The Southold Town Planning Board held a regular meeting at October
22 , 1984 at 7 :30 p.m. in the Southold Town Hall, Main Road, .Southold.
Present were :
Chairman Bennett Orlowski, Jr.
Member Richard G. Ward
Member William F . Mullen , Jr.
Member G. Ritchie Latham, Jr.

7 :30 p.m. Public hearing on the question of approval of the minor
subdivision of Philip Scire located at Cutchogue. Containing 11.782
acres .
On a motion made by Mr. Mullen, seconded by Mr. Latham it was
RESOLVED that the Southold Town Planning Board dispense with the
reading of the metes and bounds for the minor subdivision of .
Philip Scire located at Skunk Lane, Cutchogue for 4. 1ot s on 11.782
acres .
Vote of the Board: Ayes : Orlowski, Mullen, Latham, Ward
Mr. Orlowski: We have proof of publication from. the Long Island
Traveler Watchman signed by Pat Wood, notorized by Barbara Forbes ,
we also have proof of publication from the Suffolk Times signed
by Anna Liekas , and notokized,Judith Chein. We seem to have everything
in order, compliance with article 6 from the County. At this time I ' ll
aks if there is anyone out there who has any objection to this minor
subdivision? (None) Is thereaanyone in favor of the minor subdivision?
Mr. Cron: If it pleases the Board, in'-the light of the fact that
all , compliance of all agencies have been completed to date with
regard to this minor subdivision I would move in behalg of the applicant
that it be approved by the Board and that the Chairman be authorized
to indicate his approval thereon in writing on the final subdivision
map.
Mr. Orlowski: Okay, is there anyone neither pro nor con but might have
. some information pertaining to this minor subdivision that the Board
might like to hear? Hearing none I will take any .questions from the
Board. Mr. Mullen, (none) ; Mr. 'Latham?

Mr. Latham: Just Lot No. 1, is that the end of it? No more
subdivision? It is rather large .
Mr. Orlowski: Okay.
Mr. Mullen: I think we put C and R' s on it.
Mr. Orlowski: I think there is . Is there a covenants and restriction
in .there on that, . Mr. Cron?
Mr. Cron: Not at the present date, I don' t believe. I am not sure
the Board has asked for therm.
Mr. Orlowski: If .we did, would that create a problem?
Mr. Cron: No, not at all .
Mr. Orlowski: Okay, then we .will ask for them. Okay, Mr. Ward?
(none) . Alright, at this time we have coordinated lead agency in
regards to SEQRA, but we have not got anything back so I think .
it would be aproprate to take lead agency.
On a motion made by Mr. Ward, seconded by Mr. Mullen it was
RESOLVED that the Southold Town Planning Board declare themselves
lead agency with regard to the State Environmental Quality REview
Act for the minor subdivision of Philip Scire located at Cutchogue .

Mr. Orlowski: seeing that there are no problems here ,. we ,..could
.do a negative declaration at this-time .
On a motion made by Mr. Ward, seconded,. b.y Mr. Mullen the following
action was taken.
NEGATIVE DECLARATION
Pursuant to Article 8 of the Environmental Conservation Law
" State Environmental Quality Review Act and 6NYCRR Part 617 , Section -
617 . 10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that Southold -Town Planning Board as lead agency for
the action described below has determined that the project will not
have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Philip Scire located at. Cutchogue,
containing 4-lots on 11.782 acres.
The project has been determined not to-have a significant
effect on the environment for the following reasons :

An environmental assessment has been submitted which
indicated that no significant adverse effects' to the
environment were likely to occur should the project
be implemented as planned.
Because there have no been no comments from the Department of
E nvironmental Conservation in the allotted, it is assumed
that that agency has no objections .
The Suffolk County Department of Health. Services has no
objectiontn our designation of lead agency, they are in
agreement with our initial determination. The Department
has received an application and it is complete. The Health
Department maintains final jurisdiction over location of
disposal and well systems and the applicant should not under
take to construct any water supply or disposal system with-
out Health Department Approval.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations .

located at Mattituck, 4 lot s on 27 .52 acres .

