Present were: Chairman Benentt Orlowski, Jr. Member William F. Mullen,Jr. Member G. Rithie�.:Latham, Jr. Membeh Kenneth Edwards Member Richard G. Ward Town Planner Valerie Scopaz Executive Administrator Victor Lessard Secretary Diane M. Schultze 7 : 30 p.m. Public hearing on the questiono.;of approval of the minor subdivision of Stanlye and Helen Simchick located at County Route 48, and Alvah' s Lane, Cutchogue, SCTM # 1000-101-1-19. Mr. Orlowski: Good evening. I would like to call this meeting to order. The first order of business is ai0public hearing on the question of approval of the minor subdivision of Stanley and Helen Simchick located at County Route 48 and Alvah' s Lane, Cutchogue, We have proof of pubication in the Suffolk Times, signed by Gerry P.agliano and notorized by Mary Deegnan, we have proof of publication in the Long Island Traveler Watchman signed by Pat Woods and notorized by Barbara Forbes. At this time, everything is in order for a hearing. I_..will stated that I am a relative of the applicant and I will abstain from any comment in this hearing process. I will ask if there are any objections to this minor subdivision? Hearing none. Are there any endorsements of this minor subdivisions? Mr. Lark: Richard Lark, Main Road, Cutchogue, Suffolk. I represent both Mr. and Mrs. Simchick who are here tonight to answer any quesions of the Board. I think any questions that the Board had before, we have squaredi.away with the revised map and as you can see, it has been square for the Article6 process and You have a mapu.that has been stamped. Hearing none, is there anyone out there neither pro nor con but may have information pertaining to this subdivision that may be of interest to the Board? Hearing none. Any questions from the Board, Mr. Mullen, none; Mr. Latham,none; Mr. Ward, none; Mr. Edwrards, none; Ms. Scopaz , none. Okay, being no further questions, I will declare this hearing closed and thank you for coming. 7: 45 p.m. Public hearing on the question of approval of the minor subdivision of David Wilmerding for 4 lots on 12. 79 acres at Fishers Island, SCTM # 1000-9�.19r2and 3 . Mr. Orlowski: Okay, next order of business is a public hearing on the question of, approval of the minor subdivision of David Wilmerding for 4 lots on 12. 79 acres at Fishers Island. We have proof of pubiicatin in the Suffolk Times, signed by Gerry Pagliano and notorized by Mary Deegnan, we have proof of publication in the Long Island Traveler Watchman signed by Pat Woods and notorized by Barbara Forbes, we have proof of publication in the New London Day signed by Gail Zulinsky and notorized by Beverly Prescott. At this time, everything is in,,-)order for a public hearing and I will aksiif�:therez:are any obejctions hearing none, are there any endorsementsoof this subdivision. Mr. Lark: Richard Lark, Cutchogue, for the applicant. I believe that all the comments of the Planning Board in the planning process have been taken dare o )(".the-,-:various letters:�trhat haves-ensued over the last couple of months have been done and this has cleared and has cleared Article 6 approval. The only remaining item of business is to address any items that it might have for the Suffolk County Planning Commission which it made on April 1, 1987,renderedosoine comments, 3 of them to be precise. The first comment indicates`:that: th6y don' t indicate where the property is. And, I submit to you they have not seen it nor has any member of their staff seen it because the comment makes no sense when they say it is a landlocked piece. The Boardtifully well knows, who has inspected the property, that there has been existing rights-of-way to Equestrian Avenue, which is a public road and it terminates off site and the rights-o€=way are provided for with an established road, so. I don' t know how to address when the Planning Commission calls them landlocked pieces. There are four structures on each and everyone of them now. And, they have been using them for the past 30/40 hears and before that I understand there was a hotel on the property. So, I can not address that other than they don' t know what they;are talking about. I have no idea what comment 2 means, if they are talking about Stony Beach, the Board' s comments have been addressed on