A regular meeting of the Southold Town Planning Board was held
at 7 :30 p.m. , Monday, May 7 , 1984, at the Town Hall, Main
Road, Southold.
Present were:
Bennett Orlowski,Jr. , Acting-Chairman

On a motion made by Mr. Latham, seconded by Mr. Mullen it was
RESOLVED that Bennett Orlowski, Jr. , act as the Chairman for
this Planning Board meeting due,'-vt:o tlie-°,res" gnat ion of the previous
chairman,- -and -.-Inc& the Tows Board has not made a formal appointment
for a new Planning Board Chairman.

RESOLVED that the Southold Town Planning Board recommend to the

On a motion made by Mr. Mullen, seconded by Mr. Wall it was
RESOLVED that the Southold Town Planning Board dispense with the

reading of the metes and bounds for the minor subdivision of.

Mr. Orlowski: On review of the file, here, we have yet to have
the C & R' s on the large .lots every else seems to be in order,
at this time I. am going to ask if anybody. has any objections
to this minor subdivision.. Hearing none, is there anybody in
favor that would like to say something.
Mr. Rudolph Bruer: Mr. Chairman, I 'm Rudolph Bruer on behalf
of Mrs . San Andress who is present, I believe everything has
been said at all the preliminary meetings , I would just
reiterate everything that has been said before and request that
the Board grant this minor subdivision.
Mr. Orlowski: Okay
Mr. Bruer: Do you have any questions , we will be happy to answer
them.
Mr. Orlowski: Okay, is there. anybody here that has something
neither .pro nor con .but with anything pertaining to this that
we would be interested in hearing. Hearing none, .I will ask
questions of the Board;. Mr. Ward (none) ., Mr. Wall, (none) , Mr.
Latham (none) , Mr. Mullen .(none) ; Mr. Emilita did r,you see
anything. here that. .
Mr. Emilita: Well , only what is on the notes. Only if you want
to discuss the issue of the turnaround.
Mr—Orlowski: Oh, that would be here
Mr. Emilita: Well, actually, it would be here. (inaudible comments)
Mr. Orlowski: Okay, that is a turnaround, we could put that
in the . . . we would be=.asking for no .further. . . you don't plan
any further subdivision on these lots .
Mr. Bruer : We would be glad to covenant them.
Mr. Orlowski: Okay, I didn' t see the covenant in the file.
Mr. Bruer: We will supply it, if it is not .there.
Mr. Orlowski: .you will?
Mr. Bruer: Yes
Mr. Orlowski:. Okay, very good; over here, we will put this 'in writing,
but maybe a large turn-around here for emergency vehicles ,. for interior
lots 3 and 4 . Would that be an objection?
Mr. Biter: Only in that the maps are in final form, and we are only
talking about servicing two lots on a minor subdivision not a major.
Mr. Orlowski: It may come back as- 'a recommendation cf this Board.

Mr. Bruer: I understand' what you are saying:-Mr. Orlowski, but
I think .under the .circumstances at! this point, at the ,public
hearing I think the maps are .pretty much in the final form,
and we request that it remain the same. I understand we are
only talking servicing here and if there was an emergency, I
am sure the emergency vehicles are going to disregard anything
anyway just to get_to. . . just to do what they are supposed to
be doing. And, I could see it if it were to be a. publc. street,
because if the Town was. going to come in there to plow and. do .
things like that . but it looks like it is, going to be a private
road.
Mr. Orlowski: Okay, any questions.
Mr. Emilita: I still think it should have it.
Mr. . Orlowski: Well, the Board will discuss that and I ' ll close
this hearing now with this recommendation. I just wanted(.tto inform
you that.
Mr. Bruer: Okay, thank you very much.

On a motion made ,by Mr. Mullen, seconded .by Mr. Wall. it .was
RESOLVEb that the Southold Town Planning!_! Board dispense with the
reading. of .the metes and bounds for the map of the major subdivision
of Sebastian's Cove located at Mattituck.

