The Planning Board held a regular meeting on March 18, 1985 at
7 : 30 p.m. at the Southold Town Hall,Main Road, Southold. Present
were:
chairman Bennett Orlowski, Jr..
Member William F. Mullen, Jr.
Member G. Ritchie Latham, Jr.
Member Richard Ward
Member Ken Edwards
7 :30 p.m. Public hearing on the question of approval of the
minor subdivision of the Charles Simon Estate located at Wells Road,
Peconic, 4 lots on 39 .5. acres .
Mr. Orlowski: I will dispense with the reading on the metes and -
bounds We have proof of publication from the Long Island.-
Traveler Watchman signed by Pat Wood and notorized by Barbara
Forbes , proof of publication in the Suffolk Times signed by
Anna Lekkas and notorized by Ann Abate. Correspondence from
the Suffolk County Planning Commission, correspondence from
the Department of Health Services, filing fee, and everything
else in in order. At this time, I willask if there are any
objections to this minor subdivision? Hearing None, is there
any endorsements of this minor subdivision?
Mr. Richard Mead: The Simon Family endorses this proposal .
MR. Orlowski: Does any one have some information neither
pro nor con but of interest to the Board? Hearing None,
questions from the Board, Mr. Mullen, (none) ; Mr. Edwards (none) :
Mr. Ward, (none) ; Mr. Latham (none). Okay, there being no
further questions, I will declare this hearing closed and thank
you for coming: down.
Dominick Varano- The Board reviewed this proposal for 3 lots on
5 .4 acres located at Indian Neck Road, Peconic . Ken Edwards made
a field inspection of the property. The Board was to makr
recommendation to the Zoning Board of Appeals since one lot
had insufficient area.
On a motion made by Mr.. Mullen, seconded by Mr. Ward it was
RESOLVED that the Southold Town Planning Board recommend to the
Zoning Board of Appeals that the application of Dominick Varano
be approved as the Board noted that there would not be a substantial,
reduction to the zoning ordinance.

On a motion made by Mr. Mullen, seconded by Mr.Ward, it was
RESOLVED that the Southold Town Planning Board recommend that the
proposed storage building for returnable bottles be located in
the rear of the existing 7-11 building as previously recommended
on July 9 , 1984 . This site plan is located at Cutchogue.

It was also requested that the chain-link fence and guard rail
on the easterly side of the building be removed and replaced with
a gate in order to open the access for emergency vehicles , provide
access for the proposed storage building, and eliminate the
existing violation to the site plan.
On a motion made by Mr. Edwards , seconded by Mr. Mullen 'it was
RESOLVED that the Southold Town Planning Board set April 1 , 1985
at the Southold Town Hall as the time and place for the next
regular Planning Board meeting.

Mr. James Bitses was present for a discussion on his subdivision
for 4 lots on 11.6 acres to be known as "Old Town Park" located
at Southold, Mr. Bitses said that approxmia e y mon s ago
some neighbors alleged that there was a right-of-way across
the property which was not indicated on the map of "Old Town
Park. " It was noted that at that time, The Board requested
that Mr. Bitses research the property and discuss this situation
with the neighbors who were making the claim. It was also
noted that the Board held this application in abeyance until
this cou ld be worked since they could not act on a plan that
omitted a deeded right - of- way. Mr. Bitses indicated that
in order to proceed with the application he would re-submit
maps showing the right-of-way as a possible right=of-way under
contention. He noted that even with the right-of-way there
would still be 2 acres for each lot proposed. Mr. Bitses
did not want the placement of the right-of-way on the map .to
be considered an admission since he felt that the right-of-way
had been abandoned, however, he would compromise in order to
expedite the processing of the application. The Board was
agreeable to having Mr. Bitses submit. a new plan and they will
make a field inspection of the property.
On a motion made by Mr. Mullen, seconded byMr. Ward it was
RESOLVED that the Southold Town Planning Board set April 1,
1985 at 7 :30 p.m. at the Southold Twon Hall, Main Road, Southold,
as the time and place for a public hearing on the question of approval
of the minor subdivision of Andrew Lettieri located at East Marion,
2 lots on 14+ acres .

