PLANNING BOARD MINUTES
The Southold Town Planning Board held a regular meeting on
Monday, December 8, 1986 at' 7: 30 p.m. at the Southold Town
Hall, Main Road, Southold, NY 11971.
Present were:

7: 30 p.m. Public hearing on the question of approval of the
preliminary maps for the major subdivision of Daniel Marcucci
located at Southold for 7 lots on 13. 89 acres in the cluster
concept.
Mr. Orlowski: Good evening. I would like to call this meeting to
order. The first order of business is a public hearing on
the question of approval of the preliminary maps for the major
subdivision of Daniel Marcucci located at Southold for 7 lots
on 13 . 89 acres in the cluster . concept. We have proof
of publication in the Suffolk Times, signed by Carol Sgoilala
and not .rized by Mary Degnan and we have proof of publication
in the Long Island Traveler' Watchman sig ned. by Pat Wood and
notorized by Barbara Forbes. At this time, everything in the
file is in order for the preliminary hearing and I will ask
if there are any objections to this major subdivision. Please
take the microphone and state your name.
Anthony Generosa, esq. : I am Anthony Generosa. I am a resident
of Reydon Shores and I am here as a homeowner and also as a
spokesman for Reydon Shores. I would like to say the cluster
concept, seems to be in the way of the seasoned community
of Reydon Shores. Reydon Shores Association is a 55 year old
community developed in one residence in as many seperate lot
concept. Cluster concept, in our opinion might impact the
harmony when put right against80 homes. I believe it might
be better if it did not have the development like Reydon shores
against it. I am sure that the track in the future, would
lend themselves in -the future to the cluster concept, but

Mr. Generosa:
I question the wisdom of this for these thirteen plus acres.
What is .the possibility of this property not being overseen.
Will the road be dedicated to the Town or will is remain forever
as a private road. I am concerned about the private road in
the prelimainary proposal because it is cut into Reydon Drive
dangerously close to a blind curve. Wouldn' t it make more
sense to put the road into Bayview or equal distance from the
road. I, personally, as would many of my Reydon Shore neighbors
would want to see the entrance off North Bayview. Why put
a feeder road off another feeder road, why not ,put it right
off a Main Road.
Mr. Orlowski: Any other objections?
Loiuse Reebel: My name is Louise Reebel. I am a resident,
my property abuts the property. My husband and I agree, although
in theory to cluster zoning. I am concerned with the placement
of the houses because it has been placed very close to the
already existing lots. There will be more strain on the water
and sewer system. Those. homes have been there since the 1930 ' s
and why should those houses not be set down where there is
more strain on the water system and the leaching systems. I
am concerned about Reydon brive because it is a one car wide
driveway when it rains. And increased traffic would create
some major problems .. . I would feel that the placement of the
homes could probably, if the cluster zoning is maintained,
could be placed to the south which would be more in keeping
with the clustering which would be more with the intent of
two - acre zoing. The possibility that additional homes could
not be built onthe south end of the property. I think there
is an excellent intent, clustering, sometimes things change
and the future generations change that we can not see. I question
placing everything at the North end and having the entrance
off Reydon Drive. There is only 13. 89 acres and once you make
an exeption to a rule the exception then becomes the rule'.
This would not be keeping with recent zoning if you allow seven
building lots on 13 . 89 acres.
Mr. Orlowski: We say it' is two acres, but we use building
acres which is 40 , 000 square feet.
Mr. Generosa: Has it been considered if the road would be
taken for dedication?
Mr. Orlowski: No. This is a preliminary hearing, there will
still be a final hearing. Any other objections?
Mr. Fred Fiedler: I am Fred Fiedler, I live on the road where
the house will be across from the driveway. The head lights
from cars will go right into the window of my house. I do not
think that tennis courts and a sump are ' green space. If there
is water problems, the last two houses that have been built
three years had to be (inaudible) prior to water and where
the homes were palced it could create a problem and that is
about it. Thank you.

