Jr. Member G. Ritchie Latham, Jr.. Member William F. Mullen,Jr. Member Richard G. Schultze 7 :30 p.m. Public hearing on the question of approval of the major subdivision to be known as Harbor .View located at Mattituck, 38 lots on 40 acres. Chairman: Good Evening. I would like to call this meeting to order. The first order of business is a public hearing on the final map of the major subdivision to be known as "Harbor View" located at Mattituck. This is 38 lots on 40 acres. We have proof of publication in the Suffolk Times signed by Joan Gustayson and notorized by Mary Deegnan and we have proof of publication in the Long Island Traveler Watchman. This is signed by Pat Wood and notorized by Barbara Forbes. I will dispense with the reading of the metes and bounds. If any body has any problems with that, would you . let me know (none) . This has been around for quite a while, believe, I think we have everything in the file that we now need. The file is about a foot and a half thick right now. And, at this time, I will ask if there any objections to this major subdivision? Hearing none. Any endorsements of this subdivision? Mr. Conforti: Good evening, Mr. Chairman, I am Mr. Conforti, the attorney for the applicant. I am not going to give long winded t Planning Board Page 2 June 9 , 1986 Mr. Conforti: endorsement. I 've been here for four years. Aside from my request to grant final approval to the map as filed, I would further request that the Board take into consideration waiving a park fee and taking the rights to lots 1 and 2 on the map, those are the areas that are set aside for the water treatment facility. I have nothing more to say on that. Mr. Orlowski: Okay. Mr. Conforti: Thank you. Mr. Orlowski: Are there any other endorsements of this subdivision? Hearing none. Is there anyone out there neither pro nor con but may have information pertaining to this subdivision that might be of interest to the Board? Mr. Suter: Mr. Chairman, my name is Martin Suter and I reside in Mattituck, I am a property owner adjoining this and I understand there is approval of a water system and I don' t know whether it is in this record or not, but in the Zoning Board of Appeals that adjoining property owners will have access to the water supply. I understand that will be part of your approval? Mr. Orlowski: Adjoining owners? Mr. Suter: They have consented to that before the Zoning Baord of Appeals, and they don' t have any thing in the record. And, I just want it on your record. Mr. Orlowski: Can you answer that? Mr. Conforti: May I address that Mr. Chairman. Mr. Orlowski: Adjoining owners will have access to the water supply system? Mr. Conforti: It is our intention after conveyance to the Homeowners Association to have the Homeowners Association offer membership to adjoining owners. At this point in time, we can' t hold it, otherwise it is going to determinably delay our prospectus with the Attorney General' s office. But, it is the intention of the homeowners association to offer membership to adjoining property owners for the purpose of hooking up to the water treatment system. We are asking thought, that that not be a condition of approval. Again, because, only because of the extra work that would be entailed with the Attorney General' s Office. Mr. Orlowski: Does anyone else have any information that they would like to share with the Board? Hearing none. ANy questions from the Board, Mr. Mullen (not at this time) ; Mr. Latham, . (no questions) ; Mr. Ward (no questions) ; Mr. Edwards; (none) ; Mr. Emilita? Mr. Emilita: Yes, Ben, with respect to the applicant' s just recently made request here, I would cauthion the Board against taking the Planning Board Page 3 June 9, 1986 Mr. Emilita: proposed Lots 1 and 2 for park and playground. This is a wter treatment plant, I don' t think want people, the public in general, children what have you in the vicinity of this operating treatment plant. I think this should be reserved for this purpose and if the subdivision itself cannot show a suitable park and playground area, then I would certainly expect that a contribution to the park fund be made. Mr. Orlowski: I think the Board would agree with you on that. The Town Board is looking for, has hired an appraiser to conduct an appraisal of the property and come up with a park and playground fee. Anyother questions? Okay. Being no further questions, I will declare this hearing closed and thank you for coming down. On a motion made by Mr. Edwards, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board set Monday, June 23 , 1986 at the Southold Town Hall at 7: 30 p.m. as the time and place for a public hearing on the question of approval of the minor subdivison for Alice Bergen located at Mattituck, 4 lots on 11 acres. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Edwards, Ward On a motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board set Monday, June 23, 1986 at the Southold Town Hall at 7: 45 p.m. as the time and place for a public hearing on the question of approval of the minor subdivision of Creative Ventures located at Main Road, Cutchogue for 3 lots on 8 acres. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Edwards, Ward Stanley Simicich - 4 lots on, 20 acres at Alvah' s Lane and Route 48, Cutchogue. The Board will set a field inspection on this proposal prior to any recommendation with regard to layout. On a motion made by Mr. Edwards, seconded by Mr. Mullen, it was RESOLVED THAT THE Southold Town Planning Board declare themselves Lead Agency under the State Environmental Quality Review Act for the minor subdivision of Stanley Simicich located at Alvah' s Lane and County Route 48, Cutchogue. An initial determination of non-significance has been made. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Edwards, Ward Planning Board Page 4 June 9, 1986 George and Marie Schade - 2 lots on 52, 984 square feet, located at Cedar Lane, Southold. Each lot in this proposed set-off will have 26, 492' square feet and an application will need to be made to the Zoning Board of Appeals for a ,variance on lot size. The Board will conduct a field inspection prior to any action or recommendation. Thomas Shalvey -. This proposal is to reseparate two merged lots located at Cases Road, Cutchogue. It appears the applicant bought both parcels and kept them in the same ownership, therefore, the merger law applies. The Board will make a field inspection prior to any further action or recommendatins. Kalaijan Plat - 2 lots on 3. 9 acres located at Bergen Avenue, Mattituck. The Board will conduct a field inspection prior to any action or recommendation. * * * * * * * * * * 7: 45 p.m. Public hearing on the question of approval on the amendment to the minor subdivision for Frank Stillo located at Orient. Chairman: The next order of business is a" public hearing on the question of approval of the amendment to the minor subdivision for Frank Stillo located at Orient. We have proof of publication inthe Long Island Traveler Watchman signed by Pat Woods and notorized by Barbara Forbes and we also have proof of publication in the Suffolk Times notorized by Joan Gustayson and signed by Mary Deegnan. Planning Board Page 5 June 9 , 1986 Bedell vineyards - The Board reviewed this site plan for construction of a winery located at Main Road,Cutchogue. . A special exception to permit a winery has been received from the Board of Appeals. Mr. Merlon Wiggin was present as the agent for this proposal. Mr. Ward suggested that drainage calculations be submitted and the ingress and egress be amended to be 20 ' .: Mr. Wiggin replyed that the drainage calculations have been submitted and the applicant was aware that the Board would like to see the ingress/ egress widened to 201 . On a motion made by Mr. Latham, seconded by Mr. Ward, it was RESOLVED that the Southold TownPlanning Board refer the site plan for Bedell Winery for the conversionof a barn to a winery located at Main Road, Cutchogue to the Building Department for certification, subject to: 1. Receipt of amended surveys indicating a 20 ' ingress and egress to the Main' Road. . Survey dated as amended March 19, 1986; tax map no. 1000-85-2-10. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Edwards, Ward Inspector' s Report Dated May 14, 1986 for Sundown Farms - The Chairman read the report as follows, to wit: "This section of the above propert line survey was re-eastablished today be Donack as requested by Mrs. B. Kujawski. The Donack plans dated 9/12/84 were used. Thoday' s survey was also witnessed by B. Kujawski, J. Stiefer and Mr. and Mrs. Sayre. Mrs. . Sayre has a property survey by Van Tuyl dated 2/26/85 that shows the traveled way all within that property and the 20ft. Right of Way. The Donack survey is considerably. different as to the location of the common property line in this area. R. Van Tuyl as requested by B. Kujasski, cam on the site in the P.M. after the Donack survey party had left. He brought a survey map dated 5/25/50 (Map of farm owned by Mary E. Hallock) which covers the same area now known as Sundown Frms. This map shows the north side of the peoperty along Sound Avenue (named North Road previously) at 505. 53 L.F. instead of 520. 32 ft. as shown by Donack, a difference of almost 15 ft. This lesser length accounts for some .of the differences inthe property lines (East side) at the Dantes and Sayre property as shown on the Van Tuyl and Donack maps. The correct length of the north side (along Sound avenue) for Sundown Farms should be determined. The lesser length, 505. 