Mr. Orlowski: Good Evening, I would like to call this meeting
to order. First order of business is 7:30 p.m. Orient Park
Estates - This major subdivision is on 16. 1073 acres located
in Orient. SCTM 41000-19-1-15 . This is a final hearing. We
have proof of publication in the Long Island Traveler Watchman
and the Suffolk Times. At this time everything is in order for
a final hearing. I ' ll ask if there are any objections to this
subdivision? Hearing none, are there any endorsements of this
subdivision?
Lynn Gordon: Good evening, we represent the owners of this map
and the only thing I need to point: out to you at this point and
time, which I regret I haven't done before, which was brought to
my attention by Melissa today was that, we show a proposed
taking line by the DEC and in fact I 've been advised there has
actually been a taking along that line so I will, at your
request, amend the final map accordingly to show the taking.
Mr. Orlowski: O.K. . Any other endorsements of this
. subdivision? Hearing none, is there anyone out there neither y
pro nor con but may have information pertaining to this --

subdivision that would be of interest to the board? Hearing
none, any questions from the board?.
Mr. Latham: The proposed taking line is the same as the actual?
Lynn Gordon: That is what I'm advised. If it is any different
I will certainly bring it to your attention.
Mr. Orlowski: Any more questions from the board?
Board: No questions.
Mr. Orlowski: O.K. , hearing no further questions, I' ll declare
this hearing closed and thank you for coming.
Hearing Held Over From Previous Meetings:
Mr. Orlowski: Doris Price Moeller Foster - This major
subdivision is on 8.5 acres located at Cutchogue. We have the
Suffolk County Planning Commission' s Report. What is the
,pleasure of the board?
Mr. Rudy Bruer: Is there any chance to make a comment on
that?
Mr. Orlowski: Sure, go right ahead.
Mr. Rudy Bruer: I just received it today. I read it this
afternoon, my secretary picked up a copy. I have objections to
paragraph. eight of. that letter. I don' t see where it really
applies here, or that it should be in this letter, which is that
a proposed strip of land. 8.7 feet wide along the front of the
property shall be offered for dedication.. I don' t think to
subject. to this subdivision to revision of the maps under the
circumstances for this is worthy of this board or the board to
even. ask. I think it is very critical for my client. to have the
approval of this subdivision as soon as possible. A further
delay with respect to this, I think the County is going to own
this property. The lady has no money and is counting on the
sale of one of these lots and I think to pick just this one
piece of property and ask that the road be widened at her
expense and for eight feet, I think is ridiculous. I would
also, with respect to paragraph three of their recommendations
and not their requirements, I think that is absurd too under the
circumstances. Other than that we really don't have a problem.
Mr. Orlowski: Three and. eight?
Mr. Bruer: Well, eight on the requirement they said they said
it would be approved. subject to 1, 2, 8, 4, 5, 6., 7 and 8.
Eight I don't think really belongs there and number three is
just a recommendation and not a requirement. We're talking

about the bottom of the last requirement on the page, not
requirement, recommendation on page threedealing with
architectural. A possibility that there might be architectural
artifacts on the property. I'm talking about architectural
studies being done and- holding off on site pending these things.
I think is ridiculous.
Mr. Orlowski: Comments, are only comments on these reports so
you can take them and use them as you see fit.
Mr. Bruer: If the board would like, I could make_ a request that.
the board override that paragraph, paragraph eight. . By the time
we get all the maps revised the Health Department approval will-
expire.
Mr. Orlowski: Do we have a stamped map here?
Mr. Bruer: You have a stamped map.
Mr. Orlowski: No, that is why we are holding it up. What we
will do, is we will address these comments and wait for that
stamped map so by the next meeting we should be able to do
everything.
Mr. Bruer: O.K. , thank you.
Mr. Orlowski: Is that O.K. with the board? Does the board have
any comments on how to handle it?
Mr. Ward: Do you have .any other vehicle that we could
eventually get?
Mr. Bruer: When the town wants it they are going to have to
take ;it from everybody. Why just single out this one piece?
Mr. Ward: Policy wise, we have just been going through and
taking those strips as the properties come in. Some day the
town .might have to pick up other pieces also.
Mr. Bruer: Well, I don' t think there would be any problem if it
were recommended earlier, I mean this is kind. of at the last
hour 'and to have to go and revise everything, I think it is
very,, very unfair particularly with this one. I. mean it will
cause extreme hardship. It has to be redone and time, I mean
nobody is being paid on this thing until a lot is sold.
Everybody has realized the situation and ---.
Mr. McDonald: Can you envision. more than a half an. hour worth
of somebody' s time to change this? All they have to do is go
back ,and draw something on the survey.
Mr. truer: How long does it take Mr. vanTuyl to do something?

