HomeMy WebLinkAboutTR-01/02/1980 382 A .regular meeting of cthe Board of Town Trustees -was held at 7:30 p.m-. , . Wednesday, January 2,, _1980, .at the Town Hall, Main Road, Southold, New York. Present were: Trustee Anna Hataier Trustee Frank Kujawski, Jr. Trustee Henry Smith Trustee Halsey Staples Trustee Paul Stoutenburgh Deputy Supervisor Marie Johnson Y Roberta Sinnott., League of -Women Voters Troy Gustayson, Suffolk Times`, Trustee Kujawski made a motion, seconded by Trustee Stoutenburgh and carried that Trustee Staples be named temporary president for the ,-organizational meeting.,-. - Trustee Smith made a motion that-Trustee Anna Hatai.er (b-e named President of the Board of Southold Town Trustees -for. the term ending December 31, 1981. Trustee Staples seconded the motion. Presi-dent'- pro-tem- Trustee -Staples asked if .there were any-.other (nominations from the_ floor. :Trustee Kujawski -made a motion that' Trustee'- Stoutenburgh be named .Presiden.t. of the Board of :Southold .-Town Trustees for. the-.term ending .December 31-9' 1981:. Trustee Stoutenburgh seconded. :'the motion. Trustee Kujawski asked that both nominees state their.-. . experience. Trustee Stoutenburgh cited his six years as an observer -at .Town- .Trustee meetings along :with his •two.- years .as an elected :trustee. He has -been president of- the Eastern -Long Island Wetland.t 'Preservation Association from 1960 - 1968. He has been chairman of the wetlands committee .of the North (Fork .Environmental ,l . Council-•- for -six years.. He feels- he knows 'the':creeks :having been born and raised in the area. He feels he has more background of areas, people and situations.. _ .He'- stated he was instrumental in ` creating the Town wetland ordinance. He stated he would be here in the summertime and would not be absent if he were elected president. _ c Trustee Hataier stated that she worked with her husband the two years he was trustee and the past almost two years she has been a trustee in his place. She feels she knows the creeks from the water and from the 'land. She is very conscious of the dwindling environment and has endless time to devote to the position. She also feels she works well with people. Trustee Kujawski made a motion that the nominations be closed. Trustee Smith seconded the motion and it was carried. Trustee Staples called for the vote. Trustees Smith, Staples, and Hataier cast their votes for Trustee Hataier. Trustees Kujawski and Stoutenburgh abstained. Trustee Staples declared Trustee Hataier chairman. 383 ,President Hataier made. a motion designating Muriel Tolman as clerk of- the Board -of Southold Town Trustees. Trustee Staples . seconded the motion and it was carried. President Hataier made a motion designating the Chemical Bank of Southold ,as depository for the Board of Southold Town Trustees. Trustee Smith seconded the motion and it .was carried. Margaret Braatz - referral from .the Southold Town Board for report on Wetland Application #43 to erect bulkhead and dredge at Wunneweta Pond. Present were Abigail Wickham, attorney for Mrs. Braatz; David Cohn, representing Dr. John Hansen who is an adjoining owner; Mr. Gardner, property owner of adjacent property. _Ms. Wickham stated that this would join an existing bulkhead and one to be erected by Mr. Gardner. Mr. .Gardner has all necessary permits and intends to erect the bulkhead before the permit expires or to seek an extension if the time if .ho is unable :to do it. before expiration. David Cohn appeared on behalf of Dr. Hansen and stated Dr. Hansen .is :in opposition to the project. He also stated that Mrs. Braatz had written to the association for support and Ms. Wickham said the reply was favorable conditional on Mrs. Braatz doing a considerable amount of dredging. Trustee Stoutenburgh voiced his objection because of salt water intrusion which according to a study he has shows this area to be -a critical one. On motion made by Trustee Kujawski; seconded by Trustee Staples, it was RESOLVED to recommend to the Southold- Town Board disapproval of Wetland Application #43 of Margaret Braatz to construct a 78 foot timber bulkhead and dredge appr.o.xima e y 150 cubic yards of sand to be placed behind bulkhead at private property of the applicant at Wunneweta Pond, Nassau Point, Cutchogue, for the following reasons: l.. This is an unspoiled piece of wetlands. 2. This is a critical area in regard to salt water intrusion. 3. Once marsh grass and peat bog and root system is removed, the. fragile interface moves inland..' . 4. This will start a precedent in the area for bulkheading. Vote of the Board: Ayes: Hataier, Kujawski, Smith, Staples Abstain: Stoutenburgh Mr. Stoutenburgh stated that he abstained because Mrs. Braatz is a personal friend and he is involved with' her through Nature Conservancy and he does not want to prejudice. his good standing with her. Trustee Staples made a motion, seconded by Trustee Ku,-jlawski. and carried to table action on the application of Thomas S. BlankleV ✓ 384 to maintenance dredge off ..private property of- the applicant -at Jockey .Creek because all of .the trustees have not had an .