Smith, Trustee John Bredemeyer, Trustee Frank Kujawski, Trustee John Bednoski, Bay Constable Don Dzenkowski, Mr. James Redman, N.Y. S. D.E.C. . Secretary Ilene Pfifferling The Trustees discussed the protocol for operating the Arshamomaque Pond "Conditional Clamming Program" and -the criteria- to be met: When not more than 0 . 25 inches of rain is recorded for each of seven successive days, the area shall be "opened" (conditionally certified) on the eight day for shellfish harvesting and shall- remain "open" until greater than 0 . 25 inches of rain is recorded in 24 hours. A permanently bound book must be maintained to provide proof of telephone calls showing the time and date of the calls, the caller and the recipient of the calls. The procedure is that daily, as early as possible each a.m. the rain gauge is read and recorded in the record book. Daily, after reading the rain gauge, call. the Radio Station WLNG and WBAZ and request that the announce, "The Arshamomaque Pond conditional clamming is OPEN (CLOSED) on day, date. " Daily, after reading rain gauge, call N.Y. S.D.E.C. to provide the rain gauge reading and the status of the area. The rain gauge reading is to commence on November 4, 1985. REGULAR MEETING 7: 30 P.M. The regular meeting of the Board of Town Trusees was held on October 30, 1985 at the Town Hall, Main Road, Southold. President HenrV P. Smith opened the meeting at 7: 30 P.M. Present were: President Henry P. Moved by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED to APPROVE the minutes of the AUGUST 28, 1985 meeting. Vote of Board: Ayes: All This resolution was declared duly adopted. Moved by Trustee Bredemeyer seconded by Trustee Kujawski it was RESOLVED to APPROVE the minutes of the SEPTEMBER 25, 1985 meeting. Vote of Board: Ayes: All This resolution was declared duly adopted. Trustee Smith advised that the field inspections will be held on NOVEMBER 21, 1985 departing from Town Hall at 2 : OO P.M. , the date for the next regular meeting will be held on NOVEMBER 27, 1985 _ at 7: 30 P.M. . President Smith gave the Trustee monthly report for September 1985 as follows: Application Fees $65. 00 , Bulkhead fees $400 . 00, Wetland Inspection fees $55. 00, Wetland Application fees $450. 00, Dock & Ramp fees $289. 50 and Mooring Renewals $100 . 00 for a total amount of $1359 . 50 which has been submitted to the Supervisor to be placed into the general fund. II. PUBLIC NO^1ICES: 1. N.Y.S. D.E.C. RE: Notice of Complete Application for Ruth Bohn to subdivide a 81, OOO sq. ft. parcel into two residential lots (one already developed with a single-family residence, swimming pool, etc. ) located on Beebe Drive, East Cutchogue, New York. Future development of remaining lot shall require filing for a N.Y.S. D.E.C. Wetland Permit. Comments by October 11, 1985. 2. N.Y. S. D.E.C. RE: Notice of Complete Application for Joyce and Joseph Zevits to construct a single family dwelling with attached x T '—deck, approximately 29 ' to the intertidal marsh. Install a sanitary system along the east side of Little Peconic Bay Lane and approximately 100 ' landward of the intertidal marsh. Sanitary system shall be less than 100 ' from proposed well and adjacent wells. Project is located on the east side of Little Peconic Bay Lane, West Lake, Southold. Comments by: October 18, 1985. 3. N.Y. S. D.E.C. RE: Notice of Complete Application for C. Bruce Stai er to subdivide 51, 000± sq. ft. into two lots - .#.1 - 22,.775 sq.. ft. and Lot #2 - 23, 518 sq. ft. Department of the Army - New York District Corps of Engineers Re: Notice of Application for Ingeborg Mueller to construct a four ft. by seventy ft. fixed pier, two and-- ft. by sixteen ft. ramp and six ft. by forty ft. floating pier secured by two timber piles. Property is located on Westview Drive, Mattituck. Comments by October 15, 1985. 5. Department of the Army - New York District Corps of Engineers Re: Notice of Application for Matt-a-Mar Marina to construct a floating dock assembly consisting of a y 35 ft. fixed elevated ramp (a minimum of 4 ft. above grade) a 3 ft. by 15 ft. hinged ramp and eighteen 5 ft. by 24 ft. floats (432 lin. ft. ) A 5 ft'. by 30 ft. float would also be attached at a slight angle to the western end of the 432 ft. float assembly and be secured to an existing bulkhead by a 2 ft. by 24 ft. float in Mattituck Creek, Mattituck. Comments by October 20, 1985 . 