Mr. McDonald: I'm afraid you have more experience than I do
with ;that. I should ask you that question.
Mr. Bruer: It could be tomorrow or nine months from now.
Mr. Orlowski: Let's keep it open and we can do it subject to if
we have to and then we will discuss it. We could do it in
writing.
Mr. Bruer: I haven.' t spoken to Mrs. Foster on it since I only
received these comments today. I would assume that under the
circumstances she would do anything you said because she doesn't
have much choice.
Ms. Scopaz: Gentlemen, may I make a, suggestion? One way that
you could address this would be if you decide to require to go
along with the county request that there be covenants and
restrictions if we could just add to that that we want the right
of way to be given, it will be in the C & R's and any transfer
of title of the property is going to show up even though it is
not on the map.
Mr. Bruer: If you require us to put it in the covenants that at
a future time we dedicate it as long as the board would not so
violate the maps.
Mr. Ward: Alright, that's the vehicle I was looking for.
Mr. Bruer: O.K. , as long as by doing it we have not violated
the map.
Mr. Orlowski: Alright, I think it can be done.
Mr. McDonald: Do you want to go ahead and do the Planning
Commission Report now?
Mr. Orlowski: I don't think it' s going to make that ,much of a
difference if we approve it and sign it at the next meeting.
Let' s hold it over. Rudy, number three on the comments is the
other one you had a problem with right?
Mr. Bruer: Yes. Archaeological.
Mr. Orlowski: O.K. . I misunderstood., I thought ---, O.K. do it.
Mr. McDonald: If you want I ' ll enter a motion.
Mr. Orlowski: Yes, what is the pleasure of the board?
Mr. McDonald: I make a motion that we resolve to adopt the
February 8, 1990 Suffolk County Planning Commission Report with
the following amendments. (.numbers correspond to numbers in
report) :

Number 1, 2, 3, & 4 are to remain as written.
5. Is to be revised to read: No new residential structure
shall be constructed or otherwise located within 100
feet of the upland edge.
An additional item should be added as follows: No sanitary
disposal facility shall be constructed or otherwise located
75 feet of the upland edge.
6, 7 , are to remain as written. 8 is to be deleted.
9. Is to be revised to read: These covenants and
restrictions can be modified only at the request
of the then owner of the premises with the approval
of a majority plus one of the Planning Board of the
Town of Southold after a public hearing. Adjoining
property owners shall be entitled to notice of such
public hearing but their consent to such modification
shall. not be required.
10. Is to remain as written with the addition that the
and page number of the filed document be included
on the final map.
Numbers 1 - 7 and the additional item must be
presentedin a Declaration of Covenants and Restrictions in
proper legal form. A copy of the draft Declaration of Covenants
and Restrictions must be submitted for review by the Planning
Board and the Town Attorney. Once approved, the document must
be filed in the Office of the County Clerk.
Numbers 10 must be shown on the final map.
Mr. Ward: Before a second, I believe if we go back to those
items, I think the setbacks are reversed. Where it says "No new
residential structure shall be constructed or otherwise located
within should be 75 feet and the Health Department requirement
should be 100 feet.
Mr. Orlowski: Also Mark, you eliminated eight in that motion.
Mr. McDonald: Yes, deleted eight. You want to do that in the
covenants and restrictions?
Mr. Orlowski: Well, these would be the covenants and
res-tr.iction in total if we adopt it. We can leave that in and
then if we decide then that will be the only thing we will have
to eliminate.
Mr. McDonald: O.K. , then I would like to amend my motion to
change number 8 to be included, 6, 7., and 8 are to remain as
written. Also, I would like further that in item number 5