that, that is not a buildable lot that is going to be dedicated as r understand it to the Ferguson Museum Land Trust to stay Planning Board Page 3 8/27/87 Mr. Lark: in a forever wild basis. And, negotiations with the Wilmerding family and the officials of the land trust have taken place right now. So, if that is the piece they are talking about, what they refer to on the island as Stony Beach, then that is taken care of. It is shown on the map and the Board requested that it-;ibec_�shown not as:;a buildable parcel which of course it is now. I have no idea what they mean by comment three, because I don' t know-..why Resovoir Road which terminates at the property, which it does not, Mr. Edwards can tell you that was not used as access to the property. Either they have the wrong piece of property meaning the County Planning Commission or like so many instances in the Town of Southold on Long Island proper or Fishers Island they know not from whence they speak. And, I respect the Board, they do have a full quorum tonight to, in accordance with the general municple law and the-Suffolki:County Charter that you override the resolution with...a majority plus one and I respectfully move that you grant an approval of this minor subdivison of four lots. Ms. Scopaz : Mr. Chairman, May I respond to one of Mr. Lark' s questions. Just, you asked 'earl ier, you did not know the County referred to the parcel as landlocked. The generally refer to any piececbf.;property that,..does not have frontage on an existing dedicated public street as landlocked. Even though you may have rights of way agreements over private . -.:_ , property, if it is not a dedicated street, they consider it land locked which is probably why they s.aid that. Mr:: Lark: Would you agree with that assessment as good planning principals that you learned in college would you think that is -a ..good :way =to.Z tefer to,.,.a`i.piece .of property. Landlocked is pretty clear both in lawman' s terms and legal terms which means that there is no access to a piece of property. Ms. Scopaz : My agreement with that is not in question, I am simply stating for you what it means. Mr. Lark: Okay, thank you, that clarify' s it. Mr. Orlowski: Okay, any other endorsements of this subdivision? Hearing none. Anyone out their neither pro nor con but with information to the Board? Hearing none. Questions from the Board? Mr. Latham, none; Mr. Mullen, none; Mr. Ward. Mr. Ward: Just the possibility of the other1land as being set aside to the:-land trust, it may best with the filed map here to designate it as lot No. 5 so that it can be described as part of this. Mr. Lark: I talked,'to­Chandler and Palmer who does the surveys for the Island, there are no existing metes and bounds descriptions and that is due in part to the hurricanes and stuff like that it has moved around al little so that there is none and when the Board wanted to make sure it was not, we designated as Planning Board Page 4 8/24/87 Mr. Lark: not a buildable lot on this parcel. And, quite frankly the way they intend to deed it over to the, just refer to it as it is, Stony Beach which meanders around on the 5. 2 acre and shown on the survey which would be attached. On!: the map, subdivision plan. Mr. Ward: I just find it difficult to deed something over with out metes and bounds. Mr. Lark: Oh, it is done all the time, especially with the old deeds because we know what it is bounded by. But, that is how it was done, because I checked on that, there are no existing surveys of that anywhere. So, they have plotted it basically from the aerials, the current aerials that they have, to answer,-. you question and I don' t know if it...is.-:a- satisfactory answer or not, but there is none. Mr. Orlowski: Mr. Edwards, comment? (none) Ms. Scopaz (I hve nothing to add) . Okay, being no further comments, I will declare this hearing closed and thank you for coming down. On a motion made by Mr. Ward, seconded by Mr. Latham--, it was RESOLVED THAT THE Soutold Town Planning Board approve the minutes-.of the regular Planning Board meeting of August 10 , 1987. Vote of the Board: Ayes : Orlowski, Mullen, Latham, Ward, Edwards On a motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board authorize the Chairman to endorse the minor subdivision map for Richard and Anita Wilton located at Greenport. SCTM # 1000-40-3-6. Vote of the Board: Ayes: Orlowski,Mullen, Latham, Ward, Edwards On a motion made by Mr. Edwards, seconded by;::Mr. Latham, it was RESOLVED that the Southold Town Planning Board authorize the Chairman to endorse the site plan survey for Thompson, Irwin and Sandra, located at Main Road, Southold, SCTM # 1000-.63-3-8. