HomeMy WebLinkAboutTR-10/11/1983 563 BOARD OF TOWN TRUSTEES October 11 , 1983 REGULAR MEETING 7 :30 P.M. The regular meeting of the Board of Town Trustees was held on Tuesday, October 11 , 1983 at the Town Hall, Main Road, Southold. Present: President Paul Stoutenburgh Vice-President Frank Kujawski Trustee Henry Smith Trustee John Bednoski Trustee John DiVello Clerk Ilene Pfifferling President Stoutenburgh called the meeting to order. On motion made by Henry Smith seconded by John DiVello and carried, the minutes of the September 13th meeting were approved. A discussion was held in reference to the project of Armando Cappa, Armando' s Seafood, in Southold. President Stoutenburgh was concerned wit .t e maintenance of the drains that will be installed. It was suggested that this information be recorded in a ooc of record, so that a yearly inspection can be made. On motion made by Henry Smith seconded by John DiVello and carried, the mooring renewal permits for the month of November were approved. A discussion was held in reference to the mooring permit of Mr. Conrad Volinski, Sr. It was decided that, due to the death of Mr. Volinski, Sr. , this mooring shall be turned over to his son, Conrad Volinski, Jr. , seeing that he has been paying the renewal fee. DANIEL SILVERMAN On motion made by John Bednoski seconded by Frank Kujawski it was RESOLVED to deny without prejudice the application of Daniel Silverman to maintenance dredge and to construct a catwalk, ramp and float in Wunneweta Pond, Cutchogue. Vote -of Board: Ayes: Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski There was a discussion held in reference to the aforementioned application. It was decided that since the landowners were not in agreement with this project, it could not be granted. If at a later date all parties can come to agreement, the application can come before the board again. 564 ERNEST WILSBERG On motion made by Frank Kujawski seconded by Henry Smith it was RESOLVED to approve the application of Ernest Wilsberg to construct a timber bulkhead, maintenance dredge and .fill in a dredged canal east of James Creek, with the provision that the opposite shore, which he now owns, remains in it' s natural state, in perpetuity. Vote of Board: Ayes: Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski ERNEST WILSBERG - WETLAND APPLICATION #156 On motion made by Frank Kujawski seconded by Henry Smith it was . RESOLVED to recommend to the Town Board approval of the Wetland Application #156 submitted by the Land Use Company on behalf of Ernest Wilsberg to construct a .timber bulkhead, maintenance dredge, and fill in a dredged canal east of James Creek, with the provision that the opposite shore, which he now owns, remains in it' s natural state, in perpetuity. --- Vote of Board: Ayes: Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski JAMES M. MURRAY On motion made by John DiVello seconded by Frank Kujawski it was C4` RESOLVED to approve the application of James M. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski JOSEPH DUGGAN On motion made by John DiVello seconded by Henry Smith it was RESOLVED to Table the application of Joseph Duggan to donstruct 100 ' of timber bulkhead with a 20 ' return on the north end, to dredge and .fill in Dawn Lagoon, Greenport until the Trustees hear from the D.E.C. with regard to the project. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski JOSEPH DUGGAN - WETLAND APPLICATION #161 On motion made by John DiVello seconded by Henry Smith it was RESOLVED to recommend to the Town Board to Table the Wetland Application #161 submitted by the Land Use Company on Behalf of Joseph Duggan to construct 100 ' of timber bulkhead with a 20 ' return on the north end, to dredge and fill in Dawn Lagoon, Greenport until the Trustees hear from the . D.E.C. with respect to the project. Vote of Board: Ayes: Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski GUY PANCALDI On motion made by Frank Kujawski seconded by Henry Smith- it was RESOLVED to approve the application of Guy +Pancaldi to place a mushroom mooring in Mattituck Creek, with the provision that the boat does not swing into any other boat or impede- navigation: Vote of Board: Ayes : . Stoutenburgh, Smith, Kujawski, DiVello, Bednoski 565 IFREDERICK COLLIGAN On motion made by Frank Kujawski seconded by John DiVello it was RESOLVED to approve the application of John Winters to place an, offshore mooring (200Lb. ) in Deep Hole Creek, with the provision that the boat does not swing into 'any other boat or impede navigation. Vote of Board: Ayes : Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski JOHN WINTERS On motion made by Frank Kujawski seconded by John DiVello it was RESOLVED to approve the application of John Winters to place an offshore mooring (200 lb. ) in Deep Hole Creek, with the provision that the boat does not swing into any other boat or impede navigation. Vote of Board: Ayes : Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski FRANK R. RUCKEL On motion made by Henry Smith seconded by Frank Kujawski it was RESOLVED to approve the application of Frank R. Ruckel to place an offshore stake with pulley line to onshore stake in West Creek, New Suffolk. Vote of Board: Ayes: Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski PETER MICCICHE On motion made by Henry Smith seconded by Frank Kujawski it was RESOLVED to table the applicationof Peter Micciche to reconstruct and enlarge an existing boat ramp and replace. 