The regular meeting of the Board of Town Trustees was held on Thursday, December 17, 1987, at the Southold Town Hall, Main Road, Southold. Vice- President John Bredemeyer called the meeting to order at 7:10 p.m. with the following Trustees present: Vice-President John Bredemeyer Trustee Philip J. Goubeaud Trustee Albert Krupski, Jr. Trustee Ellen M. Larsen John Holzapfel, Chairman, Conservation Advisory Council Ilene Pfifferling, Clerk President Henry P. Smith (arrived at 7:18 P.m. ) Trustee Bredemeyer advised that he would proceed with the Communications and. Notices on the agenda. The approvals of the. minutes and future meeting dates will be held until the President is present. Trustee Bredemeyer advised that the Public Notices are published on the Town Clerk's Bulletin Board if anyone wishes to review them. III. COMMUI+TICATIONS: 1. A letter from Howard H. & Dorothy J. Zehner regarding Young's Boatyard and marina. 2. From Joseph Hall, --D-.E.C. , Stony Brook regarding the Orient Wharf Company application 3. From Joseph Hataier regarding a sign in Orient, requesting clarification. Trustee Bredemeyer advised that he has spoken to Mr. Hataier regarding this matter. 4. From John H. Thatcher, Jr. , President, Fishers Island Conservancy, Inc. regarding a tower on North Dumpling Island. Trustee Krupski will compose a letter to be forwarded to Mr. Thatcher. 5. From John Guldi to Dennis W. Cole, D.E.C. regarding Deep Hole Creek. 6. From Joseph Hall, D.E.C. , Stony Brook regarding a S.E.-Q.R.A. Coordination request. Panek, Ph.D. , Regional Supervisor of Natural Resources; N.Y.S D.E.C. , regarding the Christopher Connors property. 8. =From.Wilbur Klatsky a request for a Waiver of the Wetland Ordinance for the Cove Property, Main Bayview Road, Southold. Moved by Trustee Bredemeyer seconded by Trustee Goubeaud it was RESOLVED to DENY the request made by Wilbur Klatsky for a WAIVER of the Wetland Ordinance for the Cove at Southold, because of the scope of the project, the fact that the Trustees .have .a `long en''vironmental- assessment. form that has been reviewed, and that there may be considerable items from the form that should be discussed by the Board through the assessment process and through the public hearing process. Vote of Board: Ayes: Trustee Bredemeyer, Trustee Goubeaud, Trustee Krupski Trustee Smith: Absent - This resolution was declared duly adopted. 9. From Patricia C. Moore, Edson & Bruer, Attorneys regarding the Cook & Wortis matter. Trustee Smith arrived (7:18 p.m. ) 10. From Charles Hamilton, N.Y.S.D.E.C. , regarding a D.E.C. Violation issued to Ron Dobert. 11. Pieter Van Volkenburgh, Chief, Bureau of Shellfisheries, D.E.C. regarding a Conditional Shellfishing Program. 12. Fishers Island Conservancy regarding Mr. Larry Penny. 13. From En-Consultants,.Inc. on behalf of Freedman, Ilibassi & Ball a`request for a re-hearing regarding this determination by the Board. Mr. Roy Haje appeared before the Board regarding this application. The Trustees will inspect the site again during their inspections on January 21, 1987. Moved by Trustee Bredemeyer seconded by Trustee Smith it was RESOLVED that the Town Trustees amend the approval granted for En- Consultants, Inc. on behalf of Freedman, Ilibassi & Ball to conform to the application submitted to the Board of Trustees for a timber retaining wall above the mhw and to backfill with clean sand to be trucked in.:from an upland source. Property is located on Arshamomaque Avenue, Southold. Vote of Board: Trustee Krupski, No, Trustee Larsen, No. Trustee Goubeaud, No. Trustee Bredemeyer, Yes, Trustee Smith, Yes. - This resolution was declared.lost. It is noted for the record that the approval granted for the above matter was for construction of a rock rip-rap revetment: 14. From James McMahon a 1987 Hard Clam Seed Rafting Planning Report. 15. From Pieter Van Volkenburgh, Chief, Bureau 'of Shellfisheries, D:,E.C. Notice that the Conditional Shellfishing Program is suspended until further notice. 