The regular meeting of the Board of Town Trustees was held
on THURSDAY, AUGUST 1, 1985 at the Town Hall, Main Road, Southold.
The meeting was opened with President. Henry P. Smith presiding at

Moved by Trustee Kujawski seconded by Trustee Bednoski it was
RESOLVED to Approve the mooring renewals for September 1985 . -
Vote of Board: Ayes: All
This resolution was declared duly adopted.
Trustee Smith advised that the date for field inspections will be held _
on Thursday, August 22, 1985 starting at 2: 00 P.M. departing from Town
Hall, Southold. The date for the next regular meeting will be held on
Wednesday, August 28, 1985 at 7: 30 P.M. .
Trustee Smith gave the monthly report for June 1985 as follows:
Application fees $35. 0,0, Bulkhead fees 87.50, Wetland App ication
fees $750. 00, Wetland Inspection fees $10 . 00, mooring renewals $225. 00
and Dredging fees $75. 00 for a total amount of $1182 .50, which has been
forwarded to the .Supervisor.
PUBLIC NOTICES:
1. New York State Department of Environmental Conservation
Notice of Complete Application for Doris Tornlund to construct a 37 ft.
timber retaining wall, with a 20 ft. return,. on the west and a 10 ft.
return on the east. Alternatives

2. New York State Department of Environmental Conservation: . Notice
of Complete Application for Bayview Development Corp.. to remove .12 -
existing residential cottages with the remaining I ottages to
remain on :19 new lots a minimum of 91000 square feet in area.
Create 30, 000 square. foot lot for common beach area,
2. 5 acre lot for a common dock. area 29 acre parcel and 1.5 acre
parcel to remain. as open space; and 40. 5 acre parcel to be developed
in the future. Install drainage system along Sage Road. at- Arshomomaque,

There was some discussion held regarding this communication and
the Trustees felt a draft environmental impact statement would be
necessary because of- the public controversy, amount of dredging,
and the size of the spoil area.

Re: Wetland application no. 286 South Shore Development.
. It was decided that the Trustees would attend the scoping meeting
to be held regarding this application.

It was the consensus of the board to make a site inspection
to ascertain if the locations recommended by the Conservation
Advisory Council- would be adequate for the dredge spoil..from...the
Jockey Creek dredge project."

Trustee Kujawski: Did you come up with a deed to the bottom there?

Mr. Carlucci: In that particular area that I propose to dredge
there is a question of whether the Trustees own it or not.
Trustee Kujawski: There is no question in our mind', .we feel we own -
_..
Mr. Carlucci: ' We11, the rest of the creek is owned by Mr.:.'John:?:H (
Mulholland.
Trustee Smith: The bottom of the creek?
Mr. Carlucci: Yes, ,.the whole creek.
Trustee Bredemeyer.:. The question of ownership only pertains to
whether or not there is a charge for the dredge spoil if a project
is approved. I .think the concerns we had was the question when you
want to dig below the depth of the existing channel and landward of
the existing water flow you create essentially a hole where you will
collect organic matter and slumping from the side and it will not.
let water circulate normally. . That was our main concern.
Mr. Carlucci: : That is a man made canal there. Fred Horn dredged that
out. What I am doing is no different than what was done..previously
25 years ago. I just want to get rid of the silt that has built up
over the years. The whole creek bottom is about ten acres. I want
to dredge an area 40 ' x 45 ft. which comes out to about 1/100 of
an acre. You talk about an insignificant area, .virse-s -the size of -
the creek.
Trustee Kujawski: But you -are. riot going :to., dredge from that point
out to open water.
Mr,:., .Carlucci: .It wasn't dredged ,that way 25 years ago either. The water
level now is, in my area now-;;.is:,4ft. deep.. Where when you went out
you had 6 inches.-of water at low tide.
Trustee Kujawski: So if you take it down to 4 ft. deep and still 6 inches
out there, the water is going to flow into your hole and leave a mud
flat. Either it is dredge the whole thing, which we are not in favor
of or not dredge. -it.
Mr. Carlucci: Are you telling me water does not seek its own level?
Trustee Kujawski: It will seek its own level.
Mr. Carlucci: Then how will you have the water. . . .The depth in the
creek is the same as the depth in the bay. If I dig a hole at one
end the tide goes out and comes in again, you are telling me that
there will be a mud flat in one area and a deep portion on the other
end.
Trustee Kujawski: I think. .. . You seem determine to do this. You have
a-. boat you -want to moor there. Is that the problem.

