JUKE 19,1989 The Southold Town Planning Board held a regular meeting on Monday, June 19, 1989 at 7 : 30 p.m. at the Southold Town Hall, Main Road Southold. Present were: Bennett Orlowski, Jr. , Chairman Member William Mullen Member G. Richie Latham Member Kenneth Edwards Member Richard Ward Town Planner Valerie Scopaz Planner Melissa Spiro Mr. Orlowski: Good evening, I would like to call this meeting to order. First order of business is Sunbeau Associates - Before I open the public hearing, I will entertain a motion to recommend a revised bond estimate of $99,150 for Sunbeau Associates to the Town Board for their approval. Mr. Edwards: So moved. Mr. Ward: Second. Mr. Orlowski: Motion made and seconded. Any questions on the motion? All those in favor? Ayes: Mr. Mullen, Mr. Ward, Mr. Edwards, Mr. Latham, Mr. Orlowski. Mr. Orlowski: Opposed? So ordered. Mr. Orlowski: I would like to open this public hearing on the amended map dated May 31, 1989. This subdivision is on 30. 637 acres located at Mattituck. We have proof of publication in the Long Island Traveler Watchman and also have proof of publication in the Suffolk Times. At this time everything is in order for a public hearing. I' ll ask if there are any objections to this subdivision? Hearing none, are there any endorsements of this PLANNING BOARD 2 JUNE 19, 1989 subdivision? Hearing none, is there anyone out there neither pro nor con but may have information pertaining to this subdivision that would be of interest to the board? Are there any questions from the board? Mr. Edwards: If you remember at out last meeting we granted sketch approval on this parcel based on a letter from the ZBA which stated that under the new master plan the parcel is zoned R-40. Under proven inspection we found that it was not, it was R-80. I would like to move that we recind our two motions of the meeting of June 5, 1989. Mr. Ward: Second. Mr. Mullen: Mr. Chairman, I would like to have a further review of this situation because I believe approximately a year or so ago there was another change in that immediate area where someone had purchased a lot from this applicant and had put a lot line change in there. I don' t believe this is proper for the area. Mr. Orlowski: Is anyone representing the applicant here? Mr. Tuthill: I am with Richard Lark' s office representing the applicant. Mr. Mullen: I believe that not too long ago that this was a lot owned by Mrs. Pfieff and it was set off with a stipulation to one side of them and now they are doing something else to it. I can' t quite understand the situation. Mr. Tuthill: I 'm not clear as to. Mr. Mullen: In other words, approximately a year ago in that area there was a gentlemen to the other side of her that had purchased a lot and they had divided it, now we are doing further division of this property which is a very fragile area. I would like to look at it a little closer if you do not mind. Mr. Orlowski: We will set it up for an inspection. This was already set off and we just want to see where this lot line is. PLANNING BOARD 13 JUNE 19, 1989 Mr. Orlowski: At this time everything is in order to approve the map dated January 2, 1989 and also to authorize the Chairman to endorse. Mr. Ward: I would like to present the motion, Mr. Chairman. WHEREAS, Thomas Shalvey, is the owner of the property known and designated as Section 84, Block 4, Lot 11 located on Bridge Lane at Cutchogue; and WHEREAS, Thomas Shalvey, submitted to the Planning Board of the Town of Southold an application for a minor subdivision including an Environmental Assessment Form on July 11, 1988, in compliance with New York State Environmental Quality Review Law; and WHEREAS, the Planning Board of the Town of Southold pursuant to the State Environmental Quality Review Act, (Article 8) , Part 617 Title 6NYCRR having declared itself Lead Agency and having issued a negative declaration on September 18, 1988; and WHEREAS, a Public Hearing on such application was held on June 19, 1989 at 8:00 p.m. at the Town Hall, Southold, New York; and WHEREAS, the requirements of the Subdivision Regulations of the Town of Southold have been met by said subdivision application; NOW, therefore, be it RESOLVED that the application of Thomas Shalvey, map dated January 2, 1989, be approved, and the Chairman be authorized to endorse said approval with the following condition. This site plan is located on the Main Road and Factory Avenue in Mattituck. SCTM #1000-142-1-17. Mr. Orlowski: Everything is in order to start this coordination process. Mr. Edwards: So moved. So ordered. Agent for Applicant: May I ask the board for an indication of the time frame that we will be proceeding in now? We also have a pending application in the Zoning Board of Appeals. Mr. Orlowski: We just did and we are starting the coordination process and with SEQRA you know as well as I know if there are no problems within the 30 day period we will move on. You' re at the ZBA right now? Agent for applicant: We' re filed but they are waiting the outcome of your review before they proceed. Mr. Orlowski: O.K. , well we have to wait for 30 days. Agent for applicant: The