16. From Christopher Connors a request for reinspection by the Trustees. Trustee Bredemeyer advised that the• Board feels that the house placement, further to the north, is not substantially different from the original application as proposed. The need for a D.E.I.S. will still stand. The Trustees see no difference in the vegetation. The issues raised "during the scoping meeting do not seem to be countermand. Consulting on behalf of Charles A. Kirby a request to amend his application to reflect in kind replacement of 52' of bulkhead and to fill with 20 cu. yds. of fill. Property is located on Peconic Bay Blvd. , Laurel. Moved by Trustee Bredemeyer seconded by Trustee Goubeaud it was RESOLVED to Amend the application of J.M.O. Consulting on behalf of Charles A. Kirby to reflect inkind and in pleace replacement of 52' of timber bulkhead and.. to backfill with 20 cu. yds. of clean sand to be trucked in from an upland source. Property is located on Peconic Bay Blvd. , Laurel. Vote of Board: Ayes: All - This resolution was declared duly adopted. 19. From En-Consultants, Inc.. on behalf of,Wunneweta Pond Association a copy of a D.E.C. permit reflecting replacement of 18' of a 85' timber jetty. 20. From Christopher Kelley, Twomey, Latham, Shea & Kelley regarding Youngs Marina. 21. From Frank Saracino regarding his notice of violation. 22. From Joseph Hall regarding the Cove Property, Main Bayview Road, Southold. Trustee Bredemeyer turned the meeting over to President Smith. Trustee Smith advised that the next field inspection will be held on January 21, 1988 to commence at 11:00 A.M. , the next regular meeting will be held on January 28, 1988 at 7:00 P.M. to be held at the Town Hall, Main Road, Southold. Moved by Trustee Larsen seconded by Trustee Bredemeyer it was RESOLVED to Approve the minutes of the November 24, 1987 meeting. Vote of Board: Ayes: All - This resolution was declared duly adopted. Moved by Trustee Larsen seconded by Trustee Krupski it was RESOLVED to Approve the minutes of the Special Meeting of December 1, . 1987. Vote of Board: Ayes: Trustee Smith, Trustee Krupski, Trustee Goubeaud, Trustee Larsen; Trustee Bredemeyer, Abstained - This resolution was declared duly adopted. Trustee Smith advised that the Organizational Meeting will be held on January 21, 1988,. at 6:00 P.M. . Moved by Trustee Goubeaud seconded by Trustee Bredemeyer it was RESOLVED to approve the January 1988 mooring renewals. Vote of Board: Ayes: All - This resolution was declared duly adopted. Trustee Smith gave the Trustees monthly report as follows: Application fees, $75.00, Piling fees, $25.00, Wetland Inspection fees, $30.00, Wetland Applications, $750.00, Mooring fees, $160.00 for a total of .$10:40.00-. This amount was .turned .over 'to the Supervisor's office to be placed in the General Fund. EDWARD AND REGINA NORDSTROM - LEAD AGENCY DECLARATION Moved by Trustee Krupski seconded by Trustee Larsen it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Edward and Regina Nordstrom for a Wetland Permit on certain property located on Wood Lane, Peconic. 1. Vote of Board: Ayes: All - This resolution was declared duly adopted. 2. JOSEPH FISCHETTI, JR. ON BEHALF OF THE COVE AT SOUTHOLD - LEAD AGENCY DECLARATION Moved by Trustee Larsen seconded by Trustee Goubeaud it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Joseph Fischetti, Jr. on behalf of the Cove at Southold for a Wetland Permit on certain property located on Main Bayview Road, Southold. 2. Vote of Board: Ayes: All - This resolution was declared duly adopted. 3. RUSSELL E. Just on behalf of Russell E. Planitzer for a Wetland Permit on certain property located on Wilderness Point, Fishers Island. ( Trustee Krupski and Trustee elect John Bednoskt. : Jr.".will inspect.) 3. Vote of Board: Ayes: All - This resolution was declared duly adopted. 4. WILBUR KLATSKY, V.P. ON BEHALF OF THE' COVE AT SOUTHOLD - LEAD AGENCY DECLARATION Moved by Trustee Larsen seconded by Trustee Bredemeyer it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Wilbur Klatsky on behalf of the Cove at Southold for a Wetland Permit on certain property located on Main Bayview Road, Southold. 4. Vote of Board: Ayes: All - This resolution was declared duly adopted. Mr. John Holzapfel, Chairman of the Southold Town Conservation Advisory Council advised the Trustees that the Conservation Advisory Council would like to see a vegetation plan for the site regarding the Cove at Southold by Wilbur Klatsky. He also advised that there was concern regarding lawns within 100 ft. of wetlands, and the idea that if there were animals on the site that the feces would be picked up on the site. These were the recommendations of the Conservation Advisory Council. VI. ASSESSMENTS: 1. J.M.O. CONSULTING FOR ELLEN GUITON - ,TABLED Movee by Trustee Goubeaud seconded by Trustee Bredemeyer it was RESOLVED that the Southold Town Trustees TABLE the application for J.M.O. Consulting on behalf of Ellen Guiton, application no. 588, until the property is properly staked and a work plan reflecting profiles of the project is submitted for review. Property is located off of Grand Avenue, Mattituck. 