change 100 feet to 75 feet and in the additional item change 75
feet to 100 feet.
Mr. Bruer: Excuse me, what did we do with eight?
Mr. Orlowski: We're just leaving it in now until we can review
it but we are adopting this report as is. right now.
Mr. Bruer: It doesn' t say when it has to be offered, it could
be offered in the next century.
Mr. Orlowski: This will basically be the C & R' s that will go
with the property and all the rest I don't think you should have
a problem with. . If we leave it in there then we can always take
it out. If we eliminate it now then it doesn' t give us a chance
to put it back in.
Mr. Bruer: Alright.
Mr. Orlowski: We' ll discuss it Wednesday and get back to you
before the next meeting which by then we should have the Health
Department maps and then we can do everything.
Mr. Bruer: Actually, we don' t have the maps but we have the
appeals approved.
Mr. Orlowski: Do I have a second to that motion?

Mr. Ward: Mr. Chairman, I would like to offer the following
resolution.
RESOLVED to adopt the February 8, 1990 Suffolk County
Planning Commission report with the following amendments
(numbers correspond to numbers in report) :
1. Is to remain as written.
An additional item should be added as follows: There shall

be no further subdivision of lots No. 1, 2 and 3 in
perpetuity.
2. Is to be omitted. The proposed. layout has been before
the Board for many years. The Planning Board
requested that. the applicant file a Declaration of
Covenants and Restrictions
stating that Lot No. 4 be subdivided along the existing
zoning lines into one business lot and one residential
lot, upon approval of the four (4) lot subdivision. The'
board feels that the same outcome will be achieved,
without forcing the applicant to redraw the current
proposal and begin. the subdivision process again for
a major subdivision. The board has also requested
that the road be built to the Alternate Road
Specification, and will also request that the map
be filed in the County Clerk' s office.
3 . Is to be omitted.
4. Is to remain as written.

6. Is to be omitted. The Planning Board is requiring
a road built to the Alternate Road Specifications.
Final maps will contain the name of the proposed

is on 16.. 886 acres located in Orient.
SCTM #1000-1.22-3-1.4. We have the Suffolk County Planning.
Commission' s Report. What is the pleasure of the board?.
Mr. Bruer: Mr. Orlowski, may I make a comment on it?
Mr. Orlowski: Yes.
Mr. Bruer: On behalf of the applicant. I would. respectfully
request that the board override the complete recommendations of
the County Planning. on the following grounds: ( 1) I don' t
think they really appreciate the project and that even though
they have had the maps before them since at least, I think,
January 26th, 1989, they still don' t realize that this has
been submitted to the board as a cluster concept which I don't
think they realize with respect to paragraph ( 1) of their
comments. As you know the public hearing for this subdivision,
was back in February of 1989. Due to the death of one of the
developers has caused a delay in terms of getting the maps that
the Suffolk County Planning had requested. As you. know the

submission of this' subdivision goes back to 1985 and for various
reasons it was delayed due to road specs and various other
problems we had at the time. With respect to comment number two
you have. to realize that back in even, so far back as 1988 at
the recommendation of this Planning Board the Town Board has
approved the bond with respect to this road and in all instances
I think the County is way out of base in. respect to the rest of
this letter and we respectfully request that the board
completely override the recommendations. I mean the drainage
problems was addressed. by the town engineer and as I said the
bond has been approved in terms of the amount and hasn't been
posted. With respect to the other access that was a subject of
a ZBA appeal and approval. I think with the participation of
the Planning Board and the recommendations of the Zoning: Board
at that time.
Mr. Orlowski: O.K. , what is the pleasure of the board.) I think
what the Planning Commission is talking: about is in regard to
the cluster layout. The board, when looking at this may be able
to make a few changes in the lot lines and have it conform to
what they are asking for
Mr. Bruer: I think the whole concept, going back to the many
years that we had in 1985, 1986 and 1987 with respect to putting
this thing together, I think that it really does take into
consideration the concept of cluster because you have the open
space plus you have a one lot, ten acre piece of property, that
is never going to be further developed which you can only put
one house on and I think that pretty well saves .open space. The
idea is to put those four houses up there on the bluff for the
purposes of the view and expanse that you get from the
property. I don' t think that the person dealing with this
property in the County Planning has even looked at the
property. I think the lot and the beauty of the lots really go
to where the lots have been put. It has been well thought out
with respect to the physical plan of the property. I mean
really, you do get a great deal of open space there. You.'ve got
something like thirteen acres and you' re only going to have one
house on it. I mean, you've got the open space plus the ten.
Mr. Orlowski: O.K.. , since you brought this to us tonight,
let' s keep this hearing open so we don' t stay here all night.
We' ll keep it open and we' ll review it.
Mr. Bruer: By the way, the Health. Department approved these
maps back in 1987.
Mr. Orlowski: That expired.
Mr. Bruer: Absolutely, I wasn't going to do it every six months
under the circumstances of what was going on.
Mr. Orlowski: Is that O.K. with the board?

