SUBMITTED BY EN-CONSULTANTS, INC. to REPLACE EXISTING BULKHEAD
WITHIN 18", DREDGE EXISTING UPLAND AND TO PLACE SPOIL ON
ADJACENT UPLAND. INSTALL NEW BULKHEADING AND FLOATS ON PROPERTY
LOCATED AT SIXTH STREET, GREENPORT.

TRUSTEE SMITH: This is a public hearing on the application of
Stephen Shilowitz to replace existing bulkhead within 18",
dredge existing upland and to place spoil on adjacent upland,
to install new bulkhEading and floats on property located at
Sixth Street, Greenport. At this time I would like any
comments from the audience.
MR. ROY HAJE: This application involves the placement and
rearrangement and realignment of bulkheading within an old existing
basin. There will be dredging to accommodate sailboats. We
seek your approval as well as the Village of Greenport, for this
project.
TRUSTEE SMITH: Is there anyone else who wishes to come before
the board? (No comment.) I will then close this public hearing.

EXECUTIVE SESSION
6: 30 P.M. - The Trustees met with the Town Attorney to discuss
amending the Wetland Ordinance.
REGULAR MEETING
The Regular Meeting of the Board of Town Trustees was held on
Monday, November 26, 1984 at the Town Hall, Main Road, Southold,
New York. The meeting was opened with President Henry P. Smith
presiding at 7: 45 P.M.

PRESIDENT SMITH: I'd like approval of the minutes of the Regular
Meeting of October 25, 1984.
TRUSTEE KUJAWSKI: I move to approve the minutes. .
TRUSTEE BREDEMEYER: I ' ll second that motion.
Moved by Trustee Kujawski seconded by Trustee Bredemeyer it was
RESOLVED to APPROVE the minutes of the Regular Meeting of October 25th.
VOTE OF BOARD: Ayes: All
This resolution was declared duly Adopted.
PRESIDENT SMITH: I would like approval of the mooring permits for
the month of January.
Moved by Trustee Kujawski seconded by Trustee Bredemeyer it was
RESOLVED that the mooring renewal permits for January 1985, be
and hereby are approved.
VOTE OF BOARD: Ayes: All - This resolution was declared duly Adopted.
TRUSTEE SMITH: The next Regular Trustee Meeting will be held on
DECEMBER 26, 1984, inspections will be made on THURSDAY, DECEMBER 20,
1984.

RESOLVED that the next Regular Trustee Meeting will be held at
7: 30 P.M. , WEDNESDAY, DECEMBER 26, 1984 at the Town Hall, Main
Road, Southold, New York.
VOTE OF BOARD: Ayes: All
TRUSTEE SMITH: I 'd like to give a report of the Trustees Receipts
collected for October, 1984. Application Fees $40. 00 , . Grandfather
Applications $15. 00, Mooring. Renewals $130. 00, Wetland Applications
$350. 00 for a total amount of $535. 00 received. This has been
transmitted to the Supervisor to be placed in the General Fund, I
believe.
TRUSTEE SMITH: Next is our Public Notices. I have a copy of our
Public Notices, if anyone wishes to review them. I would like to
ask to Waiver the reading of these notices if there is no objection_
from the audience. (Being there was no objection to this request
the President proceeded with the agenda. )
TRUSTEE SMITH: Next is our communications. Number one is from
Edward J. Viola, Vice-President of Deep Hole Drive Property Owners
Association, regarding the Bayview Ventures Corporation.
TRUSTEE BREDEMEYER: Henry, before we go ahead .with that one, in
relation to this matter it does not appear anywhere else on the agenda,
I received a call from a .Mr. Pontoro who is a engineer in the Healtr
Department. Mr. Gill, who is the Attorney who came to talk to us
- that night, 2 guess he was very disturbed with the letter we sent
him, although I have a copy here, and it didn't seem to be something
to be disturbing to him. Apparently he reads us that we are against a
discharge into Peconic Bay, apparently discussion of sub-surface
recharge of the water plant operation was discussed. , Apparently
Mr. Pontoro feels Mr. Gillis very upset and he said the letter
that was sent him, he did not read the same as at the meeting. Do
you have a problem with restating what the feelings of the Board are?
TRUSTEE SMITH: I 've . spoken to him on the telephone myself. I told
him that the Town Trustees have no jurisdiction if he indeed discharges
into the bay. I felt the man dancing on the other end of the phone.
TRUSTEE BREDEMEYER: Oh, good.
TRUSTEE SMITH: Number 2 if from Paul J. Flagg regarding a study
of Mill Creek. Jay will you take .this one?
TRUSTEE BREDEMEYER: We are trying to set up a meeting which Mr. Flagg
will be at, myself with the Town Board on December 4th. The time will
be announced shortly, probably. in the morning, possibly in the evening
to discuss the possible additives to determine the source of the
bacterial problem, possibly some measures to mitigate it. I 'll have
some additional information at that meeting some stuff that I looked

