The Southold Town Planning Board held a regular meeting on
Monday, October 6' , 1986 at the Southold Town Hall, Main Road,
Southold at 7: 30 p.m.
Present were:

Mr. Orlowski: F6r this public hearing we have proof of publication
in the Suffolk Times, signed by Carol Ann Sgoulata and notorized
by Mary Degnan, we have proof of publication in the Long Island
Traveler Watchman signed by Pat Wood and notorized by Barbara
Forbes. . I will dispense with the readingr3bf the metes and
bounds. Everything is in order at this time. I *ill ask if '
there are any objections to this minor subdiviison. Hearing
none. I will ask if there are any endorsements of this minor
subdivision. Hearing none are there anyone neither pro nor
con but with information pertaining to this map of interest
to the Board. None. Being no further comments, questions
from the Board, Mr. Mullen, none, Mr. Ward,none. Being no
further questions, I will declare this hearing closed and
thank you for coming down.

on the question of approval of the preliminary maps. for the
major subdivision of Homes Farms Estates located at Southold.

RESOLVED that the Southold Town Planning Board set Monday,
October 20 , 1986 at 7: 45 p.m. at the Southold Town Hall,

hearing on the question of approval of the preliminary maps
for the major subdivision to be known as "Charles Acres" located
at Peconic.

Thorton Smith - The Board reviewed this new proposal 6or 35
lots on 80 acres located at Sound Avenue, Mattituck. It was
the consensus of the Board to conduct aL field inspection
prior to any action or recommendations on the sketch map layout.

On a motion made by Mr. Mullen, seconded by Mr. Waf.d, it was
RESOLVED that the Southold Town Plannig Board declare themselves
lead agency under the State Ehrionmental Quality Review Act
for the major subdivision of Thorton Smith located at Mattituok.
An initial determination of non-significance has been made.

Frank Cichanowicz - The Board reviewed this new proposal for
71ots on 17 acres in the cluster concept located ate-Indian
Neck Lane, Peconic to bbeknown as "Wild Oats" . Mr. Henry
E. Raynor, Jr. , agent forrthe applicant was present for this
discussion. Mr. Ward noted that there may be a drainage problem
with Lot No. 7 since it is a low afea and may .flood. He was
concerned that the proper drainage be obtained. . Mr. Bryer
stated that the cluster computations were questionable and
he requested a yield map to prove the density. Mr. Ward suggested
that this prposal be referred to the Highway - Superintendent
for his review and comments with regard to the drainage. Mr.
Raynor stated that there was municiple drainage in the area
of Lot No. 7. He also stated that the Departmett of Public
Works installed a drainage structure under the road at that
area. Mr. Orlowski stated that this matter will be referred
to the Highway Superintendent since he has expertise in that
area. Mr. Raynor requested that the Board take action on
the sketch map conditioned upon those items discussed. Mr.
Orlowski stated that he would abstain from any action on this
proposal since he rents his farm from the applicanb. Since
there would be no quorom for a vote with Mr. Orlowski abstainizig,
this matter\gwill be held over until the information requested
is submitted.
Mr. Thomas J. Gorman was present for a presubmission conference
to discuss the site plan for Gorman Assoctidtes located at Love Lane and
County Route 48, Mattituck. Mr. Gorman explained that this
was a simple submission for an addition on the existingo-6 ffice
building. Mr. Gorman stated that they wanted to remove the
existing 12 'x 20 ' frame garage and in that area to place the
frame addition. The use will be the same, there will not
be any additional tenants of any kind. The existing business
is an appraisal business. The same curb cut from the County
Route will be used as access. The addition will be 25 ' x
25 ' so they willbbe addih4oanother 1500 square feet of building.
Mr. Bryerestated that the parking calculations indicated that
seven parking spaces will be required. Mr. Gorman stated
that it would not be a problem if additional parkingsspaces
are required. It was the consensus of the Board to conduct
a field inspection and advise the applicatts of their comments.

Elizabeth Thompson - The Board reviwed this new proposal for
4 lots:-on 23 . 4 acres located at King. Street, Orient. The
Board requested that contours be on'�:hhe ;survey.
On a motionamade by Mr. Ward, seconded by Mr. Mullen, it was
RESOLVED that the Southold Town Planning Board declare themselves
lead agency for the minor subdivision to be knowns as "Kings
Bay Estates" located at Oreint, under the State Environmental
Quality Review aCt. an initial determination of nonesignificance
has been made.

Margaret and Kenneth Strachan, Jr. - The Board r_ew.lewed this
proposal for 3 lots on 16. 4 acres located at King Street,
Orient. The Board noted that the applicant had revised the
plans as requested. Each lot proposed had enough buildab-fie
upland and the property was diked.