30 ' of existing bulkhead within 18" of structure, 20 cu. yds. of sand is to be removed from the boat ramp enlargement, fill to be placed behind the reconstructed bulkhead until the trustees make a site inspection. Vote of Board: Ayes : Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski PETER MICCICHE -WETLAND APPLICATION #162 On motion made by Henry. Smith seconded by Frank Kujawski it was RESOLVED to recommend to the Town Board to Table the Wetland Application #162 submitted by the Land Use Company on behalf of Peter Micciche to reconstruct and enlarge an existing boat ramp enlargement. Fill is to be placed behind the reconstructed bulkhead, in Corey Creek, Southold, until the Trustees make a site inspection. Vote of Board: Ayes: Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski JERRY BADY On motion made by Henry Smith seconded by John DiVello it was RESOLVED to approve the application of .Jerry Bady to reconstruct in kind and in place an existing 65 ' seciton of timber, bulkhead. Additionally a new 25 ' section of low profile timber bulkhead will be installed above the MHW line to connect two existing structures, 566 to reconstruct a 85 ' timber dock and to dredge two 10 ' x 40 ' sections, with spoil to be placed as backfill for the bulkhead in Town(Creek, Southold, with the provision that the dredging is to be done on the northern side of the dock. The Trustees suggested that Spartina Alteriflora be planted in the unprotected area, to the east. Vote of Board: Ayes : Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski JERRY BADY - WETLAND APPLICATION #163 On motion made by Henry Smtih seconded by John DiVello it was RESOLVED to recommend to the Town Board approval of the keL Wetland Application #163 submitted by the Land Use Company on behalf of Jerry Bady to reconstruct in kind and in place an existing 65 ' section of timber bulkhead. Construction of a new bridge carrying Oaklawn Avenue over Jockey Creek, Southold. Vote of Board: Ayes : Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski SUFFOLK COUNTY DEPARTMENT OF PUBLIC WORKS - WETLAND APPLICATION #164 On motion made by Henry Smith seconded by Frank Kujawski it was RESOLVED to recommend to the Town Board approval of the Wetland Application #164 for Suffolk County Department of Public Works to remove existing bridge and bulkhead. Construction of a new bridge carrying Oaklawn Avenue over Jockey Creek, Southold. Vote of Board: Ayes : Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski WILHELM FRANKEN On motion made by Henry Smith seconded by John DiVello it was RESOLVED to approve the application of Wilhelm Franken to legalize ��o timber bulkhead whose location was misrepresented. Installation of "L" shaped bulkhead as well as 155 ' of new bulkhead to connect with existing structure at basin entrance. Additionally, 1000 sq. ft. of intertidal marsh will be created as a condition of state stipulation order, in Gull Pond, Greenport, with the provision that the state has made to remove a 17 ' section of bulkhead. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski 567 WILHELM FRANKEN - WETLAND APPLICATION #166 On motion made by Henry Smith seconded by John DiVello it was RESOLVED to recommend to the Town Board approval of the Wet- land Application #166 submitted by the Land Use Company on . behald of Wilhelm Franken to legalize timber bulkhead whose location was misrepresented. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski MAUREEN SULLIVAN - WETLAND APPLICATION #165 On motion made by Frank Kujawski seconded by Henry Smith it was RESOLVED to recommend to the Town Board approval of the Wetland Application #165 submitted by the Land Use Company on behalf of Maureen Sullivan to constrruc.t a 3 ' x 15 ' ramp leading to a 6 ' x 18 ' float secured by two 6" spiles in Cedar Beach Creek, Southold contingent on receiving a letter from the Cedar Beach Property Owners Association, giving permission to construct on Association Property. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski RON DOBERT - WETLAND APPLICATION #167 On motion made by Frank Kujawski seconded by Henry Smith it was r157 RESOLVED to recommend to the Town Board approval of the Wetland Application #167 for Ron Dobert to construct a 250 ' x 3 ' cat- walk in James Creek, Mattituck. The Trustees will speak to Mr. Petersen or a representative, while they are out on their next field inspection. DR. & SARAH RAUCH A discussion was held in reference to the letter that was received from Town Attorney, Robert W. Tasker with respect to the request for a Quit Claim Deed for Dr. and Sarah Rauch in Gull Pond, Greenport. It was decided that a letter will be sent to the Town Attorney advising him to pursue this matter.