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward, Edwards On a motion made by Mr. Latham, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board authorize the Chairman to endorse the site plan survey for Southld Square Shoppes._located at Southold, SCTM # 1000-55-5-T' Vote of the Board: Ayes.:. Orlowski, Mullen, Latham, Ward, Edwards Planning Board Page .5 8/24/87 On a motion made by Mr. Mullen, seconded by Mr. Ward, it was RESOLVED that the Southold Town Planning Board authorize the Chairman to endorse the final maps for the major subdivision of Reydon Court located at Southold, SCTM # 1000-79-5-16. Vote of the Board; Ayes Orlowski, Mullen, Latham, Ward, Edwards On a motion made by Mr. Ward, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board authorize-"-- the Chairman to:--endorse the final maps for the minor subdivision of John J. Miska located at Mattituck, SCTM # 1000-115'4-8. 1 Vote of the Board: Ayes::: Orlowski, Mullen, Latham, Ward, Edwards On a motion made by Mr. Ward, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board authorize the Chairman to endorse the final maps for the- site plan for The Cove, located at Southold, SCTM # 1000=87-5-20. Vote of the Board: Ayes : Orlowski, Mullen, Latham, Ward, Edwards On a motion made by Mr. Ward, seconded by Mr. Mullen, the following action was taken: WHEREAS, ON December 2, 1985, the Southold Twon Planning Board adopted the Land Use Plan which amended the original plan in certain aspects and whereas the Planning Board is now desirous of adopting the document entitled Master Plan Update Summary, with certain amendments as follows: 1. Beginning on, page 15, eliminate the section entitled Alternate Airport Sites --continuing to page 16. 2. On page 16, eliminate the section entitled East Marion Northerly Road. Now, therefore, be it RESOLVED that the Planning Board adopt said Master Plan Update;;Summary and cause the amendments to be made to its official copy. Vote of the Board: Ayes: Orlowski,Mullen, Latham, Ward, Edwards On a motion made by Mr. Ward, seconed by Mr. Latham, it was RESOLVED that the Southold Town Planning Board, following a a field inspection, recommend to the Building Department that a certificate of occupancy be issued to the site of Planning Board Page 6 8/24/87 William J. Mills and Co. located at Greenport, based on the approved site plan. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward, Edwards * * * * * * * * * * * On a motion made by Mr. Ward, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board approve the preliminary map for the subdivision to be known -.as "Cedarfields" located at Greenport, following::a preliminary hearing, SCTM # 1000-40-5-1, survey dated July 14, 1987 along with supplemental site utility layout, profiles, miscellaneous details and landscaping plans subject to: SCTM # 1000-40-5-7. 1. Adequate response to Draft Environmental Impact Statement (DEISM regarding potable water. 2. Provision of adequate storm drainage and roadway in accordance with Town of Southold Highway Standards. 3. Provision for Sidewalks 4. Approval by the Town' s consulting engineer. Vote of the Board: Ayes; Orlowski, Mullen, Latham, Ward, Edwards (Mr. Orlowski: Stated that he was in favor of the proposal, but-not in favor of sideWajk�) * On a motion made by Mr. Latham, seconded by Mr. Edwards, it was RESOLVED that the Southold Town Planning Board grant one six month extension on the completion of the conditions of the;.: final resolution on the major subdivision of Deborah Edson; SCTM # 1000-102-2-6, this is the only extension to be considered. Vote of the Board; Ayes : Orlowski,Mullen, Latham, Ward, Edwards Francis F. Adams - SCTM # 1000-3-3-3. The Board reviewed this proposed lot line change located at Fishers Island. Mr. Ken Edwards abstained from any discussion with regard to ::.this.: ;proposal. The Chairman read