Present were: Chairman Bennett Orlowski., Jr. Member William F. Mullen, Jr. Member G. Ritchie Latham, Jr. Member Ken Edwards Member Richard G. Ward Town Planneis .James Bryer and David Emilita Executive Administrator Victor Lessard 7 :30 p.m. Public hearing on the question of approval of the minor subdivision of Elizabeth Schwieger and Margaret Murray located at Southold, 3 lots on 4 .75 acres., which received approval from the Board of Appeals . Mr. Orlowski: We have proof of publication from the Mattituck Traveler Watchman. On a motion made by Mr. Mullen, seconded by Mr. Latham it was RESOLVED that the Southold Town Planning Board dispense with the reading of the metes and bounds for the minor subdivision of Elizabeth Schwieger and Margaret Murray. Containing 4.v75 acres . Vote of the Board: Ayes : Orlowski, Mullen, Latham, Ward, Edwards Mr. Orlowski: We also have proof of publication in the Suffolk Times notorized by ; signed by Anna Liekas, notorized by Judith Chien. We have ZBA approval). here, subject to the following conditions , that the barn on lot 2 shall not becDnsidered a principal structure a dweling as is , however, in the._ event at any time in the future that the building on Lot 2 is to be used renovated or used as a principal building- dwelling the same must meet the requirements of the zoning building codes and setbacks for principal building and dwelling use . That is the only restriction from the ZBA. We have the filing fee, we have the health services and everything else appears to be in order. Yes , state your name. Mrs . Schwieger: I am Elizabeth Schwieger. Mr. Orlowski: I take it you are in favor. Mrs . Schwieger; Yes , I am. Mr. - Orlowski: Okay. Is there anyone here- that is neither pro nor con . but may have some information pertaining to this subdivision that may be of interest to the Board? Hearing none, any questions from the Board? Mr. Mullen (none) ; Mr. Latham? Mr. Latham: We .were just having a discussion down here, two lots , it . could have been two. lots., but they have three. Mr. Orlowski: The zoning board gave him approval for three. Mr. Latham: Why? Mr. Orlowski: Well, would you cane to read the approval from the Board of Appeals . Mr. Ward: Yes : . .a hardship. Mr. Orlowski: Do you have any questions , Mr. Ward? Mr. Ward: No, nothing further than what Mr. Latham said: Mr. Orlowski:. Okay, if you want to, later you can review that, this .is just a public hearing now. . Mr. Edwards (none). Okay., being no further questions; I will declare this hearing closed and thank every body for coming down. The . new Planning Board member, Kenneth Edwards , from Fishers Island was introduced. Mr. Edwards fills the vacancy left by- the resignation of James Wall, the previous Fishers Island member. , Mr. Edwards stated that he looked forward to working with the Boardmembers . At this .time, Mrs . Elizabeth Schwieger approdzed .the Chairman to request the date of the Planning Board action. The. Chairman stated that this would be put on the next agenda of the Board,. and the Board has 45 days to make . a decision on the final application. On a motion made, by Mr. Latham, seconded by Mr. Mullazit was : RESOLVED that the Southold Town Planning Board accept and re nest complaince with Inspector John W. Vote of the Board: Ayes : Orlowski, Mullen, Latham, Ward, Edwards Mr. Orlowski: In reviewing the file, we have the filing fee,we have correspondence from Health Services . Would you like a map -down there? ( Chairman passed a map . to .James Bryer and .Victor Lessard) At this point in time, everything appears to be in order. I ' ll ask if anybody out there has any 'objection to this subdivision? Did you want to say something? Stu Harvey: Yes , maybe I need more information,what are we now in eight? Mr. Orlowski: Eight? j Page 4 12/17/84 Mr. Harvey: Eight acres to. a . . .you now have seven lots on 56 acres , and this was originally separated prior to two-acre zoning. Mr. Orlowski: Right. Mr. Harvey: So how do we end up now with going for eight acres a lot? Mr. Orlowski: Well, the applicant thought he would .rather do it this way and save the open space instead of a regular subdivision. Mr. Harvey: Can that further be subdivided? Mr. Orlowski: Not at all.. It is done on a cluster concept and the lots are up front and the rest is open space. a Mr. Harvey: So many on the sound? Mr. Orlowski.: They .are all onthe Sound,_ and all that. is left open is covenanted to be left open. Ms. Gary McLean-,: How would one gain access' to these lots? Mr.Orlowski: They will have to put in an approved road. to the property. Would you please give your name .for the secretary? Gary