Mr. Bruer: May I please interrupt once more, this is my final
interruption. Mr. Chairman and the board. The applicant would
like' reli.ef from the. board' s letter of February 14, 1990,
paragraph one. It said "-require revised maps on a scale of one
inch equals a hundred feet as requested in the Planning Board' s
January 19, 1990 correspondence. We would request that there
would be a undue hardship under the circumstances that this is
really just a lot line and the map 'is not going to be filed with .
the, County and it will require resurveying of the property
because Mr. VanTuyl. said. he could not take this particular map
and reduce it, he would have to go out and resurvey it. The
zoning board has granted the release requested as set forth in
your file based upon this map. The maps that are being
presently approved, hopefully, by the Health Department are of
this map. Your requirements under Section A106-42 sets forth
that the maps must be on a scale of not more than 1.00 feet to
the inch. That is dealing with major subdivision, it doesn' t
say it has to be. The reason you would probably want it is that
most' of it, if not all, of your files are of that standard but
we ask that the board make an- exception in this. case.
Mr. Orlowski: O.K. . Those maps are also at the Health
Department?
Mr: truer: Yes.

lots on 15. 3573 acres located at the southeast corner 'of New
Suffolk. Avenue and Ole Jule Lane in Mattituck.

Mr. McDonald: I would like to make a motion that the following
be adopted:
WHEREAS, Henry Appel, William J. Klunder and Francis J.
VanManen are the owners of the property known and designated
as SCTM #1000-114-12-14, located at the southeast corner of New
Suffolk Avenue and Ole Jule Lane in Mattituck; and
WHEREAS, this major subdivision, to be known_ as .Henry
Appel Major Subdivision, is for 7 lots on 15.3573 acres; and
WHEREAS, a final public hearing was closed on said
subdivision application at the Town Hall, Southold, New York on
February 13, 1990; and
,WHEREAS, all the requirements of the Subdivision
Regulations of the Town of Southold have been met; and
be it therefore,

RESOLVED, that the Southold Town Planning Board grant
conditional final approval on the map dated October 16, 1989,

Mr. Ward: Mr. Chairman, I would like to make a motion that the
following resolution be adopted:

WHEREAS, Loraine. S. Terry is .the owner of the property
known and designated as SCTM #1000-18-5-18.1 located at the
southwest corner of Main Road and Platt Road in Orient; and
WHEREAS, this minor subdivision, to be known as Loraine
S. Terry Minor Subdivision, is for 4 lots on 12.823 acres; and
WHEREAS, the Southold Town Planning Board, pursuant to the
State Environmental. Quality Review Act, (Article 8) , Part 617,
declared. itself Lead Agency and issued a Negative Declaration on
June 5-, 1989; and
WHEREAS, a final public hearing was closed on said
subdivision application at the town Hall, Southold, New York on
February 13, 19 9 0; and

WHEREAS, all the requirements of the Subdivision
Regulations of the Town of Southold have been met; and
be it therefore,
RESOLVED, that the Southold Town Planning Board grant
conditional final approval on the map dated April 19, 1989, and
authorize the Chairman to endorse the final surveys subject to
fulfillment of the following conditions. All conditions must be.
met within six (6) months of the date of this resolution.