at. It should be informative and maybe we can get some progress
on improving the water quality there.
' TRUSTEE SMITH: In Mill Creek.
TRUSTEE BREDEMEYER: Yes! That meeting will be on December 4th.
There will be a memo in each trustee box, regarding the meeting.
TRUSTEE SMITH: Next is a letter from Mr. John. Geideman in regard
v/ to the Richard Nass application. "Plea.se be advised that the applicatior
for work on a private canaloffiockey Creek has been cancelled for
the time being. If I am in contact with the owner. in the future to
the contrary, I will refile as necessary. Thank you for your co-
operation. " Number 4 is from Orient Association regarding the
Thomas Samuels application for subdivision at Narrow River, Orient.
Does any one have. any comments on this one? (No response. )
Number 5 is from the Orient Association regarding a public hearing
on the Orient Point Ferry. Jay do you have anything you would like
to say regarding this matter?
TRUSTEE BREDEMEYER: I 've spoken to Mr. Fred Letson who is the
President of the Orient Association. He indicated to me that they
were having a meeting in the Supervisors office today with representa-
tives of the D.O.T. to discuss some of the problems they felt
they had with it. I have a copy of a. letter from the Orient Association.
Frank, did you get this?
TRUSTEE KUJAWSKI: Yes! I have a copy .of the one that was distributed
to you.
TRUSTEE BREDEMEYER: Oh! I thought there was additional ones to
the other members of the Trustees. Whats your pleasure?
TRUSTEE 'KUJAWSKI: I don't think we have any jurisdiction.
TRUSTEE BREDEMEYER: We don't at all. Thats what I told Mr. Letson.
TRUSTEE KUJAWSKI : We' ll just let it go.
TRUSTEE SMITH: Number 6 is a letter from Jody' Adams regarding
using public beaches for access to work on private property. This
had to do with an incident at Indian Neck Lane where they had to
repair a bulkhead. They took the barrier down at the end of the
public landing to get equipment through. It was completely re-
stored when they were through. I don't think any laws were broken.
Number 7 is from John Wickham regarding property located in
Cutchogue. Mr. Wickham is requesting a quit claim deed, and he has
requested this in 1981, and the Board has not changed our feelings
on this matter. Number 8. is from Mr. Hoey requesting to further
recess the public hearing in the matter of Beixedon Estates Assoc.
Number 9. if from Trustee Arthur Roth regarding filling of vacancy
on the Board of Trustees, Town of East Hampton.
TRUSTEE KUJAWSKI : I think this is very interesting.
TRUSTEE BREDEMEYER: Yes.

