SCHEUBLEIN CTM 103-13-20.1 Property Location: 105 West Creek Avenue at Pequash Ave. at Old Pasture Road, Cutchogue SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: The applicant's 1.2792 acre parcel is located in the R-40 District with 250.23 feet along West Creek Road, 270.13 feet along Pequash Ave. (Fleets Neck Road) and 170.62 feet along Old Pasture Road, is improved with an existing single family dwelling with garage as shown on survey dated February 22, 1994 revised May 8, 1997 prepared by John Metzger, Peconic Surveyors. BASIS OF APPLICATION: Request for Variances under Section 280-15, based on the Building Inspector's June 14, 2007 Notice of Disapproval concerning a proposed accessory garage and shed in an area other than the code-required rear yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 18, 2007, and December 20, 2007, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant has applied for a variance to build a garage 26 feet by 23 feet, 20 feet from the side yard. He also wants to apply for an "as built" 8'x12' shed also 20 feet from the side yard. The driveway from the garage would be 20 feet from Pequash Avenue. Applicant is requesting relief from the code, which states that any accessory buildings must be built in the rear yard. The applicant has three front yards, which limits his ability to build any accessory buildings. Page 2—February 28, 2008 Zi�#6079—Kenneth G. Scheublein CTM No. 103-13-20.1 REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law §267-b(3)(b)(3)(1). Grant of alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. A driveway from Pequash Avenue, a well-traveled town street, from the proposed garage is proposed at only 20 feet. When cars are backed out from the proposed garage onto this well traveled town street, there could be hazards to other drivers or others in the area due to poor visibility. Also, the distance from the garage is 20 feet from the side yard, which would cause a loss of privacy to the neighbor. 2. Town Law 267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant has three front yards, which prevents any accessory buildings from being constructed in a yard other than in a side yard or front yard. Additional.Information:, .There has been opposition to placement of the proposed garage-by,the adjacent (southerly) property owner and by the Property Owners Association. The Applicant states the north and east portions of the property are heavily vegetated with some very desirable plantings that he does not want destroyed. 3. Town Law §267-,b(3)(b)(3). The variance granted herein is�substantial. .The:code states that no accessory.buildings are allowed in other than the rear yard. ,Mr. Scheublein's property has no rear yard, 4. Town Law §267-b(3)(b)(5). The difficulty is not self-created. The lot has always had three front yards. 5. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential,community will have an adverse impact on the physical or environmental conditions in the neighborhood. The driveway proposed by the applicant is only 20' long and the cars would have to back out onto busy Pequash Avenue, and the conditions are related to the grant of the variance. Also, no other accessory building is only 20 feet from,Pequash Ave. 6. Grant of the requested relief for the shed is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a garage or.a shed, while preserving and protecting the neighborhood and the health, safety and welfare of the community. RESOLUTION OF .THE BOARD: .In considering all of the above, factors,,and applying the balancing, test under New York Town Law 267-B, motion was offered by Member Oliva, seconded by Member Weisman, and duly carried, to DENY THE VARIANCE FOR THE GARAGE AS APPLIED, WITH GRANT ALTERNATE RELIEF FOR THE ACCESSORY GARAGE SUBJECT TO THE FOLLOWING CONDITIONS: Page 3—February 28, 2008 ZB#6079—Kenneth G. Scheublei.� CTM No. 103-13-20.1 1. The garage shall be turned around to place the 26' length at 28 feet from the side yard and parallel to the side yard, and the garage doors shall face North, and with a driveway designed with enough room to turnaround on the applicant's property and facing Pequash when exiting; with no backing out of vehicles onto Pequash, and 2. A screening buffer of plantings shall be placed and maintained along the east and south sides along the proposed garage ; and to GRANT THE VARIANCE as applied for regarding the existing accessory shed structure shown on the hand-drawn diagram submitted 10/18/07 and elevation diagrams with ZBA date stamp of Aug 21, 2007, and as per survey 1994 revised May 8, 1997 prepared by John Metzger, Peconic Surveyors. The above conditions shall be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from.the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this-application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Page 1 of 2-Appeal Application for Scheublein BACKGROUND The subject parcel is located in the Fleet's Neck neighborhood in Cutchogue. At 1.2792 acres, the parcel is one of the largest lots in the neighborhood. The house was built prior to 1957 and is located 36.6' from West Creek Avenue and 51.3' from the southern property line. There is a thick growth of mature specimen rhododendrons and trees on the northern third of the property. The eastern yard is landscaped and planted with grass and gardens. There is hedging, trees and shrubs at the southern boundary of the property. The