Meeting of October 17 , 1945
The Southdld:e-Town. Board met at the office of Supervisor S.
Wentworth Horton at Greenport on Wednesday,: October 17, 1945e .
The meeting was c-alled to order at 1 :30 P.M. with the follow-
ing present : Supervisor Horton; Justices Terry, Hawkins , Klipp
and Case; Town Superintendent of Highways Price ; Town Attorney
Terry and Town Clerk Booth. , .

The minutes of the previous meeting were read and duly approved

AREAS, there seems to be some doubt in the minds of the
members and officials of the Greenport Fire Department and Green-
port Village Officials relative to compensation for expense. of ,
operation of fire apparatus and equipment and materials furnished
by the Village fire department and accidential injury to any of
its legal members when answering a call in territory within F,
said towns , outside of any fire district or village and having
no fire protection, and Whereas , compensation for accidental
injuries to legal members of fire departments operating in un-
protected territory in said town is provided for under Section
205 of the General Municipal Law of the State of New York for
which indemnity insurance is carried by Southold Town under
Volunteer Firemen 's Indemnity policy No. A.G. - 227 of .the
Great American Indemnity Company to cover accidental injuries +�
to legal members of fire departments when answering a call ,t
in territory within said town having no fire protection.
Now, Therefore , be it resolved that Southold Town is -.
responsible for loss or 'damage to or expense in the operation '
of fire apparatus and equipment , and materials furnished an-
swering a call'. for assistance in territory having no fire
protection, outside any village or fire district , the same
being a legal charge against assessed property- in such un-
protected area , pursuant to Section 209 of the General
Municipal Law. ,

authorized to arrange with the Chief of• Police for special
police protection to maintain the peace on Hallowean.

A petition was read representing property owners of Orient,
requesting the Town Board to change the name of State; Street
to Skippers Lane...

Resolved : That the petition be granted to change the name
of State Street to Skippers Lane at Orient, Town of Southold,
Suffolk. County,. New York. �r
Further Resolved That the. Town Clerk beinstructed to notify

of Highways and the U.S. Post Office Departments r-
Unanimously adopted.
A petition. bearing the names of more than 51% of the resident
taxpayers and representing more than 51% of the assessed
valuation of the property proposed to be included, was pre- -
snnted to the Town Board, requesting that the Board establish
a Protection Fire District in District NO. 10 Greenport, ex- -
elusive of Greenport Village, described as follows .-
Beginning at a point on the southerly shore of Long Island
Sound at the northwesterly corner of land of Armaroy Cor-
poration and being the northwesterly corner of East Marion
Fire District; running thence a&ong said East Marion Fire
District the following courses : Southerly along said
ArmoroyCorporation; thence easterly along said Armaroy Gor-
poration; thence southerly along the easterly- line of cer-
tain land of E.B.Prince; thense westerly along land of
Wayland- C. Brown; thence southerly along land of Wayland C.
Brown and land of Daniel F. Brown to Main Road; thence across
said Main Road to the northwesterly corner of land of Fish
Estate; thence southerly along said Fish Estate to the Bay
•' ' at the southwesterly corner of said East Marion. Fire District;
thence southwesterly along the Bay to the Incorporated Village
of Greenport ; thence northwesterly, then southwesterly, then
southerly along said Incorporated- Village of Greenport to
Pipes Cove; thence southwesterly and then southerly along
said Pipes Cove to C'onklins Point; thence westerly along the
Bay,to Mill Creek; thence northerly along Mill Creek and
Arshamomaque Pond to land of Valentine Ruch; thence north-
easterly and.. then northwesterly and :thenisotthwesterly along
land of Valentine Ruch; and northwesterly along land of
..Bodecker to North Road; thence southwesterly along North
Road to a point opposite the northeasterly line of land of