53 feet, would affect the total length of Sundown Farms (west side) for location, total acreage, etc. May 15, 1986 - R. Van Tuyl gave me a copy of the 1950 Hallock Farm map. Comparision of the two maps (Donack and Van Tuyl) show he difference in bearing and length at the north side, a small difference in bearing and length inthe last course (south end) of the east side and a difference in length of 16. 94 ft.. at the southwest corner at the south end of the property. Donack shows 90. 96 ft. , Van Tuyl 74. 02 ft. This Planning Board Page 6 June 9, 1986 Sundown Farms, cont. - compares more or less with the difference in length of the two sureys at the north end. All other. dimensions and bearings are the same. I reviewed the deeds from the Planning Board files, one for the Sundown Farms and one for Long No. 3. They both conform to the Donack survey throughout. Note: The length of 520. 30 ft. (Donack) for the subdivision length along Sound Avenue has been circled in the subdivision deed. Others may have found the discrepancy in the two surveys for that distance. I would recommend that nothing be done as to tupdaing the access to Sundown Farms until the status of the common property line has been resolved. " The Chairman noted that the Board will note take any action .until this matter is resolved. On a. motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board accept Inspector John W. Davis' memorandum dated May 14, 1986 with regard to the location of common north-south property line (Sundown Farms - West side) and the Dantes and Sayre property (East side_) , Sound Avenue, Laurel. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Edwards, Ward John and Catherine Simicich - Inspector' s Report No. 510 - The Chairman read the report of Inspector John W. Davis as follows, to wit: "Comments: 5/13/86 Made inspection of road beyond -first 600 L.F. (See report NO. 497) as follows: Distance from Cox Neck Road Depth of Surface Course Road Width 700 ft. 3" 16 ft. 800 ft. Jill 16 . ft± 900 ft. 12" 17 ft± 1000 ft. 2" 16 ft. 1100 ft. 22" 16 ft. 1200 ft. 3" 16 ft. ± 1250 ft. 12 16 ft. In addition to correcting the depth of the recycled concrete (3 areas as shown above) , there was . additional work to be done on the shoulders. 5/23/86 - I went over the road length with A. Foster and showed him where the additional work was required. He said he would make the corrections that day. Some additional top course material was stockpiled on the site. 5/27/86 - I inspected the access road today. The additional work has been done and I would recommend approval of the access road. John W. Davis. On a motion made by 'Mr Mullen, seconded by Mr. Ward, it was RESOLVED that ,The Southold Town Planning Board accept Inspector Planning Board Page 7 June 9 , 1986 John W. DAvis ' report NO. 510 regarding the final approval of the access road within the subdivision known as "John and Catherine Simicich" located at Mattituck. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Edwards, Ward Access road for Richard A. Foster subdvision - Report No. 509 - The chairman read the report from Inspector John W. Davis as follows, to wit: "The following is from inspection of the above access made on May 13 , 1986. Road width at 50 ft. intervals - Average 16 ft± for 275 L.F. Depth of bankrun after topsoil removal - Estimated at 16" . Depth of stone top course from paved shoulder at Middle Road to end (at 50 ft. intervals) : 3" 412 " 4Z1 " 4" 4" 312 " 22111 an average to say 3. 7"±. Contractor had delivery tickets for 3 loads of stone blend at 38 "tons each which amounts to 114 tons. This quanityt is in excess for the 212 top course as recommended. May 20, 1986 - the Small asphalt apron as called for at the entrance has not been placed. The stone course has been carried to the paved shoulder temporarily which makes the access usable at this time. The stone will be removed there is necessary when the 2" asphalt apron in installed. The road work excluding the apron is satisfactory and acceptable. John W. Davis" On a motion made by Mr Latham, seconded by Mr. Ward, it was RESOLVED that the Southold Town Planning Baord accept Inspector John. W. Davis' report N0. 509 with regard to the final inspection on the access road within the minor subdivisionof Richard A. Foster located at Peconic; subjec to ..the applicant advising the Town when the asphalt apron has been completed. Vote of the Board: Ayes : Orlowski, Mullen, Latham, Edwards, Ward On a motion made by Mr. Ward, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board approve the set-off of C. Bruce and Anne Stai er to set-off 23, 518 square feet, from 46, 293 square feet as shown on the Van Tuyl survey dated August 21, 1985. Property is located at Wells Road, Peconic, tax map number 100-86-2-4 and 5. This property received a variance from the Board .of Appeals. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Edwards, Ward 8: 00 p.m. Public Hearing on the question of approval of the minor subdivisionfor Sunbow Associates located at MainRoad, Mattituck for 4 lot son 4 acres in the Bl zone. Must be somebody that came here. * * * * * * * * * * Ram Realty - The Board reviewed this amended subdivision map for 4 lots on 9 acres located at Platt Road, Orient. Mr.James Heffron, attorney for the applicant was present. The Chairman brought the Board up to date on the status of the property. The Chairman noted that this was approved as 4 lots on 9 . 1 acres in 1973, and in 1984 it was revised to three lots and approved under the name of Strong and the current proposal is. for 4 lots on 9. 1 acres. The first proposal under Ram Realty was for flag lots, however, at the Board' s request, this has been amended to a 50 ' right -of -way. At this point in time, the Board is considering the third subdivision on the same parcel of property. The Chairman stated that the applicant is going to have to withdraw the previous applications and subdivision maps. On a motion made byMr. Latham, seconded by Mr.. Mullen, it was RESOLVED that the Southold Town Planning Board grant sketch plan approval tothe minor subdivision amendement for MacKenzie, Ram Realty, and Peluso located at Platt Road, Orient for 4 lots on 9. 1 acres, survey dated as amended December 18, 1985 showing a 50 ' right-of-way subject to: 1. Written withdrawal of the previous . subdivision maps. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Edwards, Ward Mr. Heffron, representing the applicant as attorney stated that he is authorized to make representation that the previous application is withdrawn. The applicant' s would like to proceed on the amended maps, with the 50 ' right-of-way. The Chairman acknowledged this and requested the withdrawal be in writing for the file. Planning Board Page 9 June 9, 1986 Kapell Real Estate and Limpet Corp. - The Board reviewed this set-off located at Linnett and Brown Streets, Greenport. This proposal was also .pending before the Board of Appeals for a variance on the lot size. On a motion made by Mr.Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold TownPlanning Board refer the following comments to the Board of Appeals with regard to the proposed set off for Kapell Real Estate and Limpet Corp. located at Linnett and Brown Streets, Greenport: 1. It appears that the lots have become merged, however, the Planing Board cannot endorse this set-off since the lots are less. than the 80, 000 square foot requirement. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Edwards, Ward On amotion made by Mr. Mullen, seconded by. Mr. Ward, it was RESOLVED that the Southold Town Planning Board declare themselves lead agency under the State Environmental Quality Review Act for the major subdivision of Long Pond Estates, Section II located at Laurel Avenue, Southold. An initial determination of non- significance has been made. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Edwards, Ward On a motion made by Mr. Ward, seconded byMr. Latham, it was RESOLVED that the Southold Town Planning Board approve the sketch map -of Long Pond Estates, Section II located at Laurel Avenue, Southold for. 13 lots on 29. 87 acres in the cluster concept, survey dated as revised April 18, 1986. , tax map no. 1000-56-1-2. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Edwards, Ward San Simeon Retirement Community - The Planning Board reviewed this site plan for an adult community located at Chapel Lane, Greenport. The plan had been reviewed with Mr. Lessard and Mr. Bryer and all was found to be in order. ON a motion made by Mr. Ward, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board approve the site plan of the San Simeon Retirement Community located at Chapel Lane, Greenport for construction of 144 dwelling units, survey dated as revised January 8, 1986 with the following supplemental plans: Surveys from H2M dated March, May, and September 1984. Tax map no. 1000-45-2-10. 