The Southold Town Planning Board held a regular meeting
on September 16, 1985 at the Southold Town Hall, Main
Road, Southold, at 7: 30 p.m.
Present were:
Chairman Bennett Orlowski, Jr.
Member William F. Mullen, Jr.
Member G.Ritchie Latham, Jr.
Member Richard Ward
Member Kenneth Edwards

Executive Administrator Victor Lessard
7: 30 p.m. Mr. Harold Reese and Mr. Edward Lincur, representing
Mrs. Robertson of Brown' s Hills were present to discuss Mr.
Reese' s subdivision of Hillcrest located at Orient. Mrs. Robertson
had requested an appointment before the Board, however, was out
of Town. Mr. Lincur and Mrs. Robertson were residents of
Brown' s Hills, a development which bordered Hillcrest. The
residents of Brown' s Hills were concerned because a road
in the Hillcrest subdivision was to connect to a road in
Brown' s Hills and those roads were all private, and they
requested that this road be eliminated. Planning Board
member G. Ritchie Latham made a field inspection of the
premises. Mr. Latham suggested that the road, Soundview
Drive, be . shortened up to the East. The Town' s Inspector,
Mr. John W. Davis stated that he had no objection to the
elimination of the road, provided that some of the drainage
structures be retained and relocated. Mr. Latham stated
that he had spoken to Mr. Ray Dean, Highway .Superintendent
and Mr. Jacobs, the Deputy Superintendent, as well as,
Mr. Davis, and .they agreed that the whole road could
be eliminated. Mr. Reese stated that he would comply
with whatever the Board requested and Mr. Lincur stated
that he would rather see the road eliminated entirely.
TheChairman stated that he would like something in writing
from Mr. Dean. regarding this situation. Mr. Latham suggested
that the road be left as a paper road for the Town to utilize
for future connection. Mr. Ward questioned if there would
be any access from Soundview Drive to Brown' s Hills Road.
Mr. Reese stated that the residents of Brown' s Hills feel
very strongly about having no access as all onto their road.
Mr: Mullen stated that he wouldrather see the road left as
a paper road in case it is ever . needed. Mr. Lincur stated
that the residents did not want to see a road connect at all

since it would destroy their privacy. It was explained that
the road would not be improved, only indicated on paper, and
it would be built, only if needed, some years down the road.
Mr. Reese stated that he would have his attorney supply
the Board with a letter stating that the westerly spur
of Soundview Drive will be privided as a paper road, reserved
for future dedication to the Town of Southold. Mr. Lincur
also questioned the berm around the recharge basin. Mr
Lincur stated that .the residents were concerned about the berm
on the east of the property and the possiblity of snow
drifting across the road. The Chairman noted that Mr.
John W. Davis had submitted a report regarding this, and
the Board would forward it to Mr. Reese for his review.
Mr. Davis recommended that the berm be moved back from Brown' s
Hills Road five feet. He also recommended that the bottom
elevation of the recharge basin be lowered to compensate for
the loss in capacity.
Mr. Ron Morizzo has scheduled a presubmission conference
to discuss the site pan for Ed Pressler, for a retail
store and apartment in an existing building, located
at Main Road, Southold. Mr. Morizzo was not present
for this appointment . The Board noted that the site
plans are not complete and requested that they be revised
to indicate all the site plan elements.
On a motion made by Mr. Edwards, seconded by Mr. Latham, it was
RESOVLED that the Southold Town Planning Board set October
7, 19B5 at ' 7: 30 p.m. at the Southold Town Hall, Main
Road as the time and place for the next regular meeting
of the. Planning Board.

On a motion made by Mr. Mullen, seconded by Mr. Ward, it was
RESOLVED that the Southold Town Planning Board accept and
request compliance with _Mr. Davis ' report No 464 regarding
improvements required on the access road within the sub
division of the Bullock Property located at Westphalia
Avenue, Mattituck.

RESOLVED that the Southold Town Planning Board accept and
request compliance with Inspector Davis ' report NO. 470
regarding the required improvements within the subdivision
of John and Catherine Simicich, located at Mattituck.