Mr. Orlowski: Any other objections to this subdivision. Hearing
none. Are' there any endorsements? .,
Patricia Moore: I would like to direct my answers to any of
the Board' s questions. Doers the Board have any questions?
Mr. Orlowski: In regard to, the road, is the plan to dedicate
it or will it remain private?
Howard Young: We will be building it to Town Specifications.
Whether you accept it or not, if it is a problem, we will try
to set up a Homeowners Association, if you don' t take it. It
will not be constructed any differently, it will be constructed
to the Town Specifications'. We have made test wells and meet
NY State Drinking water standards.
Mr. Generosa: Perhaps the applicant can address to the location
of the road.
Mr. Daniel Marcucci: I believe, at any point when you layout
the road but it will have to be if someones Lights in someone' s
house, we would do it at some point.
Mr. Generosa: Would there be any problem with relocating the
road?
Mr. Marcucci: No, more traffic on North Bayview and we thought
Reydon Drive was long and -quiet and if you take the total area
of this project, I think we have 975 ' or 1000 ' of road and
if you would have to do a traffic count for 7 cars. . . .
Mr. Orlowski: There is a layout problem that will be worked
out, but the Board would like to hear endorsements at this
time since this is a public hearing. Are there any ,other endorsements?
Hearing none. Is there anyone neither pro nor con but with
information pertaining to this subdivision which may be of
interest to the Board?
Merritt -Miller: My name is Merritt Miller and I live in Reydon
Shores. The wells have passed the state standards but has anybody
inspected what the impact will be about pulling the water out
of the ground. We have had problems, no temik, but if they
pull on that water hard.
Mr. Orlowski: Any approval from this Board would be subject
to the Health Department and would have to get that approval
prior to ours, that is Suffolk County Health Department. They
have more expertise than we do in that area.
Mr. Miller: Well, that will have to be investigated.
Mr. Orlowski: Any other comments?
Mr. Howard Young: We made application to the Health Department
for individual wells. These would have to be examined by the
Health Department. Just as a comment.

Mr. Orlowski: Any other comments?
Mr. John Leonardi: There was a statement as to additional
cars. You can not say that it will be one car per family.
Families have two or three cars.
Mr. Orlowski: Any other comments?
From the audience: If you think you are in favor of this development,
what are we talking about for the land which is not built upon.
Is that placedin the deed that there will be' no further subdivision?
Mr. Orlowski: The cluster concept is a form of ownership. Plotted
on the map, this shows that it will go around the lots, the --
open space. Part of this subdivsiion will never built upon
and that is .put in the covenants forever.
Mr. Thomas Spay: I live in Reydon Shores and with regard to
the waste water disposal. We are all concerned in the Reydon
Shores area with this problem.
Mr. Orlowski: This is also a Board of Health problem. The
Health Department must grant approval of the subdivision prior
to the Planning Board taking —final-action.
Mr. Spay: This area includes the road?
Mr. Orlowski: That takes out the road. Any other comments?
Hearing none. Questions from the Board? Mr. Mullen.
Mr. Mullen: You will have a homeowners association that will
take care of the road. How will the tennis courts be handled?
Mrs. Moore: We have not discussed how the homeowners association
will be formed, but the tennis courts and the homeowners association
would take into consideration the open space, and the. . . .
Mr. Mullen: The costs would be taken into consideration_ b—
the homeowners in the area.
Mrs. Moore: Yes .
Mr. Mullen: With regard to the drainage storage area, in other words
the pond, will that be inthe agreement of the association?
We just want to make sure that the Town will not be held liable
for that. You can respond to that by letter.
Mrs . Moore: Yes, ok.
Mr. Latham: Are tennis courts allowed in open space?
Mrs. Moore: I guess you have to answer that.
Mr. Young: The park and ,playground within the open space area,
which you can see. I think we did that on Cove Beach.

Mrs. Moore: We intend to benefit the subdivision, that is
conforming. It is the intention that the tennis courts are
benefitting to the subdivision owners.
Mr. Edward: Three tennis courts for seven homes seems to be
an awful lot.
Mr. Marcucci: I intend to probably own a lot, and myself,
my wife and -my children play and that may take three tennis
courts by itself.
Mr. Orlowski: I would like to close this hearing now and thank
you for coming down. Put your comments in writing and I promise
we will review them. Thank you for coming down.

minor subdivision of Howard Hoey located at Orient;:.:-for 3
lots on38 acres.
Mr. Orlowski: Now, at 7: 45 p.m. we will have a public hearing
on thequestin of approval of the minors sixbdivision for Howard
Hoey for 3 lots on 38 acres at Main Road, Orient. We have
proof of publication from the Long Island Traveler Watchman