area immediately west of the house is landscaped with the rest of the western portion of the property being mostly overgrown with scrub trees, vines and shrubs. The parcel is surrounded on three sides by roadways (Pequash Avenue to the east, Old Pasture Road to the north, and West Creek Avenue to the west). The property, therefore, has three front yards according to the Town Code. Unaware of the forgoing Code provision, Applicant began construction of an 8' x 12' accessory shed to the south and east of the dwelling. Upon learning of the restriction with regard to front yard structures, Applicant immediately ceased construction of the shed and consulted with the Southold Building Department. Applicant seeks variances to build the 8' x 12' shed and a detached two-car garage in the southwestern corner of the premises. That portion of the property has the least desirable vegetation. Both the garage and the shed will be located at least 15' from the southern property line. Access to the garage would be off of Pequash and located approximately 200' south of the intersection of Pequash and Old Pasture. The structures would be screened from the neighbors and the street by remaining vegetation. 1. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties, if granted, because: (a) The street scape would be maintained and the mature specimen bushes and trees preserved. (b) The proposed location will preserve the privacy of the applicant and his neighbors. (c) In the interest of safety, the access driveway is located approximately 200' south of the Pequash-Old Pasture intersection. (d) The garage will be used for storage and restoration of antique cars. Accordingly, the driveway will not be heavily used. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because the "backyard" is extremely small and will not accommodate the garage and shed. 3. The amount of relief requested is not substantial because: (a) The structures will be located in an area where they will be hidden from view by neighbors and/or passers-by. (b) Proposed increase in lot coverage is only 1.25%. Total proposed lot coverage is 4.87% in a zone in which 20% coverage is permissible. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because the proposed siting of the structures is designed to preserve mature specimen rhododendrons and trees while eliminating overgrown scrub vegetation. 5. Cutchogue, New York 11935 EZ 15 December 2007 7 2007 4Town of Southold Zoning Board of Appeals of PPeAtsPO Box 1179 Southold,New York 11971 Subject: Scheublein Variance Request Hearing re: SCTM#1000-13-20.1 on 12/10/07 Ladies and Gentlemen: The Fleet's Neck Property Owners Association believes that the Town Code is the community agreement describing mutually expected behavior in Southold. We advocate compliance with the Town Code. The Town's code provides mechanisms with which to enforce the code and to make minor adjustments within criteria. Occasionally an odd situation arises that requires Zoning Board of Appeals interpretation of the code and possible mitigation of requirements in the interests of public safety,public welfare or substantial justice. In the case of Mr. Scheublein's application on SCTM# 1000-13-20.1: 1. The lot is unusual in that it bounded on three sides by roads and thus has three front yards as well as one side yard. 2. The code requires a 50' setback from each of the roads and a 20' foot setback from the side-yard lot line. Existing buildings on any of the three roads are typically set back 40 to 60 feet. 3. The parcel is over 55,000 square feet so the above setbacks yield a code legal accessory building envelope of about 62'by 200' or 12,400 square feet. 4. The accessory buildings total less than 700 square feet indicating ample room within the code legal building envelope. There are no apparent contours or natural resources present that would make any part of the lot non-buildable. It is not apparent why a variance should be sought or granted. 5. Pequash is the main thoroughfare into and out of our community. As such it is a busy road and not the safest for a curb cut. But the applicants stated use does not _ seem to add significantly to the traffic. Old Pasture is a short road between turns. The best access to the accessory building garage is from West Creek Avenue (the road faced by the applicant's house)but access from any of the roads would appear to be—legal. 6. In addition to the garage issue, an 8'xl2' "shed"under construction is about 17 feet high with a second floor apparently making the gross area about double the size not requiring a permit. This should require a permit review since it was not the intent of the code to allow ungainly structures when it sought to exempt trivial sheds. 