PLANNING BOARD MINUTES
The Southold Town Planning Board held a regular meeting on Monday,
November 24, 1986 at 7:30 p.m. at the Southold Town Hall, Main Road,
Southold, NY 11971.
Present were;
Member Richard G. Ward, action as chairman for this meeting
Member William F. Mullen; Jr.
Member G. Ritchie Latham, Jr.

7:30 p.m. Public hearing on the question of approval of the final maps
of the major subdivision of John and Olivia Fellinger - Ihar to be known
as "Woodbine Manor" located at Cutchogue for 17 lots on 20 acres.
Mr. Ward: We have a public hearing on the qeustio of approval of the
final maps for the major subdivision of John and Olivia Fellinger - Ihar
to be known as "Woodbine Manor" located at Cutchogue for 17 lots on 20
acres. This had a previous approval which has expired. At this point
we are really just here to re-affirm that. Is there anybody here with
any comments in favor, of this subdivision. Does the application wish
to be heard?
Mr. Fellinger-Ihar: We were in Europe and my lawyer Mr. Scheinberg applied.
We had run out of time becasue we had difficulties with the mortgage.
WE had to pay off the mortgage before we could (inaudible) . We believed
that we had 180 days from the last approval-to record. And, because
we had difficulties with the former owner who deceased and his wife had
difficulties. So, my lawyer, Mr. Scheinberg, after the mortgage was
released, went to the County Clerk to record but they said it was over
180 days. But, we had 180 dayes, so we had come back and the Planning
Board said no. But, becuase I was in Europe, I could not keep an eye
on these things.
Mr. Ward: Is there anyone present who would like to speak for or agains
the project. (none) Any comments from the Board.'(none) . I will declare
this hearing closed.

RESOLVED that the Southold Town Planning Board set Monday, December 8,
1986 at the Southold Town Hall, Main Road, Southold as the time and place
for the next regular Planning Board meeting.

Oh a motion made by Mr. Mullen, seconded by Mr:-. Latham, it was
RESOLVED that the Southold Town Planning Board set Monday, December
8, 1986 at 7:30 p.m. at the Southold Town- Hall:-as the time and place
for a public hearing on the question of aproval of the major subdivision
for Daniel Marcucci located at Southold for 7 lots on 13.89 acres.

RESOLVED that the Southold Town Planning Board set Monday, December 8,
1986 at 7:45 p.m. at the Southold Town Hall, as the time and place for
a public hearing on the question of aprpoval of the minor subdivision
for Howard Hoey_-for 3 lots on 38 acres located at Orient.

On a motion made by Mr. Mullen, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board declare themselves lead
agency under the State Enviroinmental Quality Review Act for the minor
subdivisio of RHR Realty Corp. located at Southold for 4 lots on 12::5
acres. An in initial determination of non -significance has been made.
Vote of the Board: Ayes: Mullen, Latham, Ward
The Board will also conduct a field inspection of this proposal prior
to any further action.
On a motion made by Mr. Mullen, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board declare themselves lead
agency under the State Enviroinmental Quality Review Act for the lot
line chagne for Robert J. Geniesse located at Fishers Island. An initial
determination of non-significance has been made.

The Board will conduct a field inspection of this proposal, prior to
any further review or action.

Edward and Althean Sidor - The Board will conduct a field inspection
of this proposal for a lot line change at Mary's Road, Mattituck.
On a motion:-,.made by Mr. Lathamy:,.seconded by Mr. Mullen, it.was
RESOLVED that-::the Southold Town.:Pl.anning Board declare itself lead agency
under the State Envirionmental Quality Review Act for the major subdivision
to be known as Farm Veu Estates located at Laurel.