RESOLVED that the Southold Town Planning Board accept and
request compliance with Inspector John W. Davis ' report NO.

of way for the minor subdivision of Howard Rosenstone.

subdivsiion access road for "Cove Beach Estates" , located
at East Marion.

extension on the action of the site plan for"The Cove"

following action was taken:
NEGATIVE DECLARATION
Pursuant to ARticle 8 of the Environmental ConservationLaw
State Environmental Quality Review Act and 6NYCRR Part 617, Section
617 . 10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that Southold Town Planning Board as lead agency
for the action described below has determined that the project
will not have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Antone Grigonis, located at Southold,
is for the cration ot a two acre lot from 13. 132 acres, Tax map
No. 1000-55-2-8. 1.
The project has been determined not to have a significant
effect on' the environment for the following reasons:
An environmental assessment has been submitted wchic
indicated that no significant adverse effects to the
environment were likely to occur should the project be
implemented as planned.
The Department of Environmental Conservation has not
sent correspondence within the alotted time, therefore,
it is assumed that there are no objections or concerns from
that agency.
The Departmlent of Health SErvices has no objection to our
designation of lead agency. There is no record of an application
to this department. The proposed ;roject appears to conform
to ARticle 6 , in regard to lot size. An applicationf or
approval of the land division by the Health Departmlent is
required. Test hole and test well data will be required.
Since the parcel is within an agircultural. area, the water
quality may be impacted by fertilizers, pesticides and/or
herbicides.
This project will meet al lthe requirements of the Code of
the Town of Southold Subdivision of Land Regulations.

It was noted that this application would need 280-a approval
on the access from the Board of Appeals since the right-of-
way was not within the metes and bounds of the subdivision.
The Board noted that since this application is a set-off,
they hold action until they have met- with the Town Attorney.
The County Health Department did not recognize set-off
applications, and since the Town did not require Article
6, Health Department Approval, prior to final approval,
applicants were being denied approvals to build. The Board
recognized this problem and would set up a joint meeting
with a representative from the Health Department and the
Town Attorney. The Chairman explained that the Town
did not require Health Department approval prior to
final approval for set-offs since this procedure was
introduced to expedite the subdivision process.

RESOLVED that the Southold Town Planning Board declare them
selves lead agency for the subdivision ofJohn Sepenoski,
located at Southold under the State Environmental Quality
Reivew Act. An initial determination on nonsignificance
has been made.

On a motion made by Mr. Latham, seconded by Mr. Ward, the following
action was taken:

The minor subdivision of John Sepenoski is for a set-off
of 85 , 124 sq. ft. from 3. 9 acres at County Route 48, Southold.
Tax Map No. 1000-69-4-9.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which indicated
that no significant adverse effects to the environment were
likely to occur should the project be implemented as
planned.

of Environmental Conservation in the alotted time, it is
assumed that there are no comments nor objections from
that agency.
The Suffolk County Health Department has noobjection to
our designation of lead agency status. There is no
record of an application to the .department. The project
appears to conform to Article 6 in regard to lot size. 'A
realty development application to the Health Department
is required. Test hold and test well datea is .also required.
The .project will meet all the requirements of the Code of
the ,Town of Southold Subdivision of Land Regulations.

Action on the proposal for John Sepenoski will beheld
over until a meeting with the Health Department and the
Town Attorney is held regarding the Health Department
approval on set-offs. (see Grigonis)
On a motion made by Mr. Latham, seconded by Mr. Mullen, it was
RESOLVED that the Southold Town Planning Board approve the
sketch map for the major subdivision of Deborah Edson, located
at Cutchogue, for 6 lots on 12. 553 acres, survey dated as last
amended July 18, 1985.