RESOLVED that the Southold Town Planning Board declare themselves
lead agency under the State Environmental Quality Review Act
for the proposal of Kenneth and Margaret Strachan located
at Orient. An initial determination of non-significance has
been made.

RESOLVED ghat the Southold Town Planning Board grant sketch
plan approval to the subdivision proposal of Margatet Strachan
and Kenneth. Strachan, Jr. for 3 lots on 16 . 4 acres located
at King Street, Orient, survey dated as amended September
22, 1986.

On a motion made by Mr. Mullen, seconded by Mr. Ward, it was
RESOLVED that the Southold Town Planning Baord refer the following
comment to the Board of Appeals with regard to the proposal
for Mr. George Damien to set off 12, 663 square feet from
28 , 919 square feet at New Suffolk:
1. This propsoal is not in�:coAformance with the two
acres zoning, therefore, the Planning Board cannot endorse
it.

On a motion made by Mr. Mullen, seconded by Mr. Ward, it was
RESOLVED that the Southold Town Planning Board refer the following
comment to the Board of Appeals with regard to the proposal
for 3 lots!-;on . 801 acres for Nick and Anna Paleos (Nickart
Realty)
1. The proposed lots are less than the required two-acre
zoning and they do not appear to have been merged.

Mr. Thomas Byrnes was present for a pre-submission conference
to discuss the site plan for the Village of Southold Shopping
Center located at County Route 48, Southold. Mr. Byrnes explained
that he would like to add an additon on the existing building
to provide five more retail stores, presently there are four.
Mr. Byrnes presented a rendering which the Board reviewed.
It was noted that he is doubling the site of the existing
retail building. It was noted that the addition would be
built on adjacent land owned by Mr. Byrnes which he would
merge to the existing lot. Mr. sByrnes stated that it would
be for retail use only. It was the consensus ;of`the Board
to make afield^inspection prior to any further recommendations
or action:on the site plan.
Community Christian Fellowship - The Board reviewed this amended
site plan for the parking area of the church. The Board had
previously approved the site plan for the new church located
at County Route 48, and Wickham Avenue, Mattituck. Following
the Board' s aproval, the applicant wished to re-locate the
parking area and entrance closer to the front -.of the building
instead of off tb the side. This amended site plan has been
certified by the Building Department. The Boar, &-,noted that
this a good move, however, requested that consideration be
given to a turnaround loop in the future.

RESOLVED that the Southold Town Planning Board approve the
amended site plan for the Community Christian Fellowshb
Church located at Mattituck to re-lcoate the parking area
and access, survey dated as amended September 24 , 1986.

RESOLVED that the Southold Town Planning Board declare themselves
lead agency under the StateeEnvironmental Quality Review Act
or the of-line change of William M. Witzke located at Laurel
Avenue, Southold. An initial determination of nonjsignificance
has been made.

following action was taken:
NEGATIVE DECLARATION
Pursuant to Article 8 of the Environmental Conservation
Law State Environmental Quality Review Act and 6NYCRR Part
617 , Section 617 . 10 and Chapter 44 of the Code of the Town
of Southold, notice is hereby given that Southold Town Planning
Board as lead agency for the action described below has determined
that the project will not have a significant effect on the
environment.
DESCRIPTION OF ACTION
The minor subdivision of William Witzke is for a lot line
change located at Laurel Avenue, Southola.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which indicated
that no significant adverse effects to the environment
were likely to occur should the project be implemented
as planned„
Because there U-has been no correspondence received from
the Suffolk County Department of Health Services in the
alotted time, it is assumed that there are no comments
or objections from thi t agency.

On a motion made by Mr. Ward, seconded by Mr. Mullen, it was
RESOLVED that the Southold Town Planning Board approve the
lot line change for William M. Witzki located at Laurel Avenue,
Southold, survey dated as amended March 21, 1986 subject to
the following:
1. The . 1019 acre,'.-of land of Witzke shall be conveyed
to the land of Joseph Poliwoda and merge with his land, not
to be considered a separate building lot.

On a motion made by Mr. Mullen, seconded by Mr. Ward, it was
RESOLVED that whereas a formal application for the approval
of a subdivision plat entitled "Leander Glover." located at
Cutchogue was submitted to the Planning Board on November
14, 1985 and filing fee of $450 was paid on November 20 , 1985
and,
WHEREAS, a public hearing was hel do said subdivisin application
and plat at the Town Hall, Southold, New York on.-September
15, 1986 at 7: 30 p.m. , and
WHEREAS, the requirements of the Subdivision Regulations of
the Town of Southold have been met by said subdivision plat
and application,
NOW, therefore, be it RESOLVED that the application of "Leander
Glover" for approval of said subdivision plat prepared by
Howard Young dated April 10 , 1986 be approved and the Chairman