Mr. Carlucci: It is that and the whole issue is that I have. a
mud flat in front of my house. Out a ways there is water, ideally
it would be nice to have a channel all the way out. .. Right now I
just want to bring it:.back the way it was.
Trustee Kujawski: The baymen. did not: comment. favorably on this
.application. . They didn't want to start a .president there and permit
one,,;property owner to . dredge this out, and then naturally other
property owners .to come in. I think probably the issue boils down
to, ; I mean we do not grant. many dredging projects at all. It is a
controversial topic. If .it is town bottom then it is questionable
as to whether it is in the public' s interest to be removing it over
the years. It may look like mud but it does-have _it' s productive
benefits. If you feel that .this bottom is .privately owned, and if
it is true that that much mf. the bottom is privately owned, then
most likely yours most likely would be. If. thats the case, then
-the.:problem..will be resolved, because we have very little to . say
about. dredging in* y.our;:.own'.bo.ttom. We will take a look at the
application, under the wetland ordinance, but we would not look at
the removal of your own bottom, the same way as we would look at it
the same way when it is our interest to protect the public' s bottom.
I think that is the avenue that .has to be explored.
Mr. Carlucci: What bothers me about this whole thing; the trustees
have been in the limelight all along on most of the dredging in-,--.the
creeks.
Trustee Smith: Just to keep the mouth open, just the entrance to the
creeks. ---- - -- - -=
Trustee Kujawski: . Nothing inside the creek.
Mr. Carlucci: What about all the projects that have gone on? I don't
understand? Are. you saying that you are totally against dredging projects?
Trustee�..:Kujawski: Marinas we recognize the need, commercial areas,
their business depends on boats coming in and out. Productive creek
bottoms, the creek adjacent tome has one foot at low tide and four
feet at high tide. There are certain types of boats. and certain times
you can'.t go .into the creek. The property .owners have not requested
to dredge it out, even though it would be alot more convenient, because
it is public bottom, it is productive.
Trustee Bredemeyer: Is it unrealistic at this time, to consider .that
there is a possibility of bringing the depth of your project"_:to
constant depth out to a smaller width, in other words to improve
the navigation to -several surrounding properties, so that it wouldn't :,
be just digging a hole at the head of the canal?
Mr. Carlucci: Something like that hasn't been thought of.
Trustee Smith: I think if you came back with permission from the

owner that he is .in favor of the project, Ithink :it would put
a different light on this project.
Mr. Carlucci: Okay. The only other :question' is' there a fee for
this dredging?
Trustee Smith: No. We can't charge you for' what is yours.
10. Peter S. Danowski,: Jr. Regarding property on Mattituck Creek.
Trustee Kujawski: There is -no problem with this. I remember when
we did this for Tom Reeve next door. This is adjacent .to the park.:.
district property. It' s common practice that dredge spoil is put
sb. .that it blocks off a waterfront owner. This is a pretty
significant: area, but on the other hand I don't know what interest
we would have in it. I think we. should pass it on to the Town Attorney
for review.
Trustee Smith: This goes. back to when we originally dredged. They
never applied for it. Everyone else. did. . Pass it on to the Town
Attorney for review.
11. Land Use .Company regarding Walter Wappaus - They are not going
with our recommendation= for the boat ramp. Now. .Mr. Wappaus wants to
reconstruct his bulkhead only. He will have to reapply"for that.
There was objection from the neighbor regarding the construction of
the boat ramp.
On motion made by Trustee Kujawski seconded by Trustee Bredemeyer it was
RESOLVED to rescind the resolution Declaring the Town Trustees lead
agency on the wetland application no. 287 for Walter Wappaus.

This resolution was declared. duly adopted.
12. Mr. James Brown requesting an 'extention .on his permit number 1849.
Moved by Trustee Smith seconded .by Trustee Bredemeyer it was
RESOLVED to grant Mr. James Brown a six month extention on his permit
1849, in Eugenes Creek. This permit will expire on February 27, 1986.
Vote of Board: Ayes: All
This resolution was declared duly adopted.
13: Guy W. -Germano, Attorney at Law regarding the 'Silverman matter.
This is.. a letter advising that the litigation has been terminated.
14. Roy L. Haje, .En-Consultants, Inc. regarding the application of
Stanle-y—W—ernick to mo i y hi.s . application to- construct a re aining
wall. to connect to his neighbors to the west rather than having a
return into the bluff.
Moved by Trustee Bredemeyer' seconded by Trustee -Bednoski it was
RESOLVED to accept the amendment as an attachment to the application
submitted.