reason I asked the question as I am sure you are aware, at the request of your staff we had previously submitted a traffic study and if there is any additional data or supplemental reports which you might require of them to facilitate the SEQRA Review, just let me know and I will try and get it to you as soon as possible. Mr. Orlowski: O.K. , our reviewers have the traffic study so if there are any comments or questions we will have them get & hold of you. Mr. Orlowski: Port of Egypt - Board to make a determination under the State Environmental Quality Review Act. This site plan is located the the Main Road at Southold. PLANNING BOARD 15 JUNE 19, 1989 SCTM. #1000-56-6-6.1. Mr. Latham: The request should be made for the following items: (1) The drainage plans, specifically in relation to parking, and proposed building, must be revised so as to be consistent with the up-dated site plan received in this office on April 19, 1989. (2) All maps must be signed and sealed by the licensed New York State professional responsible for preparing the plans. ( 3) Site grades, grading, and drainage for the parking areas must be shown. All areas shown as available for parking must actually be available for parking. ( 4) A landscape plan must be submitted for review by the Planning Board. Existing landscaping in the westerly front yard should be indicated as such. April 19th, plan shows it as parking. (5) The location of all dumpsters and above ground fuel storage tanks must be shown on the site plan. Mr. Latham: I would like to make a motion for a negative declaration and here are the reasons why: (a) The applicant is to provide a positive on-site system to collect roof runoff and site storm drainage. (b) An oil separator for the boat repair and washdown area is provided, thus there will be no direct discharge into the bay. (c) A porous surface of crushed stone is to be used to absorb minor spills, and reduce direct run off into the bay. (d) The Planning Board has required that a landscape plan be submitted for review; with particular emphasis on the road frontage. (e) The parking provided is satisfactory to the Planning Board, however, all outside storage racks are not to be utilized for boat storage during the summer months; the area is needed for parking. ( f) The Planning Board has determined that the proposed facility is a needed facility is a needed facility in the community, and that the proposed locatio is environmentally appropriate. This minor subdivision is on 3+ acres located at Mattituck. SCTM #1000-114-7-14. Mr. Orlowski I will abstain from voting. Mr. Olmsted If it would please the board, I would like to make a statement so that I can get all my views across. I wrote this this afternoon. I think the County and the Town has lost site of what I am actually trying to do here. on one large lot I have three existing houses. one built at the turn of the century, one in 1949, one in 1974. We have no intention of selling or otherwise changing anything, we are merely dividing the lot so there will be a combined ownership. As you can see we each own one lot totally and jointly share the third. It is very easy to plan development on empty field, not so with an existing homesites. I realize that when you saw the improved groups drawing on lot two you would probably have thought I was trying to put something over on you. We intend to remove the portion of the improved driveway that is an lot one and connect lot two to the proposed right-of-way. I note also that you removed the waterfront privileges from lot number one because you made the right-of-way so large. Understa ing when the ZBA grants an appeal and approves lot lines, I understand more or less they are settled then. I also note that under the Master Plan I fa-11 under one acre zoning. I have perfect conditions here, one acre lots, wells, great drainage, no run-off into the creek because of all the fragile sand. In the sand, things grow very slowly and if I have to install- a traffic circle half the size of the Roanoke interchange, I will destroy naturally seeded trees, Bayberries, Beach Plums and Wild Grapes that have taken up to thirty years to get a start. There is also a PLANNING BOARD 18 JUNE 19, 1989 question of a utility pole in the middle of this thing. The cesspools are fairly close. If you look on the drawing the lot nearest Westphalia Road has an odd looking thumb shaped cut from the creek. That was caused by illegal run-off from Westphalia Road soon after the dredging and fill in 1955 or 1956. Right now both sides of Westphalia Road still illegally run-off onto our property, but that is another matter which I will discuss with someone else. If I were to construct a traffic circle as you suggest, I might have still even more run-off into the creek and if you noticed Mattituck Creek last week-end, June 10th and llth, it was as pretty brown and I haven' t seen it that brown since the 1955 hurricane. I do not want to contribute to this run-off and I hope you feel the same way. This property has been in my family since 1915. It is my roots and I plan to retire here. I don' t cut the beach grass, I don' t pollute