Box 728 Southold, New York 11971 SEPTEMBER 25, 1985 7: 30 P.M. - REGULAR MEETING The regular meeting of the Board of Town Trustees was held on September 25, 1985 at the Town Hall, Main Road, Southold. President Smith opened the meeting at 7: 30 P.M. Present were: President Henry P. Smith Trustee John Bredemeyer (arrival at 7: 35 P.M. ) Trustee Frank Kujawski Trustee John Bednoski Secretary Ilene Pfifferling Moved by Trustee- Kujawski seconded by Trustee Bednoski it was RESOLVED to APPROVE the minutes of the regular meeting of August 1, 1985. Vote of Board: Ayes: All This resolution was declared duly adopted. Moved by Trustee Kujawski seconded by Trustee Smith it was RESOLVED to APPROVE the minutes of the Special Meeting of Sept. 10, 1985 Vote of Board: Ayes: All This resolution was declared duly adopted. Moved by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED to APPROVE the mooring renewals for November 1985 . Vote of Board: Ayes: All This resolution was declared duly adopted. Trustee Smith advised that the next regular meeting will be held on October 30, 1985. Inspections will be held prior on October 24, 1985 departing from Town Hall at 2: 00 P.M. President Smith gave the Trustee Monthly Report for August 1985 as follows: Application fees $160. 00, Wetland Inspection fees $45 . 00 Wetland Application fees $400. 00, Dock, Ramp fees $152. 75 and Mooring renewals $155. 00 for a total of $912 . 75 received and forwarded to the Supervisor' s office. Army Corps of Engineers: Notice of Application for James N. Bailey to construct a series of walkways, stairs, platforms an an irregular shaped deck mostly above mean high water leading down to a 15 ft. x 4 hinged ramp and a loft. by 10 ft. float on property located on Block Island Sound, Fishers Island. 2. U. S. Army Corps of Engineers: Notice of Application for Robert Kock to reconstruct a timber groin and installation of a ramp, float and timber. piles on .property located in Laurel, on Peconic Bay. 3. U. S. Army Corps of Engineers: Notice of Application for June L. Hussey to replace an existing bulkhead and dredge wit"F'p a-7 nd disposal on East Creek, Cutchogue. III. COMMUNICATIONS: 1. SUSAN AND VQALTER GREEN MoveTryMusTeele Smith seconded by Trustee Bredemeyer it was RESOLVED to APPROVE the mooring application for Susan & Walter Green, 3165 Pine Neck Road, Southold to secure a permit for an offshore mushroom in Jockey Creek, Southold, with the provision that a fore and aft anchor is'-used, with a minimum. of 150 lb. anchor is used on the bow. Inspection is to be made by the Bay Constable for the location of the mooring. 1. BRENEISEN = Moved by Trus ee mi seconded by Trustee Bednoski it was RESOLVED to APPROVE the mooring application of Albert J. Breneisen to secure a permit for an offshore mooring using. a 100 lb. anchor in Gull Pond, property is located at 71. Dawn DRive, Greenport, with the provision that a temporary marker is placed in the creek and subsequent inspection and approval by the Bay Constable for the location of same. 2. VOTE OF BOARD: AYES: ALL This resolution was declared duly adopted. 3. DONALD COCKS Moved by Trustee Kujawski seconded by Trustee Smith it was RESOLVED to APPROVE the application of Donald Cocks to secure a permit for an offshore mooring in Mattituck Creek, Mattituck, property is located on Inlet Drive, Mattituck, with the provision that the boat does not swing into any other boat or impede navigation. 3. VOTE OF BOARD: AYES: ALL This resolution was declared duly adopted. 4. HERBERT MANDEL Moved by Trustee Bednoski seconded by Trustee Smith it was RESOLVED to APPROVE the application of Herbert Mandel to secure a permit for the addition of a. 6 ' x 30 ' section to an existing dock on property located at 1000 Inlet Lane, Green port. 4. VOTE OF BOARD: AYES: ALL This resolution was declared duly adopted. 