McLean: Gary McLean. Mr. Orlowski: Any one else with any objections to the subdivision? Hearing none, are there any endorsements of the. subdivision? On a motion made by Mr. Latham, seconded by Mr. -Ward it was RESOLVED that the Southold Town Planning Board grant a 90-day . extension on the filing of, rht final maps for the major subdivision of Harbor View located at Mattituck, pursuant tothe request of the attorney in order that the Department of Environmental Conservation and Department of Health SErvices approvals can be obtained. Vote of the Board: Ayes : Orlowski, Mullen, Latham, Ward, Edwards On a motion made by Mr. Ward, seconded by Mr. Mullen it was RESOLVED that theSouthold Town: Planning Board approve the set-off of Joseph Wanat, _ map =d-a-ted :.as`-=1:ast _amended November 28, 1983 , located off Bergen Avenue,Mattituck and approved by the Board of Appeals for. right-of-way and insufficient width. This approval is subject to the review of the Suffolk County Planning Commission. Mr. Frank Tirelli-Mr. Chairman, I real-ly can't say . that I object to it, but I :would -like to 'have a couple of things c larif ied, on .this one parcel . It is a little confusing when I read here: 8` lots on. 14 acres in the cluster c.oncept,. .L"-assume we are ddscussing 8 building lots. of 2 acres or 1 acre. Mr. Orlowski: One acre. Page 6 12/17/84 Mr. T_irelli: One acre he is applying for. Mr. Orlowski: "Have you seen the map? Mr. Tirelli: Yes, I have, sir. Mr. Orlowski: Okay. Mr. Tirelli: And, at first I thought it .was 7 homes on .the outskirts, it looks as though .in- reviewing it -that the acrss to these lots are- on North Bayview and to the best "of my knowledge there is a couple of homes"'on .that other North Bayview, north and .south. That is.: one: area, the other area is ,that I am: not against the subdivision becaus:e .if you have a problem I 'm. all for it, if there is._.any 'kind of,.hardship lets put it that way. .But I .:understand there is also a water problem there, incther words if he is going to .look for . 8 lots that is fine.., is he going .to ask for a variance -next year. to. develop the. other acreage that he is not .using which is about 7 acres? If there is a water problem of any sort, l am aware .of the .fact and I understand that there i's a state law that were. you are in a 'situation ;where you have unbuildable land,. that you can add more and reduce . the size of your .bui'lding. lot. The only question here is I 'm not aware of .the law.or legalities that we: are.. referring to', are we referring .to salt water wetlands , are we referring to fresh water, "I don't know whether they are both `the` same.::or what. �'As. far as I can . understand about the piece. it is. the 8 hots and. there . is no .more. building 'going on, fine I 'm not against.. that. it is that as long as we are protecting the. so-callEd'.water rights or . say the feasible studies we have had "about our water prob-lem, sewage problems -and what not, that we are also booking into that area that we have don't have a problem with the water systems . Access to the property I .didn't see--anything on the map to show where`-the roads- are- going to- go, how are they going to get into this property. Mr. Orlowski: Well, first. let me say there is only 7 building lots on the property. Using the cluster concept and perserving the open space., they will be a -community formed -there and a association and the association will still own the open space . and it •wil:1. always be open. space cause this will be approved as a cluster: There will never any chance of any,. further subdivision there and there will only be 7 homes on this property. Mr. Tirelli: Well, you've answered my questions . . Mr. Orlowski: The access to the rear, is each. and every person has title to that parcel that is open ,they will still be paying the taxes on .it it just will not be for any building. Mr. Tirelli: So we _go back to the concept that it is real.ly two acres . Mr. Orlowski: Yes:, .it, is.,. And they have received preliminary approval' as -`far as article 6 goes and thats .the water from'the Suffolk County Health Services . Any,. other. objections to this : subdivision? Okay, hearing none, is there anybody. in favor of this subdivision? Page 7 12/17/84 Mr. Cron: Mr'. Chairman, if it pleases the Board, I `m here on behalf of James W. Dawson and since the Board has explained the situation fully to this gentlemen as to the nature of subdivision and its clustered concept. I don't think it is necessary to again reiterate that. In light of the fact that .all requirements have been met to date, I would respectEuilly request the Board to grant an approval . Mr. Orlowski: Okay, anyone e.lse .with. endorsements of this subdivision? Hearing none, is there anyone neither pro . nor con but may have some information with regard to this subdivision that would be of interest to the Board? Hearing none,. any questions from the Board, Mr. Mulle4, (None) ; Mr. Latham, .