RESOLVED that the Southold Town Planning Board dispense with the
reading of the metes and bounds for the minor subdivision of
Sundown Farms , located at Mattituck, containing '27 acres .
Vote of the Board: Ayes : Orlowski, MUllen, Latham, Ward
Mr. Orlowski: We have proof of publication in the. Suffolk Times,
October 1984 signed by Anna Lekas , potor.ized by Judith Chien and
also proof of publication from the Long Island Traveler Watchman
signed by Pat Wood and notorized by Barbara Forbes . At this time
the covenants and restrictions are not back from Tasker' s office,
but they have been submitted and they are basically what we asked
for. At this time I. will ask for any objections to this minor
subdivision? (hearing none) Is there anybody in favor of this
minor subdivision?

Mr. Bruer: Yes , Mr. Chairman, Rudolph Bruer,. on behalf of Mr.
and Mrs . Steiffer. I believe everything has been put before the
Board already, and said. And., we respectfully. request that the
Board approve the mapa and sign it as soon as possible . I aks ,
we ask, on behalf of Mr. Steiffer that it be done as soon as
possible because he has a practical problem in thathe wants
to build on the property and the weather, although, it is hard
to believe today, bad weather could set in and we could have
difficulty and a problem come this spring if he does not have
a foundation in. Thank you very much.
Mr. Orlowski: Okay, is there anybody else who would like to
comment in favor? Hearing none is there anybody out there neither
pro nor con but may have information pertaining to this minor
subdivision that the-"Board sould know about? Hearing none . .
I will ask questions of the Board, Mr. Mullen (none) , .Mr. Latham
(none) , Mr. Ward, (none) . Okay, at this time I will just read
Mr. Davis ' report and comments . "The read noted as a 10 ; ' travelled
road is somewhate in error. attached is a copy of the road width
down to about the. last utility pole from Sound Avenue . Thss from
report 369 datedd 6/7/84. fron the Board of Appeals . The above. . t .
length has been stabilized with sand and -gravel for depths of from 2"
to 4" . The profile is acceptable but there are potholes and depressions
throughout. Going south except for the first 250 ft. there is a wooded
area on the left side and open land on the right side . This section
would probably not present problems for emergency equipment. The
remaining length is 8 ft. in width and in a wooded area throughout.
It has been stabliized with sand and small gravel . A few test holes
indicated depths of 3" . The profile is acceptable but there are a few
irregularities . Most of the length is below the adjacent ground
level . In some areas the road sides slope up for from 2 ft. to 4 ft.
with trees near the top of the slopes . The 700 ft. section of the
raod is passable as of the present time . Emergency equipment would have
to turn around via driveways- If the aligmment of the present road
is to be accepted for access even though parts of it are in propoerty
owned by others , it should be repaired asc. updated. I would recommend
'the following: 1 . Fill the potholes and depressions in the first
2000 fet and bring in additional. bankrun sand and gravel to provide
a 6". depth. The width for the first 250 ft. would have to be 8 ft.
due to trees . The remaining 1750. ft. of 2000 could be 10 ft. in
width or more . 2 . The last 700 ft. should have the few high
areas leveled and additional bankrun brought in to also provide a
6" depth. Widening the present width would involve grading and
tree removal.: 3 . Place a compacted 2" top course of 3/4" stone
blend on' the bankrun for the full length of the. road. " Also I have
a letter from a Mrs . Sarbara .Sayre . It says "I , Barbara B. . Sayre,
own some .of the adjacent property to the west. Iown some of the
right-of-way ) (a dirt farmroad, my driveway) known as Laurel Lake
Road which passes ,over my property. I do ; not object to appreval
of the subdivision, but I want to be understood as to be
objection . to .the use of the right-of-way which passes over
my property. This is not easy to write . I would attend the
hearing but I am to be in Florida on October 22 , 1984 . My husband,
Robert Sayre , is at home if Mr. -Steiffer wishes to talk_ with him.
If Mr. STeifer intends to put in his own right-of0way on his
property adjacent to my property. that is okay with me . Of course ,
I am just not granting him premission to use my property as hus
right-of-way. Is this clear? Sorry .if the words sound so harsh
I .am not speaking them that way. I wish to be neighborly.,,