Mr. Wickham: Yes, I think that this first requirement, No lot
shall. be subdivided or lot line changed in any manner at any
future date unless authorized by the Southold Town- Planning
Board is uncalled for and. unreasonable. I came before this
board approximately three years ago with a suggestion that I had
the opportunity to sell the development rights of a substantial

piece of property to the County of, Suffolk and in order. to do
that I would have to subdivide this property, actually not
subdivide it but set off or change the lot line and your board
agreed that this was proper fitting. and .good. I came before
your board later and said alright we have reached an agreement
with the County and about to proceed and I want to change a lot
line and your board said rather than setting o t ff we wan you to
file for a minor subdivision but there will be no material
difference. There is a material difference. You have pointed
out' this first item here and this is a_ material difference. I
wanted to divide the property just as simply as that. We have
gone through a very great deal of effort, spent money and so
forth for minor subdivision maps and here we come back with the
store and you want something more. This is unreasonable,
uncalled for and particularly in view of the fact that the
County of Suffolk and the Town of Southold are getting about
1000 feet of development rights on shorefront? Who else in
the Town of Southold is selling development rights on 1000 feet
of shorefront. Just tell me. I personally have. done more to
preserve fresh water resources in the Town of Southold probably
than all the other farmers combined. We have sold development
rights on almost half of, the land that I own.. I believe
thoroughly in this sort of thing. I also said in this very room
that although I was willing to support two acre zoning, I felt
it was unreasonable and poor business for the Town of Southold
to require two acre zoning on the choice Peconic Bay frontage.
I still believe that. I think it is unreasonable, I think it is
poor business for the Town of Southold and I think .this first
item is entirely uncalled for.
Mr. Orlowski: You mean Item one? , No lot shall be subdivided or
its lot lines. changed?
Mr. Wickham: This is over five and one half acres.
Mr. Orlowski: All it is saying that if you want to subdivide it
you just have to come before the Planning Board.
Mr. Wickham: Mr. Chairman, this was a lot line change. I can
see now that I should have stayed right there and said I want a
lot line change, I do not want a minor subdivision. I have a'
contract and I can still back out of it. I have a contract to
sell my sister-in-law's estate two hundred feet of bay front and
with the proceeds acquire a piece of my fathers farm and sell
the development rights on a large part of that to the County of
Suffolk. Now, my question to you is, do you want that to happen
or don' t you? It' s just as simple as that. You know the
property, you know it very well.
Mr. Orlowski: I. guess I do, I grew up right across the street
from it.
Mr. Wickham: You also know that the two properties are worth a
million dollars and I just feel that I am being imposed on.

Mr. Orlowski: I think we are both interpreting this first
paragraph very differently. All it says is that if you plan to
subdivide again, you have to come before the Planning Board
which you would have to do if we didn' t put it in there.
Mr. Wickham: Let me put a question to you. Will you assure me
now that the Planning Board would. look favorably on it at that
point?
Mr. Orlowski: In the future? Can I ask you a question? After
this subdivision, do you plan to subdivide this again?
Mr. Wickham: I really don' t know, but what I would like to do,
because this is an odd shaped piece. I would like to sell the
development right to the County or to the Town of Southold. The
County will. not buy it because it is not ten acres but it is
just a corner that is .part of a very productive piece of
farmland and I really never want to see any of it developed but
we have got to think about the next generation, forget about me.
Mr. Orlowski: But, you as past chairman, and were up here in
this chair for many years, if you were to come in again,
wouldn't it be a subdivision of land?
Mr. Wickham: Yes, but probably not this one, part of another.
You asked me before.
Mr. Orlowski: You still have to come to the ..Planning Board.
This is only saying that. if you subdivide this piece again, you
must do it through the Planning Board. I don't know of - any
other way to do it.
Mr. Wickham: That is expected of course. We're five and one
half acres, of course I would have to come to the board but I'm
pleading for understanding. Thank you.
Mr. Orlowski: Does anyone have: any comments on this?
Mr. Ward: Obviously; he is not going to be interested in
perpetuity.
Mr. Orlowski: Well, we can take that out..
Mr. McDonald: I would like to point out that if this is further
subdivided, you are going to be creating a lot with a
substandard width. One of the lots would have to have a'
substandard width.
Mr. Orlowski: Yes, but. we wouldn' t create that, you would have
to go to the zoning board with that.
Mr. McDonald: None the less, we would be putting ourselves , in a
position where that would be the case..