(none) Mr. Ward? Mr. Ward: Any approval should be .subject to the recommendations of the Suffolk County Planning Commission that .we take the recommended highway dedication at the corner .of the intersection. Mr. Orlowski: We will note that. Mr. Edwards ,. (none) okay:.being as there are no further questions, I will declare this hearing. closed and thank you all for coming down. Cutchogue Library site plan and lot-line change- Mr. William Peters was .present for .this discussion. 'He stated that the parking is 'presentl_y on lot. No. land Lot No. 2, and the library has entered into a: contract with the Congregational Church Society of Cutchogue to purchase Lot 2 which contains the library building and that part of Lot 1 which contains the parking. for the .library. Mr. ' Peters explained that .the library cannot. proceed with the addition to the library _ site plan, and special execptions until they own their own parking. Mr. Peters said the purpose of the lot-line change subdivision would be to readjust- the- line so the library can own their own parking. Mr. Bryer stated. that in his review he. saw no problem with the .lot line change,- he did have a question regarding .the parking.. Mr. Bryer questioned the existing .number of parking spaces.. Mr. Peters said that he was' not exactly sure but he estimated that there were 5 existing spaces . Mr. Bryer said that the proposed addition is. double the size of the existing buidling and there was no increase in parking. The town code provides for 1 parking space for each 5. se_ats in a library. Mr. Bryer said that . his .computations showed that 26 parking spaces were required; and there were only 10 proposed. Mr. Peters said that..the only parking which the .library could expand on is to further along Cases Lane, however this would be a violation of . the - building code, because parking has to be 50' from any lot line . Mr. Orlowski .-requested if the library had permission to park°.in the Old School property. Mr.' Peters said that the Town Code does not. al.low librarys to have parking that they do not own, , and even though .it is used all the time, it can not be used inthe requirements because the library did not own 'it. Mr. Peters said that he could get something in writing granting the library permission to use the parking, but. .it still did not mean that he could figure it in the. site plan. . Mr. Peters did apply to the Board of Appeals for .a special execption Page 8 12/17/84 and for a variance to go less than 50' to the rear lot line. Mr. Lessaid said that as Tong as the application is before ZBA, it would be a good idea to apply for off-site parking approval too. Mr. Peters. said he would do that if he could proceed ' withthe. same application in order to expedite the action. Mr. Lessard said that the application could be amended, and Mr. Peters agreed to do that. s On a motion made by Mr. Latham, seconded by Mr. Mullen it was RESOLVED that the Southold Town Planning Board approve the lot-line change of the Cutchogue Library located at Main Road ' Cutchogue to enable the library to purchase . the parking :area. Planning Board refer the site plan of the Cutchogue Library- for -the construction of an adddtion to the library to theBuilding Department for certification. Vote of the. Board: Ayes: Orlowski, Mullen, Latham, Ward On a motion made by Mr. -Mullen, seconded by Mr. -Latham the following- -- - - action was taken: NEGATIVE DECLARATION Pursuant to Article 8 of the Environmental Conservation Law State .Environmental Quality Review Act and 6NYCRR Part 617,` Section 617 . 10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that Southold Town Planning Board as lead agency for the action described below has determined that the project will not have a significant effect on the environment. DESCRIPTION OF ACTION The minor subdivision of Andrew Lettieri is 2 lots on 11 acres located at East Marion, Tax map NO. 1000-31-5-1.2 . The project has been determined not to have a significant effect on the environment for the following reasons : An environmental. assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be. implemented. as planned. Because there has been no correspondence from the Department. of Environmental I'Conservation in the alotted time it is a, sumed there are