PLANNING BOARD MINUTES
The Southold Town Planning Board held a regular meeting on Monday,
March 9, 1987 at the Southold Town Hall, Main Road, Southold.
Present were:
Chairman Bennett Orlowski,Jr.

7:30 p.m. Public hearing on the questin of approval of the major subdivison
for James Cohill located at Mill Road and Grand Avenue, Mattituck.
Mr. Orlowski: I would like to call this meeting to order, the first
order of business is a public hearing on the question of approval of
the major subdivision of James Cohill at Mattituck. This is for 7 lot
son 18 acres in the cluster concept. We have proof of publication in
the Suffolk Times, signed by Mary Sgarlata and notorized by Mary Deegnan.
We have proof of publication in the Long Island Travler Watchman. At
this time, everything is in order and I will ask if there are any objecions
to this major subdivision. Hearing none, are there any endorsements
of this major subdivision?
Mr. Tohill: I am Anthony Tohill on behalf of the applicant.
Mr. Orlowski: Okay, are there any other endorsements of this subdivison.
Hearing none, any one neither pro nor con but may have some information
for the Board. Hearing none, questions from the Board.
Mr. Ward: Do we have anything back from the Highway Superintendent with
regard to the drainage.
Mr. Orlwoski: It has been referred, however, we have not received comments
yet. Okay, being no further comments or questions, I will declare this
hearing closed.

On a motion made by Mr. Edwards, seconded by Mr. Latham, it was
RESOLVED that the .Southold Town Planning Board set Monday, March 30,
1987 at 7:30 p.m. at the Southold Town Hall as the time and place
for the next regular Planning Board meeting.
Vote of the Board:Ayes: Orlowski,Latham, Ward, Edwards
The Board set the following new proposals for a fied inspection:
1. Albin Pietrewicz - set off of 6.5 acres from 7.02 acres at County
Route 48, and Cox's Lane, Cutchogue.
2. Petrol Stations Ltd - 3 lots on 5.6 acres (1 proposed lot in a
Bl zone) located at Main Road, Cutchogue.
3. Steve Fuchs - 13 lots on 29 acres at Deport Lane, Cutchogue in the
cluster concept.
4. Plum Gut Properties, et. al - set off 2.984 acres from 13.663 acres
locted off a right-of-way from Main Road, Orient. (to legalize an existing
lot) .
On a motion made by Mr. Ward, seconded by Mr. Latham, it was
WHEREAS, DavidJ. Saland, as a general partner, has applied to the Southold
Town Planing Board for a subdivsion for 27 lot son 64 acres in the cluster
concept located at Mill Road, Mattituck, to be known as Wolf Pit Associates,
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. That pursuant to the provision of Article 8 of the Enviroinmental
Conservation Law; Part 617 of Title 6 of the New York State Codes, Rules
and Regulations, and Chapter 44 of the Southold town Code, the Southold
Town Planning Board, as lead agency, does hereby determine that the action
prposed is' Unlisted and is likely to have a significant effect on the
environment.
2. That the Planning Board shall file and circulate such determination
as equired by the aforementioned law, rules and code.
3. That the Planning Board immediately notify the applicant
David J. Saland, general partner of Wolf Pit Associates, of this determination
and further request said applicant to prepare a Draft Environmental Impact
Statement inaccordance with the scope and contents required by the Planning
Board, and Town Planner, allin accordance with said law, rules, and code.

On a motion made by Mr. Ward, .seconded by mr. Latham, the following action
was taken:
NOTICE OF SIGNIFICANT EFFECT ON THE ENVIRONMENT
Pursuant to tthe provision sof Articl e8 of the Environmental
Conservatio Law, Part 617, of Title 6 of the New York State Codes, the
Southold Twon Planign Baord, as lead agency does hereby determine that
the action described below is Unlished and is likely to have a significant
effect ,on the environment.
DESCRIPTION OF ACTION
Proposal is for a subdivison of 64 acres into 27 residential lots with
28 acres of open space in the cluster concept. This propsoal is to be
known as "Wolf Pit Assocates" is located at Mill Lane and Old Road, Mattituck,
tax map no. 1000-107-4-2.1.
REASONS SUPPORTING THIS DETERMINATION
1. This area has been nominated by the public as an area of
"unusual localimportance" to .the Department of Environmental Conservation
wetland regulatory maps.
2. There is concern about the potential impacts the development
of this parcel may have amout the wetland systems and the natural scenic
character of the local parkland.
3. This area is of,-historic signficance and contains an historic
homesite (SPLIA Records) .