6. U. S. Army Corps of Engineers Re: Public Information Announcement to describe the Dept. ' s Nationwide Permit program and to list current nationwide _permits which are revelant to the repair activities which will be taking place. 7 . U. S. Army Corps of Engineers Re: Public Information Announcement to describe the Regional General Permits issued for waters of the United States. President Smith proceeded with the Communications. 1. From the Land Use Company a letter advising that the application for the Marina Bay Club should be held pending submission of a site plan to the Planning Board for the project. 2 . From the Southold Town Baymen' s Association information regarding the June Hussey application. 3. From Southold Town Baymen' s Association, Inc. regarding Hallocks Bay. 4. Town Attorney Tasker regarding the Harbor Lights subdivision. 5. James H. Redman, N.Y. S. D.E.C. regarding a conditional shellfish permit for Arshamomaque Pond. 6. Regina S. Pyle regarding a possible violation of the wetlands on Fisher' s Island. 7. Henry J. Tremblay request for an extention on permits. Moved by Trustee Smith seconded by Trustee Kujawski it was . RESOLVED to Approve a six month extention on wetland permit no. 219 and Trustee Permit no. 1902 permit will expire on April 29 , 1986 Vote of Board: Ayes: All 8 . From Thomas F. Rewinski, President of the Southampton Trustees.. 9. James M. Manski, U. S. Army Corps of Engineers: Re: Robert D.ier. Moved by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED to accept the letter withdrawing the wetland application for. Helen D. Reiter. Vote of Board: Ayes:. All This resolution was declared duly adopted. 12 . From the Orient Association a letter in regard to Hallock' s Bay, Orient. IV. PUBLIC HEARINGS: Moved by Trustee Kujawski seconded by Trustee Bredemeyer it was RESOLVED that the Town Trustees of the Town of Southold hereby calls a recess of their regular meeting at this time 8: 00 P.M. , to conduct following public hearings: 8: 00 P.M. - In the matter of the application of Mattituck Inlet Marina for a wetland permit. 8: 02 P.M. - In the matter of the application of Kathleen A. Newmann for a wetland permit. 8: 04 P.M. - In the matter of the application of Paradise Shores Property Owners Association for a wetland permit. 8: 06 P.M. - In the matter of the application of Reydon Shores Property Owners Association for a wetland permit. 8: 08 P.M. - In the matter of the application of Anthony Forosich for a wetland permit. 8: 10 P.M. - In the matter of the application of Dolores Holman for a wetland permit. 8: 12 P.M. - In the matter of the application of Lars Torkelsen for a wetland permit. 8: 14 P.M. - In the matter of the application of J. MATTITUCK PARK COMMISSION - LEAD AGENCY DECLARATION Moved by Trustee Bredemeyer seconded by Trustee Bednoski it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the Application of Mattituck Park Commission for a Board of Trustees - October 30, 1985 - Page 6 . wetland permit on certain property located on Peconic Bay Blvd. , Mattituck. 5. ALFRED & MARGARET MIESEMER - MOORING APPROVAL Moved by Trustee Bednoski seconded by Trustee Bredemeyer it was RESOLVED that the Southold Town Trustees APPROVE the mooring application submitted by Alfred & Margaret Miesemer to secure - a permit for an offshore mooring. in Little Creek, Cutchogue, using public access with the provision that the boat does not swing into any other boat or impede navigation. 10. Because there has .been. .no response in .the allotted time .from the New York State Department of Environmental Conservation and the Southold Town Building Department, it is assumed that there are no objections nor comments from those agencies . 11. SIGNIFICANT ENVIRONMENTAL DECLARATION NOTICE OF SIGNIFICANT EFFECT ON THE ENVIRONMENT APPLICATION NO. 312 NAME: Thomas W. Cramer This notice is issued pursuant to the provisions of. The intertidal marsh is extremely close to this property. 