Box 728 Southold, New York 11971 AUGUST 28, 1985 - 7: 30 P.M. - REGULAR MEETING The regular meeting of the Board of Town Trustees was held on August 28, 1985 at the Town Hall, Main Road, Southold. President Smith opened the meeting at 7: 30 P.M. PRESENT WERE: President Henry P. Smith Trustee John Bredemeyer Trustee John Bednoski Trustee Frank Kujawski Secretary Ilene Pfifferling Moved by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED to APPROVE the mooring renewals for OCTOBER, 1985. Vote of Board: Ayes: All This resolution was duly adopted. Trustee Smith advised that the date for the inspections will be held on September 18, 1985 starting at 2: 00 P.M. departing from Town Hall. The date for the next regular meeting will be held on September 25, 1985. President Smith gave the Trustee Monthly Report for Zuly, 1985 as follows: Application fees $335. 00, Wetland Inspection fees $30. 00, Wetland Application fees $350. 00, Dock & Ramp fees $424 . 00 and Mooring Renewal fees $110. 00 for a total of $1, 249. 00 which has been forwarded to the Supervisors office to be placed in the general fund. Trustee Smith requested that Trustee Bredemeyer read the public notices as follows: 1. New York State Dept. of Environmental Conservation Notice of Complete Application: Margaret Wagenr to construct a 370 sq. ft. deck, approximately 40 ' from the tidal wetlands. A variance is requested from the minimum required setback of 751 , pursuant to Part 661, Tidal Wetland Land Use Regulation. Property is located on a private road fronting Carey Harbor, approximately 2 mile south of Main Bayview Road, Southold. Comments by: August 30, 1985. 2. New York State Dept. of Environmental Conservation Notice of Complete Application: Stephen & Lilly Horowitz Board of Trustees - August 28, 1985 - Page 2. to construct a 40 ' x 60' single family dwelling, paved parking and driveway with on-site sanitary system between the "Channel" of Wunneweta Pond approximately 500 ' west of Wunneweta Road, Nassau Point, Cutchogue. Comments by: August 30, 1985 Trustee Smith: Now we will proceed with our communications. 1. Monson Re: Extension on wetland permit no. 183 7. Moved by Trustee Bredemeyer seconded by Trustee Bednoski it was RESOLVED to APPROVE an extention on permit no. 183 for Bernard 0. Monson for a period of six months. This permit will expire on April 25, 1986. Vote of Board: Ayes: All This resolution was declared duly adopted. 8. John Bredemeyer, III Re: Hallock' s Bay, Orient The Board discussed this correspondence. Trustee Smith advised that it was his understanding that this was a request made by the -Bay Constable. The intention was to have a maintentance permit on file, in the event the .area filled in, that the County could maintenance dredge. Moved by Trustee. Meeting reconvened at 9: 00 P.M. Trustee Smith asked if there was anyone in the audience who wished to address the Board before proceeding with the resolutions? Mr. . Thomas Samuels asked the Board if there was any provision for waivers? The Trustees advised him that there are provisons for waivers. They advised that a letter would have to be submitted with a site plan. The Board would then review same, inspect the . site. and do a resolution to waiver, if that was the determination of the Board. Mr. Charles Bowman, of the Land Use Company appeared before the Board regarding the wetland application of Daniel Silverman. After some discussion, it was determined that Mr. Bowman will withdraw the application before the Board and resubmit same at a future date. V. RESOLUTIONS 1. KATHLEEN A NEWMANN - LEAD AGENCY DECLARATION Moved by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED that the Town Trustees declare itself lead agency in the matter of the application of North Fork Marine Construction Inc. on behalf of Kathleen A. Newmann for a wetland permit on certain property located on the Fox Estate, South of Mill Road, Mattituck. 1. Vote of Board: Ayes: All This resolution was declared duly adopted. 2 . HOWARD SHAPIRO - LEAD AGENCY DECLARATION Moved by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Howard Shapiro submitted by En-Consultants, Inc. for a wetland permit on certain Property located on Anchor Lane, Southold. 4. . ANTHONY FOROSICH - LEAD AGENCY DECLARATION Moved by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Anthony Forosich submitted by En-Consultants, Inc. for a wetland permit on certain property located at 1405 Anchor Lane, Southold. 5. Vote of Board: Ayes: All This resolution was declared duly adopted. 6. DOLORES HOLMAN - LEAD AGENCY DECLARATION Moved by Trustee Kujawski seconded by Trustee Bednoski it was . RESOLVED that. the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Dolores Holman submitted by En-Consultants, Inc. for a wetland permit on certain property located at West Lake Road, Southold. 6. JAMES DELEHANTY Moved by Trustee Kujawski seconced by Trustee Smith it was RESOLVED to APPROVE the application of James Delehanty for an offshore mooring in Mattituck Creek, Mattituck. 8. JAMES HUGHES Moved by Trustee Smith seconded by Trustee Kujawski it was RESOLVED to APPROVE the application of James Hughes to secure a permit for an offshore moorin .,.in Richmond Creek, Southold. 9. Vote of Board: Ayes: All This resolution was declared duly adopted. 