On a motion; made by Mr. Ward, seconded by Mr. Latham, the followng action
was taken:
NEGATIVE DECLARATION
Pursuant to Article 8 of the Environmental conservatin Law State
Environmental Quality Review Act and 6NYCRR Part 617, Section 617.10
and Chapter 44 of the Code of the Town of Southold, notice is hereby
given that Southold town Planing Board as lead agency for the action
described below has determined that the project will not have a significant
efect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Peconic Home is for 4 lots on 45.2 acres
located at Sound Avenue, ,Mattituck, tax map no. 1000-121-3-7.
The project has been determined not to have a significant effect
on the envionment for the following reasons:

An environmental assessment has been submitted which indicated that no
significant adverse effects to the environment were likely to occur should
th eprojec the implemented as planned.
Because there has been no correspondence from the Department of Environmental
Conservationin the alotted time, it is assumed that there are o comments
or objectionsfrom that agency.
Becuase there ahs been no correspondence from the Suffolk County Department
of Health Services in the alotted time, is is assumed that there are
no comment or objections from that agency.
The project will meet all the requirements of the Code of the Town of
Southold Subdivision of Lane Regualtions.

On a motion made by Mr. Ward, seconded by Mr. latham, it--was
RESOLVED that the Southold Town Planing Board declare themselves lead
agency under the State Environmental Quality Review Act for the major
subdivision of Costello for 84 lots on 26.4 acres in the affordable housing
district located at Greenport.
Vote of the Board:Ayes: Orlowski,Latham, Ward, Edwards
On a motion made by Mr. Edwards, seconded by Mr. Ward, the following
action was taken:
WHEREAS, John Costello, has applied to the Southold Twon Planning Board
for a: subdivsionfor 84 lots. on 26.4 acres in the affordable hosuing district
located at County Route 48 and Moores's Lane , Greenport.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. That pursuant to the provision of Article 8 of the Environmental
ConservationLaw, Part 617 of Title 6 of the New York State Codes, Rules
and REgulations, and Chapter 44 of the Southold Town Code, the Southold
Twon Planning Board as lead ageecy, does hereby determine tht the action
proposed 'is Type I and is likely to have a significant efefct on the

On a motion made by Mr. Edwards, seconded by Mr. ;Ward the following
action was taken:

DESCRIPTION OF ACTION
Proposal is for a subdivison of 26.4 acres into 84 residential
lots in the affordable hosuing district located at County Route 48 and
Moores's Lane, Greenport to be referred to as "Costello Affordable Housing
Project" tax map no. 1000-40=5-p/o 1.

On a: moton made by Mr. Ward, seconded by Mr. Latham, .it was
RESOLVED thatth'e Southold .Town Planing Board grant a 90-day extension
on the final action for the site planf.or The Cove at Southold pursuant
to the request of the attorney for the applicants in order that the Suffolk
County Health Department endorsement may be obtained.

7:45 p.m. Public hearing on the question.-of approval of the minor subdivision
for Salvatore and Jeanne Catapano located.'.at Main, Main Bayview and South
Harbor Road, Southold 4 lots on 22 acres.
Mr. Orlowski: Next, we hav a public hearing on the question of approval
of the minor subdivi6ion,:of Salvator and Jeanne Catapano located at Southold.
We have proof of publicationin the Suffolk Times, signed by Carol Sgarlata
and notorized by Mary Deegnan. We have proof of publication-,in the Long
Island Traveler Watchamn. At this time, everything is in order and I
will ask if there are any objections to this minor subdivision? Hearing
none. Are there any endorsements of this minor subdivsion.
Mr. Caminiti: Mr. Chairman, Paul Caminiti, on behalf of the applicant.
We are just here to answer any questions, Mr. Catapano is in the audience.
We jsut urge tht the approval be granted. Everything is in order, we
have all the approvals.
Mr. Orlwoski: Okay, any other endorsements,-of this subdivison? Hearing
none, is there..anyone out ther neither pro nor con but may have some
informtion pertaining to this subdivision that would be of interest to
the Board. Hearing none, any questions from the Board (none) Okay, being

On a motion made by Mr.Ward; seconded by Mr. Latham, it was
RESOLVED that the Southold Town ,Planning Board recommend to the Town
Board that the change of zone request of Herbert R. Mandel from"A" to
"M" located at Boisseau Avenue and Yennecott; Drive, Southold be denied
since this zone is not consistent with--,the Master Plan Update proposal;
however, it was felt that the applicant should consider the sue of the
Affordable Housing District since this area meets the criteria for that
zone and the Board would be supportive of the AHD zoning.

site plan -at:-Ma ttituck
The.-Southold Town Planning Board reviewed this site plan for renovation
of an existing garage with gas station to a convenience store located
at Main Road, Mattituck. This proposal was pending before the Board of
Appeals and they requested input with regard to the site plan. The
Board felt that the parcel was too undersized to allow for any appropriate
parking for the.-.additional use proposed:..
On a motion made by Mr. Ward, seconded by Mr. Edwards, it`-was
RESOLVED that the Southold Town Planning Board approve the site plan
for Donald J. Grim, for construction oif a two-storey office building
accessory to the existnig building located at Oregon Road, Cutch6gue,
site plan dated as amended October 28, 1986 and as certified by the Building
Department.

