A regular meeting of the Southold Town Planning Board was held 7 :30
p.m. , Monday, September 19, 1983 at the Southold Town Hall.
Present were:
Chairman Henry E. Raynor, Jr.
. Member G. Rithchie Latham, Jr.
Member William F. Mullen, Jr.
Member Bennett Orlowski, Jr.
Building Administrator Victor Lessard
Charles Zahra met with the board for a presubmission conference the
site plan for two stores. in the future, located at Mattituck. Mr.
Zahra stated exit signs will be installed, doors to be a minimum
width of 36" and the kitchen is pre-existing and he would propose
to keep the hook-ups . .
On motion made by Mr. Latham., seconded by Mr. Orlowski, it was
RESOLVED that the Southold Town Planning Board refer the site plan
"Charles Zahra at Mattituck" to the Building Inspector' s Office for
certification.

Mrs . Joseph Conway met with the Board for a presubmission conference
to discuss a proposed mini-mall in Southold. This .Lproperty was
previously filed under the name of Scott Ben and received approval.
Mrs . Conway stated the sales area would include Dr. Bloom' s office,
and a ten foot distance between Dr. Bloom' s building and the pro-
posed structure. The units will be divided with common fire walls ,
and a five foot side yard. Mr. Raynor added to the plans proposed
plantings, walkway, grass areas, stone blend parking and ingress
and egress . Mrs . Conway stated her reduction in parking from the
previously approved plan resulted from the elimination of a lunch-
onette. It was the concensus of the Board to. field inspect the
property prior to any action.

Harbor Lights IV - Mr. Harold Reese discussed this subdivision with
the Board. Mr. Raynor reviewed correspondence from the Superintendent
of Highways and Inspector Davis ' report #315 . Mr. Reese was advised
to post his bond for this subdivision and pay the inspection fee to
the Town. Mr. Reese questioned if sections four and five would be
exempt from two-acre zoning. Mr. Raynor advised Mr. Reese to contact
the Supervisor' s office/Town Board.

On motion made by Mr. Latham, seconded by Mr. Orlowski, it was
RESOLVED that the Southold Town Planning Board accept Inspector John
W. Davis ' report #316 for compliance with regard to improvements for
the access road within the subdivision., approved as a set-off,
"Henry Domaleski, located at Southold.

On motion made by Mr. Mullen, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board accept Inspector John
W. Davis ' report #319 with regard to improvements to the access road
within the minor subdivision known as Nick & Nicki Hairstylists , Inc .
and compliance with said recommendations .

On motion made by Mr. Orlowski, seconded by Mr. Mullen, it was
RESOLVED that the Southold Town Planning Board accept Inspector John
W. Davis ' report #318 with regard to improvements to the access road
within the subdivision known as Edward & Ruth Fornuff .

On motion made by Mr. Orlowski, seconded by Mr. Mullen, it was
RESOLVED that the Southold Town Planning Board accept Inspector John
W. Davis ' report #317 with regard to the subdivision known as Peconic ,
Knolls at Peconic and recommend a release of bond presently held by
the Town of Southold.

On motion made by Mr. Orlowski, seconded by Mr. Mullen, it was
RESOLVED that the Southold Town Planning. Board set 7 :30 p.m. ,
Monday, October 17 , 1983 at the Southold Town Hall, Main Road,
Southold, New. ,York as the time and place. to hold a public hearing
on the question of the approval of the minor subdivision map of
James Manos , located at Mattituck.

On motion made by Mr. Mullen, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board accept Inspetctor John
W. Davis ' report #314 with regard to recommendation for the dedication
of Eastward Court to the Town of Southold.
Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski
Vincent Annabel minor subdivision - The Board reviewed correspondence
from Edward Tashjian requesting an amendment to Planning Board
restrictions from 100 foot set-back to 75 feet for the construction
of a residence . The Board was in agreement to inspect the area with
the 100 foot and 75 foot set-backs staked. Mr. Tashjian was present
and stated the property was already staked. Mr. Tashjian stated
the DEC requires only a 75 foot set-back and asked the same of the
Planning Board as the Suffolk County Planning Commission can not
amend their requirements ; this is done through the Planning Board
over-riding those conditions set forth.
On motion made by Mr. Latham, seconded by Mr. Orlowski, it was
RESOLVED that whereas , a formal application for the approval of a
subdivision plat entitled "Elizabeth Diefendorf" located at
New Suffolk was submitted to the Planning Board on October 31, 1982
and, an application fee in the amount of $50 was paid March 14 , 1983,
and,
WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, Southold, New York, on August 22 , 1983 at
7 :30 p.m. , and
WHEREAS, the requirements of the Subdivision Regulations of the Town
of Southold have been met by said subdivision plat and application,