The Board also requested that the applicant obtain correspondence
from the Long Island Lighting Company indicating that they will
make the installations necessary to service the subdivisionfor
Deborah Edson, pursuant to Section .106-25A of the Town Code.
Salvatore DiCiara - The Board will hold action on the set-off
of 2 acres from 31. 989 acres until a meeting with the Town
Attorney and the Health Department is held regarding the
Health Department approval pursuant to article 6.
On a motion made by Mr. Mullen, seconded by Mr. Ward, it was
RESOLVED that the Southold Town Planning Board declare themselves
lead agency for the subdivision of S-�vator Di:Ciara located at
Peconic under the State Environmental Quality Review Act. An
initial determination of non significance has been made.

Isadore Krupski - The Board will hold action on the set-off
of 2 acres from 9. 467 acres until a meeting with the
Town Attorney and the Health Department is held regarding
requiring Health Department approval on set-offs pursuant
to Article 6.
On a motion made by Mr. Latham, seconded by Mr. Ward, it was
RESOLVED that the Southold Town Planning Board declare
themselves lead agnecy for the subdivision of Isadore P. Krupski,
located at Cutchogue, under the State Environmental Quality
Review Act. An initial determination of non-significance
has been made.

Because there has been no correspondence from the Department
of Environmental Conservation in the alotted time, it
is assumed that there are no comments nor objections from
that agency.
The Suffolk County Department of Health SErvices has
no objection to ourdesignation of lead agency status.
There is no record of an application to their department.
It appears that the project conforms to ARticle 6 in
regard to lot size. An application to Health Department
is required for approval of the divisionof land under
Article 6. Test hole data and test well data will be
required. Please note that the parcel is within 1000 '
of a sanitary landfill and may influence water quality.

The Sufolk County Department of Health Services has received

an application. They have no objection to our designation
of lead agency. Although the development conforms to
Article 6 in regard to lot size, the apllication was rejected,
March 1, 1985 for insufficient water supply. The application
whent before the Health Department Board of Review on April
26, 1985 for a varaince from standards. The case is pending
a new test well data. Lot shapes appear different than previous
submission and this should be corrected.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Lane Regulations.

On a motion made by Mr. Latham, seconded by Mr. Mullen, it .was
RESOLVED that the Southold Town Planning Board approve the

last amended June 7, 1985 , as approved by the Board of Appeals .

Kay Facatselis (Pappas) - The Board reivewed this application
for a lot-line change on lots within the subdivision of Captain
Kidd Estates located at Inlet Drive, Mattituck. It was noted
that the lot-line change was applied for. to eliminate a garage
encroachment. The lots to the North were merged according
to the deed and copy of correspondence in the file from the
owner.
On a motion made by Mr. Ward, seconded by Mr.Latham, it was
RESOLVED that the Southold Town Planning Board approve the
lot-line change for Kay Facatselis located at Mattituck.
Survey dated as last revised July 30 , 1985, subject to
the conveyance of 2, 746 squre feet from the land of Pappas
tothe land of Facatselis.

On a motion made by Mr. Edwards, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board override the
resolution onf the Suffolk County Planning Commission regarding
the application. of Barbara D. Schriever, located at Orient.

On a motion made by Mr. Ward, seconded by Mr. Latham, it was
RESOLVED that whereas a formal application for the approval of
a subdivision plat entitled "Barbara D. Schriever" located at
Orient was submitted to the Planning Board on June 1, 1984 ,
and filing fee of $100 was paid on June 1, 1984, and,
WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, Southold, New York, on August 26 ,
1985 at 7: 30 p.m. , and
WHEREAS, the requirements of the Subdivision Regulations of the
Town of Southold have been met by said subdivision plat and application,
NOW, therefore, be it RESOLVED that the application of "Barbara
D. Schriever" for approval of said subdivision. plat prepared
by Rod Van Tuyl dated as amended June 25 , 1985 be approved
and the Chairman be authorized to endorse approval on said subdivision
plat, subject to the following conditions:
1. Receipt of a park and playground fee, the amount to

On a motion made by Mr.Latham, seconded by Mr. Mullen, it was
RESOLVED that whereas a formal application for the approval of
a subdivision plat entitled "Robert And Aldona Norkus" located
at Southold was submitted to the Planning Board on February
22, 1983, and filing fee of $100 was paid on April 11, 1984 ,
and,
WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, Southold, New York, on August 26 ,
1985 at 7 : 45 p.m. , and