The Board will conduct a field inspection prior to any further review
or action.
On a motion made by Mr. Mullen,,,seconded by Mr. Latham, the-following
action was taken:
NEGATIVE DECLARATION
Pursuant to Article 8 of the Environmental Conservation Law,
State Environmental Quality Review Act and 6NYCRR Part 617, Section 617.10
and Chapter 44 of the Code of the Town of Soutohld, notice is hereby
given that Southold Town Planning Board as lead agency for the action
described below has determined that the project will not have a signffccant
effect on .the environment.
DESCRIPTION OF ACTION .
The minor subdivision of Mohring Enterprises, located at Mattituck,
is :a :set off of 3.563 acres from 36.9 acres. SCTM # 1000-113-7-19.2.
The project has been determined not to have a signifianct.'effect
on the environment for the following reasons:
An envirionmental assessment has been submitted which ixidiciated
that no significant adverse effects to the environment were likely
to occur should the project be implemented as planned.
Because there has been no response from the Suffolk County Dept.
of Health Services_ in the:�alotted time, it is assumed that there are

no objections or comments from that agency. However, an application
under Aticle 6 will be required for approval of the water and
sewer.
Because there has been no response from the NYS Department of
Enviroonmental Conservation in the alotted time, it is assumed
that there aer no objections or comments from that agency.
The project willmeet all the requirements of the Code of the
Town of Southold Subdivision of Land Regulations.

On a motion made by Mr. Latham, seconded by Mr. Mullen, it was
RESOLVED that the Southold Town Planning Board approve the set off of
Mohring Enterpriese to set off 3.563 acres in the B business zone from
36.9 acres inthe A- Residential Zone located at Sound Avenue, and Cox
Neck Road, Mattituck, survey dated September 12, 1986; subject to:
1. Receipt of Article 6 approval pursuant to the Suffolk County.
Department of Health Services.
2. Consideration of the recommendations of the Suffolk County
Planning Commission (if Any) .

action was taken:

and Katina Mihaltses to be known as "Sunrise Estates" at Mattituck is
for 7 lots o 15.8 acres in the cluster concept located at Bergen Avenue,
SCTM # L000-112-2-2.

The project has been determined not to have a significant effect on the
envirionment for the following reasons:
An envir6nmental'assessment has been submitted which indicated
that-.:..no significant adverse effects to the environment were likely
to occur should the porject be implemented as planned.
The Suffolk County Department of Health Services has no objection
to our designation of lead agency. Insufficient information
is available for technical comments. The Department received
an application and it is incomplete. The Health Department has
received a subdivisin application and is awaiting test holdo
results prior to further processing. The project appears to
conform to the SC Article 6 in regard to the lot size. The application
must demonstrate that the parcel is underlain by naturally occuking
potable water supply.
Because there-'has been no correspondence from the NYS DEC received
in the alotted time, it is assumed that there are no comments
or objections from that agency.
The project will meet all the requirements of the Code of the
Town of Southold Subdivision of Land Regulations.

time, it is assumed that there are no comments objections from
that agency.

2. Consideration of recommendations, if any, from the Suffolk
County Planning Commission.

7:45 p.m. Public hearing on the question of approval of the preliminary
maps for the major subdivision of Hodor/Staller to be known as East Marion
Woods located at East Marion for 26 lots -on 59.8 acres in the cluster
concept.
Mr. Ward: Next, we have a public hearing on the quetion of approval
of the major subdivision for Hodor/Staller to be_.known as East Marion
Woods located at East Marion for 26 lots on 59.7 acres in the cluster
concept. I will dispense with the reading of the metes and bounds.
Are there any endorsements of the,.subdivision?
Mr. Price: Mr. Chairman, I am Irving Price, Attorney at Greenport and
I represent the applicant. This matter actually started August 31, 1981.
It is a long story and I will try to be brief,just for the record. This
matter had sketch plan aproval on June28, 1982 and got caught in the
rezoning for the two acres. We had two separate hearings before-:the
Town Board for relief which was denied, the secorid,-one as a result of
the decision of the appellete decision which remanded it to the Town
Board for re-hearing. The matter is now before the appellate division
again but the action is stayed pending a settlement. We have been before
the Body several times, and I believe the main point.�to consider is that
the original application was for Section I and II of a total of 59.8275
acres and it provided 35 one acre:-lots and fher.e :was still].17 acres left
in Section III for future application. The map that is before you

