The Southold' Town Planning .Board held a regular meeting on
September 24 , 1984 at 7 :30 p.m. at. the Southold Town Hall,
Main Road, Southold.
Present were:
Bennett Orlowski, Jr. , Chairman
William F. Mullen; Jr. , Member
Richard Ward, Member,
James Wall, Member
James Bryer, . Town Planner
Victor Lessard, Executive Administrator
Mr. and Mr : William Coster and their attorney Richard Lark
were present for a presubmission conference to discuss the
site plan of Coster Funeral Home located at Cutchogue. Mr
Lark explained that the Costers are contract vendees for
a piece of_ land previously subdivided by Dalchet Corp.
It was also noted that the application would have to go
to the Zoning Board of .Appeals for a special execption.
Mr. Lark pointed out why he felt this was a very good
location as it is on the corner of Old Harbor Lane and
the Main Road, lhere, .is ample room for parking and ingress
and egress , also the cemetry is across the street so this
would fit in with the surrounding area. The Chairman
questioned if the subdivision with. the Planning Board for
Dalchet Corp. was ever,,-, finalized, Mr. Lark stated that
to the best of his knowledge it was . The Chairman
requested the secretary to look in the Planning Board
file's to find out if this was ever finalized. Mr. Lark
stated that the 25 ' right-of-way- on the plans was
in order to -get to the back lot and was a condition, of
the purchase. The Chairman stated that if the subdivision
was not approved the lot could be set-off, however, because
it is less than the current two-acre zoning, a variance
for insufficient will aslo have to be obtained. Mr. Coster
gave the Board maps indicating the inside of the building.
Mr. Lark explained that if the Boardlas a problem with the
traffic flow, they can have one ingress and one egress off
the Main Road, or Harbor Lane. Mr. Lark stated that the
purpose of this meeting was to .get information for proceding
with the other steps, he requested the Board' s approval of
this preliminary plan. Mr. Coster stated that he operated a
funeral home in Queens and lived in Southold Town, he wished
to open a funeral home here to avoid communiting. The Chairman
stated that prior..lo any action, they will research the subdivision
to find out if it is a single and seperate lot.

Mr. Robert Ringold was present for a discussion on the site plan
of 382 Wells Road Corporation for a car wash located at main- Road,
Southold. Mr. Price, esq.could notee present for this meeting.
Mr. Ringold stated that all the .plans had been amended to r9flect
,vha.t was necessary for certification by the building department,
as these plans were submitted to the Building Inspector but could
not be certified. The Board stated that they were concerned
with drainage and water use fora car wash. Mr. Ringold stated
that he proposed a water syste sirniiar to the one used in his
Laurel Car wash which was approved by Suffolk County Health Department.
He . said the sytem is a re-claim system that uses one '.ga llon o
water per car . , and about as uch water as a family of 5 per day.
The water was then recyled .and used again which is why it could
be conserved. The Chairman qu stioned the correspondence from
Victor Lessard regarding. certification. Vic stated that it could
be certified, however, with the new aditions to the site plan,
it should be looked over again.
On. a motion made by Mr. Ward, seconded by Mr. Mullen it was
RESOLVED that the Southold Town Planning Board approve the site
plan of 382_Well's Road _Corp. fo the construction of a car wash
located at Arshamomaque,_plans dated as last amended August 13 , 1984
subje.dt to this plan being certified by the Building Department
and a one-year review by the Pl nning Bea rd.

Mr. Richard Lark, esq. was present for a pre-submission confernece
on the site plan 'of Allen OVs'iamik located at County Route 48 ,
Peconic, for construction of a • ,as- station. It was noted that
the Zoning Board of Appeals had1granted a variance for a special
exception on this. parcel in 197� with conditions . One of the conditions
of approval was. site plan approvlIal . Mr. Lark :aid in his research
'the Board of Appeals decision reins with the land. The Chairman
stated that the Board will conduct a field inspection prior
_to .any action. Mr. Mullen ques ,ioned if the stattion would be
for gas only, and Mr. Lark s ated it would be for gas only,
and oil and anti-freeze changes etc . Mr. Mullen also pointed out. that
the station in Cutchogue owned by Mr. Ovsainik still needed.
some improvements for compliance with the conditional approval
which was granted by the Board., these improvements included fencing
around the yard where the cars a e. kept. Mr.Lark. stated that he
will look into this and have his client .do anything. that is necessary
for compliance with the Board' s onditions of approval.
Mohring Enterprises located at Peconic- The Board reviewed this
proposal for 4 lots on 34 acres following a field inspection.
The Board was. concerned with fur�her 'subdivision of the large
lots . Mr. Ward stated that the Board looked around the pond
area, which has a right-of-way through it. Mr . Ward suggested
that a. guard rail be put along the right-of-way that crossed
the pond ' for protection by vehicles from the pond area.
The Board was also in agreement that. convenant s and restrictions
be filed for the large lots agai st further subdivision.