Mr. Orlowski; In review of the file, we have here proof of publication,
this is notorized by Clement J. Thompson for the LI Traveler Watchman,
in further review of this file, no bond or inspection fee has- been
paid yet , .
Mr. Lark: Mr. Chairman,, that is not quite true, .the initial application
fee was paid but it was told by the former 'clerk at the time to
wait until the public hearing.
Mr. Orlowski: Okay, they returned it because. . .
Mr. Lark: -Well, this is the one , if you will recall,that we got
fouled up with local law No. 11.
Mr. Orlowski: Right.
Mr. Lark: THe check was never cashed, it. was held in the office,
and I thought it was negotiated, because you had it for a long time.
And then., when. Local Law 1.1 got passed last summer, there was the
confusion, so- they said well just wait until-that-was the word.
Mr. Orlowski: Then it will be forthcoming.
Mr. Lark: Oh, yea, ' there is no .problem. In fact on March 26 , a check

Mr. Lark: was sent $lu5 for the filing fee, you.. should have that
in your file; a new check.
Mr. Orlowski: Right.
Mr. Lark: -Now, a bond, a performance bond has not been set yet,
that has to .be done, unless you have gotten something back from
the Town Board.
Mr. Orlowski: Well, we have a. bond, right here .
Mr. Lark: No, this is the first time I am receiving it.
Mr. Orlowski: Just let me see, to make sure this is it.
Mr. Lark: Right.
Mr. Orlowski: It is , Okay.
Mr. Lark: .No that we did not recieve.
Mr. Orlowski: .Well, ._we will get you a copy just to keep you up
to date. Since you are up here , I guess you are pro so we will
start with anybody here in favor?
Mr. Lark: Well ; I represent the applicant, Richard Lark, Main
Road, Cutchogue, N.Y: I believe the file is in conformance with
everything you. want, I also believe you have in your file the
maps that have by the Suffolk County Health Department so, this
is a map that did have a hearing once before.:on it but. due to
the delay and timing involved it was decided best by the former
chairman to go ahead and have another public hearing on the
final . I think you remember this one, it has been around for
some period of time .
Mr. Orlowski: Right.
Mr. Lark: .BLt , I . think you have everything that .you wanted, you
know- all the road profiles and everything were approved at ta :
previous meeting, and you have all the final application. You
have the , not only the. cloth prints , with the health department
signature, but you also have the covenants and restrictions. which
you said you wanted. You also have a copy of those and if you
do approve this, they will be filed simultaneously with the map;
you know, in the County Center. I do believe you have the application
fee , the bond, no you don' t have that. We, has that been set by
the Town_ Board yet?
Mr. Orlowski: This has not been sent over to the town Board, but
we will also need the '. inspection fee .
Mr. Lark: Right, that is predicated on the map here.
Mr. Orlowski: Right. Would. you like to add anything, you are right
this has been around for a long, long time.
Mr.. Lark: .No, I think we stretched this one quite throughly, over
the last couple of years , so there is really nothing more that I
can add. Except, if any of the board members have any questions .
But I think the file is complete.

Mr. Orlowski: Well, first I ' ll ask if there is anybody else
here in favor? Is there anybody here that has any objection
to this subdivision? Hearing none . Is there anybody here
that has something neither pro nor con but something pertaining
to this subdivision that will give us some input.
Mr. Toumanoff: Mr. Chairman, I am the applicant. And, I only want
to say that the concept behind this subdivision is to create
a residential association which will be responsible_ to the
road and responsible for the park and play ground .areas , so the
families who own the 11 lots involved, if you may remember, 4
of the 11 original lots were approved as a minor subdivision
and will be melted togethor with----.the 7 lots that under consideration
now to form one residential association, which will all jointly
enjoy. the benefits of the land.
Mr. Orlowski: Okay.
Mr. Toumanoff: What I did. say, is incorporated in the covenants
and restrictions governing both the minor.
Mr. Orlowski: Right, we have those . Okay, now would any Board
member have a question. Mr. Mullen? ' (none) .Mr. Ward (.none) , Mr
Wall (none) ; Mr. Latham.
Mr. Latham: We have that letter from the Suffolk County Planning, is
that part of the records?
Mr. Orlowski: Yes . It is in the file. Dave? (none) Okay,Alr.ight
at this time, I will declare the hearing closed and thank you all .
for coming.
Mr. Wickham: Mr. Chairman, if I may ask, as a contractor in this
and part owner, we are under some compulsion to have the highway
completed in a relativily:- short time, for one ,-of lots in the minor
subdivision. In view• of this. fact, al.ot of the highway work will
be completed in a relatively near future, would it pbe possible
to have the bond reduced at that time?
Mr. Orlowski: to reduce to. the bond because you already have it on
the minor? coming into the. . .
Mr. Wickham: No, because we already have completed the large part
if not all of the highway construction.
Mr. Mullen: I would like to answer that, I think I can help.
Mr. Orlowski: Bill is our bond expert, Mr. Mullen.
Mr. Mullen: The only way I can forsee that' is if you have it set up
into two distinct sections, therefore, you would have one bond . for
Section I and another bond for Section II . Under no circumstances
that I foresee, would the bond be reduced until everything is
completed. Unless it is sectionalized.
Mr. Wickham: May we hold this in abeyance and. discuss it later,
perhaps it would be wise to have it seciontalized.
Mr. Orlowski: You would have to submit new maps .