is for a total of 59.8275 acres, the same as in 1983, but this map only
provides for 26 one acres lots as opposed to 35 lots on 1983. On the
map that is before you tonight there is 31 plus acres in open space and
it provides for the cluster concpet. If there are any questions, I will
be glad to answer them.
Mr. Ward: Is there any one else that would like to speak on behalf of
. the property. If not is ther anyone who would like to speak positively
or negatively about the project. Was the action withdrawn with regard
to the ARticle 78.
Mr.Price; No.
Mr. Mullen: It wasn't.
Mr. Price: No, it was stayed by agreement of the counselor in court
subject to approval of the preliminary map and upon approval of the
preliminary map .it will be withdrawn.
Mr. Mullen; Okay, thank you.
Mr. Ward: Any other questions? Mr. Emilita?
Mr. Emilita: I have a question for the Boatd-to consider: The possiblity
of the clearing limits on the wooded lots. This could be done on the
final map.
Mr. Ward: Okay, being no further comments, then, I will close the hearing.
Mr. Price: May I ask what that means, clearing limits on the wooded
lots.
Mr. Ward: He is asking for building envelopes on the wooded lots so that
it would not be clear cut.
Mr. Price: Would that mean that this would get denied without that.
Mr. Emilita: No, I didn't say that.
MR. Ward: No, he didn't say that, he is looking for that on the final
submission and recommending to the Board to look into clearing limits
to show on:-.the:--final map. It has nothing to do with this phase of it.

Michael Patellis - the Board held action on the proposal for renovation
of the former VFW Hall lcoated at Boisseau Avenue, Southold to a take
out restaurant, since no revised site plans were submitted.
On a motion made by Mr.Mullen, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board approve the site plan
and supplemental landscape plan for Ted's Auto Body for construction
of an addiion on the existing auto body repair shop located at Cutchogue,
survey dated October 13, 1986, landscape plan dated November 17, 1986;
subject to:
1. Certification bythe Building Department

RESOLVED that the Southold TownPla-nning Board refer the :site
plan of Joseph Taormina and Paula Clark for renovation of the former
North Fork Video to a take out pizzeria located at Main Road, Mattituck
to the Building Department for certification. this survey is dated as
amended October 31, 1986.

On a-.!motion made by Mr.Latham, seconded by Mr. Mullen, it was
RESOLVED that whereas a formal application for the approval of a subdivision
plat entitled "Crowley Estates" located at Southold was submitted to
the Planing Board on October 14, 1986 and fiing fee was paid on May 5,
1986, and,
WHEREAS, a public hearing was held onsaid subdivision application and
plat at;:the Town Hall, Southold, NY-on November 10, 1986 at 730 p.m. ,
and
WHEREAS, the requirements of the Subdivision Regulations of the Town
of Southold have been met by said subdivisio plat and appication,
NOW, therefore, be it RESOLVED that the application of Frieda Corwley
for approval of said subdivisio plat prepared by Sidney B. Bowne and
son dated August 1985 be approved and the;:Chairman be authorized to endorse
approval on said subdivision plat, subject to the following condition..
1. Payment of the park :and playground fee. When this fee has

RESOLVED that the Southold Town Planning Board re-affirm the sketch map
approval of the minor subdivision of Thomas Samuels for 2 lots on 3.75
acres located at Orient, survey dated as last amended May 19, 1986.

