Mullen, Jr. Member G. Ritchie Latham, Jr. Member Richard Ward Town Planner Valerie Scopaz Executive Administrator Victor Lessard Secretary Diane M. Schultze Absent: Kenneth Edwards - leaving for Germany on vacation. 7 : 30 p.m. Public hearing on the question of approval of the final maps for the major subdivision of Edward and Charles Nalbantian, to be known as "Oregon Heights" located at Mattituck. 6 lots on 12 acres, SCTM="# 1000-99-3-12; 1000-100-1-21. 1; 1000-99-3-21. Mr. Orlowski: Good Evening, I wot1dllike to call this meeting to order. The first :orddr of business is a public hearing on the question of approval of the final maps for the major subdivision of Edward and Charles Nalbantian to .be known as "Oregon Heights" located at Mattituck, Everything is in order in the file. We have proof of publication inthe Suffolk Times" signed by Christina Contento and notorized by Mary Deegnan. We have proof of publication in the Long Island Traveler Watchman signed by Pat Woods and notorized by Barbara Forbes. As I said, everything at this time is in order. Aret'.there any objections to this major subdivision? Hearing none. Are,:there any endorsements to this major subdivision? Mr. William A,;,:.Sulahian: I would like the record to reflect that I appeared for the petitioners or applicants. My name is William A. Sulahian. I am an attorney and appear for the petitioners. Mullen, none; Mr. Latham, none; Mr. Ward, none; Ms. Scopaz, none. Being no. further questins, I will declare this hearing closed and thank you for coming. Mr. Sulahian : Mr. Chairman, maJy I just clarify one point. I don-Lt know if the record reflects it but I understand Mr Edward. Nalbantian has been incontact with the Board or with the secretary, Miss Schultze, about the bond, performance bond, which vasthhe subject matter of your letter of September 11, 1987 and has made arraggements in-lieu of the bond to post an actual letter of credit. Has worked that our with Mr. Rober Angig of the North Fork Bank and that should be in place at the appropriate time. Mr. Orlowski: That is fine. We will take a letter of credit any day. (see below for further discussion) ON a motion made by Mr. Latham, seconded by Mr. Mullen, it was RESOLVED that thecSoutholddTown Planning Bayard set Monday, October 19, 1987 at the Southold Town Hall,Main Road, Southold, at 7 : 30 p.m. as the time and peace for the next regular Planning Board meeting. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward On a motion made by Mr. Mullen„ seconded by Mr. Ward, it was RESOLVED that the Southold Town Planning Board accept the minutes of the regular meeting of Septemer 14, 1987. Vote of the Board: Ayes : Orlowski, Mullen, Latham, Ward Nalbantian� - Mr. Ward brought up further dmscussin on this subdivision which was the matter of a public hearing. He questioned the items requirdd by the Highway Superintendent; specifically if burbs and drainage had been requested. It was noted that the Highway Superintendent requested drainage which had been indicated on the bond estimate. It was also stated that this subdivision should be referred. to thb Fire Commissioners if has not already been for location of a fire well. if needed in this area. Vervenoitis/Pflevritis - SCTM # 1000-54-3-21.. 1. The Board reviewed this proposal at Horton' s Lane and Old North Rd. , Southold Planning Board Page 3 9/28/87 Vernenoitis, Cont. It was noted that the previous sketch plan approval had expired while the::;applicant was pursuing Article 6 approval with the County HealthDDepartment. In review of the file, the first sketch approval was issued in1--.1983 and re-affirmed again in 1986 . Mr. Ward suggested that this proposal be clustered with the douses off the corner. It was felt that since the proposal was before the Board previously and the lots were large, 4 lotsson 12 'acres, that they would agree to the present proposed :layout withaa stipulation that the driveways -for the lots be situated away from the intersection of Old North Road and Horton' s Lane, and-- the appropriate land be taken at that corner for highway purposes to facilitate better alignment. On a motion made by Mr. Ward, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planiipg Board approve the sketch map for-,-the minor subdivision of Vervenoitis, Plevritis, and Yianourakis locatedcat Southold, SCTM #1000-54-3-21, survey dated as amended March919 , 1987; for 4 lots on 12 acres; subject -.to: 1. The driveway:--,on Lot #4 shall be situated as far from the intersection of Old North Road and Horton' s Lane as possible for traffic safety. 2. That a �Iarge radius curve at the intersection of Old North Road and Horton' s Lane ..be provided for dedication to the Town for Highway Purposes to facilitate better alignment of the intersection. Vote of the Board: Ayes : Orlowski, Mullen, Latham, Ward ON a motion made by Mr. Ward, seconded by Mr. Mullen, it was RESOLVED that the Southold Town PlanningBoard authorize. the Chairman to endores.-thesurveys for the minor subdivison known as Cranberry Acres, SCTM # 1000-89-4-1, 2, 3 , 4; survey dated as amended December 31, 1985. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward Harbor Light, Section 4 - SCTM # 1000-79-4-17. 1 - 17. 9. The Board reviewed this subdivision and letter of credit which is due to expire onoOctober:_l, 1987. It was noted that due to the fact that some of the work required in the bond estimate was not complied with some corrective work as per the Engineering Consultants would be necessary. Ms. Scopaz stated that it should be brought to the attention of Mr. Reese, the developer that the letter of credit is to include Planning Board Page 4 9/28/87 this correttirvewvokk. On a motion made by Mr.Mul{len, seconded by Mr. Ward, it was RESOLVED that the- Southold Town Planning Board recommend to the Town Board thatathe letter .of credit for Harbor Lights, Section 4 be extended for a one-year period to expire on October 1, 1988. SCTM # 1000-79-4-17. 