PROPERTY FACTS/DESCRIPTION: The applicants' 25,734 square foot nonconforming parcel located in the R-40 District, and improved with a single-family dwelling as shown on survey prepared by Harold F. Tranchon Jr., 8-2-2000. The subject property is bordered by Vanston Road to the north, and Haywaters Road to the west. The dwelling has a nonconforming setback from Haywaters Road of 37.9 feet. BASIS OF APPLICATION: Request for Variances under Sections 280-122A and 280- 124, based on the Building Inspector's July 25, 2007 Notice of Disapproval and Zoning Code Interpretation #5039 (Walz Application) for the reason that proposed alterations to existing single-family dwelling, additions, and attaching garage for conversion to living space, will increase the degree of nonconformance when located less than 40 feet from the front lot line (along Haywaters Road). FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 18, 2007, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: RELIEF REQUESTED: The applicant proposes to add a second-story addition on the north end of their one-story single-family house, maintaining an existing non- conforming front yard setback of 37.9 feet from Haywaters Road. The existing attached Page 2—November 1,2007 ZB File No.6074—Gerald and Doroth --_Lasor CTM No. 111-4-12 one-story garage on the south end of the house will be converted to interior living space. Existing slopes on the property will permit the creation of a new attached garage at the cellar level on the north end of the house, accessed by a proposed new driveway from Vanston Road. ADDITIONAL INFORMATION: The architectural drawings submitted by Joseph Michael Fratzer, and corroborated by testimony at the October 18, 2007 Public Hearing from the applicant/owners, indicate that the new second floor construction will not require demolition of the first floor but that additional structural columns will be added and the existing bearing walls will remain. The North end of the foundation will be cut and spanned with laminated beams to create the new attached garage. REASONS FORWARD ACTION: On the basis of testimony presented, materials submitted and/personal inspections, the Board makes the following findings: L Town Law §267-b(3)(b)(3)(1). Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The existing non-conforming front yard setback and footprint of the house will be maintained. ZBA variance #5000 was granted in 2001 for the existing entry deck at 31 feet from Haywaters Road, which will remain and which has a Certificate of Occupancy. The proposed increase in the size of the house is in keeping with other homes in the neighborhood and will allow the applicants the room they need to live in their house full time in retirement. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant as applied for cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance since the front yard setback of the existing house upon which the second-story addition is to be built is non-conforming. 3. Town Law §267-b(3)(b)(3). The variance granted herein is not substantial at 2.3 feet less than the code required 40 feet, and only a portion of the new construction will maintain the non-conforming 37.9 feet front yard setback. The lot coverage will remain the same at 7.46% 4. Town Law §267-b(3)(b)(5). The difficulty has not been self-created but is the result of an existing non-conformity. 5. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. Grant of the variance requested is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a larger dwelling while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Member Oliva, and duly carried, to GRANT the variance as applied for, as shown on the architectural drawings Pages 1 through 7, date-stamped by ZBA August 6, 2007, and prepared 6/29/07 by Joseph Michael Gratzer. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or,survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. BASIS OF APPLICATION: Building Inspector's July 27, 2001 Notice of Disapproval for the reason that Section 100-244 and Section 100-242A, the setback from the front property line is required to be 40 feet. Applicants' proposed additions/alterations to the existing dwelling will be set back at approximately 31 ft. from the front property line. AREA VARIANCE RELIEF REQUESTED: Proposed entry deck with fully extended stairs at the west side of the house, which addition will be 31 feet at its closest point. REASONS FOR BOARD ACTION DESCRIBED .BELOW: On the basis of testimony presented, materials submitted and-personal inspection, the Board makes the following findings: 1. Grant of.an area variance will not produce an_ undesirable change in the character of the neighborhood or a detriment to nearby properties because applicant seeks to build a small deck (approx. 225 sq. ft.)with surrounding steps, which will act as the entrance to their.home. This type of entrance is common and consistent with the area. 2. The benefit sought by applicant cannot be achieved by some method, feasible for appellant to pursue, other than area variances because the lot is narrow in width and has streets located on two sides. 3. The requested area variance is not substantial. 4. Grant of the variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district.