RESOLVED that the Southold Town Planning Board set Monday, December 8, .
1986 at 8:00 p.m. at the Southold TownHall as the time and-,place for
a public hearing on theoquestion of approval of the minor subdivision
of Thomas Samuels for 2 lots on 3.75 acres.

amendments to the subdivision regulations with regard to filing fees
for minor and major subdivison applications.
Mr. Ward: Next;. we have a public hearing on the question of approval?

to filing fees for minor and major subdivision applications. I"would::_;,.: -

It has been filed with the Suffolk Times, and also with the Long Island
Traveler Watchman and the legal notice was published. The sections of
the local law that would be affected would be section A106-22 A 2 which
would become�. $200 per lot and Section A106-23 A 2 would be $1000 fee
plus $100 per acre. Is there anybody here that would like to be heard
on behalf of this proposed amendment. Any comment from the board members?
Mr. Mullen: I think.-it.:is a good idea.
Mr.Cron: What is the present fees for a subdivision.
Mr. Mullen: It is a $.100r,a lot on a minor and the inspection fee is
$150. A major is now a $50 fee and $5 an acres.
Mr.Cron: Five dollars, it is jumping from five to one hundred.
Mr. Mullen: We have had some tremendous inspections fees from Mr. Davis
and other people and the $5 situation is completely out of line in the
expenses. Als, this brings us up to what other communities are charging.
For example, last we jumped,,"on the fee for a bond from 4 to 5%. Some
communities have-6% or better. Our enginering has been going up considerabley
and when Mr. Davis.:retires, it will:_ibe an astronomical figure.
Mr..Cron: Is this based on studies?
Mr. Ward: It is based ont:the shortfall of what is happening, between
what we are collecting and what is being spent, there is a big disparacy
right now. This is to close the gap and put it on a more self-sustaining

Mr. Ward: Basis.
Mr. Mullen: We have researched this to a degree.
Mr. WArd: Any further comment, hearing none, I will close the hearing.

set off at Greenport
Mr. Ward: Next, number five, we have the Costello, Bracken and Carroll
set off proposal located at Moore's Lane and County Route 48, Greenport.
Any approval would be subject to the applicant obtaining an affordable
housing district from the Town. Is there anyone here in support of this
proposal.
Mr. Costello: Yes, my name is John Costello and I am the applicant. The
last::sentence that you said confused me slightly, what was the condition:
Mr. Ward: It would be subject to obtaining the AHD district, in other
words the approval would be subjectAo you obtaining the AHD district.
Mr. Costello: This afternoon, I made the application for the AHD district.
MR. Ward: We would rather not deal, as a Planning Board would not want
two parcels floating as two M zones, we would prefer to keep it as one
M zone parcel if you AHD does not go through. We believe that it will
.go through, but our approval will be su bject to. What-:ever the time
frame it is is that legally the two lots could be sold. We want to review
this as one parcel. We are in favor of it being divided for an M zone
for one portionnand an affordable housng,,.portion.
Mr. Costello: Could we also proceed with the site plan approvals for
this thing in the mean time.
Mr. Ward:. Yes, we would have no problem with that.
Mr. Costello: Is it possible to set up a scoping session with the Planning
Board and David Emilia. I am sure that there will have to be an addendum
done for theIDEIS And FEIS. And, I am sure that you can not make taht
decision now, but when you are available to have that scoping session.
That way we can have two stages done simultaneously.
Mr. Ward: I don't see a problem with seting up�-.a•:scoping session.
Mr. Emilita: Is Mr. Wiggon your engineer?
Mr. Costello.:. Yes.
Mr. Emilita: I spoke with him today and based on what we discused, we
are examining the two proposal that are before this Board and the envirionmental
work that has to be down. And, identifying the gaps that need to be filled
with an environmental supplement. Once we have identified those issued,
then I think it would be appropriate to hold a scoping session.