correspondence recently received from the Fishers Island Development Corp. (FIDCO) The letter stated that Mr. Ridgway, President of FIDCO had meet with Mr. O'brien, the applicant in order to understand the proposal. Mr. Ridgeway stated in his correspondence that FIDCO has no objections to Mr. O'Brien!.s proposed plan upon further review subj..ect to covenants that the two lots with dwellings will be sold only ast:a unit. Mr. McVann, Esq. , representing Mr. O'Brien, was present. He stated that he. did not think Mr. O'Brien wou ave :.any objection to this provision. Planning Board Page 7 8/24/87 On a motion made by Mr. Ward, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board approve the lot line change on.: plan made for Francis Fiske Adams, Jr. located at Fishers Island, survey dated as revised May 29, 1987 , subject to: Covenants and Restrictions filed with the office of the County Clerk stating that lots;--no. I and 2 will be sold as one unit, even upon-.-.the completion of dwelling units. Vote of the Board; Ayes: Orlowski,Mullen, Latham , Ward Abstained: Edwards Braun Oyster Company (Homan) - Site Plan for Braun Oyster Company, SCTM. # 1000-103-1-1, 2, 3, 4. Mr. William F. Mullen, Jr. abstained from any action or discussion with regard to this site plan. This proposal for an addition on existing retail store at Cutchogue had received conditional certification from the Building Department. On a motion made by Mr. Latham, seconded by Mr. Ward, it was RESOLVED THAT THE Southold Town Planning Board approve and authorize the Chairman to endorse the site plan forBraun.-. Oyster Company for construction:.iof an addition to an exis ing buildin ..for retail and office space located at Cutchogue, SCTM # 1000-103=1-1, 2, 3, and 4 subject to completion of the following conditions: 1. proposed driveway to garage would need 239k if not redesigned so as not to exit on Road. 2. Exterior lighting to be shielded to property. 3. Installationo ffuel tanks to meet requirements of State Code. Vote of the Board; Ayes: Orlowski, Latham, Ward, Edwards Abstained: Mullen McCance - Itt,-was the consensus of the Board to set.' four lot minor subdivision for a field inspection. Proposal is located at Fishers Island. The next Planning Board meeting was set for Monday, September 14, 1987 . Planning Board Page 8 8/24/87 On a motion made by Mr. Ward, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board hereby adopts the following policy with regard to the construction;of minor subdivision roads: All Raods shall be constructed in..-accordannce with:.the Highway Specifications for Roads and Drainage (Chapter A108) which includes naming all roads, installation of all utilities (LILCO, telephone, and cable TV) and bond, letter of credit or passbook to guarantee completion of improvements. The Planning Board may reduce the width to 22 ' if in its judgement the road cannot physically be extended to service future subdivisions or additional lots in excess of 4. Mullen, Jr. Member G. Ritchie Latham, Jr. Member Richard G. Ward Member Kenneth Edwards Town ;Planner Valerie Scopaz Executive Administrator Victor Lessard Secretary Diane M. Schultze Helen.: and Stanley Simchick - SCTM # 1000-101=119. Mr. Richard Lark, ESQ. as attorney for the applicants was present. Mr. and Mrs. STanley Simchick, applicants, were also present. The Chairman abstained from any discussion with regard to this proposal since he was related to the applicants. A ptblic .hearing was held on this minor subdivision for 4 lots on 20 Acres at Alvah' Lane and County Route 48, Cutchogue. It was noted that the Suffolk County Planning Commission reviewed this proposal and denied it. Mr. Ward, acting Chairman for this review, stated that they .Board was basically in favor of this proposal with covenants and restrictions that any further subdivision on the large lot would be a major subdivision. Mr. Ward explained that the Board had previously discussed with the applicant relocating the lots and thetapplicant was not willing to do so. Mr. Ward.:stated that the Board would have to override the County if they chose to accept the proposal as it was. On a motion made by Mr. Edwards, seconed by Mr.Latham, it was RESOLVED that the Southold Town Planning Board override the resolution of the