On a motion made by Mr. Ward, seconede by Mb. Latham it was
RESOLVED that the Southold Town Planning Board approve the set-
off of Louise Wilson Estate located at Mattituck, mapped June
15 , 1984 subject to the review of the Suffolk County Planning
Commission, and the conditions of the Board of Appeals approval .

On a motion made by Mr. Latham, seconded by Mr. Ward it was
RESOLVED that the Southold Town Planning Board grant a 90-day
extension on the filing of final maps for the major subdivision
of Harbor View located at Mattituck.

The following new proposals were set for a field inspection;
1. Stephen Weinrib-set-off for two lots on 3 .879 acres at
Lighthouse Road, Southold.
2 . Markiewicz Estates-4lots on 11 acres at Mill Laney Mattituck
3 . Louise O. Day- 2 lots on 13 acres at Indian NeckRoad, Peconic
4 . John azd Catherine Simicick- 4 lots on 11 acres at Cox Neck
Road, Mattituck.
5 . Margaret and Helen Conway-lot line changes at Horton' s Lane, Southold
Mr. Nichalos Aliano was present for a presubmission conference
to discuss the site plan of Beachcomber Enterprises , to construct
apartments behind the existing motel at Duck Pond road, Cutchogue.
Mr. Ward questioned. the grades and noted that the buildings and
parking are across varying slopes Mr. WARd said that in one
building one side of the building would be at the 50 ' elevation
and one would be at the 20 ' elevation. Mr. Ward requested the
grading plan. Mr. Edwards quextioned the area that was zoned
M1 . Mr. Aliano said that his parcel -is 50 ' from McBride Farm.
Mr. Aliano explained that the apartments would be year round,
garden apartments and would not be condominiums. at this time.
Mr. Aliano said a ball park price for the apartments would
be $700 per month. Mr. Alaino was not willing to covenant
that the apartments would not be condominiums in the future,
but he might be able to covenant that for a certain timeperiod
they would not be converted. Mr. Aliano explained that the
hotel presentely on the site is a seperate enterprise . It was
the consensus of theBoard to conduct a field inspection and
then give Mr. Aliano their recommendations for a site plan.
Mr. Peter Stoutenburg was present for a presubmission conference

for the site plan of Williston Beverage (Thomas Yasso, principal)
for the construction of a storage for refrigeration, located., at
Mattituck.
On a motion made by Mr. Mullen, seconded by Mr.Latham it was
RESOLVED that the Southold Town Planning Board refer the site
plan of Williston Beverage for the construction of .an addition
for efrigeration storage to the Building Department for
certification.
Vote of the Board: Ayes : Orlowski, Mullen, Latham, Ward, Edwards
Ann Saba-Ken Edwards made a field inspection of this proposal for
a set-off located at Stillwater Avenue, Cutchogue. He noted that
it is in conformance with the surrounding area.
On a motion made by Mr. Edwards , mconded by Mr. Latham it was
RESOLVED thatthe Southold Town Planning Board recommend t o the
Zoning Board of Appeals that the application of Ann Saba located
at Cutchogue be approved since it is in conformance with the surrounding
area.

On amotion made by Mr. Latham, seconded by Mr. Mullen it was
RESOLVED that the Southold Town Planning Board approve the prliminary
maps .for the major subdivision of Richard J. Cron located .at
Laurel, 6 lots on 13 . 894 acres , maps dated as last amended
December 4 ,. 1984 .

On a motion made by Mr. Mullen, seconded by Mr. Edwards it was
RESOLVED that the Southold Town Planning Boardrefer the major
subdivision of Richard J. Cron at Laurel to the Town Board
prusuant to Section 106-38 E (3) of the Southold Town Code in
order for the Town Board to. determine the amount of money to
be deposited with the Town in lieu of eland for )park and playground.