WHEREAS, the requirements of the Subdivision Regulations of the
Town of Southold have been met by said subdivision plat and application,
NOW, therefore, be it RESOLVED that the application of "Robert
and Aldona Norkus" for approval of said subdivision plat prepared
by Rod Van Tuyl dated April 24, 1984 be approved and the Chairman
be authorized to endorse approval on said subdivision plat,
subject to the following conditions:
1. No lot shall be subdivided or its lot line changes in
any manner at anyfuture date unless authorized by the Southold
Town Planning Board.
2. No residential .structure or sanitary disposal facility
shall be installed or constructed within 100 feet of the upland
edge of the tidal wetlands along the shoreline of Cedar Beach
Harbor.
3. No stormwater runoff resulting from the development of
the subdivision or any of the lots shall be discharged directly
in the adjacent body of water nor the tindal wetland bordering
that body of water.
4. A conservation or scenic easement having a minimum width
of 50 ' shall be established along the upland side of the tidal
wetlands along Cedar Beach Harbor to insure that no development
adverse to the aesthetic quality of the shoreline will take place
along the shoreline. A conservation or scenie easement does
not prevent future lot owners from constructing catwalks and/or
docks providing all the necessary Town, State, and Federal
approvals are obtained for the construcion.
5. Adequate road and drainage improvements shall be made
in existing roads (paper streets,- Orchard Lane and Clearview
Road) to insure that there is adequate access to the lots not
only for the lot owners but also for emergency and service
vehicles.
6. Conditions 1-5, inclusive, shall be filed as covenants
and restrictions in the office of the County clerk on or prior
to the granting of approval to this subdivision.
7. Receipt of a park and playground fee, the amount of
said fee to be determined by the Town Board, pursuant to
Section 106-3,8E.

Marie Patterson - The Board reviewed the resolution of the
Suffolk County Planning Commission regarding this set-off.
It was noted that the Planning Commission denied this
application. Also in the file was correspondence from the
applicant requesting that the Planning Board override the
County indicating her :reasons for this request. This
set-off received approval from the Board of Appeals and

On a motion made by Mr.Mullen, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board override
the denial of the Suffolk County Planning Commission regarding
the set-off of Marie Patterson, located at Laurel.

On a motion made by Mr. Edwards, seconded by Mr. Ward, it was
RESOLVED that the Southold Town Planning Board set Monday
October 7, 1985 at 7 : 30 p.m. at the Southold Town Hall,
Main Road, Southold as the time and place for a public
hearing on the .question of approval of the minor subdivision
of Robert J. - Miller, located at Fishers Island. -

John J. Breslin - The Planning Board will conduct a field
inspection of this new proposal for 4 lots on 18. 348 acres,
located at County Route 48 , Peconic, prior to any recommendations.
On a motion made by Mr. Edwards, seconded by Mr. Mullen, it was
RESOLVED that the Southold Town Planning Board declare itself
lead agency for the subdivision of John J. Breslen, known
as "Vine View Estates" under the State Environmental Quality
REview Act. 'An in itial determination of non-significance
has been made.

The Board reviewed the following new proposals Joseph Gazza,
Bernice Lettieri , Andrew Lettieri, Joseph F. Gazza, and
Lettieri and Grundbesitzer. These proposals are for
contiguous parcels at East Marion. All the lots created,
12 total, are proposed to have access off a right-of-way.
In addition, there was a previous set-off of one lot which
would also have access off the right-of-way. It was
the consensus of the Board to request that the right-of-way
be improved as a Town road.
On a motion made by Mr. Mullen., seconded by Mr. Ward, it was
RESOLVED that the Southold Town Planning. Board request that the
50 ' right-of-way through out the above mentioned subdivisions
located at East Marion be constructed in compliance with the
Town of Southold Highway Specifications and Standard Sheets.