TRUSTEE KUJAWSKI: Did .you notice that the WHEREAS, has both the
Trustees of . Southold and Southampton?
TRUSTEE BREDEMEYER: Yes. It might be interesting reading to.
the public.
TRUSTEE SMITH: "Whereas the Trustees of Southold and Southampton Town-
ships are on record as determining that the said Trustees will fill
any vacancy in their bodies by a majority vote of their Trustee
members. " In other words we have 4 trustees and. . .
TRUSTEE KUJAWSKI: No. What this is, apparently there is a slot to
fill in East Hampton. Because they say there is no established
procedure or policy for the filling of a vacancy on.-the Trustees
of the Freeholders and Commonalty of East Hampton, and whereas
we and Southampton are already on record to fill our own vacancy,
which is not true, and Whereas East Hampton shall act in accordance
they are saying. they are going to appoint their own new members
when a vacancy occurs.
TRUSTEE SMITH: - Number 10 is from the Department of Agriculture and
Markets regarding Agriculture and Market Projects .
TRUSTEE BREDEMEYER: Do you think this is disseminated widely enough
or should we possibly have something to say about this to disseminat,
it or make it available to people who may be interested in the
community. It seems they have changed some of their objectives to try
make available grants and aid for projects which will be smaller
and 'not on such a grandiose scale, as some of the past descriptions.

TRUSTEE KUJAWSKI: I think Jay you could take section three. If
you could get the paper to .print this, it may stimulate interest
in the commercial fishing industry or possibly someone related to
agriculture.
TRUSTEE SMITH: At this time I 'd like a motion to recess this
regular meeting to hold our public hearings. I would like to
waiver the formal reading of the applications if there are no
objections from the audience. (no response. )

submitted by the Land Use Company to install a fixed dock leading
to a ramp and float secured by spiles on property located at Home
Pike Road, Mattituck, lot no. 13/14.
Having received no testimony a motion was-made.- by Trustee Kujawski
and seconded by Trustee Bredemeyer and it was further
RESOLVED that this public hearing be and hereby is closed by unamious
vote of the Board.
8: 04 P.M. - In the matter of the application of Stanley Chase
submitted by the Land Use Company to install a fixed dock leading
to a ramp and float secured by spiles on property located on the
east side of South Drive, Mattituck.
Having received no testimony a motion was made by Trustee Kujawski
and seconded by Trustee Bredemeyer and it was further
RESOLVED that this public hearing be and hereby is closed by unamious
vote of the Board.
8 : 06 P.M. - In the matter of the application of Carlo DeGaudenzi
to construct a timber retaining wall, ramp and float dock and to
maintenance dredge on property located at 3520 Ole Jule Lane,
Mattituck.
The minutes of this public hearing have- been prepared under separate
cover. Following the. public hearing, the foll-owing action was
taken concerning this hearing:

RESOLVED that this public hearing be and hereby is closed by unamious
vote of the Board:
8: 10 P.M. - In the matter of the application of Bess Pulitzer to
repair and strengthen existing wooden bulkhead and addition of new
piling and tie rods, and to backfill on property located at Lighthouse
Lane, Southold. Having received no testimony a motion was made by
Trustee Kujawski and seconded by Trustee Bredemeyer and it was further
RESOLVED that this public hearing be and hereby .is closed by unamious
vote of the Board.
8: 12 P.M.- In the matter of the application of Leonard Beckenstein
to construct a timber dock, fixed elevated catwalk, ramp and two
floats on property located on the south side of Jackson' s Landing,
Mattituck on Lot number R. Minutes of this public hearing have been
prepared under separate 'cover. Following the public hearing, the
following action was taken concerning this hearing:

RESOLVED that this public hearing be and hereby is closed by unamious
vote of the Board.
8: 14 P.M. - In the matter of the application of Leonard Beckenstein
to construct a timber .dock consisting of a catwalk, ramp and two
floats on property located on the south side of Jackson' s Landing,
Mattituck, Lot no. 3. Minutes of this public hearing have been
prepared under separate cover. Following the public hearing, the
following action was taken concerning this hearing:

8: 16 P.M. - In the matter of the application of Stephen Shilowitz
to construct a bulkhead within 18,' of existing structure to dredge
and to construct floating docks, on property located at Sixth Street
in Greenport. Minutes of this public hearing have been prepared
under separate cover. Following the public hearing, the following
action was taken concerning this hearing:
Moved by Trustee Kujawski seconded by Trustee Bredemeyer it was
RESOLVED that this public hearing be and hereby is closed by
unamious vote of the Board.
8: 18 P.M. - In the matter of the .applciation of June Hussey to
replace 100 ft. of existing bulkhead and to recover sand lost into
the creek on property located at 1065 Fleetwood Road, Cutchogue..
Having received no testimony- a motion was made by Trustee Kujawski
seconded by Trustee Bredemeyer it was
RESOLVED that this public hearing be and hereby .is closed by
unamious vote of the Board.
Meeting reconvened at 8:19 P::M.
TRUSTEE SMITH: The first application is an application for
Mr. Ralph Grandinetti to place an offshore mooring in Gull Pond,
e Grenport, using a mushroom anchor.
1. Moved by Trustee. Bredemeyer seconded by Trustee Bednoski it was
RESOLVED to DENY without prejudice the application for Ralph .
Grandinetti to place a mushroom mooring in Gull Pond, and be it
further
RESOLVED that the Clerk is hereby authorized and directed to
send a letter to Mr. Grandinetti stating that: "As it seems now
there is no open space in Gull Pond. We conducted a survey ✓
- a couple of years ago with a map provided by Mr. Geideman. We
went around and up-dated all of the moorings in the creek, and
at this time it is full, so there is no room- at this time for
a private mooring. The trustees would be happy to meet with
you if you can secure -a location for the mooring.

2. Moved by Trustee Smith seconded by Trustee Bredemeyer it was
RESOLVED .that the Board of Town Trustees declare lead agency
on the Wetland Application of Theodore Krukowski to construct
a catwalk and floating dock and to moor a boat on property
located at 15 Stillwater Avenue, Cutchogue.
2. VOTE OF BOARD: AYES: ALL
This resolution was declared duly adopted.
TRUSTEE SMITH: Number three is an environmental assessment on the
application of Tosca Holding & Realty Company to construct a groin
at Huckleberry Hill, East Marion.
3. Moved by Trustee Smith seconded by Trustee Kujawski it was

RESOLVED to TABLE making the Environmental Assessment on the
R " Wetland application of Tosca Holding & Realty Company, seeing
that there is a question of a groin nearby which may be put in
' illegally, and be it further
RESOLVED that the Clerk is hereby authorized and directed to
send a letter to the DEC regarding the illegal _groin.

This resolution was declared duly adopted.
TRUSTEE SMITH: Next is another environmental assessment for Charles
H. Thomas, I would like to ask to waiver- the formal .reading of the
resolution declaring a negative declaration on this application.
Are there any objections? (No comment. )
4. Moved by Trustee Bredemeyer seconded by Trustee Kujawski it was
RESOLVED to make a negative declaration on the application of
Charles H. .Thomas.
4. VOTE OF BOARD: Ayes: All
This resolution was declared duly adopted.
TRUSTEE SMITH: Environmental assessment on the wetland application
of John S. Tessier. Again I would like to ask to. waiver the formal
reading of the Enivronmental Assessment. (No comment. )
5. Moved by Trustee Kuj.awski seconded by Trustee Smith it was
RESOLVED that the Wetland Application submitted by John S. Tessier.
on -behalf of the Gardiner. Bay Estates to maintenance dredge& fill in
Spring. Pond, East Marion was determined to have a SIGNIFICANT
EFFECT and Type 1 project because of the amount of dredging that
will occur.
5. VOTE OF BOARD: AYES: ALL
This resolution was declared duly adopted.
TRUSTEE KUJAWSKI: The applicant will be requested to prepare a
draft environmental impact statement according to the SEQRA
regulations. He will have to consider all the environmental aspects
of this project in further detail. There will be a public hearing
coming up on this.
SECRETARY: There is no time limitation on the DEIS . You can't
hold a public hearing, or you will have to make a decision within
thirty days of the public hearing on the application, under the W.O.
TRUSTEE KUJAWSKI: What I 'm saying is until we recieve the DEIS
let's not schedule the public hearing.
SECRETARY: You wouldn't.
TRUSTEE KUJAWSKI: Fine.
TRUSTEE SMITH: Next is another Environmental Assessment on Port of
Egypt Marine & C&L Realty. What' s your. pleasure on this one?

