The meet- ing was called to order at 1 :30 P..M. with the following present : Supervisor Horton; Justices Terry, Hawkins and Klipp ; Town Supt. of Highways Price, Town attorney Terry and Town Clerk Booth. The minutes of the previous meeting were read and duly approved i� as read. Moved by Justice Hawkins , seconded by Justice Terry; RESOLVED: That Monroe L. Biggs of Greenport be and hereby is ap- pointed Special Constable while employed on the- property of Char- les Sage to serve without pay and at the pleasure of the Town Board. Unanimously adopted. •> Moved by Justice Terry, seconded by Justice Hawkins; RESOLVED: That Lyle F. Tuthill. of Orient be and he is hereby ap- pointed as Trustee of the Town of Southold to fill out the unexpir- ed term of the late Frederick Taber, 'said Lyle F. Tuthill to as- sume the duties of said office as of this day. Unanimously adopted. -. Moved by Justice Klipp, seconded by Justice Hawkins ; RESOLVED: That the resolution on the East-Nest Greenport Fire Protection District which was duly adopted by this Board at a regular Town Board Meeting which was held on May 17 , 1946, be rescinded. Unanimously adopted. ' r Moved by Justice Klipp , seconded by Justice Hawkins ; AREAS, There has been duly established in this Town a fire pro tection District, known as "East-Vest Greenport- Fire Protection Dis- trict, Town of Southold, N.Y." embracing territory in said Town Adjacent to the Village of Greenport , New York, as such territory is more fully described in the resolution establishing such district and duly adopted by this Board on the 14th day of November, 1945 and AREAS, it was proposed that contracts be entered into with the Village of Greenport for the furnishing of fire protection to such district , and for the furnishing of water for fire protection.pur- { poses through the said district, and T=REAS, due notice has been given of, a public hearing to be `JJ held at this Village on the 2nd day of April, 1946, at 8o fclocT r P.M. to consider such a contract, the notice duly specifying the time and place of the hearing, as aforesaid, and giving in general terms the proposed contracts , and all persons interest and appearing having been heard, it is hereby RESOLVED, that this Town Board enter into agreements with said --� Village of Greenport for the furnishing of fire protection and of _y water for fire protection purposes , in such district , in substan- tially the following form.; and that these contracts! be executed on behalf of- this Board by the Supervisor of the Town of Southold:- This Agreement, made this first day of July, 1946, between the Town Board of the Town of Southold, Suffolk County, New York, _ -_— hereinafter designated as Town, and the Village of Greenport, Suf- folk C'ounty,. New Yark, hereinafter designated as. the Village' WITNESSETH, WHEREAS, there has been duly established in the ` Sddd Town a fire protection district known as "East-?Nest Greenport > � Fire Protection District, Town, of Southold, N.Y.", hereinafter designated as the District , embracing territory in said Town adjacent to the said Village as such territory is more fully described in the resolution establishing such District and- duly adopted by the Town Board of the Town on the 14th day of November, 1945, and �MEREAS, following a public hearing duly called of the said Board duly authorizing a c-ontract with the Village for fire pro- tection tothe District upon the terms and provisions herein set forth, and 46 WHEREAS , this contract has also been duly authorized b the Board of Trustees and the Mayor of the Village , NOW, THEREFORE, the Town does engage the Village tofurnish such pr ogee t i on. in the manner following, to wit:- 1. The fire department of the Village shall at all times during the period of this Agreement be subject to- call for at- tendance upon any fire occuring in said District , and when notified ' by alarm or telephone call from any person within a distance of the , fire within the District , such department shall respond and attend upon the fire without delay with one or more companies , and with suitable ladder, pumping and hose apparatus of the Village, as Fol- lows :- t 2 750 gal. pumpers 1 550 gal.. pumper with 300 gal. water --- 1 500 gal. pumper with 150 gal. water 1 hook and ladder 1 flood light 1 salvage wagon .Upon arriving at the scene of the fire the firemen of the Village - attending sh,.all proceed diligently and in every way reasonably suggested to the extinguishment of the fire and the saving of life and property in connection therewith: -- It is understood and agreed by the parties hereto that the furni- shing of the apparatus of the Village Fire Department and the re- � sponse by the firemen shall be dub jest to the order of the Chief of r the Fire Department cif the Village, or his subordinates in authority., _ who, in their discretion in the event of any emergency,, as, for exanTle, ano the r fire at the same time in the said District or in --_ the Village, may designate such men and apparatus to any particular fine as they may deem necessary. Furthermore, the said Chief, or his subordinates in authority, shall have absolute discretion as �- to the sending in of additional alarms and calling in response to a fire the -departments of other districts. 