Presubmission conference for Drs. Cilletti and Claps
Drs. Ciletti and Claps were present for the Board' s discussion
of this site plan, located at North Road, Southold. Dr.
Claps explained that the surveyor had indicated the largest
possible building that could be constructed on the site,
however, they only wished to construct a 1, 000 square foot
office building at this time. The office would be for their
use. The Board requested that the survey be amended to show
the exact footprint of the office building which they propose,
and also indicate the future buildings. The Board explained
the project could be constructed in phases, however, the site
plan should the entire layout at this time, since that will
help the Board in their review. The Board questioned the
ingress and egress to the site. Dr. Ciletti explained that.
they had proposed to have the ingress from Route 48 and the
! egress from Horton' s Lane to eliminate congestion on County
Route 48 . The Board also requested asphalt pavement in the
parking area. It was the consensus of the Board to
make a field inspection of the premises prior to any further
action, upon receipt of the amended site plans showing
! the building envelopes and asphalt parking, and sufficient
number of parking spaces. The Board stated that the parking
can be determined-, by computing the total square footage of all
the buildings proposed, even though construction would be
done in phases. The Board also suggested that an application
be made for a curb cut with the County to insure that the
proposed driveway could be constructed as proposed.
James and Mary Tyler - The Board reviewed this site plan
for construction of a mechanics garage located at Main Road,
Mattituck.The proposal is before the Board of Appeals for
a special exception and they are requesting the Planning Board' s
recommendation. It was noted that this proposal isfor the
auto mechanics only, there will be no retail sales and no
selling of petroleum products. The site plan had been
amended to show spot grades and the Board has made a field
inspection of the premises.
On a motion made by Mr.Ward, seconded by Mr. Mullen, it was
RESOLVED that the Southold Town Planning Board refer the
following recommendation to the Board of Appeals regarding
the special exception for the site plan of James and Mary
Tyler:
The Planning Board recommends that the application be
approved since it is conforming with the surrounding area.

John Costello - The Board reviewed this proposal for a change
of zone which is pending before the Town Board. This change
would be from"A" residential/agricultural to "M" Light-
Multiple zoning; the location is the corner of Moore ' s Lane,
and Route 48 , Greenport. � Mr: Costello was present
On a motion made by Mr. Latham, seconded by Mr. Mullen, it was
RESOLVED that the Southold Town Planning Board recommend to the
Town Board that the change of zone application of John Costello
from "A" Agricultural and Residential to "M" Light Multiple
located at Greenport, be approved.
It is the Planning Board' s intent, in endorsing the
M, Light-Multiple zone, to obtain affordable housing. Therefore,
the Board also recommends that any approval be conditioned upon
obtaining approved covenants and restrictions to parallel the
"Hamlet Density" zone in the proposed zoning ordinance to
provide for .affordable housing.

C. Bruce Staiger - The Board reviewed this proposal for
a set-off to re-separate merged lots . This is located at
Wells Road, Peconic. The applicant has obtained health
department approval, and the proposal is pending before the
Board of Appeals for insufficient area variances. The Board
of Appeals has requested the Planning Board' s recommendation
onthe proposal. The Board will make a field inspection and
submit their; recommendations to the Board of Appeals at the
next regular meeting which is scheduled for October 7 .
Walter and Marilyn Gatz - The Board reviewed this site plan
for construction of offices and an addition on an existing
restaurant located at County Route 48, Mattituck. Mr. Garrett
Strang, architect, and Mr. Peter Danowski, attorney were
present for this discussion. Mr. Strang explained that
they still have not received approval from the County
for the curb cut onto Route 48. The Chairman stated
that a previous site plan for the site was denied access
to the County Road. James Bryer questioned the proposed
grades. Mr. Strang stated that there will be minimum
grading at the drains, there will be no grading in phase
1 and the excavated material from phase 1 will be used to
fill phase 2 of the proposal, which is low. Mr. Lessard
pointed out that the storm wwaer runoff must remain on the
property. Mr.Orlowski stated that the Board could not accept
the "small car" parking which was shown on the plan. Since
this is not in the code, the Board cannot accept it. Mr.
Strang indicated that this would be eliminated from the plan.
Mr. Ward questioned the concepts onthe landscaping. Mr.
Strang stated that there are no plans, however, the owner
is a landscaper, so this will be done in a proper fashion.