Mr. Toumanoff: I don thinkf,we want to make an issue of this
Mr. Chairman.
Mr. Lark: And besides , that would .have to go to the Town Board, anyway
because they haven' t set the bond, and any reductions would be an
implication to them.
Mr. Orlowski: right.
Mr. Lark: All .you have is recommending power at this stage.
Mr. Orlowski: And the engineer would ,have to submit another report.
Mr. Lark: Right, correct, that is right Mr. Orlowski
Mr. Orlowski: And it could get very confusing.
Mr. Toumanoff : It is not an issue Mr. Chairman. In fact, it is
actually more economical to do the whole road at one time.
Mr. Orlowski: I would say so. Okay.

a .mended the Tans from the approved preliminary plans Mr.
and Mrs . Ihar were present. Mr. Ihar presented a' letter dated
February 1984 , which was in the file, explaining his reasoning
for developing this in Sections . The Chairman indicated that this
could not be done because when the amen.d.ed` maps were presented,
they must be considered under the present zoning. The final
hearing wi.l,l be on the map which received preliminary approval
showing all the lots , not only 'a portion of them. The Chairman
also indicated. that the roads must be imporved to the satisfaction
of the Planning Board y after approval of the subdivision,prior
to any building permits being issued. Mr. Ihar stated that he
had spoken to the Superintendent of Highways and will proceed
according to. the specifications required. The Planning Board
will re-schedule a.'public-hearing on the question of approval
of the final map- for this subdivision .in October pursuant to
the request. of Mr. Ihar that this be scheduled when he returns
to Southold. The Chairman requested that Mr. Ihar. request an
extension in writing for filing the final maps and for holding
a public hearing. Mr. Ihar stated he would submit this request
in writing.

Rodrequiz site plan located at Fishers Island-Mr.Lark, attorney
for Mr. Roderquz has cancelled this appointment for a presubmission
conference for this site plan to construct a home on business
property due to the fact that he will need a use varience
from the Board of Appeals and will obtain that prior to seeking
site plan approval' .
Domalski at Mattituck- The Board will make a field inspection
of the proposed subdivision.
Meskousis at Mattituck-The Board will .make afield inspection
of the proposed set-off.
Wasson at Mattituck-The Board requests that the applicant and/or
his attorney sbhedule an appointment with the Planning Board to
discuss this proposal for a lot-line change.
Litteiri at East Marion-The Board will make a field inspection
of this proposed subdivision. It was noted that this. is adjacent
to. the -subdivision of Cove Beach Associates . ,.
Blue Horizons at Peconic-The Board is` in receipt of 'the covenants
and restrictions as requested which state that there will be
no further subdivision of lot No. 7 in perpituity. These have
not been reviewed by the Town Attorney, however, and prior to
any action of the Planning Board this will have to be done.

RESOLVED that the. Southold Town Planning Board accepts Report
NO. 355 of John W. Davis regarding the final inspection of:
the access road .within the subdivision of Greenbiar Homes .

The Planning Board will get a determination on . their jurisdiction
for requesting compliance with the recommendation for a stop sign

RESOLVED that the Southold Town. Planning Board deny .the
subdivision of John and 'Frances Divello located at Mattituck
due to the insufficient area of the lots

On a motion made. Mr. Latham, seconded by Mr—Ward it was
RESOLVED that whereas, a formal application for the approval of a
subdivision plat entitled "Robert and Jean Lenzner" located at
Matttituck was submitted to the Planning Board on April 19, 1982
and, a filing .fee was paid on January 11, 1983 .
WHEREAS., a public hearing was held on said subdivision application
and plat at the Town Hall, Southold, New York, on March 12 , .1984
8 : 45 p.m. , and
WHEREAS, the requirements of the Subdivision Regulations of -the Town.
of Southold have been met by said .subdivision plat and application,
NOW, therefore, be it RESOLVED that the application of Robert and Jean
Lenzner . for approval of said subdivision plat prepared by A.W. . Young
dated Dec. 1, 1969 and last amended Sept.Q9, 1982 , be approved and the
chairman be authorized to endorse approval on said siabdivis .on plat
subject to the following condi.tions. within six months from. date of
resolution:

1. No lot shall be subdivided or its lot lines changed .in any
manner at any future date unless authorized by the Town of Southold
Planning Board.
2 . No grading shall be permitted within 50 feet of the top edge of tr
bluff except that that may be 'necessary to control or remedy erosion
or to prevent stormwater from flowing over the edge of the bluff. Any
clearing _.and cutting of .vegetation within. this area shall be
limited .to .that. necessary for maintenance.
3 . No residential structure and sanitary disposal facility shall j
be constructed within . 100 feet of the top edge of the bluff.
4 . No stormwater runoff. resulting from the development' and' improvemen
of the subdivision or any of its lots shall be discharged down. the fac
of the bluff in any manner.