the water and we chide people who do. I try to make mostly natural plantings and the trustees require that no one shall fertilize within 100 feet of the water or wetlands. I' ll do it, no problem. I am a native son, not developer with lawyers or consultants. I have not appeared here at any time to speed this thing along even though you've been doing it since February of 1987. I also note that in the State Building Code Rule 280A State and Town provides that there shall be provided a suitable access road but no where does it say anything about a turn-around or circle. We anticipate no problems getting in and out of our property in the future nor did we have any problems in the past. We also note that we have our approvals from the Suffolk County Department of Health, the New York State of Environmental Conservation in place for some time. I thank you for your time. Mr. Ward: There really is no reason the turn- around has to be excluded, we can leave it as a right-of-way. One of the problems with the layout is the fact that the. right-of-way is taking away square footage from the lots. It could be a right-of-way rather than a separate parcel and that way it could just be property on the lot rather than have to be discounted. Mr. Olmstead: The way I understand it, would jointly own the right-of- way. Mr. Ward: I think it might be cleaner just to leave the lot lines through and have a right-of-way rather than dedicating out the right-of-way because it would never be expanded. Mr. Orlowski: It will be on the board' s next work session and we will get back to you the end of next week. Mr. Orlowski: Grange former Church of the Open Door) - Board to discuss this proposal with the applicant. This proposal is located on Beckwith Avenue at Southold. PLANNING BOARD 19 JUNE 19, 1989 SCTM #1000-61-1-25. Mr. Caminiti: I'm appearing for Walt Glassner on this Beckwith property, the old church building of the Open Door and the story goes back to when the church first assigned to sell the property and to move. The church was appraised at $160,000, but because of the poor market we were not able to sell that building. At that time, I decided to buy that building and to move my office from Main Road up to Beckwith. At the time, we thought we would make it into an office building and I spoke to Victor and he indicated to me that as long as I stayed out of the shopping mall concept, he would allow one office and at that time all we needed was the five parking spaces. I think the reasoning at that time was, previously it was a meeting hall which required thirty parking spaces. The building is a lovely building but it lacks one thing, the building occupies most of the property. At least two thirds of the parcel is occupied by the building itself. The church received a special exception and- a certificate of occupancy, which at that time also would have allowed, or should have provided thirty parking spaces. It operated in that capacity first as a grange and then as the church in a very high density area requiring thirty spaces. The thought was well if you are going to go from high density use to low density use and you only require five parking spaces, it would be an allowably change in use. Because the renovation is much to high and Walter then decided, he' s a person of the church, he purchased the building and received a court order. He purchased the building for $160,000. The problem now very frankly, we need your help, we don' t know what to do with the building. Under the Master Plan it' s hamlet density and Walter has in mind a office and small accessory apartment. He had in mind at one time a two family house, but that could be too much use for the septic system, but they would consider one office and an accessory apartment. The problem now though is, we have been informed that in order to do that we need twenty parking spaces. It is just physically impossible to put in any parking there at all. I think basically what we are doing is asking the board if under the provisions of the town code if you could waive that provision there is additional parking within 300 feet or right behind the Mattituck Auto Parts with access from Traveler Street. It is really what we would like and I suggested to Walter to go before the board and at least get some ideas as to, even if he wants to resell it. I think Nancy has some preliminary sketches and ideas she would like to submit to, but basically, it is a hardship to the man, there is really no place to put parking other than Traveler Street. Mr. Ward: Is there public water there? Mr. Caminiti: Yes. Mr. Ward: Is the Health Department still giving you a hard time on the sanitary? PLANNING BOARD 20 JUNE 19, 1989 Nancy Speelman: The Health Department, their major concern, we talked to Bob Jewel, was that for two apartments it exceeded the allowed amount of water per day and they would not allow the two apartments. Mr. Ward: What about enlarging the system? Ms. Speelman: The area of the site is so small and so dense that they wouldn' t accept it so we came back with possible one apartment on the upper floor below that we would be less than