On a motion made by Mr. Mullen, seconded by Mr. Ward it was
RESOLVED that the- Southold Tow Planning Board grant sketch plan
approval of the minor subdivision of Mohring Enterprises_L Inc.
at Peconic, plans dated as last amended July 16 , 1984 subject to
the following convenants and restrictions: .
1 . No further subdivisi n of Lots 1,2 , and 3 in perpituity.
2 . Any further subdivis on of lot 4 will constitute a major
subdivision.

RESOLVED that the Southold Town Planning Board declare themselves

Act for the minor subdivision f Mohring Enterprises , Inc. at Peconic .

Alexander Enterprises- The Boa d' reviewed this proposal for 4 lots
on 28.6 acres located at Mattit ck , , following a field inspection.
David Saland, agent and owner was present for this discussion.
The Chairman stated tPa.t the Boa�d 'was in agreement for covenants
and restrictions as to' no. furth� r subdivision in perpuity. Mr.
Saland stated that he was not a reeable to this., however, would
check with his attorney and get back to the Board. Mr. Saland
stated that the reasonhe is doi g a minor subidvision is due to the
water aid se,�n,er approval by the uffolk County Health Dept. , they
consider lots over 5 acres exem t from the requirements of Article
6 , therefore, the applicant doe not have to obtain approval
of the water. Mr. Saland stat d that he would be willimg to
covenant that the lots .not be s bdivided without Planning Boatd
approval, but not in perpuity. The Board stated that they would
only accept covenants as to no further subdivisin in perpuity.
The Chairman stated that if Mr. Saland has plans for future
subdivision of this property a layout of the lots be presented
so the Board can have an overla of tehe future .sections .
The Board .was in agreement that they would wait until the
covenants as requested or maps a e received prior to any action.
Marie J. Patterson-The Board reviewed this proposal for 2 . lots
on 1 . 05 acreslocated at Mattituc It was noted that the proposal
is before the Zoning Board of. Ap eals for a variance on the
insufficient area and the Zoning;lannin
Board was waiting for our
recommendations .
On a motion made by Mr. Mullen, econded by Mr. .Ward it was
RESOLVED THAT THE Southold Town g Board, fol_lowing a field

inspection, recommend to the Zoning Board of Appeals that the
set-off of Marie J. Patterson be denied since it is not
conforming with the current two-acres zonieng

On a motion made by Mr.' Ward, seconded by Mr. Mullen it was
RESOLVED that the Southold Town Planning Board approve the site
plan for Goldsmith and Tuthill for construction of an. office
and storage building at Southold, plan dated August. 16 , 1984
subject to reciept' of three (3) copies of the survey indicating
landscaping around the proposed building and a one-year review
by the Planning board.
Vote of the Board: Ayes: Orlowski, Mullen, Ward, Wall
It was noted that this site plan received approval from. the
Zoning Board of Appeals for the set-back variance, and was
certifed by the Building department.
The Board discussed a recommendation to the Town Board on the
set-back from the bluff on the LI Sound. A previous recommendation
was made to the Town Board, however, the Planning Board wanted
t oinclude ' set-backs from. fresh water and tidal wetlands, as.
well as ,the .bluff. The Board noted that the DEC is recommendaing
25 ' .set-back and that is too close.. Mr. Lessard recommended
75 ' back from the wetland.
On a .motion made by Mr. Ward, seconded by Mr. Wall it was
RESOLVED that the Southold town Planning Board recommend to the
Town Board that the following amendments be made 'to the proposed
. local law in relation to building set-baak requirements on lots
adjacent to Tidal .Waters, and to .include Fresh Waters .
Proposed Section 100-1.19 .2 (A) to read as. follows :
A.. All buildings located on lots adjacent to Long Island Sound
shall be set-back not less than 00 feet from the - to p of the
bluff or bank bordering on Long Island Sound.
Proposed Section 100-119 .2 (B) to-read as follows :
F. All buildings located on lots adjacent to any Bay, Creek, or
other Tidal Waters shall be set-back 75 feet from the mean high
water mark .of any such Bay, Creek, or other Tidal Wetlands .
Proposed Section 100-119 .2 (C) to be added and to read
as follows :
C. all. buildings located on lots adjacent . to Long Is-land Sound where
no bluff or bank exists , shall be set-back not less than 100'
from the mean high water mark,

D. All buildings located on . lots adjacent to any pond, stream, or
freshwater wetlands shall be set-back 75 feet from the water mark
of any such pond, stream, or wetlands .