Mr.. Costello:: This project is less dense than the DEIS And FEIS that
wer previoulsy submitted. As soon as possible, I.would like a scoping
session so tht the engineer can work on that section of .it.
Mr. Ward: Okay, I will take a motion with regard to the action.
On a motoin made by Mr. Mullen, seconded by Mr. Latham, it was
RESOLVED that ,the Southold Town Planning Board approve the set off for
the Costello property located at County Route 48, and Moores's Lane,
Greenport to set off 26.45 acres from 48.7 acres, survey datd October
25,1986; subject to:
Receipt of a changeo6f zone on Parcel B to Affordable Housing
District with 100% affordable housing.

On a motion made by Mr. Latham, seconeded by Mr. Mullen, it was
RESOLVED that the Southold Town Planning Board accept the profile submitted
by Inspector John W. Davis for the access road withinthe minor subdivision
formally of Frank STillo, now owned by BLBD Enterprises located atcOrient.

On a motion::smade by Mr. Mullen, seconded by Mr. Latham , it was
RESOLVED that the Southold Town Planning Board approve the amended site
plan for Pipes Cove Condominium located at Sixth Street, Greenport/Southold
for construction of 8 units in 3 buildings, site plan dated as revised
September 21, 1986; subject to:
1. Certification by the Building Department.

8:15 p.m. Mr. Henry E. Raynor, Jr. , as agent has scheduled a presubmission '

Mr. Raynro: I am here tonight on behalf of the project for-Tidemark.

Mr. Raynor: Cliffside Associates. We have a proposed site planwhich
is a reflection on:-the Town of Southold being in great demand for transient
motel uses. My recollection is that thisiis probably the first motel
that has come before the Board in 10 years. I have Doug Herlin; the
architect, if you have any questions. The project exists as:;6 buildngs
as well as amenity package that includes tennis courts and swimming pool.
The plans conform and fulfill all the elements of Section 100-34 in addition
to try to reflect this Board's requests, that includes the additional
drainage plans by area and location, calculations and staking the property,
has been taken care of. The Board has been furnished with a disclosure
statement of the principals of Cliffside. And, as a result of the field
inspection and the Board's recommendation, Building F.has been lowered.
The attorney has also drawn a proposed set�,ofcobenants and restrictions.
We have also received the Village of Greenport water contracts and I
have an affidavit which is going to the Board of Appeals with regard
to the execution:,of that contract as well as the fact that they will
be serviced by the Village of Greenport. I believe those are all the
outstanding elements. I believe the plan complies with all the requierments
of the ordinance. If all is satisfactory, I would request that the Board
send this onto the Building Department for certification. It was certifed
several years ago, however, it was certified under a different use and
it will require re-certification.
Mr. Ward: Have you contacted the county regarding the curb cut.
Mr. Raynor: We are in the process_�of doing that.
Mr. Ward: How about DEC?
Mr. Raynor: I believe that is in::the file.
Mr. Mullen: There is a different figure in the covenants.
Mr. Raynor: There is an error based on:-,the computation. It is also
the same in the ZBA and I addressed that and Counselor will make the
correction tothe correct number.
Mr. Emilita: We have two Board's involved, the Zoning Board and the
Planning Board. At some point lead agency is going to have to be determined.
;-.hasn't been done yet, so we have not made
between the two Boards: That
a dtermination;-under SEQRA.
Mr. Ward: We did with the prior application. We did it with the residential
use.
Mr. Raynor: This has been through that process.
Mr. Ward: We can take lead agency, the worst is that there are two resolutions
on file.

agency under the State Environmental Quality Review Act for the site .

8:30 p.m. Ms:.Elizabeth Thompson, applicant, was present for an appointment
to discuss the proposal for Kings Bay Estates, located at Orient for
4 lots on 25 acres. This..appointment was made at the Board's request.
Mr. Ward: Next, we have Elizabeth Thompson who has scheduled an appointment
to discuss the King Bay Estatesat Orient. Is the--applicant here?
Ms. Thompson: Yes.
Mr. Ward: Goodevening. We were concerned in .looking at it and we asked
for building envelopes. If these were the envelopes then-we felt it
was too restrictive. What we are saying is we were looking to take the
upper acre.: If wei•were to.)take this and then noone could put a barn
in here. So what we were looking to do is, without forcing the cluster,
because we realize the integrity of this, would be in a sense we would
end up with the same. So, if you were to give us the building envelopes
as a one acre; it would mean that everything behind that line would be
were the development would be for houses, garages and barns.
The open space would really be open. So, if you are in agreement, we
can amend that and go from there.