On a motion made by Mr.Latham, seconded by Mr. Ward, it-,was
RESOLVED that the Southold Town Planning Board approve the site plan
for Joseph Shipman for construction of a 35' x 50' storage building accessory
to the existing building located at Main Road, Laurel, survey dated as
amended February 25, 1987 as certified by the Building Department.

Jehovah's Witnes Church -
The Board held over this proposal to make recommendation to the Building
Department for a certificate of occupancy on the addition since a field
inspection has not been made. This proposal is located at Indian Neck
Lane, Peconic.

On a motion made by Mr. Latham, seconded by Mr.- Ward, it was
RESOLVED that the Soutold Town Planning Board recommend to the Town Board
that the Proposed Local Law in Relationto Bed and Breakfast Facilities
be approved.

On a motion made by Mr. Ward, seconded by Mr. Edwards, it was
RESOLVED that the Southold town Planning Board recommend to the Town
Board that the proposed Local Law in Relation to Accessory Apartments
in Existing Dwellings be approved.

On a motion made by Mr. Latham seconded by Mr. Ward, it was
RESOLVED that whereas a formal application for the approval of a subdivision
plat entitled "Russell E. and Joan A. Mann located at Southold was
submitted to the Planning Board on January 14, 1983 and,
WHEREAS, a public hearing was held on said subdivision application and
plat at the Town Hall, Southold, New York, on Monday, February 23, 1987
at 7:45 p.m. , and
WHEREAS, the requirements of the Subdivision Regulations-,of -the Town ,;
of Southold have been met by said subdivision plat and application,
NOW, therefore, be it RESOLVED that the application of Russell E and
Joan A. Mann be approval of said subdivision plat prepared by Rod Van
Tuyl daetd as amended July 29, 1983 be approved and the Chairman be authorized
to endorse approval on said subdivision plat, subject to the following
condition within six months from the date of this resolution:
1. Receipt of the executed agreement with the Village of Greenport
for the utilities.

On a motion made by Mr. Latham, seconded by Mr. Ward, it was
RESOLVED that whereas a formal application for the approval of a subdivision
plat entitled "Deborah Edson" located at Cutchogue was submitted to the
Planning Board on June 3, 1986 and,
WHEREAS, a public hearing was held on said subdivision application and
plat at the Town Hall, Southold, New York, on Monday, February 23, 1987
at 7:30 p.m. , and

WHEREAS, the requiremetns of the Subdivision Regulations of the Town
of Southold have bben met by said subdivision plat and application,
NOW, htherefore, be it RESOLVED that the application of Deborah Edson
for approval of said subdivision plat prepared by- Rod Van Tuyl dated
December 31, 1986 be aprpoved and the Chairman be authorized to endorse
approval on said subdivision plat, subject to the following condition
within six months fromthe date of this resolution:
1. Receipt and acceptance by the Town Clerk of the park -and
playground fee in the amount of $9,531.25 this is in lieu of
a land reservation.

On a motionmade by Mr. Latham, seconded by Mr. Edwards, it was
RESOLVED that the Southold Town Planning Board approve the sketch plan
for the major subdivision of L and R Vineyards located at Elijah's Lane
and County Route 48, Mattituck; Section I being 24 lot son 57.3 acres
in the cluster concept; SectionII being 2 lots on 58.5 acres, survey
dated as amended January 14, 1987 (total 26 lots)

8:00 p.m. Ms. Regi Weile, Architect, was present`--to discuss the site
plan for the Quiet Man Inn located at Main Road, Southold. The proposal
was for construction of a 10' addition. This plan is also pending before
the Board of Appeals and a -request was made for comments to that Board.
On a motion made by Mr. Latham, seconded by Mr. Ward, it.was
RESOLVED that the Southold Town Planning Board refer the following comments
and input to the Board of Appeals with regard to the site plan and parking
for the Quiet Man Inn at Southold:
1. It was noted that there is a parking deficiency which is
the main concern of the Planning Board.
2. It was requested that the applicant obtain a written agreement
for off-site parking to meet the required parking and alleviate
the parking problem. Based upon the information submitted, five
(5) off-site parking spaces would be required.
3. It was recommended that the parking spaces on site be
parallel in order to allow some area for landscaping.

On a motion made by Mr.Ward, seconded by Mr. Latham, it .was
RESOLVED that the Southold Town Planning Board refer the site plan for
John Senko for construction of an office/retail complex to the Building
Department for certification. This proposal is located at Main and Ackerly
Pond Roads, Southold. Site Plan dated as revised February 25, 1987.
This proposal has also received a variance on the lot size from the Board
of Appeals (#3552) .