7. The Building Department should always insist on reasonable and complete drawings of the intended accessory structures. Potential residential use of accessory structures warrants full and verifiable disclosure in the permit application. While in this case we make no assertion in this regard, scale three view drawings showing structure,utilities, equipment and exterior appearance dated and signed should always be demanded and provided. Please consider the above in any action you may take on this and all other permit/variance applications. Scheublein#6079 I am the homeowner of the property directly adjacent and to the east of Mr. Scheublein. Our properties are nearly identical in size and each has a property line running along West Creek Avenue and another along Pequash Ave. As our lots are among the largest in the Fleets Neck community, it is my opinion that his request to have both a detached garage and storage shed is reasonable. However, our "rear"yards face Pequash Ave., the main road in and out of our community, and an exception to existing zoning is required by us from the community for buildings such as are being sought by Mr. Scheublein. Therefore, I also believe we have a greater responsibility to our neighbors and the community. Unfortunately, the combination of the structure heights, co-location in one corner of the lot, and siting in such close proximity to Pequash Ave. as proposed will negatively impact our community's street scape. It is also an unnecessary and unfair burden on my property line. And the garage will almost directly face the front entrance of a home on Pequash Ave., without the same mitigating set back from the road as was required by all of the surrounding homes. To the best of my knowledge, of the approximately 300 homes in the Fleets Neck community, there is not one two story shed as is proposed by the applicant. There is also not one home with an attached garage that also has both a 2 car detached garage and shed, as would be the case if the applicants request is granted. The only two homes without attached garages that do have both a 1 story shed and a detached 2 car garage, are spaced at opposite ends of their property. Finally, no surrounding structure is nearly as close to the road as is being proposed. , The Application Project Description(Section V- Purpose of New Construction) states that the garage will be used to "...store antique cars.." The applicants September 12th response to the Boards specific follow up inquiry to disclose"inside structural information...proposed use of each floor area...or other proposed use for each room." failed to disclose that a proposed use was to refurbish cars. In addition, only after I incurred the cost of engaging an attorney was it revealed that the proposed use of the garage includes car lifts to store up to 4 cars. An addendum Background section of the application does state, two-thirds into the text (ld) that the garage will also be used for the restoration of cars,but fails to mention anything regarding car lifts and 4 car 3 1 Y storage. Given the above and potential material adverse impact on me and my neighbors and very possibly the environment if he is painting cars, draining hazardous materials or performing certain metal work, please allow the community an opportunity to see professional architectural plans prior to any affirmative variance ruling. As applicants current driveway is constructed of broken cement pieces salvaged from another project and is bound together by dirt and weeds, the plans should include the driveway to fully access its impact on Pequash Ave. The Background section also states that"The structures would be screened from the neighbors and the street by remaining vegetation", "the structures will be located in an area where they will be hidden from view by neighbors and/or passers-by" and that the proposed location of the structures is on"That portion of the property has the least desirable vegetation." Given the amount of dead vegetation, mostly bear vegetation and felled tree and branches, it seems one who has seen the property over the winter months is being asked to believe a description and ignore what their eyes have seen. As the esthetic impact of the project is in dispute and very important, rather than endure a horticultural/semantic squabble, please wait just one month when the leaves are down and the "scrub" dies off, to assess the accuracy of some critical representations made by the applicant. This would not cause a hardship on the applicant. And although I did have the"benefit" of seeing the 17' shed in early spring, concerns about such an unusual shed height may not be as sever as I suspect. I believe it will become more apparent that this proposed variance will absolutely not "preserve the privacy of the neighbors" as is stated by applicant and contrary to their representation, the"CHARACTER" of our neighborhood will be materially and adversely impacted. It will also be both a financial and emotional"detriment to nearby properties." Suggested Compromise Although I have tried to identify a fair and reasonable solution for all concerned parties and not simply push the problem on to others, I do not speak herein for any other homeowner. But, as the following suggestions illustrate the applicant's request is not "The MINIMUM that is necessary and adequate..." as stated in the application. The proposed shed along my property line is set back approximately 57' from Pequash. However, due to its highly unusual relative height and lack of evergreen screen, it will have a negative impact on both the Pequash and West Creek Ave. street scapes as well as my privacy 6 months of the year. I have no objection to a 1 story shed (9'-10' height), with Just a couple of 6' evergreen trees planted between it and Peauash Ave., at its current location. It would have a minimal negative visual impact, and Mr. Scheublein would have his storage shed exactly where he wants it. 2V The Proposed 22' height 4 car 2 level garage just 20' from the main road and 15' from my property line is an unnecessary and unfair imposition on me and the