Mr. ORlowski : I don' t, the right-of-way is there and it has been
used. I take it is a common right-of-way.
Mr. Bruer: Mr. Steiffer informs me that the entrance way from
Main Rd. that she uses is actually on his property.
Mr. Orlowski: ..Okay. Does the Board have .any questions at this...
time?
David Emilita- Mr. Chairman, I have a question as the covenants
and restrictions ..
Mr. Orlowski: The C and R' s state that lot lb 1,. the large lot,
will not be subdivided any more than a minor subdivision.
Mr. Emilita: They already did a tenor.
Mr. Orlowski.: Any further than a minor, than four lots , no more
than four lots . That- is in the covenant and restriction that we
have now.
Mr, . Emilita: We are creating four lots now, this is the minor on
the parcel .
Mr: Orlowski: Right.
Mr. Emilita: The next subdivision would be a major.
Mr'. Orlowski: In our approval.we could put in, yes .
Mr. Emilita: So, in other words , there may be further subdivision.
Mr. Orlowski: But not parcel 1 , parcel 1 only. Two, three and four
are covenanted in perpuity as to no further subdivision.., and we have
that and it is at Mr. Tasker's office now. Lot NO. 1 is no more than
four lots and if you want we could make that now.
Mr. Bruer: I might state that there is no intention to subdivide , it
is something like 13 acres and it is right on Main Road.
Mr. Orlowski: Are you going to -.g-iveus a covenant to that effect?
Mr. Bruer: As to two, three and four, yes .
Mr. Orlowski: What about Lot No. 1?
Mr. Bruer: I will do that.
Mr. Orlowski: On Lot No. 1 too?
Mr. Bruer: That it will never be subdivided into more than four lots .
That is not a suprise , that was said in the beginning. You are talking
about 27 acres .
Mr. Orlowski: In that it would have to conform to a major in that
the road would have to be fixed up.
Mr. Bruer: They are going to service Lot No. 1 with another road
anyway .

Mr. Orlowski: If I was doing that, I would make sure it is 50' .
Mr. Joseph Steiffer: It would have to be fifty feet just to service
four lots . .
Mr. Orlowski: Not now, but if it was to come in again, it would
come in as a major. So we will put that in there : Anyother
questions? Hearing none, I will declare this. hearing closed.

RESOLVED that the Southold Town Planning Boards-clare itself lead
agency with regard to the subdivision of Ronald Strain located
at Cutchogue under the State Environmental Quality Review Act.

Because there has been no correspondence from the Department

objection to our status of lead agency, they are in
agreement with our initial determination and there is
no record of an application to their department. The

Department has the following notes: this was submitted- as
a previous proposal for 24 parcels listed under "Sound Road
EStates" , Test well indicates nitrate contamination, this
proposal is exempt from requirements of Article VI . The
Health -Department maintains final jurisdiction over location
of water supply and disposal system and the approvals must be obtained