8 : 00 p.m. Public hearing on the question of approval of the
minor subdivision of Thomas Samuels located at Narrow River
Road, Orient for 2 lots on_D3' 75 acres. '_a:11 :. 1,
Mr. Orlowski: The next order of business is a public hearing
on the question of approval of the minor subdivision for Thomas
Samuels, 2 lotsoon 3175 acres. We have proof of publication
in the Long Island Traveler Watchman signed-- by Pat Woods
and notorized by Barbara Forbes, we hve proof of publication
in the Suffolk Times signed by Carol Sgoilata, and notorized
by Mary Degnan. At this time, everything is in order, it
has been a_'...Ion_ g wait for County Health approval but the applicants_
now has that. I will ask if there are any objections to this
minor subdivision?
Mr. Martin Trent: I would like to`-- say that the approval

Mr. Trent: of this subdivision would indicate the failure
of local government. The first public hearing7_I attended
was before the department of Environmental' Conservation, then
the Health Department and third the Planning Board, and this
is the third hearing. I have no problem and I have known
it is the plan to maiximize-, the (inaudible) . The concerned
agencies who have reviewed ;the project rather do not have
the will (inaudible) It is .a fragmite marsh. The DEC proved
oncle again that they a useless agency. The Health Department
wetland inspector is aware and finally .relented that the water
is treatable and additional fill be trucked in. t_ The final
disposition rests with you.' This property and this subdivision
will sit right on Hallock' s Bay. It think in the end he will
possibly-':.see:- -the approval 'bait I think that the tapproval
would denote failure of this Board.
Mr. Orlowski: Any other objections, hearing none, any endorsements
of this subdivision? Hearing none, anyone with comments neither
pro nor con but of interest to the Board? Hearing none. Questions
from the Board? Mr. Ward?
Mr. Ward: All approvals:.are ;in,,::.-:-.;If the Maspter Plan was
in effect we would be looking at 5 acre zoning but we are
not, we are looking at 2. We looked at it, but there is nothing
else we can do but go along.
Mr. Latham: The applicant' complies by the Board.
Mr. Edwards: Applicant has all approvals.
Mr. Emilita: Mr. Trent, are you an employee of the Health
Department?
Mr. Trent: Yes, I am.
Mr. Einilita: And this got approval from the Health Department
for the subdivision?
Mr. Trent: My Department 'approved it, not me.
On a motion made by Mr. Mullen, seconded by Mr. Ward, it was
RESOLVED that the Southold Town Planning Board set Monday,
December 22, 1986 at 7: 30 , p.m. at the Southold Town Hall as
the time and place for the next regular meeting.

RESOLVED that the Southold Town Planning Board set Monday,
December 22, 1986 at the Southold Town Hall, Main Road, Southold,
at 7; 30 p.m. as the:--time and place for a public hearing on
the question of aproval of the preliminary maps for the major
subdivision of Edward and Charles Nalbantian toy_°be known as
Oregon Heights located at Mattituck.

The-.-Planning Board set the following proposals for a field
inspection:
Michael Adams - 23 lots on - 52 acres in the cluster concept
located at County Route 48, Peconic.
Baysidd Farms - 16 lots on 104 acres at South Harbor Road,
Peconic. This is in the cluster concept.
L & R Vineyards - cluster subdivision for 300lots onll7. 4
acres -at County Route 48 and Elijah' s Lane,Mattituck.
Mary Bonkoski - set off located at Alvah' s Lane, Cutchogue
Cove Beach - Mr. Harold Reese was present. Mr. Reese stated
that he would be entitled to 41 lots and only proposed 40 .
Mr. Ward stated that when the wetlands are deleted fewer_:
lots can be plotted out. A yield map was. requested based
on aitwo,r-= acre standard subdivision layout. The Board will
conduct a field inspection prior to any further review or,'!
recommendations.
Frey and Whitman - Mr- . Garrett Strang, architect, was present
for a presubmission conference to discuss this site plan for
Frey and Whitman located at Main Road, Peconic. This proposal
was for renovation of two 'existing buildings into:,a retail
shopping center. Mr. Ward had made a review of this propsoal.
Mr. Ward stated that the area designated as landscaped area
would have to be shown with a landscaped plan. Mr. Strang
stated that the client is - in contract to purchase the parcel
and would like to close by the end of the-;. year, if possible.
Mr. Strang stated that before he finalizes any plans he would
like the Board' s input on the layout and whether they are
in favor of the proposal. Mr. Ward questioned if the area
computed as landscape including any brickwork or paving or
whether iit is grassed and shrubbed. Mr. Strang stated that
a full landscape plan will be submitted. Mr. Orlowski questioned
if the existing structures will be used. Mr. Strang stated
that the existing building with the accessory apartment will
be maintained with a facelift. Mr. Orlowski questioned how
the parking was calculated. Mr. Strang stated that the parking
meets the parking requirements for the retail area. Mr. Bryer
stated that he briefly reviewed it and it was acceptable,
however, the site plan elements needed to be further defined.