On a motion made by Mr. Latham, seconded byMr.Mullen it was-
RESOLVED that whereas, a formal application for the approval of a
subdivision plat entitled "Alexander Enterprises" located at
Laurel was submitted to the Planning Bo�.rd on August 6 , 1984
and, filing fee was paid on August 6 , 1984 in the amount of $100 ,
WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, Southold, New York, on March 4 , 1985 at
8 : 00 p.m. , and
WHEREAS, the requirements of the Subdivision Regulations of the Town
of Southold have been met by said subdivision plat and application,
NOW, therefore, be it RESOLVED that the application o� Saland and San Andre:
"Alexander Ent'for approval of said subdivision plat prepared by
Young. and Young , last dated July 6 , 1984 , be approved and the
chairman be authorized to endorse approval on said subdivision plat
subject to the following condition
1 . Filing of the covenants and restrictions as to no further
subdivision in perpetuity with the Suffolk County Clerk.

Margery D. BUrns- The Board reviewed this proposal for 3 lots on
5 .9 acres , located at Middle Road, Southold. It was noted that
the Suffolk County Planning Commission had denied the proposal
since they felt that the parcel in the back was landlocked, and
the noise from the railroad would be bothersome . The Board
noted that there was a 25 ' right-of-way to the rear lot and any
prospective purchaser of the lot would see the railroad tracks ,
also the train does not run that frequently in this area.
On a motion made by Mr. Mullen, seconded by Mr. Ward it was
RESOLVED THAT the Southold `town Planning Board override the
Suffolk County Planning Commission' s resolution of disapproval
regarding the minor subdivisionof M. Dickinson Burns located at
Southold.

Om, a motion made byMr.Latham, seconded by Mr. Mullen it was
RESOLVED that whereas, a formal application for the approval of a

WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, Southold, New York', on March 4 , 1985 at
7 : 45 p.m. , and
WHEREAS, the requirements of the Subdivision Regulations of the Town
of Southold have been met by said subdivision plat and application,
NOW, therefore, be it RESOLVED that the application of M. Dickinson
Burns for approval of said subdivision plat prepared by Rod
Van Tuyl, last amendment dated October 18, 1984 , be approved and the
chairman be authorized to endorse approval on said subdivision plat.

On a motion made by Mr. Mullen, seconded by Mr. Latham it was
RESOLVED that the Southold Town Planning Board recommend to the
Town Board that the letter of credit for Highpoint at East
Marion, Section II be reduced to $63 , 000 as recommended by John
W.Davis andRay Dean, Superintendent of Highways .

On a motion made by Mr. Mullen, seconded by Mr. Latham it was
RESOLVED that the Southold Town Planning Board declare itself
lead agency with regard to the State Environmental Quality Review
Act for the ; set-off of Charles Gillispie located at East Marion.

On a motion made by Mr. Latham, seconded byM r. Mullen it was
RESOLVED that the Southold Town Planning Board approve the set-off
of Charles S . Gillispie located at East Marion for 2 lots on 6 .5
acres , plans dated as last amended February 19 , 1985 subject to
the review of the Suffolk County Planning Commission.

On a motion made by Mr. Mullen, seconded by Mr. Ward it was
RESOLVED that the Southold Town Planning Board approve the
lot line change for Joseph H. Sawicki to move the rear lot-
%line of lots on Joseph and Constance Sawicki at North Road, Southold
twenty-two (22) feet south.

Dr. Joseph Lizewski was. present for a presubmissio.n conference
to discuss the site plan for conts`truction of two private racquet&_
ball courts located at Main Road, Cutchogue, application is
also before the Board of Appeals . Mr. Lizewski stated that the plan
shows 20 parking spaces , however, he could put in more if necessary.
He also explained the way the building is designed, you will have
to go down one-story to play on the racquetball courts . Only
8 people could play at one time, four people to a court. Dr.
Lizewski said that the landscaping and parking would be done
and, the parking will be gravel and whatever was called for.
The Board questioned if the existing barn structure woudld
remain. Mr. Lizewski said that this building currently housed
the well , however, it will be moved in the future. It was
the consensus of the Board to conduct a field inspection prior
to any action or recommendation to the Board of Appeals .
Alfred Bouffard was present for a presubmission conference to
discuss his site plan for consturction of a building for the
manufacturing of aerospace products. Mr. Bouffard explained
that he had previously had the parcel re-zoned C-Industrial .
This application is also before the Board of Appeals and they
are requesting the Planning Board' s recommendation. Mr. Bouffard
said there were three buildings on the site and this proposed
building will take the place of two of them. He stated he
has begun to clear the tanks away. He explained that his
manufacturing was for machining and subassemblies , there would
be no use of chemicals . Mr. Bouffard employes approximately
12 people. It was the consensus of the Board to .conduct a
field inspection of the premesis located at Westphalia Avenue,
Mattituck prior to any action or recommendation to the Board
of Appeals .
On a motion made by Mr. Mullen, seconded by Mr. Edwards it was
RESOLVED that the Southold Town Planning Board refer the site paln
of "The Cove" located at Southold, for the constructirn of 33
condominium units to the Building Department for certification
plans dated September 13 , 1984 and February 1 , 1985 .