-opportunity to make an inspection. On motion made by Trustee Stoutenburgh, seconded by' Trustee Staples, it was RESOLVED to recommend to the Southold Town Board approval of the. Wetland Application -#44 .of David S. Strong for maintenance dredging :of private marina. Vote of the Board: Ayes: Hataier, Kujawski, Smith, Staples, : Stoutenburgh J The applications of Margaret Braatz .to place bulkhead and dredge at Wunneweta Pond were tabled. On motion made .by Trustee Staples, seconded by Trustee Smith, it was 1 RESOLVED to approve the application of Arthur David to place dock'-off private property at East Creek with the .-condition that it be built so that it is from twelve to eighteen inches above the existing grass. Vote of the Board: ' Ayes: Hataier, Kujawski, Smith, Staples, Stoutenburgh On motion made by Trustee, Stoutenburgh, seconded. by Trustee Smith, it was RESOLVED to approve the issuance by the Board of Southold Town Trustees of..a quitclaim deed to Ralph and Anna Lavinia for whatever property the town--trustees may have claim- to between- Richmond Creek and land of the Lavinias. , Vote of the Board: Ayes: Hataier, Kujawski, Smith, Staples, Stoutenburgh The mdtter-�_of.-the-=.application of Joanne Galligan for a quitclaim deed to . filled in pr.operty'at Mattituck. .Creek'was discussed. It was the consensus of the Board that it would be in agreement with this if there were a covenant that the property will not be subdivided. President Hataier wily contact the attorney for Ms. Galligan-..to see if .this is. -agreeable. 385 Trustee Staples made .a. motion, seconded by Trustee Kujawski and carried to approve the minutes of the regular meeting of December 4, 1979 with the following amendments: Page 378 - in the matter of Lavinia, the location of the property if Richmond Creek rather than Mattituck Creek Page 378 - in the matter of Zeidler.sk the following is to be added in the condition oof: approval. "Any excess spoil above that being placed behind the bulkhead will be placed, on the beach on the" east side of the mouth. " A letter was received from the owner of Matt-a-Mar regarding the area in front of the retaining wall which runs from the lift pit ✓ to Wickham Avenue. The Board does not feel that the wording is strong enough and the contractor will be so advised. The permit will not be issued until the letter is received with the proper wording. . On motion' made by' -President Hataier, seconded- by=Trustee Kujawski, it was RESOLVED to approve the -application of Robert Kowalski for an offshore -mooring at publicly leased pr'gperty, at Narrow River. ✓ Vote of the Boardi- Ayes: ,. Hataier; -Kujawski, Staples, Stoutenburgh Abstain:;Smith Trustee Smith abstained because Mr. ,,Kowalski is 'an employee of his. On motion made'-by Trustee,.:Staples, seconded by Tru�stee' Smith, it was RESOLVED to table the': application of Thomas Occhiogrosso to place floating dock,'off private property at Corey Creek ,for further .information on the two existing pilings and clarification of property lines. Vote of the Board: Ayes: Hataier, .Kujawski, Smith, Staples',` Stoutenburgh_ Trustee Stoutenburgh made a motion that the following moorings be renewed•. f.or the month of January pending the $5 fee. Yaro Don Zieran On motion made by Trustee Stoutenburgh, -seconded by Trustee Kujawski, it was RESOLVED that the Board of Southold Town Trustees set $2.00 per cubic...yard -as the;,value- of ,the creek bottom if-, it.-is`•taken out and used for private use. If the fill is placed on public property,with the approval of the Board of Town Trustees to enhance the area, there would be no .(charge. Vote of the Board: Ayes: Hataier, Kujawski, Smith, Staples, ` Stoutenburgh A letter was read from the Fleet' s Neck Property Owners Assn. in which they request that the illegally placed fill be removed from the end of East Road in Cutchogue. There will be an inspection of the.;area. by the Trustees .at .2.,p,,m. on Sunday, January 6, 1980. President Hataier will contact the Association. :. -C - -- - There'"was discussion regarding getting,information to` the residents of the Town as to what is going on and what kind of permits are required. Enforcement was discussed and a guideline book for:-the board was mentioned.- The Board does not'-want .permits issued without the requirement that.:after the work is done the Board is notified. Trustee._ Stoutenburrgh.-made..a. motion to write a-l.letter.-to-the Town Board and ask them.' 'if the Ba Constable::could be--given time J off from his day to attend the one meeting a month of the Board of Town .Trustees so he and the Board can have a- -closer relationship of what goes on in the town .creeks. Trustee Xu6awski_ seconded the motion and it was carried. c :' 387 Trustee Kujawski . made a motion that a letter be sent to the Southold Town Board reminding them that the. lease of the Narrow River property expires in 1981 and requesting that consideration be given to acquiring land in the Narrow River area for public access. Trustee Staples seconded the motion and :it was carried. The Board discussed checking with the Town Attorney, Robert Tasker, about the possibility of maintenance bonds when large construction work is being done il ,-the creeks. There being no further- .business to come before the Board, Trustee Staples made a- motion, _ seconded by- Trustee Kujawski, and carried to adjourn the meeting.
