HomeMy WebLinkAboutTB-11/14/1945 N . 27 Meeting of November 14, 1945 -ter The Southold Town Board met at the office of Supervisor S. Wentworth Horton, at Greenport , on Wednesday, Nov. 14, 1945. The meeting was called to order at 1:30 P.M. with the following �..„ present : Supervisor Horton; Justices Terry; Hawkins ; Klipp and Case; Superintendent of Highways Price; Town Attorney Terry and Town Clerk Booth. The minutes of the previous meeting were read and duly approved ' as read. In accordance with the announcement at the previous meeting and the advertisement and posting, the Board adjourned to the -� Village Hall, to act on the matter of .the petition to create a Protection Fire-- District in Greenport in the area outside of the IneDppDrated Village. Supervisor Horton opened the meeting at ~-� 2 P.M. and,'read the call of the meeting. He called upon those pre- sent asking if any person would like to speak for or against the -� petition. Harold Thornhill, Albert Hatocchio, Sherwood Rouse and Claude Angell responded in favor of the petition. Claude Angell spoke in behalf of Mrs . Grace Robinson who was out of � town. There being no further persons desiring to be heard on the matter, Supervisor Horton declared the hearing closed at 2;15. The Board retired to the off ice 'of the Supervisor to resume its business session. WHEREAS, there was duly presented to this Town Board of the Town of Southold, Suffolk County, New York, a written petition for -' the establis4ment of a fire protection district to embrace the territory situate in this -Town and hereinafter described, and it duly appearing that the said petition was duly signed and,- acknowledged or proved by resident taxpayers owning taxable real property aggregating at least one-half of the assessed valuation of all the taxable real property situate in such territory, . owned by resident taxpayers, as such valuations appear upon the latest completed assessment roll of the said Town of Southold; and WHEREAS, a notice in due form, containing a description of the proposed fire protection district and specifying the time when and the place where the Town Board would meet to consider the pet- ition and to hear all persons interested in the subject con- _� , cerning the same , was duly published and pos.ted- as required by law, and VMREAS, pursuant to such notice, a public hearing was duly held by said Town Board on the 14th day of Notrember, 1945, commencing N` at 2 :00 o 'clock P.M., at `Greenport , in the Town of Southold, Suffolk County, New York, being immediately adjacent to the limits of the proposed fire protection district and WHEREAS, all persons interested, who desired to be heard, were duly heard, and due deliberation having been had, NOW, upon toe evidence given at such public hearing and on motion of Justice of the Peace Norman E. Klipp and seconded by Justice of the Peace Harry Terry, it is hereby RESOLVED, pursuant to Article Eleven of the `town Law of .the State of New York, that it is hereby determined that it is in the public interest to grant in whole the relief sought by the petition afore- said, and that it is in such interest that there be and thereW hereby is established a fire protection district within the Town of Southold, Suffolk County, New York, to be known as the EAST AND !NEST GREENPORT FIRE PROTECTION ,DISTRICT and to be contained in and embraced in the following boundaries, to wit :- BEGINNING at a point on the southerly shore of Long Island Sound at the northwesterly corner of land 'of Armaroy Corporation and -- being the northwesterly corner of East Marion Fire District; run- ning thence along said East Marion Fire District the following 'J~ courses : Southerly along said Armaroy Corporation; thence east- erly along said Armaroy Corporation; thence southerly along the easterly line of .certain land of E.B. Prince; thence westerly , thence southerly along land of along land of Wayland C. Brown Wayland C. Brown and land of Daniel F. Brown to Main Road; thence 8 across said Main Road to the northwesterly corner of land of Fish Estate; thence southerly along said Fish Estate to the Bay at the southwesterly corner of said East Marion Fire District ; thence southwesterly along the Bay to the Incorporated Village of Greenport; thence northwesterly, then southwesterly, then southerly -- along said Incorporated Village ,of Greenport to Pipes Cove; thence southwesterly and then southerly along said Pipes Cove to Conklins Point; thence westerly along the Bay to Mill Creek; thence northerly .-,- along Mill Creek and Arshamomoque Pond to land of Valentine Ruch; r thence northeasterly and then northwesterly and then southwesterly "-0' along land of Valentine Ruch; then northwesterly along land of Bodecker to North Road; thence southwesterly along North Road to a J point opposite the northeasterly line of land of Burt; ..thence across North Road and along said land of Burt to Long Island Sound; thence northeasterly along said Long Island Sound to the point bf .beginning. and it is further RESOLVED, that this Board does hereby find and determine that all the property, property owners and interested persons within the proposed ` r district are benefited thereby, and that all property or property owners benefited are included therein. Moved by Justice Terry, seconded by Justice Case Resolved : That the Receiver of Taxes be authorized to employ a Senior � Clerk at a daily wage of $7.00 and a Junior Clerk at a daily wage - of r- $6.00. Unanimously adopted. i- The bonds for the Receiver of Taxes for $50,000, written by the American Y� Surety Co. were presented to the Board. Moved by Justice Hawkins , seconded by Justice Terry: `!f S• �CaaazcJ Resolved : That the Town Board approve the bond ofhe Receiver of _ Taxes as - written by the American Surety Co., as to its form, manner of execution and sufficiency of security. Unanimously adopted. Moved by Justice Terry; seconded by Justice Case: Resolved: That the regular monthly audit meeting of the Town Board be held at the office of the Supervisor on Wed.