Resolved : That a Vublie Nearing be held to consider said
petition at the Village Hall, Greenport , N.Y. for the
ti--. establishment of a Protection Fire District, said Hearing
to be held on Wednesday, Nov. 14, 1945, at 2 o'clock P.M.
Unanimously adopted.
W. Gourtland Case and A. Halsey Brown appeared before the
Town Board requesting the discontinuance of that portion of
-..r Aquaview, Avenue which is east of Cedar Drive (150 feet )
_y and revert it to the former owner. The opinion of the Board
is that the road. cannot be closed without the consent of
the adjacent property- owners. The Board would
consider the request if the property owners consented to-
close the road. Mr. Brown also asked if the Town Board would
consider selling Town owned sand pit at East Marion. The matter
was laid on the table to be discussed later. . The Hearing on
the matter of purchasing machinery for the Town Highway Dept.
Y* was duly opened at 2 P.M. No person appeared before the Board
to speak against the items mentioned in the legal notice pub-
lished in the Town papers, the Hearing was closed at 2 :40 P.M.

Whereas : The Town Superintendent of Highways did on the 5th
day of October, 1945, duly recommend the purchase of certain
machinery pursurant to the provisions of Section 142 'of the
Highway Law and a notice of such recommendation has been duly
• published as .p-rovided in such action,'
NOW THEREFORE BE IT RESOLVED that pursuant to Section 142 of
the Highway.:Law, the Town Superintendent of- Highways is hereby
authorized to purchase from Municipal Machinery Co. with ap-
proval of the Superintendent of Highways , one P. & H. Model
T 50 Truck Crane equipped .for' drag line operation with a lf2
4f yard bucket mounted on a ten wheel tandum drive chassis for
the total price of $13,580. to be delivered at Peconic , N.Y.
on' or about Dec . 90, 1945.
_-� The Town Superintendent of Highways is hereby authorized,
subject to the ppproval of the County Superintendent of Highways,
to surrender to the above named vendor, one Michigan Truck
Crane as part payment for the above machinery to be purchased.
The terms of payment will be as follows :
Trade-in allowance $43,000, check dranw on Machinery Fund
$9,580 - Total- $13,580.

B'E IT FURTHER RESOLVED that the Town Superintendent of Highways
" be authorized to purchase from H.O. Penn machinery Go. with the
approval of the County Supt. of Highways , one D.6 Caterpillar
Tractor, equipped with a• R-63 Lapiant-Choate Trailbuilder
for the total price of $7,070. -to be delivered at Peconic on
of about Feb. ,15, 1946.
The Town Superintendent of Highways is hereby authorized, subject
to the approval of the County Supt. of Highways , to surrender
to the above named vendor, one Caterpillar 60 Tractor as part
payment fo3b the above machinery. The terms of payment will
be as follows : Trade-in allowance 4000. , Check dramm on
Machinery Fund $6,574. - .Total7 ,070.

Resolved : That the monthly Audit meeting of the Town. Board
will be held on Nov.. 7,. 1945, at 1:30 P.M. and the preliminary �-
budget meeting be held at 2 A.M.

The Southold Town Board ,'met at the office of Supervisor S.
Wentworth Horton, at Greenport, on Wednesday, Nov. 7, 1945. �
The meeting was called to order to 1:30 P.M. with the following
present : Supervisor Horton; Justices Terry, Hawkins and Case;
Town Superintendent of Highways Price;. Town. Attorney Terry and
Town Clerk Booth.
The Board sat at once as a committee on audit to examine claims
against the Town concluding the audit at 2 .P.M. 4.
This Town Board has met at the time and place specified. in. ,~
the notice of public hearing on the preliminary. budget and as
'there were no interested persons having appeared before the
Board to speak either for or against any of the items in the
proposed budget , the hearing on the budget was formally closed
at 2 :10 P.M.
Moved by Justice Hawkins ; seconded by Justice Case : On roll
call unanimously adopted.
Resolved : That this Town Board does hereby adopt such pre—
liminavy budget as originally compiled, as the annual budget
of this Town for the fiscal year beginning on the First day 7k
of J'anuary, 1946, and that such budget as so adopted be entered ,r
.in detail in the minutes of the proceedings of this Town Board
as Follows : .