15. ' John S. Tessier,. Chairman of the Marine"Committee -for Gardiners-
Bay Estates Homeowners Association, Inc. requesting a 10' year
maintenance dredging permit.
Trustee Smith: It is not the policy of the. Board. of Trustees to
give a ten year maintenance permit. They. will .have to. reapply if
they' need to maintenance dredge again. Now we: .will move on to
our Public Hearings.
Moved by Trustee Bredemeyer seconded by .Trustee Kujawski it. was
RESOLVED to recess the regular meeting to hold the public hearings.

8: 00 P.M. -: In the matter of the application submitted by En-Consultants
Inc. on behalf of William Thompson to add one. 6 'x20 ' float to outer end
of existing dock consisting of 41x36 ' walk, 4 'x16 ' ramp and (2) . 6 'x20 '
floats. Relocate. (2) mooring piles to 15 ' e/o..proposed float. Purpose
of additional float is .to get into deeper waterfor- the owner' s boat.
Amendments to the old permit are. requested. . Property is located on
South Drive, Mattituck.
8: 02 P.M. - In the matter of the application of Dr. Michael Lilly
submitted by En-Consultants, Inc. to rebuild- in same location and
configuration 100± lin. ft. of existing timber bulkhead:. Approximately
25 cu. yds. of clean sand. and loam will be trucked in for backfill.
Project is located at . 2095 Nassau Point Road, Cutchogue.
8: 04 P.M. - In the matter of the application of John Vassil submitted.'-.
by En-Consultants, Inc. . to reconstruct a 5 'x15 ' fixed platform.
Install a 41x12 ' ramp leading to a. 6 'x16 ' float secured by (2).
8" diameter x 20 ' pilings on property located at 495 Salt Lake Lane/
Rochelle Place, Mattituck...
8: 06 P.M. . - In the matter of the application of Lorraine Fabry to .
construct a rear deck on property located at 3700 Deephole Drive,
-Mattituck.
8: 08 P.M. - In the matter of the -application. of John Loretto
submitted by the Chesterfield Association, Inc. to construct
200± lin. ft. of timber bulkhead at the toe of the bluff to prevent
further erosion. Truck. in 200 cu. yds. of clean sand for backfill.
In addition owner will vegetate bluff. Property is located at
Glenn Court, Cutchogue.
There was no testimony taken for or against the above referenced
applications. Trustee Smith reconvened the meeting at 8:25 P.M.
and commenced with the resolutions.

construction of a swimming pool on property located -on Sleepy Hollow
Lane, Southold, subject to the following recommendations:
1. During excavation the fill must' be contained so that it
does not wash into the creek.
2. All discharge from the pool is to be kept out of the creek.
3. . Immediately following construction,. all areas of exposed
soil shall:.. be properly protected with a suitable erosion control
device and/or .vegetated to prevent entry of eroded. soil into the
nearby Waters. '

in regard to the State Environmental Quality Review Act in the matter:,.
of the Application of Costello Marine Contracting Company on behalf
of Helen Reiter for a Wetland Permit on certain property located on
Main Road, Southold.

RESOLVED to TABLE the mooring application submitted by Wilhelm and
Silke Franken for an offshore mooring in Gull Pond, Greenport until
the Board makes -a site inspection as this location is quite congested
and the request is for a 38 ft. boat. .

RESOLVED to Approve the application of Katherine Kennelly to secure
a permit for an offshore mooring_ in Deep Hole Creek, Mattituck, in
front of her own property.

the suggestion that astern anchor is used to secure the boat.

RESOLVED to Approve the mooring application submitted by Anne S. _
Hopkins in Narrow River, Orient, with the provision the boat is
placed on the extreme northern end.