Frey and Whitman, cont.
Mr. Orlowski stated that the ,Board will make a field inspection
of the premises and further advise Mr. Strang. Mr. Strang
stated that he had hoped the �Board could get back to him soon
since his clients were anxious to close on the property.
Birndorf and Rizzo - The Board made a field inspection of
this proposal for 4 lots on 9 acres at Main Road, Cutchogue.
It was noted that there is a telephone pole in the right-of-way
as proposed, however, it wasifelt that this could be moved.
Mr. Orlowski stated that he felt that the right-of-way should
stay as proposed since the line of sight was much better than
on the other (easterly ) side of the property.
On a motion made by Mr. Ward, seconded by Mr. _Orlowski, it was
RESOLVED that the Southold Town Planning Board, following a
field inspectin approve the sketch map for the minor subdivision
of Birndorf and Rizzo located at Main Road, Cutchogue, for
4 lots on 9 acres. Survey dated May 23 , 1986

RHR Corporation -
On a motion made by Mr. Ward', seconded by Mr. Mullen, it was
RESOLVED that the Southold Town Planning Board approve the
sketch map for the minor subdivision of RHR Realty, Cor, following
a field inspection, located at Southold for 4 lots on 12. 5
acres, survey dated as amended October 22 1986; subject
to .
1. Covenants and restrictions filed witht he County Clerk
stating that ther will be no further subdivision ofany of the
lots.
Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward, Edwards
Henry Lytle - Abigail Wickham, Esq. was present for the applicants
for this 8: 30. p.m. appoint to discuss the status of this subdivision
for 2 lots on 9. 06 acres, located at Peconic. Ms. Wickham
explained to the Board that; she had prepared covenants and
restiictions on this property which was approved by the Town
Attorney. Ms. Wickham also stated that the property would
be split down the middle and create large lots. Ms. Wickham
stated that she would like to have the Board look favorably
on this proposal since Mr. Lytle had passed on and Mrs. Lytle
was not in a position to take care of the entire property.

Mr. Orlowski questioned the narrow lots and Ms. Wickham stated
that she had received correspondence from the Building Department
with regard to the lot width.'
On a motion made by Mr. Ward, 'seconed. by Mr. Mullen, it was
RESOLVED that the Southold Town Planning Board approve the
sketch map for the minor subdivison of Henry B. Lytle for
2 lots on 9. 06 acres located 'at Peconic, survey dated as amended
October 22, 1984, subject to:-
1. Filing the covenants and restrictions stating no further
subdivision with the County Clerk. These coveantns and restrictions
were previously submitted and approved by the Town Attorney.
2. Abandoning the existing 100 ' x 150 ' lot within the
proposed lot NO. 2 and the ' right-of-way.

M. Paul Friedberg - Ms. Wickham, Esq.also scheduled an appointment
before the Board to discuss this major subdivision proposal
located at .Mill Road, Mattituck. However, Dan Ross, Esq.
also of Wickham, Wickham, and Bressler appeared on behalf.
of the applicant. Mr. Ross explained to the Board his clients
concerns with regard to the 'requests of the Board. The Board
had requested that the lots propsoed in the low area be relocated
to the higher ground on the North of the -property. However,
Mr. Friedberg and Mr. Diachow, who was operating a nursery
on the property stated that this would infringe on the nursery
land. Also, Mr. Ross stated that they had submitted test
borings and Mr. Diachow staged that there was no problem with
drainage in the area, therefore, they requested that the Board
not require that the lots in the low area be re-located. Mr.
Ward questioned if they would be willing to covenant against
the existing structure on the north end of the .property becoming
a residence. Mr. Ross stated that they would consider a covenants
such as this. Mr. Ward noted that the test hole does not
show silt at 5' . Mr. Ross stated that there is gravel underneath.
Mr. Ward stated that they had requested the test hole to determinate
if there would be any evidence of mitigating a problem. Mr.
Ross stated that there would not be any problem as far as
he saw. Mr. Ward stated that there would probably be three
lots which would have to be re-located or re-moved. (lots
5, 6 and 7. KMr. Bryer stated that the cluster computations
would not permit a yield of 13 lots on this proposal. Mr.
Orlowski stated that a yield map should be submitted to prove
the yield. Mr. Orlowski questioned the use of the open space
and Mr. Ross stated that the open space will be used for anursery

