access road to be sketched in near lot #32 . Mr. Mandell stated he would like to give money in lieu of park and play- ground. On motion made by .Mr. Orlowski, seconded by Mr. Wall, it was RESOLVED that the Southold Town Planning Board declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the major subdivision known as Herbert Mandel, located at East Marion.