10 . JOHN KRAMER Moved by Trustee .Smith seconded by Trustee Kujawski it was RESOLVED to DISAPPROVE without prejudice the application of John Kramer to place four spiles 25 ' from the bulkhead in Sterling Creek, Green port. The Board. ;would like a letter of permission from the adjacent property owners. 10. Vote of Board: Ayes: All This resolution was declared duly adopted. 11. T. J. AND HELEN MCDONAGH Moved by Trustee Bednoski seconded by Trustee Kujawski it was RESOLVED to APPROVE the application of T. J. and Helen McDonagh to. secure a permit for an existing stake in West Lake, Southold. 11. Vote of Board: Ayes: All This resolution was declared duly adopted. 12. See Resolution No. 29. PEARSON LEAD AGENCY DECLARATION Moved by Trustee Kujawski seconded by Trustee Smith it was RESOLVED that the Southold Town Trustees declare itself lead Agency in regard to the State Environmental Quality Review Act in the matter of the application of John W.-Pearson for a wetland permit on certain property located at 3258 South Harbor Road Southold. 14. Vote of Board: Ayes: All This resolution was declared duly adopted. 15. JOHN P. CHARLES Moved by Trustee Bredemeyer seconded by Trustee Bednoski it was RESOLVED to APPROVE the mooring application for John P. . Charles to secure a permit for an o s ore mooring in Narrow River, 0rient. 15. Vote of Board: Ayes: All This resolution was declared duly adopted. 16. NANCY ,ELFLEIN- S.E.Q.R.A. ENVIRONMENTAL DETERMINATION Moved by Trustee Bednoski seconded by Trustee. Bredemeyer it was RESOLVED that pursuant to Article 8 of the Environmental Conservation Law State Environmental Quality Review and 6NYCRR Part 617, Section 617. 10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that the Southold Town Trustees as lead agency for tha action described below, has determined that the project, which is unlisted, will not have 'a significant effect on the Environment. DESCRIPTION OF ACTION: Application of the Land Use Company on behalf of Nancy E. Elflein for the construction of s single family dweilling on a pre-existing, non-conforming lot. Article 25 set back of neighboring houses is noted. As are existing sanitary systems. Approximately 200 cu. yds. . of clean fill will be required to raise house to flood plain elevation. Property is located on the corner of Little Peconic Bay Lane and Cedar Point Drive West, Southold. The project has been determined not to have a significant effect on the environment for% the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effect to the environment are likely to occur should the project be implemented as planned. Because there has been a response from the Southold Town Conservation Advisory Council indicating that this project would not have a significant effect to the environment. Because there has been no response in the allotted time from the New York State Department of Environmental Conservation and Board of Trustees - August 28, 1985 - Page 7. the Southold Town Building Department, it is assumed that there are no objections nor .comments from those agencies. 16. Vote of Board: Ayes: All This resolution was declared duly adopted. 17. DORIS TORNLUND - S.E.Q.R.A. ENVIRONMENTAL DETERMINATION Moved by Trustee Ber:edeme'yer:_ second:ed by. Trustee-Kujawski it +was RESOLVED that pursuant to. Article 8 of the Environmental Conservation Law State Environmental Quality Review and 6NYCRR Part 617, Section 617. 10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that the Southold Town Trustees as lead agency for the action described below, has determined that the project which is unlisted will not have a significant effect on the environment. DESCRIPTION OF ACTION: Application submitted by the Land Use Company on behalf of Doris Tornlund to construct a 37 ft. low timber retaining wall along an eroded bank above MHW. Retaining wall will have tow returns, one 20 ft. and one 10 ft. Property is located on. a private R.O.W. off of Pine Tree Road, Cutchogue. The Project has been determined not to have a significant effect on the environment for:::the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effect to the environment are likely to. occur should the project be implemented as planneed. Because there has been a response form the Southold Town Conservation Advisory Council indicating. that this project would not have a significant effect to' the environment. Because there has been no response in the allotted time from the New York State Department of Environmental Conservation and the Southold Town Building Department, it is assumed that there are no�..objections nor comments from those agencies. 17. Vote of Board: Ayes: All This resolution was declared duly adopted. Trustee Smith: The next resolution is for the Marina Bay Club. 18 . MARINA BAY CLUB - S.E.Q.R.A. ENVIRONMENTAL DETERMINATION Moved by Trustee Kujawski seconded by Trustee Smith it was RESOLVED to TABLE the Environmental Assessment on the application of the Marina Bay Club. 18. Vote of Board: Ayes: All This resolution was declared duly adopted. 