Mr. Orlowski: 7:55 p.m. Hanoch & Watts - Public hearing on
the final map dated September 15 , 1988. This minor subdivision
is on 12. 622 acres located at Cutchogue. We have proof of
publication in the Long Island Traveler Watchman and the Suffolk
Times. At this time everything is in order for a public hearing
and I ' ll ask if there are any objections to this minor
subdivision? Hearing none, are there any endorsements of this
subdivision. ?
Mr. David Kapell: I represent the applicant and I have Mr.
Watts here with me this evening. We would like to ask the board
to act favorably on this application. I believe we have
complied with all the requirements that have been set forth by
this board and the County of Suffolk Department of Health. We
have one question we would like to ask the board with regards to
a late requirement in connection with the installation of a
firewell. I 'm going to let Mr. Watts speak.
Mr. Watts: I hadn't been aware of this until really just very
recently, but I looked at the site and there is one at the
corner of Alvah' s Lane and the North Road. I believe they are
painted red. There is another one across the road from the part
of the parcel that is on the North Road, I believe. Finally,
just to the southwest along Alvah' s Lane from the Grigonis
property which adjourns mine on the southwest, I believe there
is another one. It does seem like there is quite a density
there relative to what I see in other places and I would like to

know what are the requirements as far as density that makes this
one necessary?
Mr. Orlowski: We' ll have to question the fire district on
that. They make all the decisions as far as fire protection in
the subdivision so we' ll bring that question to their attention.

Mr. Charles Cuddy: I represent the applicant. This two lot
subdivision has been before the board for more than a year and
it has health department approval. The covenants have been
filed as requested by the board and I ask that it be approved at
this time. I believe it is in proper order. Thank you.

agencies. I think we have discussed this many times and I would

Mr. Stan Sims: This piece of parcel encompasses part of the
sensitive water according to your map. Has that been taken into
consideration?
Mr. Orlowski: It' s been clustered out of there if you notice
the way the map has been laid out we clustered it and left that
area from the railroad track to the south open.
Mr. Sims: Do you have an idea how far south?
Mr. Orlowski: About 900 feet, I guess.
Mr. Sims: Thank you.

on the final map received by the Planning Board on September 28,

Mattituck. SCTM #1000-107-3-2. 1. Everything is in order for
this final hearing. There is proof of publication in the Long

David Saland: Applicant. I have done what I can for the board
on this subdivision. I went to five acre zoning. I had a
little dispute as far as the reed bed and I think we have
settled that to everyone' s satisfaction with the engineers of
the town and I ask that you grant me approval as soon as
possible.

Mr. Ward: I don't really have any questions on the map itself
but just related to the dam verses the reed bed that I think we
will be working out with Sidney Bowne when we meet with them
this week. I would recommend we leave it open until we resolve
that.
Ms. Scopaz: I concur with what Mr. Ward is suggesting.
Mr. Orlowsk: O.K. , until we solve our engineering problem with
the drainage, which appears the engineer was out there and
changed their mind, we will meet with the engineer. Until then
we will leave the hearing open until we iron that out. We're
suppose to meet with them by the end of this week.
Mr. Orlowski: 8 : 13 p.m. Timothy Gray - Public hearing on the
final map dated March 29, 1989. This minor subdivision is on
9. 1568 acres located at Southold. SCTM #1000-58-1-2.
Everything is in order for a final hearing. I 'll ask if there

Karen Hagen from Wickham, Wickham and Bressler representing the
applicant. I wanted to advise the board that the covenants that
were approved have been forwarded to Mr. Baxter for signature by
all the owners and we are prepared to advise the
surveyor to add that and the liber and page numbers to the map.

we discussed that and sent the recommendation to the applicant.

repeat that so I know what we have to do.

sketched something up, would you like to look at this?
Mr. Ward: Yes, I think you have a right-of-way on there. We' ll
just take a look at it. Basically, what we are saying is you
come across and take the slope area and leave this as open
space. Make this a flag lot. They can build a common drive-way
but make this as part of this lot and make this as part of this
lot. It may mean, in fact, that this will get moved back to
something like that. I 'm just doing it diametrically where
these lots get pushed back a little bit but this steeped slope
area here with no direct access to that lot.

Representative: Couldn' t we do the same thing by leaving this
as a scenic easement and letting lot one own that? Not disturb
it by any kind of covenants on it that you might want, but leave
it as ownership as one and not to split up the two open spaces?
Mr. Ward: You' re saying to leave it as part of lot one?
Representative: Yes, and we could make it an easement, a scenic
easement or a natural open space easement.
Mr. Ward: O.K. , sounds good, but you will create the two flag
lots?
Representative: Yes, I have no problem with that.
Mr. Ward: This one is right on the nose so when you take this
out you' re going to have to move it a little bit.