Cove Beach Associates
Mr. Harold Reese had scheduled-'-an appointment to discuss the proposal
for the pending major subdivision at East Marion, formerly referred to
as Cove Beach Associates.

Mr. Ward: Mr. Reese has requested an appointment to discuss
the proposal for the pending major subdivision at East Marion-
formerly referred to as Cove Beach Associates.
Mr. Reese: We fairly recently came,-under contract this particular
property which . . . .(inaudible) We have a closing later on this
month. In going over the plan, the thing I have noticed,
of course I was not in any of the planing stages on this,
the total acreage is 96 acres of which about 32 acres, almost
1/3 is open space. It seems to,.-me, a little on the high side,
30% open space. Looking at the map, I think you have copies
of this map, as you come in there is a 20 acre tract. On
the left hand,,side -of.,.the turn in the road, you can see a
big open space tract there, 19. 5 acres and it fairly flat
and it would seem to me to make an ideal spot for three or
four 1 Z or/two acre plots for people who want horses or something
of this nature. But, again not being in on it in the beginning,
I guess I should start with the Planning Board, there would
be three or four additional lotson the road.
Mr. Ward: As applicant here, we have givenlit,.sketch approval
if you want to withdraw sketch and come back and with another
proposal, we have seen three or four proposals over the last
few years. I can understand. . .
Mr. Reese: I can understand, I realize I have come in on
the tail end- of this thing. I could do that if I had the
Board' s permission.
Mr. Ward: Sketch approval is not the tail end.
Mr. Reese: Well, as far as I am concerned.
Mr. Latham: All.. people; ever did with the property was buy and sell it.
Mr. Reese: Well, I thought .it. might interest the Board to
know we had this, 90% bought 22 years ago. And, it was snapped
out from under us. That is the reason I am so particularly
interested in it, I want to join you people in living out
here and I have a homesite picked out where I would like to
build myself and that is the .reason I longed for it and finally
I have it.

Mr.--Ward: Our input with the various -applicants that have
been before us that we were trying to get some open space
and cluster to a certain degree create the open space as a
buffer to the Dam Pond area and leave that as an open space,
so we were not disturbing what we felt were delightful wetlands.
That would also help maximum some of the lots on the Sound
and would provide open space where we felt it was signficant.
But actually this could be massaged different. ways depending
on the application.
Mr Reese: Alright, with the Board' s permission could I withdraw
that and then come in here,,:with another plan?
Mr. Ward: Sure. --- ---- -- ----- --- - - -- --- --- - ----- — -- -- - -- -
Mr. Reese: Is-. the Board in favor of raising the ratio .
of open space or lowering it.
Mr. Ward: We were more in favor of getting more open space
not less.
Mr. Reese: I understand the Board' s position of course, but
I would like to look at our position as well.
Mr. Ward: Why don' t you do a rough sketch on .it and come see
us with that.
Mr. Reese: The only change I would make is in that section,
twenty acres.
Mr. Latham: That is the old sand pit, isn' t it.
Mr. Reese: Yes. We have had several requests over the past
years from people who are interested in having,.-horses and
one acre is a little too small with two acres it may cater
to a small segment.
Mr. Ward: Why don' t you take 1/2 of it in open space, put
a barn up and fence it in.
Mr. Lessard: It may surprise you to know if it strictly no
residence on it, it would require 10 acres to put a horse
on it. I didn' t write this law, so don' t get mad at me.
But, that is what the Book says today.
Mr. Reese: You need 10 acres.
Mr. Lessard: For an open lot, yes.