following action was taken:
NEGATIVE DECLARATION

617, Section 617 . 10 and Chapter 44 of the Code of the Town
of Southold, notice is hereby given that Southold Town Planning
Board as lead agency for the action described below has determined
that the project will not have a significant effect on the
environment.
DESCRIPTION OF ACTION
The minor subdivision of Emilia Pike is- for a set off
of 40 , 000 square feet from 90, 382 square feet located at Main
Road, Mattituck, tax map no. 1000-. 40-3-26 .
The project has been determined not to have a significant
effect on the environment for the following reasons :
An environmental assessment has been submitted which indicated
that no significant adverse effects to the environment
were likely to occur should the project be implemented
as planned.
Because there has not been any correspondence from the
Suffolk County Department of Health Services, in the alotted
time, it is assumed that there are no objections or comments
from that agency.
Because there has not been any correspondence from the
NYS Department of Environmental Conservation in the alotted
time, it is assumed that there are no objections or comments
from that agency.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations.

On a motin made by Mr. Mullen, seconded by Mr. Ward, it was
RESOLVED that the Southold Town Planning Board approve the
set-off of Emilia Pike to set off 40 , 000 square feet ofrom
90, 382 square feet located at Main Road, Mattituck. Survey
dated as amended July 22, 1985. Subjec tto:
1. Article 6 approval pursuant to the Suffolk County
Department of Health Services
2. Review and consideration of comments from the Suffolk
County Planning Commission.
Vote of the Board : Ayes : Orlowski, Mullen, Ward
Proposed Town Zoning Code and Map - The Planning Board noted
that the Town Board had declared themselves lead agency under
the State Environmental Quality Review Act and were coordinating
under that process. It was also noted that the Suffolk County
Planning Commission has sent corresondence requesting additional
information prior to any review of the plan. They were requesting
a composite zoning map, a tabular summary indicating the areas
of the existing as opposed to the proposed. zoning� . the Planning
Board comments , and copy of the Master Plan updated and comprehensive
land use plan. The Board stated that with regard to the State
Environmental Quality Review Act, no response by the October
20 deadline indicates that they have no objections or comments
to this. Therefore, it was the consensus of the Board not
to transmit any correspondence on this matter. It was the consensus
of the Board to send correspondence with regard to the County
Planning Commission' s comments, to"'wit: either RPPW or Szepatowski
Assoicates should be hired :to address items No. Land 2 as
per the County' s request. With regard to item No. 4 of the
County' s correspondence, the Planning Board will forward a
Master Plan Update with compostie land use plan for their ,
review. The Planning Board felt that after many years of
work it is the finest plan that could be produced and recommends
that it be adopted.
On a motion made by Mr. Mullen, seconded by Mr. Ward, it was
RESOLVED that the Southold Town Planning Board grant a .90=day
extension for finalizing the site plan for "The Cove"located
at Southold pursuant to the request of the attorney for the
applicant in order that the Suffolk County Department of
Health Services approval may be :obtained.

Edward Dart -The Board reviewed correspondence from the applicant
with regard to the conditions on the subdivision. It was
noted.-that these conditions were recommended by the Suffolk
County Planning Commission, however, there was ,a condition
which contradicted agreements already imposed bythe Planning
Board. Mr. Cron, esq. requested that the Board override the
contradictory condition and amend the resolution accordingely.
This matter dealt specifically with the existing building
on the site and the fact that the� proposed 'lot line would:
go through the building. It was noted that the covenants
and restriction as per the Baord' s request with regard to
this building would be filed with the County Clerk, therefore,
they could amend the resolution accordingly. This matter
will be held over for the October 20 meeting since there were
only three members and to override the County Planning Commision,
a majority plus one is needed (4 members) .

RESOLVED that the Southold Town Planning Board declare themselves
lead agency under the State Environmental Quality Review Act
for the - set-off of Joseph and Ann Pacelli located at Southold.

ON a motion made by Mr. Ward, seconded by Mr. Mullen, the
following action was taken:

that no significant adverse effects to the environment
were likely to occur should the project be implemented
as planned.

time, it is assumed that there are no comments or objections
from that agency.
Because there has been no correspondence from the Suffolk

The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations .

On a motion made by Mr. Mullen, seconded by Mr. Ward, it was
RESOLVED that the Southold Town Planning Board approve the
set off of Joseph and Ann Pacelli located at North Bayview
Road, Southold to set off 22, 058 square feet from 39, 177
square feet, survey dated as amended September 12 , 1986.

On a motion made by Mr. Ward, seconded by Mr. Mullen, it was
RESOLVED that the Southold Town Planning Board refer to the
Southold Town Board the following recommendation with regard
to the Proposed Local Law in relation to Affordable Housing:
It was the Planning Board' s original recommendation on
the Affordable Housing District that Section 100-55. 7 C (2)
be. amended (50% ' of the units. to be affordable housing - not
the percentages as proposed) and the Board has not changed
their position on this.
The Board will forward a copy of prior correspondence on this
matter and a copy of their prior resolution (dated May 19 ,
1986) as well as, a copy of the memorandum of Szepatowski
Associates which also includes this recommendation.