Suffolk County Planning Commission with regard to the minor subdivision of Helen and Stanley Simchick located at Cutchogue. Vote of the Board: Ayes: Mullen, Latham, Ward, Edwards Abstained: Orlowski Planning Board Page 2 9114/87 The County Planning Commission was overridden with a majority plus one vote of the Board. Mr. Lark questioned the resolution of the Board and the Board clarified that they overrode the County Plannning Commission. The Board also reviewed the memorandum of the Town Planner and were in favor of the recommendations presented in it. The felt they could grant approval to the subdivision with the recommendations as conditions to the approval. On a motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that whereas, a formal application for the approval of a subdivision plat entitled "STanley Simchick" located at Southold was submitted tothe Planning Board on May 20, 1986, and a filing fee was paid, and WHEREAS, a public hearing was held on said subdivisio application and plat-at the Southold Twon Hall, Southold, New York, on August 24 , 1987 at 7: 30p.m. , and 1. WHEREAS, the requirements of the Subdivision REgulations of: the Town of Southold have been met by said subdivision plat and application, NOW, therefore, be itRESOLVED that the applicaion of Stanley,--)"--, Simchick for approval of said subdivision plat prepared by Rod Van Tuyl of April 3, 1987 , be approved and the Chairman be authorized to endorse approval on said subdivision plat, subjectc:to; 1. Access driveway to Lot 3 shall be from Alvah' s Lane only. The access driveway to LOt 3 shall be located at least 150 ' north of the point where alvah' s Lane meets County Route 48. Condition shall be filed as Covenants and Restrictions on property deed. 2. All driveways for Lots 2, 3 , and 4 shall be T-shaped so as to prevewnt the need to back a vehicle out of the driveway. Circular driveways with two access points to public streets shall also be prohibited, for traffic safety reasons. 3. A covenant and Restriction shall be filed with Lot #1 prohibiting further subdivision of the property except as a major subdivision. Vote of the Board: Ayes: Mullen, Latham, Ward, Edwards Abstained: Orlowski Mr. Lark stated that',he wished to discuss the resolution passed by the Board with his client and he would approach the Board later in the meeting should their be a problem with it. Planning Board Page33:- 9/14/87 On a motion made by Mr. Edwards, '- seconded by Mr. Mullen, it was RESOLVED that the,-',Southold Town Planning Board override the resolution;'of the Suffolk County Planning Commissionwith regard to the minor subdivision of David Wilmerding, located at Fis.ehrs Island, SCTM # 1000-9-9-2, 3 , based on the request of the attorney at the public hearing. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward, Edwards On a motion made by Mr. Edwards, seconded by Mr. Latham, it was RESOLVED that whereas, a formal applicationf or the approval of a subdivision plat entitled "David Wilmerding": _located at Fishers Island, SCTM # 1000-9-9-2, 3 , was submitted to the Planning Board on February 3, 1987 and filing .fee was paidn, and WHEREAS, a public hearing was held on said subdivision application and plat at the Southold Town Hall, Southold, New York, on August 24 , 1987 at 7: 45 p.m. , and WHEREAS, the requirements of the Subdivision REgulation of the town of Southold have been met by said subdivision plat and appicant, NOW, Therefore, be it RESOLVED that the application of David Wilmerding for approval of said subdivision;_,plat prepared by Chandler, Plamer, and King, dated as amended August' 27, 1987 be approved and the Chairman be authorized to endorse approval on said subdivision plat. Vote of the Board: Ayes : Orlowski,Mullen, Latham, Edwards, Ward On a motion made by Mr. Latham, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board set Monday, S,eptember 28, 1987 at the Southold Twon Hall, Main Road Southold at 7: 30 p.m. as the time and place for the next regular._-Planning Board meeting. Vote of the Board: Ayes : Orlowski,Mullen, Latham, Edwards, Ward * * * * * * * * * * * On a _,motion made by Mr. Mullen, seconed by Mr. Latham, it was RESOLVED that the Southold Town Planning Board approve the minutes of the regular meeting of August 