John Simon f;Estate- The Board reviewed the correspondence form the
Suffolk County Planning Commission. The County resolved to disapprove
the subdivision map. It was noted that their reasons ire: creation
of landlocked parcels since they do not have access on a public
road, the lots are less than the required two-acre zoning, and
the set-off was not referred to the County for their review.
The Board alsoiead correspondence from the attorney for- the
applicant. The attorney noted that the right-of-way would be
25 ' in width and improved to the specifications of the Town,
the lots are under the two-acre zoning because they received
relief from the Town Board and the set-off was approved by
the Planning Board be a previous application. It was also
noted that any further subdivision of the parcel would be
considered a" major subdivision.
On a motion made byM r. Mullen, seconded by Mr. Latham it was
RESOLVED that the Southold Town Planning Board override the
Soffolk County Planning Commission's resolutirn. of disapproval
regarding the minor subdivision of the Jbhn Simon Estate located
at Peconic.
Vote of the Board: Ayes : Orlowski, Mullen, Latham, Ward, Edwrads
Daniel Shelly-The Board reviewed the correspondence from the
Suffolk County Planning Commission. The County resolved to
disapprove the subdivssion map since the parcels created were
landlocked, that is they did not have frontage on an existing
public or proposed road. The Board read correspondence
from the applicant's attorney indicating that this did have
frontage on the right-of-way which was improved accordnng to
the Town' s requirements . It was noted that the- Board had made
an inspection of the right-of-way and felt :that=it was an
excellent one .
Ona motion made by Mr. Latham, seconded by M . Mullen it was
RESOLVED that the Southold Town Planning Board override; the
Suffolk County Planning Commission' resolution regarding the
minor subdivssion of Daniel Shelley located at Cutchogue .
Vote of the Board: Ayes : ORlowski, Mullen., Latham, Ward, Edwards
Antone Mileska-The Board reviewed the correspondence from the
Suffolk County Planning Commission. The County resolved to
disapprove the subdivision map since the lots created were
less than the two-acre minimum requirement and the County
felt that the Planning Board should review these subdivisions .
It was noted that the Planning Board did review this subdivision
and sent their recommendations to -the Zoning Board of Appeals .
The Board approved a variance for the one-acre zoning.
On a motion made by Mr. Mullen, seconded by Mr. Latham it was