19. HELEN REITER - S.E.Q.R.A. ENVIRONMENTAL DETERMINATION Moved by Trustee Smith seconded by Trustee Bredemeyer WHEREAS, Costello Marine Contracting Corporation on behalf of Helen D. Reiter has heretofore applied to the Southold Town Trustees, . pursuant to Chapter 44 of the Code of the Town of Southold for permission to construct a 500 ft. timber bulkhead Z Board of Trustees - August 28, 1985 - Page 8 . and a 700 ft. retaining wall. To maintenance dredge 2000 cu. yds. of spoil and to place behind the proposed bulkhead. Property is located approximately 300 ft. south west of Mill Creek Bridge, Main Road, Southold, New York. NOW, THEREFORE IT IS RESOLVED AS FOLLOWS: 1, Pursuant to the provisions of Article 8 of the Environmental Conservation. Law; Part. 617 of Title 6 of the New York State Code, the Southold Town Trustees, as lead Agency, does hereby determine .that the action proposed is a Type l. Action and is likely to have a significant effect on . the environment. 2. That the Secretary to the Trustees shall file and circulate such determination as required by the aforementioned law, rules and code. 3. That the Secretary to the Trustees shall immediately notify the applicant, Costello Marine Contracting Corporation, on behalf of Helen D. Reiter and further request said applicant ' to prepare a Draft Environmental Impact Statement, all in accordance with said law, rules and code. 19. ENVIRONMENTAL .ASSESSMENT Moved by Trustee Bredemeyer seconded by Trustee Bednoski Pursuant to Article 8 of the Environmental Conservation Law State Environmental Quality Review and 6NYCRR Part 617, Section 617. 10 and Chapter 4.4 of the Code of the Town of Southold, notice is hereby given that the Southold Town Trustees, as lead agency for the action described below, has determined that the project which is unlisted will not have a significant effect on:.-.the environment. SOUTHPORT DEVELOPMENT Moved by Trustee Bredemeyer seconded by Trustee Kujawski it was RESOLVED .that the Trustees rescind their resolution adopted on ,7une 26, 1985 (resolution no. 28) declarin .lead agency on the wetland application of Southport Development. 22. WILHELM AND SILKE FRANKEN Moved by Trustee Smith seconded by Trustee Kujawski it was RESOLVED to APPROVE the application of Wilhelm and Silke Franken for a mooring .in Gull Pdnd, Green port subject to the placement of a temporary marker in the creek and review by the Bay Constable for accurate location of the mooring. 23. Vote of Board: Ayes: All This resolution was declared duly adopted. 24. Trustee. Smith: Next we will approve/deny the wetland applications. A. PORT OF EGYPT ENTERPRISES AND C & L REALTY, INC. Moved by Trustee Kujawski seconded by Trustee Smith WHEREAS, the Port of Egypt Enterprises and C & L Realty, Inc. applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated April 14, 1985 WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on August 28, 1985 at which time all interested persons were given an opportunity to be heard, NOW, ' THEREFORE BE IT, RESOLVED that Port of Egypt Enterprises and C & L Realty, Inc. e granted permission under the provisions of the Wetland Ordinance of the Town of Southold,—New York,with the provision that care is a en concerning the marsh grasses west of the ramp This permit will expire on August 28, 1986 if work has not commenced by said date. JOHN KRAMER Moved by Trustee Kujawski seconded by Trustee Smith WHEREAS, John Kramer applied to the Southold Town Trustees for a permit under the- provisions- of the Wetland Ordinance of the Town of Southold, application dated April 20, 1985 and WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and Recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on. August 28, 1985 at which time all interested persons were given an opportunity to be heard, NOW, THEREFORE BE IT RESOLVED that John Kramer is denied without prejedice his request for approval for a wetland permit.,as there are Declarations of Covenants and Restrictions placed on the Map of Harbor Lights Estates which restrict the construction or to maintain a dock or other structures extending out and into the canal. BRUCE RAMBOLI Moved by Trustee Kujawski seconded by Trustee Smith WHEREAS, Bruce Ramboli applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated."April 20, 1985 and WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on. August 28, 1985 at which time all interested persons were given an opportunity to be heard NOW, THEREFORE, be it RESOLVED that Bruce Ramboli be granted permission under the provisions of the Wetland Ordinance of the Town of Southold, New York all in accordance with the application. This permit will expire on August 28, 1986 if work has not commenced by said date. There shall be two inspections. required; and the Trustees shall be notified when the project ids complete. C. Trustee Smith WHEREAS , Robert Frey applied to the Southold Town Trustees for a permit under. the provisions of the Wetland Ordinance of the Town of Southold, application dated April 20, 1985 and WHEREAS , said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS , a public hearing was held by the Town Trustees with respect to said application on August 28, 1985 at which time all interested persons were given an opportunity to be heard, now, therefore, be it RESOLVED that Robert Frey be granted permission under the provisions of the -Wetland Ordinance ot tne- Town of Southold, New York, all in accordance witn tne application.
