SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been . referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and ithe February 25, 2008 Suffolk County Department of Planning reply states; that,. the, application is considered by the" County as a matter for local . determination, as there appears to be no significant county-wide or inter-community impact. PROPERTY FACTS/DESCRIPTION: The applicants' property contains 8,004 square,feet,.'with 7,411 square feet,.between the front line adjacent to the street and the existing bulkhead, with 50 feet along the front line, 50.02 feet along,a tie line of the short .of, the Long Island Sound, as shown on the August 22, 2007 survey, amended January 9, 2008 by John T. Metzger, Land Surveyor. BASIS OF APPLICATION: Request for Variances under Sections 280-116 and 280- 124, based on the Building Inspector's February 5, 2008 amended Notice of Disapproval concerning a new single-family dwelling (after demolition 'of the existing dwelling) for the reasons that the new construction will be: (a) less than 25 feet on a single side yard, and (b) less than 25 feet for total side yard setbacks, and (c) less than the code-required 100 feet from the bank or bluff landward of the shore or beach of the Long Island'Sound. LWRP: TOWN CODE CHAPTER 268 DETERMINATION: After review, a reply was issued by the Town's LWRP Coordinator in a letter dated February 21, -2008 with a;recommendation that the proposed construction be deemed consistent under Policy.4.1, 5 and 6.3, with a requirement for a minimum 20 foot non-turf buffer between the' bulkhead and the proposed. new residential structure. Graseck CTM 5-8-2-i agrees and accepts this recommendation for the reasons given and relying on the mitigating factors offered into the hearing record by the owner with his architect's testimony: 1. The proposed two-story home will be a minimum of 36 feet from the existing bulkhead; 2. Elevated decks on the water side are approximately 10' in width which places the home itself on the first and second story at a minimum of 46 feet from the bulkhead; 3. Total lot area is 8,004 square feet (metes and bounds description) which is comparable to the existing lots in the immediate area; 4. All roof runoff will be diverted to dry wells placed on the landward side of the home (a/k/a street front yard of the parcel); 5. Indigenous planting to be utilized in and around seaward side of the proposed renovated home; 6. The new construction utilizes a height at 32.6 feet to the top of the ridge, which will be conforming. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 27, 2008, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants request relief concerning a proposed 24% lot coverage and side setbacks related to construction of a new single-family dwelling, after demolition of the existing nonconforming dwelling on a nonconforming lot. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law §267-b(3)(b)(3)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because: a. Even though the home will be significantly altered from a single-story cottage to a two-story dwelling, several of the existing homes in the area are being brought up to year-round dwellings; b. All water runoff will be placed into drywells on the landward side of the parcel; Page 3—April 10, 2008 ZBA#6135—C. and E. Graseck CTM -5 s 8-Z-/ c. Actual placement of the proposed new two-story dwelling will be set back at a greater from the bulkhead than the existing one-story home, after removal of ground-level decks that have existed over the years. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicants cannot be achieved by some other process for the applicant to pursue, other than an area variance because the lot is less than one-quarter of the land that would be required to conform to present day zoning and there is no other alternative to a variance process. 3. Town Law §267-b(3)(b)(3). The variance granted herein is not substantial. The house will be more conforming to the code, and the applicant has considered the side yard setbacks and bulkhead setbacks determined of the code based on legal size of this lot. 4. Town Law §267-b(3)(b)(5). The difficulty was not self-created. 5. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicants confirmed that they have obtained applicable agency approvals under the wetlands and other environmental agencies. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new single-family dwelling after removal of the existing home, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all 'of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Chairman Goehringer, seconded by Member Weisman, and duly carried, to Grant the variances as applied for, and as shown on the survey revised April 3, 2008 by John T. Metzger, Land Surveyor, 11-14-2007 "A-Site" diagram, 04-04-08 Elevation Drawing A-3, 01-07-08 Drawings A-1 and A-2, subject to the following Conditions: 1. A gutter and downspout drainage system diverting roof water runoff into drywell(s) shall be installed, with the drywell(s) placed on the landward side, shown southerly of the rear line, of home, and 2. This decision is based upon all conditions imposed by all Boards and Agencies of the Town of Southold, to include and not be limited to conditions placed in the recommendations of the LWRP Coordinator and the Southold Board of Town Trustees. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. SCTM#58-2-12 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program(LWRP)Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the denoted following Policy Standards and therefore is CONSISTENT with the LWRP. Policy Standards 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested: A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 1. Avoid development other than water-dependent uses in coastal hazard areas. Locate new development which is not water-dependent as far away from coastal hazard areas as practical. b. Avoid hazards by siting structures to maximize the distance from Coastal Erosion Hazard Areas. The proposal includes relocating the new residential structure 10 feet landward from the existing location. Due to the parcel configuration, size, setbacks and separation distances for sanitary systems, there is little to no ability to site the structure (as proposed) further away from the Coastal Erosion Hazard Area. 3. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for: a. structures which functionally require a location on the coast or in coastal waters. b. water-dependent uses which cannot avoid exposure to hazards. C. sites in areas with extensive public investment, public infrastructure, or major public facilities. C. sites where relocation of an existing structure is not practical. For,reasons discussed above, the relocation of the structure is not practical and therefore the proposed action furthers the above sub- policies to the greatest extent practical. In the event that the action is approved,the following best management practice(BMP)is recommended: 1. Require a minimum 20 foot non-turf buffer between the bulkhead and the proposed new residential structure. The BMP will further Policies 5, Protect and improve water quality in the Town of Southold and 6.3 Protect and restore tidal and freshwater wetlands,item D (below). D. Provide adequate buffers between wetlands and adjacent or nearby uses and activities in order to ensure protection of the wetland's character, quality, values, and functions. No. 6135 (Graseck) Dear Mr. Goehringer: We have completed a site inspection of the above parcel as you have requested. The Suffolk County Soil Survey has this parcel mapped as Be (Beaches) and Du(Dunes). Both soils consist of sands and gravel. Permeability of this soil is rapid. At the present time the lot is very well vegetated with beach grasses and shrubs. Most of the property slopes away from the Sound and toward the existing house and road. The house does not have gutters, downspouts or drywells and roof surface water runoff exits onto the soil surface. Bulkheading is in good condition and the decking appears to be in fair to good condition. High tide reaches the base of the existing Bulkhead. Recommendations include: (1)Use non turf plantings such as Native Grasses and Shrubs that are salt and drought tolerant. (2)Require gutters and downspouts draining into drywells. In this case it would be better to have the roof water runoff flow into stormwater chambers, such as; StormTech,Landsaver, Contech, Cultech, Infiltrator chambers or onto,the ground surface in order to allow more filtration time for the water to percolate. Drywells here will limit the amount of soil that the roof water runoff will filter through. If you have any further questions regarding this site inspection,please feel free to contact us again. We feel we have a strong interest in the--decisions being made, but-due to a vacation planned to Italy starting 3/25/08 to 4/4/08,we can not attend. We are requesting an adjournment to a date which will enable us to attend. If this is not possible,,-we wish to go on record as to our concerns. The size and placement of the proposed structure will most certainly affect both the P P P Y market value and the aesthetic value of our home. There is a very definite correlation between beauty and value,and a water view is most desirable when one selects a spot to live. We fear this will all be adversely changed by the proposed project with its requested variances. The obscuring of the view of L.I. Sound was not what we envisioned when we purchased our home in 1996. We spent a considerable amount of money in improving our home, and every improvement was made in strict compliance with the Town Codes. The Building Inspectors did a very professional job, and were quite pleased with the entire project. If you inspect our front deck, it appears to be the result of clever design planning with a "nautical flair". In fact it was the result of careful planning in order to comply with the code prohibiting building closer than 35 ft. from the street. The Town officials charged with enforcing codes can make or break a community. Kenny's Beach was a summer bungalow enclave with many beach front lots measuring 50 ft. across. This was not a scheme which was meant to accommodate larger beachfront homes which could block out the beauty of Long Island Sound from all but the few who have the privilege of living on its banks. If this sort of building persists,we will end up with a 35ft.high wall reaching from McCabes Beach to the County Park Land. This would be just awful for those of us not situated on_the water_. We appreciate the Graseck's desire for a larger home to accommodate a growing family, but we trust the Town will weigh their desires to improve against the interest of their neighbors who will most definitely be harmed if the prevailing rules are disregarded.