Mr. Wickham: Let me say, there is another thing that I think is
perhaps unreasonable, I wouldn' t know. My sister-in-law is in.
the hospital with both lung cancer and pneumonia and again it
isn't her business that she or I are concerned about but it is
the next generation. I think that perhaps 100 feet back from
the bay is unreasonable. I. know that her children plan on a
cluster subdivision. putting this 200 feet with 300 feet that
they have and of course it will have to come before the Planning
Board but I'm not sure that 100 feet back from the shoreline is
a realistic figure. Maybe it is because there is an awful lot
of beach out front.
Mr. Orlowski: I don' t think you will have a problem there. Why
don't you take and review these. Did you just get those
comments?
Mr. Wickham: Yes.
Mr. Orlowski: Alright. You take them and review them and we
will take a look. If you have any comments on them put them in
writing and then we should have the information we need to make
a determination.

the side and retread into the sand.. Next you are going to have

started this thing? Was it 1986 or 1987? I forget.

approval so that is when you started.
Mr. Olmstead: I think I started in 1987.

say just have it match existing because there is no topsoil on
Westphalia Road?

hardware store on 3,200 square feet located on Main Road in
Cutchogue.

Mr. Ward: Mr. Chairman, I move that the Southold Town Planning
Board start the coordination process on this unlisted action.
The Board assumes lead agency status and in that capacity makes
an initial determination. of non-significance.
Mr. Edwards: Second.

Mr. Orlowski: Board to set Monday, March 26, 1990 at 7:30 p.m.
at the Southold Town Hall, Main Road, Southold as the time and
place for the next regular Planning Board meeting.
APPROVAL OF PLANNING BOARD MINUTES OF JANUARY 18, 1990.
Mr. Edwards: I make a motion that we approve the minutes.
Mr. McDonald: Second.
Mr. Orlowski.: Motion made and seconded. Any questions on the

Ayes: Mr. Latham, Mr. McDonald, Mr. Edwards,

Mr. Orlowski: ' Opposed? So ordered..
Mr. Orlowski: Being there is nothing left on my agenda, I will
ask it anyone has any comments or questions.
Mr. Wickham: Yes, Mr. Chairman. Going through this
recommendation from Charlie Lind, the Commission offers the
following comments on the map for your use and consideration.
I'm willing Mr. Chairman to accept numbers 1, 2, 3r, 4, 5, & 6
and in the comments number 3 and I think number 3 is the only
one that is pertinent. Using your 'own arguments, number 1 and 2
are not pertinent because you are going to have to come to the
Planning Board anyway. I'm going to have to come before the
County Board of Health anyway. Number 4, there is a possibility
that this site may contain material of archaeological value.
Every lot south of Route 25 is in this category and I think this
is unreasonable.
Mr. Orlowski: Yes, these are only comments.

Mr. Wickham: I understand, but what I'm saying is accept number
three because I think they should be filed in. the office of the
County Clerk.
Mr. Orlowski: You have no problem with the rest. of them..
Mr. Wickham: I have no problem with the understanding that my
testimony will receive consideration the next time.
Mr. Edwards: Let' s do it now.
Mr. Latham: We adjourned.
Mr. Orlowski: We can do it. What is the pleasure of the board?
Mr. Edwards: If he is agreeable we can do it. I' ll make a
motion that we accept it.

Ann Cravitz: Saltaire Estates in Mattituck in regard to the
subdivision farm next to us.
Mr. Orlowski: Yes, we are working on it and we are reviewing it
and we know all the arguments.
Ms. Cravitz: O.K. Thank you.
Mr. Orlowski: Any other comments from the board?
Mr. Latham: Just would like to make a motion that we adjourn.
Board: No questions.
Mr. Orlowski: Being no further comments or questions, Mr.