no comments or objections by that agency. Page 9 12/17/84 ^ 1 The Suffolk County Health Department has no objection of our designation of lead agency. There is no record of an application to that department. It appears that the project can be served by Subsurface sewage disposal system and a .public water system. They note that information is needed regarding subsoil conditions to a depth of 17 ' and location, elevation of corners of parcel, subdivision application must be filed and approved -by Department of HEAlth, intended use of parcels . They request these items prior to further review. The project will meet all the requirements of the Code of the Town of Southold Subdivision of Land Regulations . Mullen; .seconded by Mr. Ward: the following action was taken: NEGATIVE DECLARATION Pursuant to Article 8 of the Environmental Conservation Law State Environmental Quality Review Act and 6NYCRR Part 617, Section - 617 . 10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that Southold Town Planning Board as lead agency for the action described below has determined that the project will not have a significant effect on the environment. _ DESCRIPTION OF ACTION The Minor subdivision of George and Irving Newman is four lots on 16 .4 acres located at Orient. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. Because there have been no correspondence from the Department of Environmental Conservation, in, the alotted time, it is assumed that the agency has no comments ' or concerns. It is noted that Article 6 requires a subdivision map to be ffled and approved by the Health Department. The following information is needed prior to review and determination: 'A) Subsoil conditions to a depth of 17 ' and B) "Letter of Jurisdiction determination for parcels from NYS Department of Environmental Conservation. The project will meet all the requirements of the Code of the Town of Southold Subdivision of Land Regulations. Further information can be obtained by contacting Diane M. Schultze-,; Secretary, Southold Town Planning Board, Main Road, Southold, New York 11971 Vote of the Bo:ard: .Ayes : Orlowski, Mullen, Latham, Ward George and Irving Newman-The Board discussed the la�,out of this subdivision, Mr. .Latham suggested moving lot No. 4 to the dike . Mr. Latham a`lso ' said that he met with a representative of the Nature Conservancy and they .are very interested in the parcel of meadow Stephenson Beach located at East Marion-Orient- The Planning Board reviewed the resolution of the County PlanningCommission disapproving 'this subdivision. The Board then read the correspondence fromthe applicant requesting the Board to override this resolution. The Chairman noted that Lot. No. 2 will be dedicated to the East Marion-Orient.' park district and he felt the people of the community had a lot. to gain 'by this proposal. It was also noted that prior to .any building, health department approval had to be obtained for Lot No. 3 and this was contained in the covenants and restrictions to be filed with the County Clerk. After this review the following action was taken. On a motion, made by Mr. Latham, seconded by Mr; Mullen it was RESOLVED that the Southold Town Planning Board override the Suffolk CountyPlanning Commission' s resolution. of disapproval regarding the minor subdivision of Stephenson Beach located at Orient, for 3 lots on 13 .4 acres . Vote of the Board: Ayes : Orlowski, Mullen, Latham., WArd qi Page 11 .2/17/84 ON a motion made by Mr. Mullen, seconded- by Mr. Ward it .was RESOLVED that -the Southold .Town Planning Board approve the set-off of Daniel C. Shelley located. at Cutchogue, map dated as last amended November 8 , 1984 , for two lots on 3 .872 acres , subject to the. Suffolk County Planning Commission's review. Vote of the Board: Ayes : Orlowski, Mullen, Latham, Ward It was noted that the application received 280-a from the Zoning Board of Appeals . Serge Doyan set-off at Fishers Island- Boardmember Ken Edwards made a field inspection of the premises-a-nd noted that there was no problem on the site. The application is before the Board of Appeals due to the undersized lots . Mr. Edwards noted. that the lots in the immediate neighborhood are also small . On a motion made by Mr. Edwards , seconded by Mr. Latham it was. RESOLVED that the Southold Town Planning Board approve the set=off_ of Serge Doyan located at Fishers Island, for two lots on 2 .94 acres,. .plan dated April 19 ,. 