On a motion made by. Mr. Mullen, seconded by Mr. Ward it was
RESOLVED that the Southold Town Planning Board, alfter a field
inspection, approve the one-year review of the approved site
plan of the North Fork Ba_n_k and Trust Co. at_Cutcho ue for a temperary
certificate of occupancy .l}obe issued subject to a one Tear review
prior to issuance of the final certificate of occupancy.

On a motion made by Mr. Mullen, seconded by Mr.. Ward it was
RESOLVED that the Southold Town Planning Board, after a field
inspection, approve the one-year review of the East End Suzy
Company site_plan_at Gree_nport for issuance of a temperary
certificate of occupancy subject to a one-year review prior to
the issuance .of a final certificate of occupancy.

On a motion made by Mr. Wall , seconded by Mr.. Ward it was
RESOLVED that theSouthold Town- Planning Board approve the set-off
of Anne Borland loc.ated. at Fishers Island, dated October 17 , 1983
subject to covenants and restrictions filed with the County Clerk as
to no further subdivision of either lot in perpituity, and the
review of the Suffolk County Planning Commission.

Sundown Farms__located ,at Mattituck- The Board reviewed correspondence
from the TowrAttorney regarding the right-of-way. The Town Attorney
stated in his letter to the Board that they don't have jurisdiction
over the use of the right-of-way and must assume that the applicant
has approvaltD use what he is coming to the Board for approval.. of.
The Board stated that they agree that they may not .have jurisdiction
over who uses the right-of-way, but it was the consensus of the Board
that a 25 ' right-of-way be placed on the map to show that there is
a right-of-way totally within the subdivision , as opposed to the
existingtraveled right-of-way which is inside and outside the
subdivision boundry.
On a motion made by Mr. Ward, seconded by Mr. Wall it was

RESOLVED that the Southold Town Planning Board- declare itself
lead ageng with regard to the subdivisionof Sundown Farms
located at Mattituck. An initial determination of non
significance has been made.

hereby given that Southold Town Planning Board as lead agency for
the action described below has determined that the project will not
have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Sundown Farms is a 4 lot subdivision
on 27 .5 .acres at Mattituck.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned..
Because there has been no correspondence from the DEC
in the allotted time it is deemed that they have no concerns'
or comments regarding this matter.
The Suffolk County Department of Health Services has no
objection to our designation of lead agency status . Their
primary environmental concern pertaining to development is
that the applicant comply with the requirements of Article Vand VI
and relevant constructioAstandards for water and sanitary sewage
disposal. The health department maintains jurisdiction over
final location of disposal and well systems and the applicant
should not undertake to construct any water supply or disposal
system without Health Department Approval.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations .

Diller cont:
The Board questioned the right-of-way and the location around
the recharge basin which appears to- create a fifth lot in the
corner of the property,. It was requested that the. applicant
continue the right-of-way. along the westerly propoerty line
instead of around the' recharge basin. The Board also requested
that the applicant. give further consideration ,to joining with
the right-of-way .of the neighbouring lot, John Simon. Mr. Lessard
stated that he made a field inspection and the problem of
water3 n.-off from. the SimonIroperty to. the Diller property must
be handled since it is killing trees. The Board stated that
they will conduct another field" inspection to see what could
be done regarding the drainage and the right-of-way.

Brewer Yacht Yard located at-'Gre.enport-- The Board reviewed the
two site ,plans pending to make improvements at Brewer Yacht Yard.
On a motion made by Mr. Ward, seconded by Mr. Mullen it was
RESOLVED that the Southold Tow n Plannin gBoard refer the site plan
of . Brewer Yacht Yard for the construction of an addition on an
existing_ building f5r-office_and storage towthe building department
for certification.

The Board reviewed the other site plan for proposed excavation,
bulkheading, relocation of travel lift well, maintenance dredging
and reconfiguration of floating pier assembly projects '-The Board
noted thatthe Department of Environmental Conservation had taken
lead agency and granted ,a negative declaration for this project.
The Board questioned where the spoils would be located and how
the landscaping would be done . The Chairman stated that he
had spoken to Mr. Daniel Nathez who is the agent for this project
today, and Mr. Natchez explained that all the landscaping would
be done to make the spoil area atractive. The Board, however,
requested that theis be indicated on the plan. Mr. Ed Vianney,
general manager of Brewer Yacht Yard, was present. He stated
that he would refer this information to theagent.
On a motion made by Mr. Ward, seconded by Mr. Mullen it was
RESOLVED that .the Southoldtown Planning Board request a larger
scale site plan to indlude all the required site plan elements .