2. Within the marsh there are a variety of species of nesting fowl. 3. .. DANIEL SILVERMAN - ENVIRONMENTAL ASSESSMENT Moved by Trustee Bednoski seconded by Trustee Kujawski it was RESOLVED to declare the following environmental declaration: S.E.Q.R.A. SIGNIFICANT ENVIRONMENTAL DECLARATION NOTICE OF SIGNIFICANT EFFECT ON THE 'ENVIRONMENT APPLICATION NO. 314 NAME: Daniel Silverman This. notice is issued pursuant to the provisions of Article 8 of the Environmental Conservation Law, Part. 617 of Title: 6 of the New York State Codes, Rules and Regulations, and Chapter 44 of the Southold Town Codes, the Southold Town. Trustees,. as lead agency, does hereby determine that the action described below is. a Type 1 Action and is likely to have a significant effect on the environment and that a Draft Environmental Impact Statement. is requested to be prepared. TYPE OF ACTION: Type 1 DESCRIPTION OF ACTION: To construct a dock and dredge approximately 150 cu. yds. of dredge spoil to be removed to upland site. An alternate dredge spoil method is to construct an intertidal wetland on location Shown. LOCATION OF PROJECT: Town of Southold, County of Suffolk, more particularly known as: Wunneweta Road, Nassau Point Cutchogue, Suffolk County Tax Map No. 1000-111-14-32 . REASONS SUPPORTING THIS DETERMINATION: 1. The unanimous disapproval of the Conservation Advisory Council. 2. The environmental magnitude of the project in this small pond. 3. The controversy surrounding this project, from the immediate neighbors. 4. The precedent that would be set to begin dredging ,in an area like this and the subsequent applications that would come before the board, by lots of other people who have been denied dredging in a small area like this. 5. The inability of getting a barge in there. 15. VOTE OF Board: Ayes: Trustee Kujawski, Trustee Bednoski No: Trustee Smith, Trustee Bredemeyer This resolution was not carried. 22 Board of Trustees - October 30, 1985 - Page 12 . Moved by Trustee Smith seconded by Trustee Kujawski - it was Resolved to Table the application of Daniel Silverman until the January, 1986 meeting. Vote of Board: Ayes: All . This resolution was declared duly. adopted. The Trustees commenced with the approvals of the Wetland Application= as follows: 16- A. MATTITUCK INLET MARINA - APPROVAL Moved by Trustee Kujawski seconded by Trustee Bredemeyer. WHEREAS,- En-Consultants, Inc. on behalf of Mattituck Inlet Marina applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated July 18, 1985 and; WHEREAS, said application was referred to the Southold Town Conservation Advisory' Council for their findings and recommendation and, WHEREAS, a public hearing was held by the Town Trustees with respec to said application on October 30, 1985 at .which time all inter -:e persons were given an opportunity to be heard, now, . therefore, i RESOLVED that En-Consultants, Inc. on behalf of the Mattituck Inlet Marina be granted permission under the provisions of the Wetland Ordinance of the Town of Southold, New York, all in accordance with the application. This permit will expire on October 30, 1986 if work has not commenced by said date. There shall be two inspections required; and the Trustees shall be notified when the project is complete. 16-A. NEUMANN - -WETLAND APPROVAL Moved by Trustee Kujawski seconded by Trustee Bredemeyer WHEREAS, the North Fork Marine Construction, Inc. on behalf of Kathleen A. Neumann applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated July 31, 1985 and WHEREAS, said application was referred to the Southold town Conservation Advisory .Council ..for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on October 30, 1985 at which time all interested persons were given an Lopportunity to be heard, now, therefore, be it RESOLVED that North Fork Marine Construction, Inc. on behalf of Kathleen A. Neumann be granted permission under the provisions of the Wetland Ordinance of the town of Southold, New York, all in . accordance with the application. This permit will expire on October 30 , 1986 if work has not commenced by said date. There shall be two inspections required; and the Trustees shall be notified when the project is complete. 16-B. Mrs. Walker of Stype Real Estate, Inc. requested a. determination on the need of a wetland permit regarding property of Ernest Sauer. The Board personally visited the subject property and it was determined that a wetland permit would be required. The secretary has forwarded a letter to the Stype Real. Estate c/o Mrs . Walker along with a wetland application .for their pursual. A request was made by Gerald Doroski for a determination on the need of a wetland permit to fill on property located off of a R.O.W. off of the North Road, Peconic. The Board made a site inspection on "October-- 24, 1985. The subject parcel was not properly staked so the Board directed that a letter be forwarded to Mr. Doroski advising him to properly stake the parcel for a reinspection on November 21, 1985.