TRUSTEE BREDEMEYER: We may have to discuss the spoil area a little
more thoroughly. I would think it is non-significant.
6. Moved by Trustee Bredemeyer seconded by Trustee Smith it was
RESOLVED that a non-significant determination be made on the
Wetland Application of Port of Egypt Marine & C&L Realty for
maintenance dredging and filling on property located on the
Main Road, Southold.
6. VOTE OF BOARD: AYES: ALL
This resolution was declared duly adopted.
TRUSTEE SMITH: Number 7 is an. Environmental Assessment on the
Wetland Application of John Newman to to construct rip-rap,
remove solid-fill walk and replace with an open pile-supported
structure: construct docks, remove and replace bulkheads and
dredge on property located on Sailors Needle Road, Mattituck.
This is right across the creek from Strong's Marina. Frank do.
you want to take this one?
TRUSTEE KUJAWSKI : I was hoping someone representing Mr. Newman
would be here. I don't know if we can do this without ,his agreeing.
TRUSTEE BREDEMEYER: In his absence I .would think we would have to
positive deck this. We were going to ask him to segment this
application anduwe would consider .handling part of it at a future
date.
TRUSTEE KUJAWSKI: I 'll offer a motion to TABLE this application
with the understanding that we will send a letter to Mr_ Newman.
advising him that we would positive .deck this project if the
dredging is included but are willing to consider the project with-
out the dredging as non-significant.
TRUSTEE BREDEMEYER: I ' ll second that motion.. This applicant is
trying to do something that we and the DEC would like to do. He
is coming in with a full bill of particulars what he wants to do,
and this enables us to work with the applicant, and see a way through.

RESOLVED to APPROVE the Wetland and Trustee applications for
Carlo DeGaudenzi for work on property located at 3520 Ole
Jule Lane, Mattituck, all in accordance with the application
submitted.

12. Moved by Trustee Bredemeyer seconded by Trustee Kujawski it was
RESOLVED to APPROVE the Wetland and Trustee application for
Bess Pulitzer for work on property located on Main Road, Orient
with the provision that any excavated areas where there is spartina
grass, the grass must be replaced, as recommended by C.A.C.

RESOLVED to APPROVE the Wetland and Trustee applications submitted
by Leonard Beckenstein for Lot no. 3 and Lot no. 8 in Mattituck all
in accordance with the applications submitted.

RESOLVED to APPROVE the Wetland application for Stephen Shilowitz

accordance with the application submitted.

RESOLVED to APPROVE" the Wetland and Trustee Applicationf for June
Hussey for work on property located at 1065 Fleetwood Road,
Cutchogue, all in accordance with the application submitted.

17. Moved by Trustee Kujawski seconded by Trustee . Bednoski it was
RESOLVED that the Board of Town Trustees declare lead agency on
the Wetland Application submitted by En-consultants on behalf of
Richards to construct a dock, hingedramp and tioatsecured.

TRUSTEE SMITH: John will you take this one for Constantine P.
Geor iopoulos.
TRUSTEE BREDEMEYER: This is the one I think the DEC would have
interest in as well as the County Health Dept. This applicant
proposed to fill wetland and construct a single family dwelling
on a spur road leading to Great Pond, which is considered a class
I, or has a class of open body of fresh water, with. potential use
of drinking water supply and fully .associated values for social_,
economic, and environmental values. It also has a whole list of
indicator plants. I think we would like to coordinate lead agency
status or request the DEC to take lead agency.
TRUSTEE SMITH: Didn't this come up once before?
SECRETARY: Yes. This is. a new application. They went before
the Town Board, the application was denied without prejudice.
Now they are submitting ..another application-which is a request
to fill an even greater amount.
TRUSTEE KUJAWSKI: I concur with this . Something this significant
we are going to need. a little expertise and we need. .
TRUSTEE SMITH: Do you want the DEC to take lead agency?
TRUSTEE KUJAWSKI: ,:_ Definitely. we need their staff.
TRUSTEE SMITH: I ' ll go along with that.
TRUSTEE KUJAWSKI: Jay.
TRUSTEE BREDEMEYER.: I move that we coordinate lead agency with
the DEC informing them of our concerns. They may wish to
take lead agency. It' s done by agreement.
TRUSTEE KUJAWSKI: I ' ll second that.
18. Moved by Trustee Bredemeyer seconded by Trustee Kujawski it was
RESOLVED to TABLE the application of Constantine P. Georgiopoulos