5 . Access to the beach shall. only be by means of a suitable structure
designed and constructed in a-manner that will result in the least
disturbance .of the stability of the bluff. Access shall - only be
a common structure to be shared by both owners .
6 . The,right=of-way shall .be constructed and offered for dedication I as a town road. The angiilar. bend in the alignment shall be
replaced with a large radius curve .

7 . The water quality on the subject premises at the time of the
last sampling exceeded the drinking water ,standards established by
the Suffolk County Department of Health Services and treatment may

and restrictions in the office of the County Clerk on .or :prior to
the granting of .approval of this subdivision.

the. .time and place for a public hearing on the question of
approval of the final -maps of the major subdivision of

Samuels stated he had no objection to this but wondered if
the :Town had funds for this purchase, he added: that he would not
donate but would be open to discussing this possibility with the
Town. Mr.. Orlowski stated that presently the Board does not
rU_dk favorably on this subdivision. It was. noted that the Board.
will make another field inspection in order .to familirize. the
new Board member and Town Planner with the subdivision.

�Mr. John Kowalski was present for a. uresubmission conference
to discuss his ,si-te plan for a proposed fish market and
office building located at 5outjjold. He explained that there
would be two (2) seperate buildings and the office building
woucld. be constructed at a later date, after the fish market.
He further explained that the fish market would be a retail '°
operation, and the occupants of the office will be determined
at. a later .date.. The Board stated that they will make a
field inspection of this site plan prior , totaking any .action
on this proposal,
Mr. Douglas Castoldi was present fora presubmission conference
to discuss the amended site plan of 'the Beachwood Cafe for
t P nQnstrugtiog of an additjon on this restaurant. . The Chairman
explained that due to the fact .that this application was mislaid
during the. transfer of secretaries in the Planning Board office
that this had been sent tothe Building Department for certification
prior to. -this meeting. There was correspondence in the file that
this site plan amendment was certified by the Building Department.

RESOLVED.- that the Southold Town- Planning Board. forward the
preliminary maps for the major subdivision known .as ".Laurel
Estates" located at Laure.l �to the necessary state, county-,
..and Town agencies .for their review prior to the public hearing.

of approval of the,. pre-lminary map for the major subdivision_
,known as Laurel Estates located at Laurel.

It was noted that the lot No " 16 within the Laurel Estates
subdivision would not be subdivided into more than four lots
in perpuity with covenants and° restrictions, .and the open
space area would :be farmland . possibly offered to the Farmland.

On a motion made by Mr. Mullen, seconded by Mr. Ward it was
RESOLVED that theS'outhold Town Planning Board refer the
bond estimate for the water main extension within the subdivision
—f Tenn -Marcus., lnC&Lea af Crppnp6rt to the Town Roam for
their approval of the bond amount.
Vote of the Board: Ayes : Orlowski,Mullen., Latham, Wall, Ward
Dawson- cluster located at Southold. Mr. Cron, esq. was present
to request sketch approval for this cluster which was approved
by the Town Board for development in the cluster concept.
On a motion made by Mr. Mullen, seconded by Mr. Wall it was
RESOLVED that the Southold Town Planning Board approve the
sketch map for the major subdivision of James W. Dawson, in
the cluster concept , located at- Southold, dated September
.19, 1983 and amended January 26 , 1984 .
Vote of the Board: Ayes : Orlowski,Mullen, Latham, Wall , Ward
Wells-set-off located at Southold. The Board reveiwed the
amended map reflecting their recommendation that the road
width of the adjacent parcel to the North contain 175 ' so
if. it were subdivided in the furture that lot would not need
a variance for insufficient width. This required that the
set-off piece be moved southerly.
On a motion made by Mr. Latham,:-seconded by Mr. Mullen it was.
RESOLVED that the Southold Town Planning Board approve the .
set-off of . George Wells located at Southold dated .January 27 , 1984
And amended April 9, 1984 under Section 106-13 of the Southold
Town Code.
Vote of the Board: Ayes: Orlowski,Mullen, Latham,, Wall, Ward
DiMaaQio-minor subdivision located at Southold. Mrs . DiMaggio
was present to discuss this proposal with the Board, she explained
that the -property was zoned budIness and the existing house is
pre-existing, non-conforming. The Board explained that by
subdividing this property, it would have to. be made conforming,
the Board also noted that the area is insufficient for business
zoned property. Mrs . DiMaggio stated that she would like to
withdraw this application and the Board requested that this be
done in writing. She stated that it would be done in- writing.