Mr. Ward: If it is not a residential lot, if it is your open - -
space you would need 10 acres.
Mr. Lessard: Okay, but it also gives you the right to breed
those horses too. Okay, so it is a thought. To me, they did
an awful job and it should be modified but if the horse people
are happy, the politians are happy and I just enforce it.
Mr. Ward: Everybody is happy.
Mr. Lessard, No, I am not happy.
Mr. Latham: The other people adjoining you to the east, they
wanted to use your road. , I don' t think it is a good idea,myself,
becuae it is the only road for this whole thing.
Mr. Mullen: It is a heavy concentration.
Mr. Latham: In case something should happen. . . .
Mr. Mullen: Have them alerted to the situation.
Mr. Reese: They havenLt .approached me. �-
Mr. Latham: Nothing to d I o with your subdivsion.
Mr. Reese: No, they did .approach me and wanted to know when
we would start on this and I said probably in the spring,
and they said good and I ;am sure they want to tap in . for electricity.
I said I did'nt mind, but apparently that is what is holding
it up, they can' t get. electricity down there. Well, alright,
I thank the Board for listening to me.
Mr. Richard J. Cron, Esq. has scheduled an presubmission conference to
discuss the proposed site plan for Theodore Petikas for construction
of a restaurant/snack bar located at County Route 48, Greenport.
Mr. Ward: Next, we have Mr. Theodore Petikas and Mr. Rchard.;J. Cron
have scheduled a presubmission conference to discuss this site plan
for construction of a restaurant located at Greenport. Mr. Cron, isn't
this at the Zoning Board of Appeals.
Mr. Cron: A prior application -,is before the Board, but since that time
the submission before the Boardicovered the residential area, but the
amended application, new application deals with a much "smaller scaled
down type of facility. Since the residential area is only utilzed as
parking.

Mr. Ward: You are aware that our recommendation_:on -.the Master Plan is
to make this residential.
Mr. Cron: I am aware of your resolution on the prior application that
you would: have, because of what is recommended on the Master Plan, that
you wold have recommended denial. I am not certain that that is appropriate.
Now, wether that will be the same here, I don't know. In light of the
fact that it isa differnt application. But, in any event, we should
start somewhere. I am not certain that-' I need the ZBA on this application.
We have defined the commercial aspect of the premises.
Mr. Ward: With the parking, how far can you go into the residential
zone.
Mr. Cron: I don't think there is any prohibition of it at all.
Mr. Lessard: There is, it is not a permitted use. The only time it is
a permitted use is in-the A zone. If you want me to look it up I will.
Mr. Cron: Yes, I am curious.
Mr. Lessard: You will need a use variance in the A zone. Becasue, that
is not normally permitted in that zone.
Mr. Cron: Well, if I am forced to do it. Well, I guess there is one
way to find out, make an application to the Buil'dng Department for a
permit.
Mr. Lessard: Then I wil be sure to find it.
Mr. Ward: Is there a well on this site.
Mr. Cron: They have?public water, so water is really not a problem.
Mr. latham: Is this on Route 25, it says so on::the key map.
Mr. Cron: No, it is all on Route 48, look on the key map.
Mr. Lessard: Look at 100-12 I. I think that is what we are looking for.
Mr. Cron: Well, I assume I will be stimed by the Planning Baord as far
as site plan, so I will have to go to you and make my application for
the building permit.
Mr. lessard: Yes, and we will shake it out from there.

Mr. Richard Cron, Esq. questioned the Board with the regard to the procedure
for fiing minor subdivsion maps which was a requirement for this approved
minor subdivision at County Route 48. He statedcthat it is a major process
and questioned if:-iall minors would have to be filed. Mr Ward stated
that they would since that is the requirement of the CountyPlanning Commission
as well.