NOW, therefore, be it RESOLVED that the application of "Elizabeth
Diefendorf" for approval of said subdivision plat prepared by
Roderick Van Tuyl, P.C. dated January 11 , 1983 , be approved and the -
chairman be authorized to endorse approval on said subdivision plat
subject to the following conditions :
1. No lot shall be subdivided or its lot lines changed in
any manner at any future date unless authorized by the
Southold Town Planning Board.
2 . No residential structure or sanitary disposal facility
shall be installed or constructed within 100 feet of
the upland edge of the tidal wetlands along the shore- - --
line of West Creek.
3 . No stormwater runoff resulting from the development of
the subdivision or any of the lots shall be discharged
directly into the adjacent body of water and tidal wet-
lands.
4 . Conditions 1-3 , inclusive, shall be filed as covenants
and restirctions in the office of the County Clerk within
six (6) months .from date of resolution.

On motion made by Mr. Latham, seconded by Mr. Orlowski, it was
RESOLVED that the Southold .Town Planning Board approve the subdivision
map "Highpoint at East Marion, Section I and the Chairman be authorized
to endorse approval on said map subject to receipt and acceptance of
the performance bond by the Town Board within 90 days from date of
resolution.

St. Peter' s Lutheran Church - Rev. Coleman was present to discuss
this site plan with the Board. Mr. Raynor read letter from George
Fisher regarding certification for the construction of two four-unit
buildings . It was noted that one of the proposed structures is
located in a "B" Zone and under the ordinance multiple dwellings are
not permitted. Rev. Coleman stated this site plan had been approved
in 1976 prior to the change in the zoning regulartions in 1979. It
was the concensus of the Board to contact the Town Attorney and re-
quest if this approval is still in effect.
On motion made by Mr. Orlowski, seconded by Mr. Lahtam, it was
RESOLVED that the Southold Town Planning Board approve the site plan
"St. Peters Lutheran Church, Section I" for the construction of
two four-unit buildings , subject to receipt of letter from the Town
Attorney with regard to clarification of the "B" Zone that was ap-
proved on the site plan prior to the change in the zoning ordinance
in 1979.

On. motion made by Mr. Orlowski, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board approve the sketch map
of Daniel C. Shelley, dated October 18 , 1983 . and amended May 23 , 1983
subject to approval by the Zoning Board of Appeals and improvements
to be made on the 25 ' .wide right-of-way that falls within the juris-
diction of the Planning Board.
Vote of the Board: Ayes : Raynor, Latham, Mullen, Orlowski
Maybelle Carde - it was the concensus of the Board to field inspect
this property prior to taking any action.
Daniel & Patricia Stengner- It was the concensus of the Board that
Mr. Rudolph Bruer, Esq. meet with the Board to discuss this proposal
of three lots.

Ralph Merrill - The Board reviewed this proposal to unmerge two
lots, each containing a residence . It was the concensus of the
Board to hold this application in abeyance until the Town Attorney
forwards correspondence to the office confirming that any filed
and approved subdivision map, on which lots have become merged,
need only Zoning Board of Appeals approval . It was noted this map
was filed in the early 1920' s .

Highpoint at East Marion, Section II - Mr. Howard. Young was present
to discuss this with the Board.. Mr. Young requested that a final
hearing be scheduled for this subdivision. Mr. Young was advised
that a preliminary hearing was held for Section I only and the board
could not determine if Section II would fall under the present zoning
of 2-acre lots . Mr. Young stated the board had reviewed the entire
proposal with regard to firewells , drainage, roads , etc. The Board
advised Mr. Young to contact the Supervisor' s office with regard to
the review board and exemptions from two-acre lots .
Old Town Park/Bitses - Mr. Latham and Mr. Orlowski made an inspection
of this property. Because of the overgrowth being extremely heavy,
they were only able to obtain access to lot number one, and were un-
able to determine if the remaining lots were buildable . It was noted
there were two house trailers on the property. It was the concensus
of the Board to request information from the Conservation Advisory
Council for this proposal and request that Mr. Bitses clear an area
along Corey Creek, the easterly side of the property and the roadway
so that the Board can arrange another inspection.
On motion made by Mr. Orlowski, seconded by Mr. Mullen, it was
RESOLVED that the Southold Town Planning set 7 :30 p.m. , Monday, _
September 26 , 1983 at the Town Hall, Main. Road, Southold, New York
as the time and place for the next regular meeting of the Planning .
Board.

Being no further business to come before the Board Mr. Mullen made
a motion to adjourn, seconded by Mr. Latham and carried.