1 It was noted that this plan has received certification by the Building Department. Vote of the Board: Ayes: Orlowski; Mullen, Latham, Edwards, Ward Planning Board Page 10 June 9, 1986 Henry Appel - The Board reviewed this proposal for a subdivision located at Ole' Jule Lane and New Suffolk Avenue, Mattituck. There had been two plans submitted to the Board a cluster subdivision and a conventional subdivision. Upon a field inspection, the Board preferred the cluster layout with seven lots, leaving open space in the rear. On a motion made by Mr. Edwards, seconded by Mr. Latham, it was RESOLVED that the- Southold Town Planning Board declare themselves lead agency under the State Environmental Quality Review Act for the cluster major subdivision of Henry Appel located at .Mattituck, an initial determination of non-significance has. been made. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Edwards, Ward On a motion made by Mr. Latham, seconded byMr. Ward, it was RESOLVED that the Southold Town Planning Board approve the sketch map of the major subdivision of Henry Appel located at Ole Jule Lane and. New Suffolk Avenue, Mattituck for 7 lots on 15. 3 acres in the cluster concept. Survey dated July 1.8:, 1986 (Plan "B") , tax map no. 1000-114-12-14. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Edwards, Ward Larry and Violet Tuminello' - The Board reviewed this site plan for a restaurant located at Main Road, Southold. It was noted that construction is complete and the. applicants were requesting a certificate of. occupancy. Mr. Ward stated that upon a field inspection, he noticed that the asphalt pavement was still in front of the premises and this was to be removed . since there was to be no parking in front. Mr. Ward also stated that the landscaping should be addressed. On a motion made by Mr. Ward, seconded by Mr. Mullen, it was RESOLVED that. the Southold Town Planning Board, having made a field inspection of thesite recommend to the Building Departtment that a certificate .of occupancy be issued for the restaurant of Larry and. Violet Tuminello located at Main Road, Arshamomaque subject to: 1. Removing the existing ashpalt in front of the building prior to opening. 2. Completing the required landscaping, subject to a six - month review. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Edwards, Ward Planning Board Page 11 June 9 , 1986 280 North Road - Mr. John Tsunis, esq and Mr. Robert Gruber, architect have scheduled an appointment to discuss this site plan (formerlly Greenport Mall) for construction of offices . and .retail stores located at Greenport. Mr. Tsunis and Mr. Gruber were present. Mr. Tsunis stated that this is a new site plan since the previous meeting with the Board. There have been three previous meetings and at the last discussion they have included the Board' s recommendations for a sidewalk to the rear of the building, additional landscaping, moving the building further towards the street, . away from the residential area, and they eliminated the residential area landscaping pursuant to the plan. Mr. Gruber stated that this plan incorporates every recommendation of the Planning Board. On a motion made by Mr. Mullen, seconded by Mr. Ward, it was RESOLVED that the Southold Town Planning Board refer the site plan of 280 North Raod, Greenport, for the construction of an office and retail store complex, at County Route 48, " to the Building Department for certification." Survey dated April 23 , 1986. Vote of the Board: Ayes: Orlowski, Mullen, Latham,. Edwards, Ward ON a motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board. declare. themselves lead agency under the State Environmental .Quality Review Act for the set-off of Gretchen Heigl located at Sound View Avenue, Southold. An initial determination of non-significance has been made: Vote of the Board: Ayes: Orlowski, Mullen, Latham, Edwards,Ward On a motion made by Mr. Mullen, seconded by Mr. Latham, the following action was taken: NEGATIVE DECLARATION Pursuant to Article 8 of the. Environmental Conservation Law State Environmental Quality Review, Act and 6NYCRR Part 617, Section 617. 10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that Southold Town Planning Board as lead ".agency for the action described below has determined that the project will not have a significant effect on the environment. DESCRIPTION OF ACTION The minor subdivision of Gretchen Heigl is a set off of 65 , 000 square feet from 3. 