three hundred gallons a day. Mr. Ward: Is the whole area served by public water? Ms. Speelman: Not in every case. According to their records, there is public water there but a lot of people try not to hook up. Mr. Ward: You have some wells in the area that are being impacted? Ms. Speelman: We felt that two apartments would be least amount of parking, least amount of parking on the street. We thought that was the best proposal but now we've come into a problem with the Health apartment so we are looking for alternative uses and let me show you. Here' s a survey of the property, he only can put on four parking spaces. To do even four parking spaces we have back out onto Travelers and it is tight. Three is fine for realistic. There is a drop, a substantial drop towards this part of the building from Travelers, it has to be filled. Mr. Ward: Is the building line low as well as the floor line in the back? Ms. Speelman: The church used it as a play ground for kids so it can be filled and used for parking. It is a small site, the actual area of the site is about 4600 square feet.. Allowable in this district is 20,000 so we are far below the minimum lot. This is part of our problem. What we are thinking of and this is just basically diagrams showing a one bedroom apartment on the upper level which is the actual old section, the old grange. Using that, this area is a one story in the rear and then using the entire remaining portion of the building for office space. This proposal yields 17 spaces, one for the upper apartment and about 1600 square feet of office area so we' re around 17 spaces. You can see where the side is we just can' t do it. Mr. Caminiti is pointing out that within 300 feet, I think it is almost 250, there is a lot that is being leased by the town so potentially that clause in the parking would be some relief for us as a waiver. Mr. Latham: Is the town just leasing it? PLANNING BOARD 21 JUNE 19, 1989 Ms. Speelman: That' s what we've been told by the Highway Superintendent. Mr. Ward: Along Traveler and Beckwith, what kind of parallel parking capability is there? Ms. Speelman: There is some, I don' t think it is actually curbed at this point. Beckwith, a lot of people park on Beckwith. Traveler Watchman is across the street, there is a lot of activity here. Mr. Mullen: They park down at the railroad station. There is one advantage there. It' s a one-way street too. Ms. Speelman: Yes, Beckwith is one-way. Mr. Ward: Beckwith is one way, but I think there is some discretion about making Traveler one-way East. Mr. Latham: Does the railroad own the right of way? How far do they go out. Mr. Mullen: I think the whole parking area is theirs. Mr. Edwards: Who actually owns the land that the Town is leasing for public parking now? Ms. Speelman: Matti-tuck Auto parts. Mr. Ward: Do you know what the width of Traveler Street is? Ms. Speelman: No I don' t. This is fairly wide here. Along Beckwith now, there are accountants and it' s kind of a mixed use area. I think next door there are two apartments. Mr. Camineti: There is Malgraff' s property to the south, to the west is the old Town Hall that was owned by Loretta DiMaggio. That exits out onto Main Road right behind the pharmacy. Oh, that' s right, she had that subdivided, the old post office. Mr. Orlowski: Why don' t you give us the list of uses that you are considering. Mr. Ward: The rational for what you are doing, numbers that you feel would be a practical number of use of cars for this kind of business. Ms. Scopaz: Would there be a possibility of perhaps curbing or place some curbing around Traveler Street so that there is a possibility of providing some on street parking there. Mr. Ward: Maybe you can check the actual width of Traveler, maybe we will be half way surprised and find a few more feet. PLANNING BOARD 22 JUNE 19, 19a9 Ms. Speelman: If what I recall, it is relatively wide at this point. Mr. Ward: Yes it is. Mr. Mullen: Let' s get some input from them and then take a look at it and check it out. Ms. Speelman: O.K. , would you like us to submit a final application at this point? Mr. Ward: if you want, why don' t you do a rough one showing parking and showing what you think can be done, what would be reasonable before you go any further with it. Ms. Speelman: O.K. , maybe what I can do is I can show you directly where that adjacent lot is going to be. Mr. Caminiti: We did have a problem with the visibility on this corner. Mr. Ward: Maybe you should check with Ray Jacobs. Ms. Speelman: Yes, we' ll talk to him. What do you feel about the on site parking that we have shown? Do you think that is realistic? Mr. Ward: Well, maybe as the apartment use because it is on site for the permanent use and your secondary use in a sense it's not there all the time, it' s the office. Ms. Speelman: So one or two spaces in the rear. Mr. Ward: Yes, I think otherwise you've got a problem. Mr. Orlowski: O.K. , I have nothing left on my agenda. Mr. Orlowski: - Dorothy Bosco - I am here on behalf of my mother and she has a hardship situation and I was hoping that perhaps if you read the details that something could be done.