must be worked out because the open space is for the use and
enjoyment of the homeowners. Mr. Ross noted that a yield
map had been submitted, however, it had not be stamped by
a licensed engineer or surveyor. It was noted upon receipt

of same the Board would further review this proposal. There was
considereble discussion with :regard to re-locating or removing
the lots in the low area, however, there was no agreement
worked out with the applicant.
8: 45 p.m. Mr. John Costello- had scheduled an appointment
with the Board to disucss this site plan for the condominium
and affordable housing project located at Moore' s Lane and
County Route 48 , Greenport. The Board had received a change
of zone application and was to make recommendation to the
Town Board. It was noted that the application was made to
the Town Board for a change of zone to an Affordable Housing
District (AHD) in order to provide 50% of the total site for
lower priced housing. On half of the total site, the affordable
housing would be 100%. It was noted that the site plan submitted
must contain all of the site plan elements and there was a
possibility that an Envirionmental Impact Statement would
� be required for this proposal.
On a motion made by Mr. Ward, Seconded by Mr. Edwards, it was
RESOLVED that the Southold Town Planning Board recommend to
the Town Board that the change of zone petitiion of John A.
Costello requesting a zone change from"M" to Affordable Housing
District "AHD" be approved subject to providing 100% affordable
housing based upon the previously submitted and approved subdivision
Map.
Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward, Edwards
Harvest Estates
Farm Veu - Mr. Richard J. Cron, Esq. was present for the
Board' s review of these twolmajor subdivisions located at
Aldrich Lane, Laurel. The proposal for Harvest Estates was
for 19 lots on 48. 5 acres and thr proposal for Farm Veu was
for 52 lots on 111. 5 acres.' The Board noted that these two
proposals are adjoining properties and requested that the
layouts for the two subdivisions mesh with each other. It
was noted that a cul-de-sac proposed for Harvest Estates was
longer than the 800 ' permitted by the code and there should
be two access roads since there are more than 20 lots proposed.
Mr. Ward suggested a layout which would mesh the two proposals
and provide alot of open space which would be a vista, since
it was the Board' s intent to obtain continuous open space.
Mr. Cron stated that the Board should not combine the two
proposals since there were ' two different property owners .
The Board noted that the two projects were submitted simultaneoulsy
and therefore they could consider both together. The Board' s
main intent was to have the • open space along the road for
a vista withi-the building lots in the rear.

On a motion made by Mr. Edwards, seconded by Mr. Mullen, it was
RESOLVED that the Southold Town Planning Board, following
a field inspection, approve the lot - line change for Robert
J. Geniesse located at Fishers Island to re-configure two
existing building lots. No additional building lots will be
cretLted by this approval.

On a motion made by Mr. Mullen, seconded .by Mr. Ward, it was
RESOLVED that the Soutohld Twon Planning Board accept and
and request compliance with Inspector John W. Davis ' report
No. 552 with regard to the improvements required for the access
road within the proposed minor subdivision for Winds Way Building
Corp. , New Suffolk Avenue, Cutchogue.

On a motion made by-:Mr. Mullen, seconded by Mr. Ward, it was
RESOLLED that the Southold Town Planning Board acept and request
compiance with Inspector John W. Davis' report No. 553 with
regard to the improvements to the access road within the minor
subdivision of N. Charles DeLuca located at Southold.
Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward, Edwards
On a motion made by Mr. Latham, seconded by Mr. Edwards, it was
RESOLVED that the Southold Town Planning Board accept and
request compliance with Inspector John W. Davis ' report No.
554 with regard to the improvements to the access road within
the minor subdivision of Thomas and Karen Uhlinger located
at Oregon Road, Cutchogue.

On a motionmade by Mr. Mullen, seconded by Mr. Latham, it was
RESOLVED that whereas--a formal application for -the approval
of .a subdivision plat entitled "Woodbine Manor" located at
Cutchogue was submitted to the Planing Board on October 20,
1986 and filing fee of $110 'was paid on October 20, 1986 and,
WHEREAS, a public hearing was held on said subdivisio application
and plat at the Town Hall, Southold, New York, on Monday, November
24 , 1986 at 7: 30 p.m. and

WHEREAS, the requirements of the subdivision Regulations of
the Town of Southol have been met by said subdivision plat
and application,
NOW, therefore, be it RESOLVED that the application of John
and Olivia Fellninger- Ihar for approval of said subdivision
plat prepared by Howard Young dated as amended February 4,
1986 be approved and the -Chairman be authoried to endorse
approval on said subdivision plat.