24 acres located at Soundview Avenue, Southold. Tax Map NO. 1000-68-1-14. Planning Board Page 12 June 9 , 1986 The project has been determined not to have a significant effect on the environment for the following reasons : An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. The Suffolk County Department of Health Services has no objection to our designation of lead agency. There is no record of an app- lication to the Health Department. The Suffolk County Department of Health Services requires an application prior to reivew. The proposed action appears to conform to the minimum lot size requirement of Suffolk County Sanitary Code (Article 6) . Test hole and test well data is required by the Health Department prior to further review. Because there has been no correspondence from the Department of Environmental Conservation n the alotted time, it is assumed that there are no comments nor objections from that agency. The project will meet all the requirements of the Code of the Town of Southold Subdivision of Land Regulations. Further information can be obtained by contacting Diane M. Schultze, Secretary Southold Town Planning Board, Main Road, Southold, New York, 11971. Vote of the Board: Ayes : Orlowski, Mullen, Latham, Edwards, Ward On a motion made by Mr. Ward, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planing Board approve the set off of Gretchen Heigl located at Soundview Avenue, Southold to set off 65, 000 square feet from 3. 24 acres, survey dated July 25, 1985, tax map no. 1000-68-1-14, subject to: 1. Approval of the water and sewer by the Suffolk County Department of Health SErvices pursuant to Article 6 . 2. Review and consideration of comments from the Suffolk County Planning Commission. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Edwards, Ward Emil Conklin Estate - The Board reviewed this proposal for 4 lots on 7. 785 located at County Route 48, Greenport.. The Planning Board held a public hearing on this matter. While the applicant had received Article 6 approval, it was the consensus of the Board to hold action until a contract had been obtained from the Village of Greenport since public water was proposed. Planning Board Page 13 June 9, 1986 N. Charles DeLuca - The Board reviewed this subdivision proposal for 4 lots on 10. 38 acres at Main Road, Southold, following a public hearing. It was noted that although the. subdivision received Article 6, there was no signed contract from the Village of Greenport since the subdivison would have public water. The Board also noted that there was no provision in the covenants and restrictions for no further subdivision of Lot No. 1 inperpetuity. The Board requested that the covenants and restrictions be amended to include this provision. The Board had held a public hearing on this matter and was in the 45 day time frame for action. On a motion made by Mr. Ward, seconded by Mr. Latham, it was RESOVLED that the Southold Town Planning Board grant a 90-day extension on the final action on the minor subdivision map for N. Charles DeLuca subject to receipt of request of same. from applicant, in order that the contract from the village of Greenport for the water and sewer may be secured and the declaration of covenants amended in accordance with the Planning Board' s request. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Edwards, Ward Pindar Vineyards - The Board made a field inspection of this site located at Main Road, Peconic. This site plan is for renovation of an existing barn into a winery. The Board was in receipt of amended surveys indicating all the changes requested. Mr. Harold Halperin, esq. was present. Mr. Halperin stated that the applicant was willing to comply with all .the requirements of the Board following the field review. However, Mr. Halperin requested that the Board re-consider the actual paving and the widening of the access roads. Mr. Halperin stated that his client felt that both of these items would affect the aesthetic impact of the area. Mr. Halperin stated that they would not like Pindar Vineyards to look like the Long Island Expressway or a shopping mall or a commercial enterprise. Mr. Halperin requested the option in lieu of asphalt paving to use stone through out and with respect to the widening of the road from 15 to 20 feet that this be re-considered. Mr. Halperin stated that the road widening would mean loosing, considerable landscape area. Mr. Orlowski noted that the amended site plan shows a 20 foot ingress and egress which conforms to the Board' s request. It was the Board' s opinion that widening the roads and asphalt would be an important feature due to the amount of traffic entering the site. On a motion made by Mr. Ward, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board approve the site plan for Pindar Vineyards for a winery located at Main Road, Peconic, survey dated as amended May 28 , 1986, subject to: 1. Receipt of amended surveys indicating the asphalt pavement in accordance with the Town of Southold Highway Specifications and the elimination of parking stall Number 25. Planning Board Page 14 June 9, 1986 Vote of the Board: Ayes: Orlowski, Mullen, Latham, Edwards, Ward Francis and Patricia O'Malley - The Board reviewed this subdivision for 20 lots on 50 acres located at Laurel Avenue, Southold. Mr. Howard Young, surveyor, was, .present as agent for the O'Malleys. The Board discussed with Mr. Young relocating the proposed road slightly to the South. Mr. Young agreed to doing this if the Board would lay some guidelines for him. On a motion made by Mr. Latham, seconded by Mr. Ward, it was RESOLVED that the Southold Town Planning Board approve the sketch map for the major subdivision of Francis and Patricia O'Malley located at Laurel Avenue, Southold for 20 lots on 50 acres in the cluster concept, survey dated as amended April 9, 1986, tax map no. 1000-55-6-35 and 36 and 1000-56-1-1, subject to . 