Mr. Henry E. Raynor, Jr. was present for a pre-submission conference.
on the site plan of W.B.W. Corp located at Cutchogue . This proposel
is for construction. of 8 retail stores . Mr. Raynor supplied- the
Board with the .Long Evnironmental Assessment Form which was requested.
Mr. Raynor, explaind the changes that. were . made to the siteplan.
He explained that the stores were originally laid out in a north/
south direction and they are now laid in a U shape, with colonial
, architecture, 2 story situation. In re-designing the proposal,
Mr. Raynor stated, the area of building has been decreased from
over 9 ,000 square feet to just over6 ,000 square. feet This presents
an 11 lot coverage for. building .area--..ratio to`-the -_total area.
Mr. Raynor pointed the ingrees is on the easterly side of thelot, and
the egrees is on thevesterly end of the property. He went on
to state that the interior circulation is a single loop in front
and a single'" loop, one-way in the rear:.. He noted , 'that the parking
is over that required `under the zoning. The landscaping is on all
three sides of the building, the building is set-back beyond that
of the building on the westerly lot 30 ' . Mr. Raynor indicated
that he wou, ., be forwarding a seperate plan showing plantings and .
lighting, however, they would be using on ly one sign as shown on
the current plan. Mr. Raynor requested that this plan be referred
to the Building Department for certification and- stated the
three principals of the corporation, Walsh, Brantuk and Walsh
each being 1/3 owner. Mr. Ward questioned the location of the
roof .type units such as the air conditioning. Mr. Raynor stated
that they had ,been removed and everything will be housed in the
basement.• Mr. Ward also requested that cons�:ideration be given
to locating the building at a set-back even_, with the building
located on the westerly lot.

WBW Corp cont.- Mr. Ward explained that this would provide
more landscaping in the front yard and perhaps all the parking
could be located in the rear.. Mr. Raynor stated that they would
take this into consideration, however, they stated the reasoning
for the proposal as .submitted was so that a -"Jarge area would not
have to be paved and the pavement could be broken up. Mr. . Raynor
explained that there would be three buildings covered by an. arcade..
It was the consensus of the Board that this. plan was the best of
the plans sub'm'itted for this .project. It was the consensus of
the Board that consideration be -given to moving the parking to
the. rear . of the _b.uilding to procide more landscaping and buffering in'�-
the front as per 'Mr. Ward's recommendation. This could .be done be
by shifting the building evn to the set-back line of the building
to- the West, closer to the. Main Road. It was also noted that the
proposed' sign encoraches on the sidewalk slightly.
On a motion made by Mr. Ward, seconded by Mt. Mullen it was
RESOLVED That the Southold Town Planning Board delcares itself
lead agency with regard to the State Envornmental Quality Review
Act for the site plan of W.B.W. Corp for the construction of
retail stores .located at Cutchogue .
Vote of the Board: Ayes : Orlowski, Mullen, Latham, Ward
Cranberry Acres Although not on the agenda., Mr. Raynor explained
to the Board that he had been retained b.y. the .c.ontract vendee for
the project and would be re-submitting maps changing the proposal
from a . major subdvision to a minor subdivision.
The appointment of Abigail Wickham, esq. for the site plan .of
. Gemma located at Cutchogue was cancelled .at the request of Mrs..
Wickham.
Allen Ov.sianik The Board had made a field. inspection of the
- property, however, has some questions for the applicant.. It was
the consensus of the Board to re-uest that the applicant schedule
an appointment to discuss this project with the Board.
Long Island. Nurseries- It was the consensus of the Board .to make
a field insepction of the property prior to any action. This
proposal is for 2 lots on 22 .5 acres at Mattituck.
John and Dorothy Moeller-The Board reviewed this file for a 2 lot
-subdivision on 2 .73 acres which received relief from the two-acre
zoning from the Town Board It was the consensus of the Board
to make a field inspection prior to any action.

ON a motion made by Mr. Mullen, seconded by Mr. Latham it was
RESOLVED that the Southold Town Planning R)ard approve the
minutes of the regular meeting of August 27 , 1984 .
Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward
On a motion made by Mr. Mullen, seconded by Mr. Ward it was
RESOLVED that the Southold Town Planning Board set November 5 , 1984
at 7 :30 p.m. at the Southold Town Hall -as the time and place
for a regular meeting :-of the Board.

On a motion made by Mr. Latham, seconded by Mr. Mullen i t was
RESOLVED that whereas a formal application for the approval of
a subdivision plat entitled "Albert W. Albertson, Jr.. " located
at Southold was submitted to the Planning Board on June 11, 1984 , and
. filing fee was paid on 'June .11, 1984 in the amount of $50. , and
WHEREAS, a public hearing was held on said subdivision application
and plat at the Southold Town Hall, Southold, New York, on
October 8 , 1984 at 7 :30 p.m. , and
WHEREAS, the requirements of the Subdivision Regulations. of the
Town of Southold have been met by said subdivision plat and application,
NOW, therefore, be it RESOLVED that the application of.. Alb.ert W.
Albertson, jr. , for approval of said subdivision plat prepared by
Donak Associates , dated June 4 , . 1984 , be approved and the Chairman
be authorized to endorse approval on :aid subdivision plat.