24, 1987 . Vote of the Board: Ayes : Orlowski,Mullen, Latham, Edwards, Ward i Planining Board Page 4 9/14/87 On a motion made by Mr. Ward, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board authorize the Chairman to endorse the minor subdivision of Winds Way Building Corp. located at New Suffolk Avenue, Cutchogue, SCTM # 1000-116-1-1. Said subdivision was approved by a resolutin of the Planning Board and the conditions satisfied. Vote of the Board: Ayes: Orlowski,Mullen, Latham, Edwards, Ward * * * * * * * * * * * On a motion made by Mr. Mullen, seconded by Mr. Ward, it was RESOLVED that the Southold Town Planning Board authorize the Chairman to endorse the minor subdivision (set off) of Albin Pietrewicz located at County Route 48 and Alvah' s Lane at Cutchogue, SCTM # 1000-84-1-26. This subdivision had been approved by a resolutin of the Board. Vote of the Board: Ayes : Orlowski,Mullen, Latham, Edwards, Ward * * * * * * * * * * * On a motion made by Mr. Ward, seconded by Mr. Mullen, tYie, following action,.;was taken: NEGATIVE DECLARATION Pursuant to Article 8 of the ENvironmental Conservation Law State ENvironmental Quality Review Act and 6NYCRR Part 617, Section 617. 10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that the Southold Town Planning Board as lead agency for the action described below has determined that the project will not have a significant effect on the environment. Description of action ; The minor subdivision of Plum Gut Properties is located at Main Road, Orient for 4 lots::-:on 15 acres, tax map no . 1000-18=3=9. 1. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. Because ther has been no correspondence from the Suffolk County Department of Health Services in the;.ialloted time, it is assumed that there are no comments or objections from that agency. Day, located at Indian Neck Lane, Peconic, SCTM # 1000-84-1-26. This subddivision has been approved by a resolution:- of the Board and the conditions of same have been satisfied. Vote of the Board: Ayes : Orlowski,Mullen, Latham, Edwards, Ward * * * * * * * * * * * On a motion made by Mr. Mullen, seconded by Mr. Ward, it was RESOLVED that the Southold Town Planning accept the final inspection report for the Engineering Consultants, dated August 25, 1987 with regard to the access road and approval of same for the minor subdivision of Robert and Jean Lenzner. The Board reviewed this site plan following a field inspection for recommendation to the Building Department on an issuance of a Certificate of Occupancy. Maureen of Pindar Vineyards at Peconic was present for::-the Board' s discussion. The Board outlined the items of the plan that still needed compliance:. They were: Planning Board Page 7 9/14/87 Lineup the southerly parking stalls in the parking area, adding the landscaping as called for in .the front of the building. Maureen explained- that they cou•ld�_have a problem with-:the,.tlandscaping inz,the front�_of the building since there-is drainage there. The Board stated that this needed to be done and if any, modifications were contemplated they should have been brought to the Board on:.:an amended site plan. The Board agreed that the certificate of occupancy should not be issued until the site complied with the approved site plan. Mr. Simchick approached'.-the Board as well. Mr. Simchick explained that Lot #2 was for his own .home, Lot #3 was for his daughter and Lot #4 was for a friend. He also stated that Lot #1 may be sold as a horse farm and a condition that any further subdivision would have to be considered a major subdivision would encourage someone<.,to develope it into many lots. Mr. Simchick asked that the Board re-consider this condition because he felt that it was just inviting trouble. Mr. Ward explained that when any subdivison of that lot, even one addition lot, is presented to the County Health Department, they would require that it be treated as.-:a:.-.major because they consider the proposed 4 lots as a minor and any further lot.:� would be added to that number. Therefore, the Planning Board was just corrdinating so that any further subdivision wiould be recognized as a major by all,pparties havinq:.,approval jurisdiction. Mr. Simchick stated that he understood this and agreed to the condition.