1 - 17. 9 Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward On a motion made by Mr. Mullen, seconded by Mr; Latham, it was was RESOLVED that the Southold Town Planning Board, following a field inspection, recommendato the Building Department that a certificate of occupancy be issued for the site plan for Gary Flanner Olsen located at Cutchogue, SCTM # 1000-97-5-4. 4, subject to a ene-year review. Vote of: the Board: Ayes : Orlowski, Mullen, Latham, Ward On a motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board, following:ia fielddinspection, recommend totthe Building Department that a Certificate of occupancy be issued for:_-the site plan of Mattituck Holding Co. , locatedc?at Mattituck, SCTM # 1000-�06-6-p/o 13. 3 subject to a one-year review. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward North Fork County ClIub - Mr. Lessard questioned if the Beard had re-inspected this site plan at Main Road, Cutchog.ue. It was noted that the Board had previously inspected this site and conditioned the recommendationoon an additional 6•momtEh review. Mr. Orlowski stated that he had been a.t the site, however, asked Mr. Lessard if he would advise the Board when the remaining improvements have been complied with for an additional inspection. Mr. Lessard stated that he would, with-"---the Planner, Ms. Scopaz . * * * * * * * * * * Pudge Corp. - The Board reVx6wed this revised site plan for mini-storage buildings at Horton' s Lane, Southold. Mr. William F. Mullen, Jr. abstained from any discussion since the applicant was a client of his. The Board noted that the revised plan is all in order. " for construction of five (5)- mini-storage buildings located at Horton' s Lane, Southold, SCTM# 1000-63-1-p/o, 10 , survey dated as amended September 1, 1987 subject to: 1. Anyirevisions or modifications to the drainage as may be recommended by the Town Engineering Consultant. 2. A fire hydrant which may be requestdd;by the SouthoIdSEihe District. 3. Street trees to be plantdd where noted with a 22 " - 3" minimum caliper as per the Town Highway Speditications. 4. All conditions- of Board of Appeals approval of Sept. 10 , 1987 Vote of the Board: Ayes : Orlowski, Mullen, Latham, Ward On a motion made by Mr. Ward, seconded by Mr. Mullen, �t was RESOLVED that the Southold Town Planning Board grant sketch plan approval to the minor subdivision of Eugene and Juliana Davison located at Laurel, to beeknown as "Strawberry Fields" , SCTM# 1000-121-3-5; for 4 lots on 12 acres; survey dated l/7/86. Vote of the Board: Ayes : Orlowski, Mullen, Latham, Ward On a motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board set Monday, October 19, 1987 at 7: 30 p.m. at the Southold Town Hall, Main Road, Southold, NY 11971 as the time and place for a public hearing on the question of approval of the minor subdivision for Eugene and Juliana Davison located at Mattituck, SCTM # 1000-121-3-5. Vote of the Board: Ayes : Orlowski, Mullen, Latham, Ward On a motionr,made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board grant a six-month extension on filing the final- subdivision mapl"for the manor subdivision of Petrol Stations located at Cutchogue, SCTM # 1000-109-1-23 . Said extension is pursuant to the requett of the attorney for the«applicant in order that Article 6 approval inay be pursued, and will expire on March 28, 1897. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward Planning Board Page 6 9/28/87 Arthur Junege - The Board reviewed this change of zone proposal as per the request of the Town Board for recommendation. Thecchange of zone is from A to C located at County Route 48 , Cutchogue, SCTM # 1000-96-1-19. The Town Planner recommended that the applicant be asked toccome to the next Planning Board meeting in orddr to explain the use proposed for the site and the reason for the request for the chaxn(ge of zone. The Board agreed that this would be a good procedure and suggested that this procedure be established for all proposals for change of zone prior to recommendations to the Town Board. It was the consensus that Mr. Junge will be contacted to attend the next regular Planning Board meeting to explain his proposal. Raeburn/Murphy - The Board reviewed this minor subdivision located at Cutchogue, SCTM # 1000-7372-2, 3. It was noted that the Town Attorney, Francis Yakaboski, had been in contact with teh attorney forlt,Mrs. Beckyvaohnston, Mr. Michael Hall. Mr. Hall stated that he had received a signed agreement for right-of-way over land of Bokina for Mrs. Johnston so that there was legal access to that lot and the parcel would not be landlocked. Based upon this information, Mr. Yakaboski recommended that the Board proceed with endorsement of the approved minor subdivision map as submitted since access would not have to be indiated on this survey to the Johnston lot. Mr. Yakaboski also recommended that the Board override any previous conditions which stated that access would have to be ppovided over the Raeburn/ Murphy subdivision for access to teh Johnston lot. Vote of the Board: Ayes : Orlowski, Mullen, Latham, Ward On a motion, made by mr. Ward, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board authorize the Chaitman to endorse the minor subdivision of Raeburn/Murphy, survey dated as amended Sepbember 26, 1987 received by the Planning Board on August LTD, 1987; subject to receipt of borrespondence from Michael Hall, as attorney for Becky Johnston, indicating the status of the right-of-way agreement from Bokina as--required by Section 280-a of Town Law, as pel the Vote of the Board: Ayes : Orlowski, Mullen, Latham, Ward PlanningBBoard page 7 9/28/87 Being no further business to come- before the Boara,00n a motion made by Mr. Mullen, seconded by Mr. ]Latham, and carried, the meeting was adjoined at 8: 00 p.m. Respectfully submitted, Diane M.