On a motion made by Mr.Mullen, seconded by Mr. Ward, it was
RESOLVED that the Southold Town Planning Board, following
a public hearing, approve the preliminary map for the
major subdivision to be known as East Marion Woods for 26
lots on 59. 8 acres at Rocky Point Road, East marion, survey
dated as amended November 20', 1986; subject to:
1. Withdrawal and discontinuance, without cost, of the
ARticle 78 proceeding currently pending against the Planning
Board entitled Hodor/Staller versus the Planning Board
of the Town of Southold, Index, # 84-13627.
Vote of the Board: Ayes : Orlowski, Mullen, Latham, Ward, Edwards
On a motion made by Mr. Ward, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Plannig Board approve the
sketch map for the major subdivison of Wolf Pit Associates
for 27 lots on 64 acres in the cluster concept located at
Mill Lane, Mattituck, survey dated as amended November 5,
1986.
Vote of the Board: Ayes: Orlwoski, Mullen, Latham, Ward, Edwards
On a motion made by Mr. Mullen, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board declare themselves
lead agency under the State' Environmental Quality Review Act
for the major cluster subdivision of elf Pit Associates located
at Mattituck. An initial determination of non-significance
has been made.

On a motion made by Mr. Ward, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board approve the
sketch map for the major subdivision of Frank Cichanowicz ,
III to be known as "Wild Oats" located at Indian Neck Lane,
Peconic for 7 lots on 14. 734 acres , survey dated as amended
November 7, 1986, in the cluster concept.
Vote of the Board: Ayes: Mullen, Latham, Ward, Edwards
Abstained: Orlowski
On a motion made by Mr. Ward, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board recommend to
the Highway Superintendent and Highway Committee of the Town
Board that the draft specifications for access roads within
minor subdivision be adopted, with the following revisions :
PARAGRAPH #11 - Amend this to read: "No lots shall be sold
and and no building permits issued for the cosntruction
of any buildings or structures on the premises to which
this access is referred until all of the conditions set
forth herein have been complied with. "
PARAGRAPH #14 - Amend this to read: "The following utilities
are to be installed underground at the time of the improvement:
electric, telephone, water, sewer, gas and cable television. "

On a motion made by Mr.Ward, seconded by Mr. Edwards , it was
RESOLVED that the Southold ,Town Planning Board approve the
sketch map for the minor subdivision to be known as"Kings
Bay Estates" located at Orient for 4 lots on23. 44 acres with
3. 4 acres of open space, survey dated as amended December
2, 1986 , subject to:
Creating an agricultrual' easment over the area to the
south of the building envelopes.

On a motion made by Mr. Ward, seconded by Mr. Mullen, it was
RESOLVED that the Southold Town Plannig Board grant a 90-day
extension on the conditional approval of the Planning Board
for the minor subdivision of Philip J. and Sharyn Ofrias to
be known as "Arshamomaque island" located at Southold pursuant
to the request of the applicant. This extension to expire

on April 14, 1987.

On a motion made by M. Latham, seconded by Mr. Mullen, it
was
RESOLVED that the Southold Town Planning Board grant a final
90-day extension on the conditional approval of the minor
subdivision to be knowns as "Cranberry Acres" located at Southold,
pursuant to the request of the attorney. This extension to
expire on march 15, 1987. Please note, this is the last extension
which will be considered bylthe Board.

Mr. John Costello approached the Board with regard to a Draft
Environmental Impact Statement and whether the Board will
request one for the applications to be made to the Planning
Board.. It was noted that a .Draft Environmental Impact Statement
was prepared for the change ;of zone. Mr. Costello also requested
if the Draft Environmental Impact Statement could be prepared
prior to the Planning Board - declaring a lead agency. Mr.
Emilita stated that they cannot be in a SEQRA (State Environmental
Quality 'Review Act) with -two agencies at the same time, therfore,
they would have to wait for - the change of zone to be passed.
The Chairman noted that the - application for the townhouses
in the "M" zone will be a site plan and the application for
the affordable housing will : be a subdivision.
Being no further business to come before the Board, on a motion
made by Mr. Mullen, seconded by Mr. Edwards, and carried,
the meeting adjourned at 9: 43 p.m.