TRUSTEE KUJAWSKI: This is an assessment of an application that we

Trustee Bredemeyer and myself to look at the long range plans for
Strongs Marina. The application was modified slightly to become' 'a

retaining wall, leaving the material and spartina grass in front
of it and yet removing some of the bog down below so that the
catwalk can be brought in. With that understanding I would move
to make a non-significant determination on this project.

Trustees of the Town of Southold, at the Southold Town Hall, Main
Road, Southold, New York on WEDNESDAY, DECEMBER 26, 1984 on the
following applications for permits under the provisions of the Wetland
Ordinance of the town of Southold, to commence at 8 : 00 P.M. :
In the matter of the application of CHARLES H. THOMAS to
construct a dock structure on property located at 306
Trumans Path, East Marion.
In the matter of the application of PORT OF EGYPT ENT. , INC.
& C. &L. REALTY CO. to maintenance dredge and fill on property
located on Main Road, Southold.
In the matter of the application of STRONGS MARINE CENTER
submitted by En-Consultants, Inc. to install a timber retaining
wall, to remove bog, which has fallen into the creek, by back-
hoe, and float dock, in James Creek, on property located at
Camp Mineola Road, Mattituck.

RESOLVED to declare lead agency on the wetland application of
Martin and Florence Gellman to repair and extend existing dock and
to place removable ramp and floats with pilings in Mattituck Creek,
Mattituck.

RESOLVED to grant permits, under the grandfather clause to Mr. Norman
Wenk - bulkhead in .James Creek, and Joyce G. Monk - dock structure in
East Creek, all in accordance with the applications submitted.

�( In the matter of John Hartungs, Old Harbor Road, New Suffolk,
the Board agreed that a storm damage permit would be issued .to
Mr. Hartungs to reclaim sand lost into the creek from the March
storm and to place it behind the repaired bulkhead. No Trustee
permit will be required.
In the matter of Mr. Eugene Burger residing on Stillwater Avenue,
:. Gutchogue for a determination on the need of a permit for work
O ,(,"to be done, it was the consensus of the Board that Mr. Burger
would have to prepare the necessary applications for a dock,
to. be. submitted to the Trustee office for processing.
In regard to the letter . from Jerry Goehringer, Chairman, Zoning
Board of Appeals regarding property located on the corner of
Lighthouse Road and Soundview Avenue, Southold. Trustee Bredemeyer
indicated that under Chapter. 97, Article I, section. 97-13, Sub-
section. under-Wetlands, B. "Freshwater wetlands as defined in
Article 24, ' Title I, 2470107, Subdivisions l (A) to 1 (D) inclusive,.
of the Environmental Conservation Law of the State of New York.
[Added 8-26-76 by L.L. No. 2-19761 this would give the Trustees
jurisdiction. Trustee Smith stated that the pond is completely
surrounded by wetlands, and directed that a letter forwarded to
Mr. Goehringer advising him of same.
The Board agreed to schedule a work session to be held' on- December 6 ____ a
7: 00 P.M. to discuss matters relative to houseboats.
Trustee Smith directed that a letter be sent to Mr. Rowland Clark
to see if he is interested in hosting a meeting of the East End
Trustees.
There being no further business to come properly before the Board
at this : time a motion was made by Trustee Kuj'awski and seconded
by Trustee Bredemeyer and it was further _
RESOLVED that this Trustee meeting be and hereby is Adjourned.