This plan should include grading, drainage, buildings , parking,
pavement, paths , lighting, landscaping, etc. (This is instead
of the current which' indicated -each site -plan element A
on a sepe.rate page. ) The Board also requests another plan
indicating .the site restoration of spoil areas including
grading and landscaping.

When the Board was in receipt of this plan, a referral would
be made to the Building Department, for certification.

at Southold, for 2 lots on 4 .568 acres .

On a motion made by Mr. Mullen, seconded by Mr. Ward it was
RESOLVED that the Southold Town Planning Board grant a 90 day
extension on the action of the final maps of "Cove Beach" at
Ea—s-E Marion pursuant to TITerequest o7 the attorney for the applicant
in order Fat the approvals of the Suffolk County Department of Health
Services and Department of Environmental Conservation can be obtained.

"Cove Beach" Cont.
The Board discussed the 100 ' set-back from the bluff which.-the
Suffolk County Planning Commission was requesting for allthe
lots on the Sound.. The Board noted, after a field inspection,
that several of the lots. do have a bluff, but the remainder
have a gradual . slope. Since the bluff lots had a set-back
of 100 ' from the bluff, the Board recommended that the other
lots have a 100 set-back from the mean high water mark. This
would tie into the proposed set-back already indicated on the
map and place the homes just in the line of the moods . Richard
Ward, boardmember, drew a line on the map reflecting the Board' s
request of .the set-back .from the mean high water mark.
On a :motion made by Mr. Mullen, seconded by Mr. Wall it was
RESOLVED that the Southold Town Planning Board request. a 100'
set-back from the mean high water mark and recommend the set-back
line as drawn on the enclosed copy of the survey for Cove Beach
at East Marion.

The project has been determined not to have a significant
effect . on the environment for2the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
The Department of Environmental Conservation has indicated
that a permit is required from this agency. under Article
25 , Tidal Wetlands Act.
The Department of Health Services has recieved an .application
and it is a complete application, however, the applicant
has proposed the use ofindividual private wells , which
will require a variance under Article 6 of the Sanitary
Code.

On a motion made by Mr. Mullen, seconded by Mr. Wall it was
RESOLVED that the Southold Town Planning Board grant a 90-day
extension from the date of this resolution for the filing of the
final maps pursuant to the request of the attorney for the
major subdivision of Harbor View located at Mattituck. This
request is for the applicant to obtain approvals from the
Department of Environmental Conservation and Department of
Health Services .

Briscoe Smith located at _Fishers Island- The Board reviewed this
proposal which was given relief from the two: acre zoning by the
Town Board. _

RESOLVED that the Southold Town Planning Board grant sketch approval
to the minor subdivision of Briscoe R. Smith located at Fishers
_Island plans dated- September 22 , 1981 and amended May 14 , 1982 ,
November 26 , 1982 and February 14 , 1984 .
Vote of the Board: Ayes: Orlowski, Mullen, Ward, Wall
On a.,-=tion 'raade by Mr. Wall, seconded by Mr. Mullen it was
RESOLVED that the Southold Town Planning Board grant a 90 day
extension from the date of this resolution for the action on the
final mays of Homestead Acres pursuant to the request of the
attorney for the applicant.

William Mullen discussed a talk he had with Dr. Lee Koppleman
regarding the master plan and affordable housing. He was dis- '
turbed - with Mr. Koppleman' s opinions on Southold' s work with
the Master Plan and their efforts for providing housing,
He stated that he will be discussing ideas. for modular housing
with John Meisner, who had prepared a presentation on this
subiect and was, interested in building some in Southold.

On a motion made by Mr. Mullen, seconded by Mr. Wall it was
RESOLVED that the Southold Town Planning Board send correspondence
to Dr. Koppleman stating the work done on affordable housing
and the Master Plan so Dr. Koppleman will know the status of the
Board' s work.
Vote of the Board: Ayes: Orlowski, Mullen, Ward, .Wall
Being no further business to come before the Board, on a motion
made by Mr. Mullen, seconded by .Mr. Wall and carried the
meeting was adjourned at 9 : 07 p.m.