On a motion made by Mr. Ward, seconded by Mr. Mullen, it was
RESOLVED that the Southold Town Planning Board refer the site
plan of Donald Grim for construction of a storage building
iocated at Oregon Road, Cutchogue to the Building Department
for certification. Site plan dated March 10 , 1986 . This
as received a special exception from the Board of Appeals.
It was noted that the Board would not take final action on
this site plan until the subdivision, which this lot is part
of, (Glover) is finalized.

On a motion made by Mr. Ward, seconded by Mr. Mullen, it was-
RESOLVED that the Southold Town Planning Board waive the requirement
for formal site plan review for the site plan of Charles Zahra located
at Mattituck, since this is a preexisting buildng and no site
improvements could be made at this time. If any physical
changes are made subsequent to this, however, it may need
formal site plan considerationand should be reviewed by the
Planning Board.

Winds Way Building Corp. — The Board reviewed this proposal
for 4 lots on Moore' s Lane (Linden Avenue) Cutchogue. Mrs.
Pat Moore, attorney for the applicant was present for this
review. Mr. Ward had questions onthe tie line for Downs Creek.
Mr. Ward also requested that each parcel contain the number
of acres of upland. versus wetland. Mrs. Moore indicated that
the applicant had the maps revised 'with everything that was
requested. Mr. Ward questioned how the Board would prove
the tie line is the property line. Mrs . Moore stated that
the applicant owns to the high water mark and that fluctuates.
Mr. Ward stated that if that is the case then the map is correct.
He noted, however, that in terms of lot computation, they
must show on the map and guarantee that each lot has 80, 000
square feet of upland.
On a motion made by Mr. Ward, seconded by Mr. Mullen, it was
RESOLVED that the Southold Town Planning Board approve the
sketch map for the minor subdivision of Winds Way Building
Corp. located at Linden Avenue, Cutchogue, survey dated as
amended October 1, 1986, tax map no . 1000-116-1-8 . , subject
to:
Amended surveys indicating the amount of upland versus
the amount of wetland on Lots 2, 3 , and 4.

Charles Simmons - Mr. Charles Simmons and Mrs. Abigail
Wickham, esq. were present to discuss the minor subdivision
of Mr. Simmons for 4 lots on 57. 7 acres at Laurel. Mrs. Wickham
explained to the Board that Mr. Simmons has recently closed
with the Town on the sale of development rights on 36 acres
of farmland on this site. This will prevent any further subdivision
of those 36 acres in perpetuity since the -propoerty is considered
sterile with no development rights. Mrs. Wickham questioned
the right-of-way and how this will affect the development.

to be filed for the right-of-way specifing the width of the
improvements and noting that it will never be widened. MRs.
Wickham wanted this in the deeds to maintain .a barrier between
the existing house and the right-of-way. She was concerned
because of the width of the right-of-way and even though it
would not be improved to the full width, everyone would have
access over it and in the future if it is not specified, the
lot owners may vote to have the buffer removed. Mr-. . Simmons
was not in favor of this happening and wanted to protect himself.
Mrs. Wickham also asked that it be noted on the map where
the improved right-of-way is as opposed to the entire right-of-way.
Mrs. Wickham stated that the applicant would not want' to convey
the lots without some agreement that they could not disturb
anything outside of the improved width of the righ-of-way.
Mr. Lessard stated that the approved right-of-way would have
to come from the Planning Board. Mrs. Wickham pointed out.
that the 280-a access width is 15 ' . Mrs. Wickham stated that
she would you stipulate the 15 ' improved width on the survey.
Mr. Orlowski stated that she could put covenants and restrictions
on the deeds for the sale of lots 1 and 2. Mrs. Wickham stated
that it could be a private covenant. .
On a motion made by Mr. Ward, seconded by Mr.Mullen, it was
RESOLVED that the Southold Town Planning Board approve the
sketch map for the minor subdivision of Charles P. Simmons
located at Sound Avenue, Mattituck .for 4 lots on 57. 7 acres,
survey dated as amende dAugust 20 , 1986 , tax map no 1000-112-1-8 ,
subject to:
1. Removal of the notation with regard to the covenants
from the subdivision map.
Vote of the Board : Ayes: Orlowski, Mullen, Ward
Mr. Mullen introduced discussion with regard to an article
from the Wall Street Journal with regard to fees to reduce
low cost housing.
The Planning Board will inspect the North Fork Bank prior
to the next meeting , regarding the issuance of a certificate
of occupany.

Being no further business to come before the Board, on a motion
made by Mr. Mullen, seconded by Mr. Ward and carried, the
meeting was adjourned at 8: 47 p.m.