20 In consideration of the furnishing aid and the use of the apparatus as aforesaid, the Village shall receive the sum of Thirty-six Hundred $3600) Dollars per year during the perioff of this Agreement. { 3. All monies to be paid under this Agreement shall. be a charge up.6nr the said District , to be assessed and levied upon the taxable property in said District and collected with the Town Taxes , and shall be payable as follows : $5,400, on the first day of Feb- ruary, 1947; $4,600.. on the first day of February, 1948; $3,6006 on the first day of February, 1949 ; $3,600. on the first day of Feb- ruary, 1950; and $1,800. on the first day of February,, 1951. ^ �a TT_ 4e_ This Agreement shall continue for a period of five (5 years from. the date hereof. Philli s _ Village Clerk This Agreement, made this first day of July, 1946, between the Tolnn Board of -the Town of Southold, Suffolk County, New Y. rk, hereinafter designated as the Town, and' the Village of Greenport, Suffolk County, New York, hereinafter designated as the: Villgge, AJ WITNESSETH, WHEREAS there has been duly established in the said Town a fire protection district known as "East-Test Greenport Fire Protection District, To•,:,,n of Southold, N.Y." hereinafter de-signat-ed as the District, embracing territory in said Town adjacent to the said Village as such territory is more fully described in the 47 r resolution establishing such District and duly adopted by the Town . Board of the Town on the 14th day of November, 1945, and l]HEREAS, following a. public hearing duly called of the said >, Board duly authorizing a contract with the Village for the furnish- ing of water for fire protection purposes through the said District, upon the terms and provisions herein set forth, and + ,.MREAS , this contract has also been duly authorized by the Board of Trustees and the Mayor of the Villge, NOW, THEREFORE, in consideration of the amount to be paid and of `the mutual covenants and agreements as Hereinafter set forth, the parties hereto agree as follows :® 1. The Village agrees, throughout that portion of the District- _„ where its water mains are now installed, to install hydrants for fire protection purposes, to the end that maximum protection 'for fire insurance purposes is afforded to property adjacent to the said mains. J 2. The Village agrees, from time to time, as conditions warrant, to extend its mains throughout the public roads of the District, and to install hydrants therein at the rate of not less than ten '.(10 ) hydrants per mile. " 3. In the event that to afford a maximum of protection for fire protection purposes the installation of hydrants at 'a rate of exceed- ing ten hydrants per mile is indicated in any portion of the district, the parties will agree upon :the location of such hydrants, and, should they be unable to agree as between themselves as to the proper location of such hydrants , such hydrants will be installed in accordance with the recommendations made by .the engineers or other representatiiaes of the Board of Suburban Insurance Underwriters or other appropriate Board having authority to fix rates and establish rules for fire insurance purposes: ,. 4. In consideration for the installation of 'the hydrants and the furnishing of water for fire protection purposes , the Town shall pay to the Village the sum of Forty ( 40) 'Dollars per hydrant pe"r year -- for a term of five (5) years: The Village undertakes to furnish acid maintain sufficient water pressure to meet the requirements of Board ti-+ of Suburban Insurance Underwriters , or such other Board as has auth- ority to establish specifications as to required pressure, for war- ranting reduced fire insurance premiums , and the payments indicated above shall be paid for those hydrants which meet such specifications 1- r and requirements. ` The liability of the 'Town for such payments shall commence when , T notice to the effect that such hydrants have been installed and ap- proved has been given to the Town Clerk or Town Supervisor by the Village. All payments due to the Village by the Town pursuant to -� - this agreement shall be made on the first day of February of every year during the term of this agreement, at which time the Town shall pay to the Village the amounts owing to and including the thirty- first day of December of the preceeding year. In the event that this contract is not renewed at the expiration thereof, the Town lhall pay to the Village such amount as may be due at the termination of -- this agreement within sitty (60 ) days after such expiration. 5. All moneys to be paid under this agreement shall be a charge upon the district to be assessed and levied upon the taxable property therein and collected with the town taxes. 6. This agreement shall continue for a period of five (5) years from the date hereof. Superintendent of Highwasy did on the 4th day {_ of June , 1946, duly recommend the purchase of certain machinery pursuant to the provisions of Section 142 of the Highway Law, and a notice of such recommendation Yr s been duly published 'as provided in such action, Now Therefore Be It Resolved : That pursuant to section 142 of the Highway Law the Town Superintendent of Highwayy is hereby authorized to purchase from the Four Wheel Drive Truck Co'. with the approval of the County Superintendent of Highways : One four . wheel truck Model S.U.`:p Ton capacity for a total price of $8,173. delivered at Peco.nic N:Y. on about July 1, 1946. BE IT FURTHER RESOLVED: That the Town Superintendent of Highways be authorized to purchase from Long Island Produce & Fertilizer Co. with the approval of the County Superintendent of Highwa one Model A Farwall Tractor for a total price of Q'860. to be del- ` ? ivered at Pec onic on or about July 1, 1946. • Unanimously adopted. Moved by Justice Terry, seconded by Justice Hawkins, on roll call unanimously adopted; WHEREAS : Sterling Gemetery Inc, has petitioned the Southold Town Board for permission to acquire additional lands for cemetery f._purposes; THEREFORE THEREFORE BE IT RESOLVED: That permission be grantedi to sterl- ing Cemetery Inc . to acquire for cemetery purposes the land specifi- ed in said petition as follows : Beginning at the northeasterly cornor of land of said Sterling Cemetery .Inc . , on the southerly line of North Road and running thence along said southerly line of North Road. , N.66o It 2011 E. fifty (50) feet; thence on a line at right angles to said ,.. southerly line of North Road, S. 23o58t40Tf E. five hundred thiry- five and sixty hundredths (535.60 ) feet to other land of said Sterl- ing Cemetery Inc ; thence along said other land of 'Sterling Cemetery Inc. three courses , asfollows : 1.