Simi'chick-minor subdivision located at M'attituck'_. Mr. Charles
Cuddy, esq .was present to discuss this application. with the.
Board. which is a subdivision' of lots in a previously approved
minor. The Board noted that when this application was submitted
as a minor and approved, the applicant stated there. would be
no further subdivision, and now a new application has been made
to 'subdivide lot No. 2 into two Parcels. The Board stated
that this intent to further subdivide should have been indicated
at the previous submission. . This proposal will now have to
have Zoning Board ofAppeals . approval due to the insufficient
area of the lots ; each would. have less than the two-acre
requirement. . The Board will make a field inspection with the
new member and re-schedule this for ,-the May 21, 1984 meeting.'
Blower=minor subdivision located at Southold. Mr. Robert Gillispie,
III was present to discuss this subdivision..with the Board._ The
Board noted that they have made a field isnpection of the area,
and find the proposed access road is located in an area .of the
land where the contours are too varied to accommodate a right-of-
way. They .stated that the right-of-way to 'the east is possibly
better, or the right-of-way could also be constructed to the west.
It was suggested that since one house could be build on the land
as it exists , that this be done- and then the subdivision could
.be made later, so the right-of-way could be constructed to serve
the house and vacant lot, in the best way.
Rosenstone-minor subdivision located at .CuteYoguo. The Board
stated that they may request ,covenants and restrictions as to
no further subdivision in perpuity due to the large size of .the
lots . The Board also. noted that there may be another subdivision
in the area adjacent this proposal and they will research this ,
since it is ' possible that a road may by needed to serve both
subdivisions . It was requested that new surveys be submitted to
include key maps. This will be placed on the next agenda, following
the submission of a key map.

Stephenson Beach located at EastMar'ion-Orient. Mr. Robert Gillispe,
III was present to .discuss the minor subdivision. He stated
that this subdivision: was_ proposed in .,order to donate lot No. 2
to the East Marion-Orient Park Distri&t. The Board noted that
Suffolk County Department of Health Services approval was needed
prior to approval of this subdivision if ' lot No.. l and Lot No. .
3 were to be building lots . The Board discussed the idea of
the Town buying a parcel of. this subdivision which abuts the
Lond Island Sound. Mr. Robert Gil1ispie. stated that this
would -be up .to .the stockholders, but, would rather donate
it to the park district. The. Board. .requested a certificate
of disclosure listing all the principals of the corporation.
Mr. Gillispie stated that they were anxious for approval of
this subdivision. and were willing to place covenants of
the lots that Nos . 1 and 3 would not be buildable unless
Department' of Health Services grants approval . for the water.
The Board will- review this proposal again prior to action.
On a motion made by Mr. Mr. Mullen, seccnded _by Mr. .Wa.11 it was

of Jean C. Holland due to "the insufficient area of thb,-- lots. which

Miller-minor subdivision located at Laurel : Mr. George O. Gu.ldi,
esq. was present to .discuss the proposal with the Board. Mr. Guldi
stated that this proposal is 'presently before the Zoning Board of
Appeals for approval of the 'access road. The Board questioned
the s�t-back requirement from LILCO for the high .voltage wire
running across the property. The Board also questioned the
wetlands area and requested that this area be deleted from the
buildable base of the subdivision. The Board stated that this
wetland area cannot be included in the computations for
determining area. Mr. Guldi presented a letter to the Board
stating his opinion as to why the wetlands don't have to be
excluded from the buildable area. The Chairman read from the
Code of the Town of Southold, Sectionl06-36C where it states
that the land subject to flooding or land deemd by the Planning
Board to be uninhabitable shall not be platterl for residential
occupancy. The Chairman further stated that this provision
in the ordinance means that only the upland can be considered
part of the building lot. Mr. Guldi stated that this was
Mr. Tasker' s opinion, but that it is not clearly stated in
the code under subdivisions only in the cluster section and
his proposal is not a cluster. The Board will get another
opinion from the Town Attorney, Mr. Tasker, regarding this
prior to any action. The Board noted that with the deletion
of the wetlands , the subdivision would three undersized lots ;
however, if the proposal contained two lots, there would
be enough area.

discussion regarding the roads in-'the approved subdivision. It
was the- consensus of.. the Board that Inspector John W. Davis
inspect the roads. and`. submit a report to the "Planning "Board as
to the progress withthe construction.