1983-., subject to the variance needed from the Zoning Board of Appeals . Vote of the Board: Ayes : Orlowski, Mullen, Latham, Ward Allen Ovsianik- Mr. Ovsianik and Mr. Lark, esq. vere present to discuss this site plan for a gas station located at Peconic . Mr. Lark said that the plans with the changes as per the Board' s request had been submitted. It was the consensus of the Board to hold this over for further review .as the maps were .received a short time before the meeting. Winds Way Building Corp.-Mr. Wendell was present for this discussion on the site plan to construct an additional office at North Road, Southold adjacent to' the existing offices . Following a field inspection, the Board had recommended changes in the- parking layout which the applicant agreed to. The Board' s recommendations were to have the parking closer to- the building and provide a loop for one-way ingress and egress , to aid the traffic flow. On. a motion made by Mr. Ward, seconded by Mr. Mullen it was RESOLVED that the Southold Town Planning. Board. refer .the site plan. of Winds Way Professional Center for the construction of 'of.fice .buildiRgs. located at Southold to the Building Department or r ificaticn subject to receipt of. six (6) copies of the survey with the parking changes as recommended by the Planning Board. Vote of the Board: Ayes.: Orlowski, Mullen, Latham, Ward Page 12 -.2/17/84 Farmers Home AdministrationThe Board made a field inspection of this proposal for 2 lots on 35 .acres. located at Soundview Avenue and North Road, Mattituck. The Board made a field inspection of the premises and it was the consensus of the Board to request access through the 5 acre lot. on North. Road to the back 30 _.acres . This request is made since the only way onto the 30 acre parcel is around to Soundview Avenue , and the .Board felt it would be better to have additional access off North Road. Cove Beach Estates at East Marion- Mr. Ri.chard, Cron, esq. presented a request fora 90-day extension on the action of the. final maps . Mr. Cron said that the County Planning Commission had 'raised alot of questions concerning the approval of this application. One of the County' s concerns was the set-back from the bluff , Mr. Cron had the .survey .amend the maps to reflect the Board's request, since .there was no bluff and the set-back would be from , the mean high watermark. Mr. Cron stated, however, that nothing . seemed to satisfy the county' s_ questions- even though the Planning Board had gone over everything was satisfied with .the layout. Mr. Orlowski said that the problem lies with the fact that Southold. has no member on the County Planning Commission. to reviee the maps . He noted that Mr. :Ward was recommended to be on the Commission,, but no appointment had been givenat this time. Mr'. Cron said if the County..persists he .will request that the Planning Board override them. . Mr. Cron said that he is .also having the survey put a notation on the map regarding the use of open. space for a well if one of the lotowners cannot use the lot, this will satisfy the Health Department' s article 6 approval and then everything will be in order fot the Board action. On a motion made by Mr.Latham, seconded by Mr. Mullen it was RESOLVED that the Southold Town Planning Board grant. 90- day extension on the action of the final maps for the major subdivision of Cove Beach located at East Marion pursuant to the .request of the attorney for the applicant in order that the final approval of the Department -of Health Services can be obtained, and the review ofthe Suffolk County. Davis, field inspector and Mr. Lawrence Tuthill , Town Engineer were present for this discussion regarding the construction of the access road within. the approved minor subdivision at Mattituck. Mr. Tuthill presented his report on the road work, and the Chairman read the report submitted by Mr. Davis . The Board agreed that the road was constructed poorly . and agreen that they should send the comments to the applicant for corrections . Mr. Davis stated that the profiles and. dips in the .road .is the worst problem. Mr. Tuthill said that if some trees. were cleared it whould help the situation. Mr. Davis said that emergency vehicles could turn in driveways . The property on the FI.DCO map states that it is two lots , but does not show a lot line separating the lots . Mr. Edward said that he also inspected this property and saw no problem,. with the land, however, there is a question on the lotline . Mr. Orlowski said. the Board would look into this proposal for Lilly Emmet West and put it on the agenda for the first meeting in January.. Mr. Stu Harvey discussed the set-backs proposed with the Board. Mr. Cron, esq. reviewed the subdivision of James W. DAwson. and the ,resolution 'of the- Suffolk County Planning Commission with the .