Mr. Ward also questioned the architectural renderings. Mr.
Strang stated that nothing had been drawn on this Mr.
Mullen questioned if any tenants had been lined up and Mr.
Strang stated that there were none as yet. The Chairman
felt that there might be a hardship of the county does not
permit access onto County Route 48. Mr. Strang stated
that the divider on Sound Avenue would not prohibit East
bound traffic from entering the property from that road.
The Board felt that the Building Department could review
this proposal and if any changes are to be made, they then
could be made.
On a motion made by Mr. Mullen, seconded by Mr. Edwards, it was
RESOLVED that the Southold Town Planning Board refer the site
plan of Walter and Marilyn Gatz for construction of offices and
retail stores with renovation of existing restaurant located
at Mattituck to the Building Department for certification; subject
to receipt of surveys indicating the eliminationof the small
car parking, and showing spot grades and first floor elevations.

Nicholas Petikas - The Board reviewed this site plan for
construction of a restaurant with a retail use located at
County route 48 and Sound Road, Greenport. It was noted
that this property is zoned both B and A, with the majority
of the property in the A zone. This proposal is also before
the Board of Appeals for approval to use the entire parcel
for business uses. The Board of Appeals has requested the
Planning Board comments regarding this proposal.
On a motion made by Mr.Ward, seconded- by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board refer the following
recommendation to the Board of Appeals .regarding the site plan
for Nicholas Petikas, located at Greenport:
It is the intent of the proposed Master Plan to eliminate
the business zone on this propoerty, therefore, we recommend
that the application be denied.

North Fork Bancorporation - The Board reviewed this site
plan for renovation of an existing shopping center into an
office building, located at Main Road, Mattituck. . This
proposal received certification from the Building Department.
The Board noted that a landscape plan had not been submitted.

On a motion made by Mr.Ward, seconded by Mr. Mullen, it was
RESOLVED that the Southold Town Planning Board approve teh
site plan for North Fork Bancorpoation for renovation of an
existing shopping center to be used for office space, located
at Mattituck; site plan dated, as last amended, September 5 , 1985.
This approval is subject to receipt of a final landscape plan and
a one-year review by the Planning Board prior to a certificate of
occupancy.

On a motion made by Mr. Ward, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board approve the sketch
map for the minor subdivision of Alice Bergen located at Mattituck
for 4 lots on 11. 063 acres, survey dated June 11, 1985; subject
to receipt of covenants and restrictions stating no further
subdivision in perpetuity.

On a motion made by Mr. Mullen, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board recommend to the
Board of Appeals that the application for Frank Zaleski be denied
since the Board cannot endorse the udnersized lots, and recommends
that ht eparcel remain as one lot.

On a motion made by. Mr. Ward, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board recommend to
the Southold Town Board of Appeals that the lot to be set-off
inthe application of. William Nedoszytko have the minimum required
lot width of 175 ' since thereis enough area to accomodate this.

Board member William. F. Mullen introduced discussion regarding
affordable housing. He stated that there should be a definition
or a guideline to determine this. Mr. Mullen recommended basing
the prices for affordable housing .on the size of the house built
with a price range of aprpoximatlely $55 , 000 to $75 , 000. The
Chairman felt that this was a very good idea since many people
had approached him about providing affordable housing with a

price of $100, 000 and up. It was the consensus of the
Board that the price range which they would like to have
is between $55, 000 and $75, 000. The Board requested that this
be noted in the minutes of the meeting. Mr. Costello
stated that while it is good to set guildlines for price
on affordable housing, the Board should be aware that the
prices will be forced to change as inflation goes up over the
years. Mr. Costello felt that the Master plan will help
the situation by the creation of one-acre lots in some areas .
of the Town. The Board wished Mr.Costello luck on his
project.