5. DR. AND MRS. LUCHSINGER Moved by- Trustee Rujawski seconded by Trustee Bednoski it was RESOLVED that the Town Trustees of the Town of Southold hereby grant a WAIVER on the need of a wetland permit for Dr. and Mrs. Luchsinger for the construction of an addition to an existing residence and a deck on the property, subject to the following provisions: 1. Roof ' run off shall be discharged into dry wells. 2. Care should be taken so as to preclude the entry of any construction material into adjacent waters. 3. Immediately following construction, all areas of exposed soil shall be properly protected with suitable erosion control devices and/or vegetated to prevent entry of eroded soil into nearby waters. 5. Phyllis Birkby, Architect for the addition of an 8 ' x 13 ' 8 room to an existing single family residence located on Soundview Avenue, Southold, subject to the following provisions:' 1. 'Roof run off shall be discharged into dry wells. 2. Care should be taken 'so as to preclude the entry of any construction material into adjacent waters. 3. RAYMOND SWEENEY Move by Trustee Bredemeyer seconded by Trustee Bednoski it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Raymond Sweeney submitted by the North Fork Marine Construction, Inc. for a wetland permit on certain property located at 12 Sandy .Beach Road, Greenport. 8. S.E.Q.-R.A SIGNIFICANT DETERMINATION NOTICE OF SIGNIFICANT EFFECT ON THE ENVIRONMENT Moved by Trustee Kujawski- seconded by Trustee Bredemeyer; WHEREAS, The Land Use Company on behalf of the Marina Bay Club has heretofore applied to the Southold Town Trustees, pursuant to Chapter 44 of the Code of the Town of Southold for permission to reconstruct an existing marina by installing 130 Slips, catwalks, and floats. . Area will be maintenance dredged to 6 ' at mean low. water. Approximately 22, 000 cu. yds. of ' sand will be removed and placed landward of proposed 680 ' of new bulkhead, on property:,located on Main Street, New Suffolk. NOW, THEREFORE, IT IS RESOLVED AS FOLLOWS: I 1. That pursuant to the provisions of Article 8 of the Environmental Conservation Law; Part 617 of Title. 6 of the New York State Code, the Southold Town Trustees, as . lead agency, does hereby determine that. the action proposed is a Type I Action, and is likely to have a Significant Effect on the environment. It is noted that the Trustees have received numerous letters of concern regarding parking, sewage and fresh water. The Conservation Advisory has advised that they have questions and concerns regarding this application. 2. That the Secretary to the Trustees shall immediately file and circulate such determination as required.:by the aforementioned law, rules and code. 3. That the- Secretary to the Trustees shall immediately notify' the applicant, The Land Use Company on behalf of the Marina Bay Club and further request said applicant to prepare a Draft Environmental Impact Statement, all in accordance with said law, rules and code 9. Trustee Smith advised that they should put their application in to the Trustee office, and that the permit process takes approximately three months for approval. Mr. DeLumba discussed this matter with the Board further— The Trustees requested that the secretary locate the map of Mattituck Creek, to try to determine the width of the Federal Channel. The Board will have to ascertain if the spiles will be in Town or Federal waters, as proposed by Mr. DeLumba. It was the consensus of the Board to meet with Mr. DeLumba and the Bay Constable on October 4, 1985 at 4: 30 P.M. at the site on Naugles- Road, MaETTEuck. Mr. Sidoro, a Mattituck resident advised that the Board should inspec e' property at both low and high tides. The Trustees explained that they were looking for the width of the Federal Channel verses the total width between the jettys. Mr. Thomas Cramer appeared before the Board in regard to his app cation tor a wetland permit. The Board advised that they will be making a site inspection on October 24, 1985 and recommended that he call the Trustee Office if he had any questions. They also recommended that he stake the premises for inspection. Mr. Michael Carlucci appeared before the Board in regard to his application or a we an perms .