RESOLVED that the Southold Town Planning Board override the
resolution of the Suffolk County Planning Commission regarding
the set-off of Antone Mileska, located at Mattituck.
Vote of the Board: Ayes : Orlowski, Mullen, Latham, Ward, Edwards
Richard and Donnalee Relyea- The Board reviewed the correspondence
from the Suffolk County Planning Commission. The County resolved
to disapprove the subddvision map since there creation of a
landlocked parcel which did not have frontage on an existing
public or proposed road, 'the county also indicated that all the
existing buildings were not shown on the survey. The Board
also read correspondence from the applicant indicating why the
Board should override the County. It was noted'i,vhat the layout
was at the suggestion of the Planning Board.. in order to provide
a right-of-way for future dedication to the Town and the Board
had inspected the property so they were familar with the existing
buildings .
Ona motion made by Mr. Latham, seconded by Mr. Mullen it was
RESOLVED THAT the Southold Town P'1,8a n•ing Board override the
Suffolk County Planning Commissin' s resolution of disapproval
regarding the minor subdivision. of Richard and Donnalee Relyea
located at Laurel .
Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward, Edwards
Mr. Garrett Strang and Mr. Herbert Mandel were present to discuss
Mr. Mandel's proposal for the construction of two attached two-
family residences at Rocky Point road, East Marion. Mr. Strang
stated that they were before the Board to obtain the Board's
feeling on this proposal prior to pursuring a zone change. It
was noted that the property currently lies in a C1 zone, general
industrial. Mr. Strang said that the applicant would change
the zone to 'M" which he felt would be better for the community
than the C 1 zone which permitted heavy uses . The site plan
indictted 8 units in two buildings . Mr.. Strang pointed out that
the applicant owns adjoining parcels which would be merged to this
parcel to obtain more squrre footage . It was noted that the
applicant might apply for a use variance instead of a change of
zone . Mr. Mandel stated that the tanks that were on the property
have been removed. The units would be rental and would be
1000 sq. ft. 2 bedroom apartments with a garage and a driveway
to service each garage . The rental would be year round. Mr.
Mandel said that the price would be targeted for the medium
bracket estimating aproximately $500-$800 per month for each
unit. Mr. Strang said that they would be required to put in
a sanitary system, however, if the Village of Greenport water
and sewer comes into the area, they will contract with them.
Mr. Mandel said it was not his intention to convert into a
condominium or co-op and he would consider putting a covenants
and restrictions on the unit that they would not be converted,

Mr. Latham suggested that Mr. Mandel put his business proposal
(which was the subject of a previous change of zone from A to
B�,:- en the Main Road in East Marion) . � be relocated to this
area instead of the apartment units . Mr. Strang stated that
in the C zone that use would need a special ex.cept.i.or! too.
It was the consensus of the Board to make. a field inspection
prior to any recommendations .
On a motionmade by Mr.Latham, seconded by Mr. Mullen it was
RE,. 'OLVED that the Southold Town Planning Board approve the lot-
line change for Robert Demarest located at Orient to increase
the lot by 30,500 square feet, map dated June 29, 1984 and
amended February 20, 1985 .

On a motion made by Mr.Edwards , seconded by Mr. Latham it was
RESOLVED that the Southold Town Planning Board approve the lot-
line change for the Estate of Cora Demarest located at Orient,
map dated June 29, 1984 and amended February 20, 1985 .

On a motion made by Mr. Mullen, seconded by Mr.Latham it was
RESOLVED that`. the Southold Town Planning Board approve the
lot-line change for Harrison M. Demarest, Jr. , located at Orient,
map dated June 29, 1984 and amended February 20, 1985 .

On a motion made by Mr. Latham, seconded by Mr. Mullen it was
RESOLVED that the Southold Town Planning Board approve the lot-
line change for Louis Demarest to increase the lot be 69,700
square feet, located at Orient, amap dated June 29, 1984 and
amended February 20, 1985 .

On a motion made by Mr. Edwards , seconded by Mr. Mullen it was
RESOLVED that the Southold Town Planning Board accept the report
of Inspector John W. Davis regarddng the pavement width within
the subdivision of Go1dem_V_jaw Zatdtes located at Laurel.

On a motion made by Mr. Edwards , seconded by Mr.Latham it was
RESOLVED that the Southold Town Planing Board set Monday,
April 1, 1985 at 7 :45 p.m. as the public hearing to consider
the amendments to -the Subdivision Regulations regarding Flanni_ng
Board fees .
Vote of the Board: Ayes : Orlowski, Mullen , Latham, Ward, Edwardx
Mr. Cuddy appeared before the Board and questioned when the public
hearing would be held on Simicich subdivision. The Board stated
that article 6 approval had to be obtained prior to the public
hearing.
Mr. Cuddy questioned the action taken on the Cutchogue -7-ll store
and the application for a storage building. The Board stated
that they request that the building"b`eput in the rear, however,
it would be up to the decision of the Board of Appeals regarding
the variance.
Long Pond - Town Engineer, Larry Tuthill, was present and presented
the Board with an updated bond estimate on this subdivision.
Being no further business to come -before the Board on a motion
made by Mr. Latham, seconded by Mr. Ward and carried the meeting
was adjourned at 9 : 17 p.m.