On. a motion made by Mr. Ward, seconded by Mr. Mullen it was
RESOLVED that the Southold Town Planning Board aprove the site
plan 'of Brewer Yacht Yard, located at Greenport, dated July 26 ,
and September 1, 1983 for the construction on an addition on an
existing building to be used for office and storage.

On a ration made 'byMr. Latham, seconded by Mr. Mullen. it was
RESOLVED that the Southold Town Planning Board accept Report
No. 397 of Inspector John W. Davis for the access road within the
subdivision of Settler' s at Oysterponds located at ORient.

On a motion made by Mr. Latham, seconded by Mr. Ward it was
RESOLVED that the Southold Town Planning Board accept Report
NO. 397a from Inspector John W. Davis for the final inspection
on the right-of-way within the minor subdivision of George acid
Opal Askcin, located at Southold.

On a motion made by Mr. Ward, seconded by Mr. Latham it was
RESOLVED that the Southold Town Planning Board accept reports
No. 391 and 395 from Inspector John W. Davis for the work done
on the curbs within the subdivision of Grand View Estates at
Orient.
Vote of the Board: Ayes : Orlowski, Mullen, Latham, Ward
It was the consensus of the Board to refer the above reports
to the developer, request compliance, and make Mr. Davis
aware of any other condition.
On a motion made by Mr. Mullen, seconded by Mr. Ward it was
RESOLVED that the Southold Town .Planning Board set Monday,
November 5 , 1984 at 7 :30 p.m. at the ' Southold Town Hall,
Main Road, Southold as the time and place .for a public hearing
on .the question of approval of the minor subdivision .of Richard
and' So hia Greenfield to be known as "Cabot' s Woods" located
at Peconic.
Vote of the Board: . Ayes : Orlowski, Mullen, Latham, Ward
On a. motion made by Mr. Latham, seconded by Mr. Mullen it was
RESOLVED THAT the Southold Town Planning Board grant a 30
day extension on the filing of. the final maps , and the final hearing

the existing cottage so that could be used as a . reference
for identifying where the buidings would be located.

On a. motion made by Mr.Mullen, seconded by Mr. Latham it was
RESOLVED that the Southold Town Planning Board grant Freida,
Crowley 90' days extension from the date of this resolution for
filing the preliminary maps for the major subdivision. This
is pursuant to the request of the attorney for the applicant
in order that A .ticle 6 approval can be obtained.

Mr. Mullen questioned if the Town Board had any response from the
bonding company in regards to the. .major subdivision of Highland
Estates , owned by Richard Mohring. He also questioned if there
was any response from our Town Engineer on the Board's request
for updated bond estimates . Mr. Mullen suggested a meeting with
the Town Board in order to bring their attention to these bonds
and request that the. Town accept only letters of credit or passbooks
instead of bonds from bondir}g companies . It was noted that there
had .been no response from either the bonding company or the Town
engineer on the Board' s request. It was suggested. that .a recommendation
should be. made to the building department that no certificates of
occupant' will be issued .until the Town has the .money to. make_ the
improvmments to the road, or until the developer does same .

Rutho Oliva presented the minutes of the Master .Plan Hamlet Meetings
to the Board. The. Chairman 'noted that the Master Plan Update is_
progressing well .
.Mr. Latham questioned the curbs in Grandview Estates at Orient which
are under construction. It was .noted that all reports. - of the
work will be sent to the developer, Harold Reese, so he will be
aware of the situation.
Being no further business to come before the Board, on a motion
made by Mr. Mullen, seconded by Mr. Latham and carried, the meeting
adjourned at 8 :45 p.m.