On a motion made by Mr. Ward, seconded by Mr. latham, it was
RESOLVED that the Southold Town Planning Board approve the site pan for
"The Village of Southold Shopping Center" located at County Route 48,
Southold for the construction of a 5000 square foot addition on the existing
retail stores, site plan dated as amended March 5, 1987 with supplemental
site plan and landscape plan dated January 5, 1987; subject to:
1. One additional leaching pool (for a total of 10)
to accomodate stormwater runoff.

Sufolk Times -
The Board reviewed this site plan for construction of an office buildng
for the newspaper business located at Main Road, Mattituck, this plan
has been certified. Mr. Garrett Strang, architect, stated that the landscaping
plan had not been finalized and it was the consensus of the Baord to
hold this proposal and action on same until such time as the landscaping
plan has been submitted and reviewed.
On a motion made by Mr. Ward, seconded by Mr. Edwards, it was
RESOLVED that teh Southold Town Planning Board grant a 90-day extension
on the completion of the conditions for the minor subdivision of Cranberry
Acres located at. Southold pursuant to the request for the attorney for
the applicant. This resolution supersedes the resolution of December
8, 1986.

On a motion made by Mr. Edwards, seconded by Mr. Ward, it was
RESOLVED that the Southold Town Planning Board declare themselves lead
agency under the State Environmental Quality Review Act for the set off
of Peter Blank, Jr. , and George R. Latham, Jr. , located at Orient. An
initial determination of non-significance has been made.
Vote of the Board: Ayes: Orlowski, Ward, Edwards
Abstained: Latham
On a motion made by Mr. Edwards, seconded by Mr. Ward, it was
RESOLVED that the Southold Town Planning Board approve the set off of
Peter Blank, Jr. , and George R. Latham., Jr. , located at King Street,
Orient, to set off 160,000 square feet from 11.3 acres, survey dated
February 5, 987; subject to:
1. Receipt of approval from the Suffolk County Department of
Health Services, pursuant to Article 6.
Vote of the Board:Ayes: Orlowski, Ward, Edwards
Abstained: Latham
On a motion made by Mr. Edwards, seconded by Mr. Ward, the following
action was taken:
NEGATIVE DECLARATAION

State Environmental Quality Review Act and 6NYCRR Part 617, Section 617.10
and Chap.ter:=44 of the Code of the Town of Southold, notice is hereby
given that Southold Town Planning Board as lead agency for the action
described below has determined that the project will not have a significant
effect on the environment.
DESCRIPTION OF ACTION
The minor subdivison of Peter Blank, Jr. , and George R. Latham,
Jr. is to be set off 160,000 square feet from 11.3 acres at King Street,
Orient, tax map no. 1000-27-4.-10.1.
The .project has been determined not to have a significant effect on the
environment for the following reasons:
An environmental assessment has been submitted which indicated that no
significant adverse effects::to the environment were likely to occur should
the::project be implemented as planned.
Because there has not. been a response from the Health Department in the
alotted time, it is assumed that there are no comments or objections
from that agency.

On a motion made by Mr. Latham, seconded by Mr. Edwards, it was
RESOLVED that the Southold Town Planning Board declare.--themselves lead
agency under .the State Environmental Quality Review Act for the minor
subdivision of David Wilmerding located at Fishers Island. An initial
determination of non-significance has been made.
Vote of the Board:Ayes: Orlowski,Latham, Ward, Edwards
On a motion made by Mr. Edwards, seconded by Mr. Latham, it was
RESOLVED that the Southold Town Planning Board, following a field inspection,
approve the sktech plan for the minor subdivisin of David Wilmerding
for 4 lots on 12.79 acres located at Fishers Island, survey dated as
revised January 8, 1987; subject to:
1. Amended'surveys indicating tht the "other land of Wilmerding"
will not be a building lot. The Board also questioned who this land
will be deeded to and requested that this be placed on the survey as
well.

On a motion made ,by Mr. Ward, seconded by Mr. Edwards, it was
RESOLVED that the Southold Town Planning Board refer the site
plan for North Fork Wood Design for renovation of an existing barn to
a woodworking shop, located at Pec.onic, to the Building Department for
certifiction: Survey dated as amended March 5, 1987.
Vote of the Board:Ayes: Orlowski,Latham, Ward, Edwards
Mr. Kenneth Edwards thanked Executive Administrator Victor Lessard and
Supervisor Francis J. MUrphy for their help-:-in getting the FIDCO maps
adopted by the Suffolk County Health Services Department.

Being no=..further business to come before the Board, on a motion made
by MR. Edwards, seconded by Mr. Latham, and carried, the meeting was
adjourned at 8:45 p.m.
