FINDINGS, DELIBERATIONS AND DETERMINAT ®1�� ��d ®�� ��eP� MEETING OF MARCH 13, 2008 ZB# 6125: SEROTA PROPERTIES CTM 97-5-12 Property Location: King Kullen Shopping Center, 31525 Main Road, Cutchogue SEQRA DETERMINATION- The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type 11 category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated January 25, 2008 stating that this application is considered a matter for local determination as there appears to be no significant county- wide or inter-community impact. BASIS OF APPLICATION= Request for a Variance under Section 280-85A(2), based on the Building Inspector's October 29, 2007 Notice of Disapproval concerning a proposed new ground sign, replacing the existing ground sign. The proposed sign will be greater than three square feet in total area with an additional allowance of 20%of the total for the name of the business center. PROPERTY FACTS/DESCRIPTION: The applicant's property consists of a total land area (together) of 224,899 square feet, and is improved with a retail shopping center, bank business building, as shown on the November 8, 2006 survey prepared by Barrett, Bonacci & VanWeele, P.C. ZONING CHAPTER 280 OF TOWN CODE (formerly Chapter 100)= Zoning Code Section 280- 85(2) states that each business establishment name shall occupy no more than three square feet in total area with additional allowance of twenty per cent of the total for the name of the business center. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on February 28, 2008, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: Page 2—March 13, 2008 ZBA 46125—Serota Properties CTM 97-5-12 AREA VARIANCE RELIEF REQUESTED: The applicant requests a variance for replacement of a free-standing directory sign with a sign 11 feet high containing five business establishment signs, one measuring approximately 10 square feet and four measuring approximately five (5) square feet each. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law §267-b(3)(b)(3)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The replacement sign will not be as tall or as wide or high as the existing one, and will be more in keeping with the existing shopping plaza. The new sign will be 5'by 8"at a reduced height of 11 feet measured from ground, instead of the existing 5'x 13' at approximately 17' total height measured from ground. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Clarity and visibility in this location in a shopping plaza warrant larger area for business names than are customarily permitted on a single ground sign structure. 3. Town Law §267-b(3)(b)(3). The relief sought is substantial but not excessive, given the size of the shopping center. Signs for the individual business establishments would average 5 square feet in area (4 signs at 9.5" x 60" and one at 22" x 60"), for variances of approximately 60 percent. The replacement sign will not be as tall or as wide or high as the existing one, and will be more in keeping with the existing shopping plaza. The new sign will be 5' by 8 at a reduced height of 11 feet measured from ground, instead of the existing 5' x 13' at approximately 17' total height measured from ground. 4. Town Law §267-b(3)(b)(5). The difficulty was self-created. It is the result of a proposal to replace an older sign with a newer nonconforming one. 5. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Simon, seconded by Member Oliva, and duly carried. to GRANT the variance as applied for, as shown on the survey of November 8, 2006 prepared by Barrett, Bonacci & Van Weele, P.C. and undated Alley Cat sign diagram, subject to the following Condition: That the sign shall not be internally illuminated without Planning Board approval. The above condition shall be written into the Building Inspector's Certificate of Occupancy, when issued. A„y deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