RESOLVED to waiver the need. of .a wetland .permit for Jonathan G.
Litvany for the construction of a home on property located at
Fleetwood Road, Cutchogue subject .to. the following recommendations
1. Roof .run off .shall be discharged into dry wells.
2. Driveways and parking areas within 75 ft. of the wetlands
shall be of porous construction. Blacktop shall not be used on this
site.
3. Care shall be taken so as to preclude the entry of any
construction material into adjacent waters.
4. Immediately following construction, all areas of exposed
soil shall be properly protected with suitable erosion control
devices and/or vegetated to prevent .entry of eroded soil into
nearby waters.

.WHEREAS, Paul T. Canalizo has heretofore applied to the Southold Town
Trustees, . pursuant to,-Chapter 44 of the Code of the Town of Southold
for permission to construct a residence less than 75 ft. from the edge
of a wetland on property located on t e east side ot Meadow ane _
north of New Suffolk Avenue, Mattituc , New York,
NOW; THEREFORE, IT IS RESOLVED AS FOLLO .
1. That pursuant to • the provisions of Article 8 of - the Environmental
Conservation Law; Part 617 of Title 6 of the New York State Codes,
Rules and Regulations, and Chapter 44 of th Southold :Town Code, the
Southold Town Trustees, as lead agency, does hereby determine that the
action proposed is- a Type 1 Action and is likely to have a significant
effect on the environment.
2,. That the Secretary to the Board of Trustees shall file and
circulate such determinatio4 as required by the aforementioned law,
rules and code.

22. LONE STAR INDUSTRIES - 'S.E.Q.-R.A. ENVIRONMENTAL 'DETERMINATION .
Moved by Trustee Kujawski seconded by Trustee. Smith it was
RESOLVED that pursuant to Article 8 of the Environmental Conservation
Law State Environmental Quality Review and: 6NYCRR 'Part 617, Section
617. 10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that the Southold Town Trustees as lead agency for
the action described below, has determined that' the project, which is
unlisted, will. not have a significant effect on the Environment.
DESCRIPTION OF. ACTION: Application of Lone Star Industries to place

E. For-projects involving activities to be accomplished over a period or more
than one year, the permittee shall notify the Regional Permit Administrator
in writing at least 48 hours-to -the- comreencement of resumption of work each- .

F. If project design modifications take place after permit issuance, the permit-
tee shall submit the appropriate plan changes for approval by the Regional
Permit Administrator,prior to undertaking, any such modifications. The
permittee is advised that substantial modification may require submission of
a new application for permit.
G. All necessary precautions shall be taken to preclude contamination of any
wetlands or waterway by suspended solids, sediment, fuels, solvents, lubric-
ants, epoxy coatings, paints, concrete, leachate or any other environmental-
ly deleterious materials associated with the project work.
H. Any failure to comply precisely with all of the terms and conditions of this
permit, unless authorized in writing, shall be treated as a violation of
the Environmental Conservation Law.
I. The permittee- is advised to obtain any permits or approvals that rtay be re-.
quired from the U.S. Department of Army Corps of Engineers, New York District,
- 26 Federal Plaza, New York, NY 10007, (Attention Regulatory Functions
Branch), prior to commencing work authorized herein.

RESOLVED that the Southold Town Trustees declare itself lead agency
in regard to the State Environmental Quality Review Act in the matter
of the application of Mattituck Inlet Marina submitted by En-Consultants,
Inc. for a wetland permit on certain property located on Mill Road,
Mattituck.

foundation walls, grading for truck ramps, removal of a wooden
catwalk and backfilling .the bulkhead, in. Mattituck, with the stipulation
that a letter of permission .is submitted from the owner of the property
advising the Mr. Wells has .permission to do the work.

The Trustees discussed a drainage problem on Kenney' s Road and
Dogwood Lane in: _Southold.. . :,-.It: .was:.:the consensus of the Board to
send a letter to the Town Board .in support of: correcting this
problem.
The Board discussed the bulkhead at the end of West Road. adjacent. ,to
Boatmans Harbor Marina which is in desperate need o repair.
The Trustees directed that a letter be forwarded to the Town Board
recommending that the: bulkhead, be repaired.
The Trustees directed that a letter be sent to Mr. - Joseph Sanzone,
Superintendent, Suffolk County Department of Health & Vector
Control Services, requesting his assistance in determinating the
potential public health significance associated with the closure. of
the entrance to Halls Creek in New Suffolk.