1. Relocation of the access road. Vote of the Board: Ayes : Orlowski, Mullen, Latham, Edwards, Ward On a motion made by Mr. Ward, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning. Board approve the site plan of Sterling Idea Ventures for construction of an office/ retail complex located at Main Road, Mattituck survey dated as amended 5/16/86, tax map no. 1000-122-6-31, subject to: 1. Inclusion of the landscape plan on the site plan 2. Inclusion of the roof drainage calculations on the. site plan. Vote of .the Board: Ayes : Orlowski, Mullen, Latham, Edwards, Ward Marina Bay Club - The Board reviewed this site plan to make a determination under the STate Environmental Quality Review .Act. Mr. Emilita, Town Planner, stated that based upon the site plan information that was submitted and the Part I of the Long Environmental Assessment Form, he has completed a Part .II and Part III. Mr. Emilita that the recommendation was a positive declaration to request a Draft Environmental Impact Statemetn. On a. motion made by Mr. Ward, seconded by Mr. Latham, the following action was taken: WHEREAS, Richard Carr has hereto fore applied to the Southold Town Planning Board for a site plan for construction of a marinea with retail store, restaurant, post office, boat storage and docking Planning Board Page 15 June 9, 1986 facilities, located at main Street, New Suffolk and known as "Marina Bay Club" NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. That pursuant to the provisions of Article 8 of the ENvironmental Conservation Law, Part 617 of Title 6 of the New York States Code Rules and Regulations, and Chapter 44 of the- Southold Town Code, the Southold Town Planning Board, as lead agency, does hereby determine that the action proposed is a Type I action and is likely to have a significant effect on the environment. 2. That the Planning Board shall file and circulate such determination as required by the aforementioned law, rules and code. 3. That the Planning Board immediately notify the applicant, Richard Carr, of this determination, and further request said applicant to prepare a Draft Environmental Impact Statement in accordance with the scope and contents required by the Planning Board and Town Planner, all in accordance with said law, rules and code. Vote of the Board: Ayes : Orlowski, Mullen, Latham, Edwards, Ward Discussion was introduced by Mr. William F. Mullen, Jr. , regarding Main Street Market located at Main Road, Southold.. Mr. Mullen stated that there is a serious traffic problem with cars exiting out of the one-way entrance. On one occasion Mr. Mullen counted 17 cars exiting in this manner. Mr. Mullen suggested that a fence be put up so that only one car can be in the driveway at one time. This way a car could not exit when one was entering. It was noted that there is a one-way only sign which is very small and not easily. seen.. Mr. Mullen stated that they have marked out the parking stalls, however, he felt that there would be a serious accident if the ingress and egress was not clearly marked. Mr. Lessard suggested moving the ingress as far to the East as possible so that people walking out of the building were not in the way of on-coming cars. Mr.Mullen stated that it might be an inconvenience to move the ingress since most of the customers are elderly. Mr. Orlowski recommended putting a fence up. from the building easterly to cut down the size of the ingress to allow for only one -car. Mr. Lessard stated that he will suggest this to Mr. Malinowski, the owner and he felt that there would not be a problem with it. Mr. Mullen discussed police enforcement. Mr. Lessard stated that there would have to be a resolutin of the Town Board because it is private property. This matter was discussed in a Planning Board resolution of September 1984. Correspondence was sent to Mr.. Maiinowski in May 1986 noting that the conditions of the September 1984 resolution were not met and the Board requested compliance prior to July 4, 1986. Melissa, who is a student at the University of Rhode Island getting a degree in Planning, will be helping in the Planning Board office for the summer.