community. If the Proposed garage were located approximately 60' from Mr. Scheublein's rear door except on the Old Pasture Rd. side of the property,with a 55' set back from Peguash Ave. he would have the size garage he wants, it would be no further from his rear door than he has proposed and his landscaped backyard would be undisturbed.And surrounding homes would have a significantly improved noise buffer. The garage would be about 120' off of West Creek Ave. and set 30' further back than the rear of the home. As the driveway cut out would be approximately 110' from the corner, situated across from a small wooded area, far from all homes, the negative visual impacts of the garage would not unfairly burden his neighbors,passers-by, nor be a traffic hazard. With better spacing of the two structures and a deeper setback the Pequash street scape would also be preserved. Although it is my opinion that the building of cars is not consistent with a residential neighborhood and may have other environmental implications, this may unfortunately not be an issue within your jurisdiction. I do request that you have the applicant strike the statement"and refurbish antique cars" from the application so that if a variance is granted and problems arise in the future as to the intensity of use, there cannot be a claim that the ZBA explicitly granted a zoning variance for the building of cars in a densely populated residentially zoned community. I also hope that the Board will conclude that a 2 level car storage facility with car lifts, given the stated intention to refurbish cars, is not a reasonable residentially zoned use. I have made a substantial investment in border plantings. I have not ask the applicant for any vegetative screening concessions between our property's with the exception of several Yews at the front of our property border that were planted at my expense and by agreement with my predecessor neighbor and which Mr. Scheublein has previously agreed shall not be removed(some may be just on the applicant's side of the property line). But I can not"plant away" construction project or automotive refurbishing noise. Since Mr. Scheublein moved in approximately 3 1/2 years ago we have had to live with ongoing construction noise from one major project after another. As he has stated many times,working on building projects is what he enjoys doing. And he has also acknowledged that because he likes to do all the work himself,projects take longer to complete. It is his right. But the importance of a noise buffer for neighbors can not be overstated. I thank each of you in advance for your serious consideration as to the impact this potential variance will have on us emotionally and potentially financially. Our request for compromises are not made lightly and would significantly mitigate the adverse impact on us, our neighbors and Pequash Ave. It would also allow Mr. Scheublein both a storage shed where he choose and the sized garage he requested, without any undue hardship. The Scheublein residence faces West Creek Avenue. The adjoining residence of LaRocca also faces West Creek Avenue. The defacto rear yard of the property is the Pequash Avenue side. The area is heavily screened with natural vegetation. Much of this is the magnificent rhododendrum varieties that the McNeills propogated themselves over the many years they owned the property. Most of that vegetation has been cleared from the LaRocca property, but the owners of the subject property have maintained many of these shrubs, some of which are tree size by now. The site plan does not include the evergreen plantings on the east and south sides as required in condition 2, to screen the garage from view along Pequash Avenue and the southerly property line. In order to authorize your request as a de minimus deviation from the relief granted, I will need to receive a site plan showing the width(s) of the proposed driveway and the required plantings. Scheublein requests that the Board approve a garage location which increases two setbacks but preserves a mature Korean Dogwood tree. At the recommendation of Michael Verity, I am providing you with seven copies of two garage site plans prepared by Mr. Scheublein. Garage Site Plan#1 depicts the detached accessory garage in the location determined by the Board in its decision dated February 28, 2008 (corrected March 18, 2008). Utilizing Plan#1 will result in destruction of a mature more than 20-foot tall Korean Dogwood, a mature holly tree, and a mature oak tree. In order to avoid the removal of an impossible to replicate long-growing Korean Dogwood, Mr. Scheublein respectfully requests that the Board consider Garage Site Plan#2. On that plan, the proposed garage has been rotated approximately 12' toward the northeast. The garage remains within the ZBA's setbacks of 28' from the southern line and 20' from Pequash. However, the southeastern corner of the garage is now proposed to be 25' from Pequash. That minor shifting of the garage building results in the preservation of the mature Korean Dogwood.' Mr. Scheublein proposes the foregoing modification because, as is evident from the rest of his property, he is attempting to retain, restore and maintain old growth plantings (some of which are rare specimens). Mr. Scheublein could "clear cut" his property following the example of many people and ' Unfortunately, the mature holly and the oak will have to be sacrificed.