Moores Lane in Greenport. We have proof of publication in the
Long Island Traveler Watchman and also proof of publication in
the Suffolk Times. At this time everything is in order for a
final hearing. I ' ll ask if there are any objections to this
subdivision? Hearing none, are there any endorsements of this
subdivision? Hearing none, is there anyone out there neither
pro nor con but may have information pertaining to this
subdivision that would be of interest to the board? Hearing
none, any questions from the board? Mr. Latham? Mr. Ward?
Mr. Ward: We have several comments that we will put on the
record and basically state to the applicant. Since the Planning
Board is very much in favor of this project and we would like to
see it get to final approval that we will go on record here
tonight that when and if all these items are in order we will
call a special meeting for a final map. This happens to be an
affordable housing project and we think the merits of the
project are long overdue and we will go to every effort we can
but let me say that at the present moment a list of things that
need to be complied with and responded to as well as addressed
before we will give it final approval. ( 1) Receipt, and review
by the Planning Board, of any comments from the Suffolk County
Planning Commission. (2) Receipt of a draft Declaration of
Covenants and Restrictions including, but not limited to, the
covenants and restrictions contained in the reasons for the
Negative Declaration and the correspondence from Donald Bracken
dated April 19, 1989. Additional covenants and restrictions may
be required upon review of the Suffolk County Planning
Commission report. Upon approval of the draft document by the
Town Attorney, the document must be filed with the County Clerk
prior to endorsement of the subdivision map by the Chairman.
(3) Receipt of a valid water contract from the Village of
Greenport. ( 4) Receipt of, and compliance with, the final
review by the Town Engineer. (5) Receipt, review and adoption
of the bond estimate for improvements. A bond, Letter of
Credit, or equivalent must be submitted prior to endorsement of
the map by the Chairman. (6) The open space maintenance must be
addressed. (7) Final maps must show the location of the well
and the 200 foot non-pollution easement. Restrictions for this
easement must be included in the Declaration of Covenants and
Restrictions. (8 ) The final maps must show the location of
fire hydrants. I think all of these items could be addressed
and wrapped up and put a bow on this project and as I stated on
behalf of the board, we will look to receive this information
and look favorably upon it and hold a special meeting if it is
done before the next regular Planning Board Meeting.

going to look into but I don' t think that they will have any

request, I would like to offer the following findings statement
that the final design of the project must be reduced as
follows: (1) reduce the traffic impact ( 2) reduce building and
land coverage ( 3 ) reduce number and size of units ( 4) require

less water and thus produce smaller amounts of sewage and as
elaborated upon in the final report we adopt it.

Mr. Raynor: I don't believe anyone from your office has
contacted us, however, I have no problem with that.
I would like to request from the board, because of the time
limits of this application, some compliance with regard to the
applicant' s construction schedule. My question before the board
is this, this has been ongoing for an excess of four years and
the applicant is very desirous of keeping his crews. He is in
the building business, he is a contractor in Quogue and his
desires of putting in foundations so that he can frame and shell
the proposed structures. The third revision which was submitted
to you, I understand fully that it is not completely reviewed
because it was only forthcoming this Friday. Those questions
that were left in abeyance in no way restrict nor do they apply
to what can be deemed as the actual structures themselves. They
were more referenced to elevations, they were referenced to the
dimensions of the sign in front. The backflush on swimming
pools in question. Those elements have all been complied with
to the best of my knowledge in that of Henderson and Bodwell as
well as Douglas Kurland, the architect. I would ask
consideration of this board to allow the applicant to go forward
and to be able to set foundations so that he may keep both his
crews and some of the local crews employed throughout the
winter. It has become something of economic circumstance and I
would hope the board would be able to expedite its influence
with regard to the building inspector' s office so that some type
of structure can be forthcoming before the ground freezes.
Mr. Ward: Where do you stand with the ZBA at this point?
Mr. Raynor: The ZBA has been waiting for this board' s
determination statement from the FEIS as I requested for
considerable length of time. We had a public hearing and there
was no opposition at that public hearing and my input with the
ZBA is they have no problem with a favorable decision pending
the receipt of the finding statement from this board.
Mr. Orlowski: Ms. Scopaz do you have any comments on that?
This board has never moved forward to ask the Building

Department to issue any foundation permits before. When is the
Zoning Board going to meet next?
Mr. Raynor: I believe their next meeting is the 20th of this
month, however, that puts a referral back to your board which
upon the completion of the findings statement on the SEQRA, you
have 45 days. Now that puts us into December and a good freeze
and it becomes something of an economic consideration. I am not
asking for a building permit, I am asking for the ability for
the foundations, which under the code are not a structure to be
set. I would presume that by December, in the 45 days, that the
board could make a determination. I asked them to make a
determination subject too. However, I realize the circulation
factor' s on the SEQRA prohibit the board from doing that.
Mr. Orlowski: Well, for now we' ll take that into
consideration. We will be holding one or two special meetings
between now and our next meeting so that could be addressed
then.

agreement but has not yet done so. We' ll make sure that is in
before we wait this long.