1. Vote of Board: Ayes: All - This resolution was declared duly adopted. 2. J.M.O. CONSULTING FOR DR., VELJKO J. KRSTULOVIC - TABLED Moved by Trustee Bredemeyer seconded by Trustee Goubeaud it was RESOLVED that the Southold Town Trustees TABLE the application for J.M.O. Consulting on behalf of Dr. Veljko J. Krstulovic as the Trustees suggest that the structure be constructed in kind and in place. A plan-of construction is also requested. Property is located on South Drive, Mattituck. 2. The Trustees have determined that they have no jurisdiction in regard to this proposal. J. PETER FINIGAN: In the matter of the request made by J. Peter Finigan for an on site inspection for a determination of jurisdiction on property located on Main Bayview Road,, Southold, the Trustees determined that a wetland permit will be required. It was determined that the proposed house is 50 ft. to wetlands. JOHN WICKHAM: Trustee Bredemeyer advised, during:'conversation with Mr. Wickham in Town Hall, he advised that he will put into cultivation, in the near future, his property to the dike. Trustee Bredemeyer is concerned, whereas Mr. Wickham will be working in Town Wetlands and very possibly on Town Trustee land. It doesn't seem like this is going to stop, at least from what Mr. Wickham indicated. Trustee Bredemeyer advised that he .has called Legislator Gregory Blass in an attempt to have the "Ag" district reviewed. Trustee Bredemeyer advised that he has requested that Mr. Wickham contact the Trustee office to review this matter with him further. OLD MILL INN, MATTITUCK:_ A letter is to be forwarded to the Health Dept. requesting that .they intercede with. strict. enforcement under the State Public Health Law"9 with regard to the problem with the sanitary system at the Old Mill Inn, Mattituck. Trustee Smith. advised that Ahe' Trustee's- are going to miss Mr. Goubeaud, because he is very qualified for the job. He was a great asset tothe Trustees. Trustee Smith advised that the Trustees will be getting a new Board member, John Bednoski, Jr. who has been a Trustee in the past. Trustee Smith and Trustee Bredemeyer both have worked with Mr. Bednoski, in a good working relationship with him in the past. Trustee Smith advised that he is looking forward to working with him. The Town Board can petition the Board of Elections to run a Special Election, but by the time- that happened it would be time for the next election. The Town Board can appoint a person to fill this position, and with that I woukld like to ask the Town Board to appoint Phillip J. Goubeaud for the remainder of the term until the next election. , and I would like to move this in a resolution, can I have a second to that? As you know, we have several, factors.that you have to consider. Before I begin, I would like to introduce Mrs. Kuerner and her daughters. First item is whether this project will adversely affect any of the wetlands of the Town. This property, if you have gone and looked at it, has absolutely no wetlands. It is a small house, it has a patio in the rear. It has a retaining wall, so the entire property is as non-wetlands as you can get. However, we are here for a wetland permit. The big issue is whether it will cause damage from erosion.; turbidity or siltation. So, 'again we have the bulkheading or retaining wall, to be more specific. It is not going to have any affect on the wetlands. Again, we are not going to have any .affect on the wetlands. Will there be a cause of saltwater intrusion onto the fresh water resources of the town. Again, no. Will it adversely addect fish, shellfish or other beneficial marine organisams, aquatic wildlife and vegetation or the natural habitat thereof. No. Will it increase the danger of flood or storm tide. No. Will it change the course of any channel- or the natural movement or flow of any waters. Again no. Will it weaken or undermine the lateral support of other lands in the vicinity. Again no. Will it otherwise adversely affect the health, safety and general welfare of the people of the town. Again no. I have some exhibits Jor you for the record. Trustee Smith: The Board doesn"t. have any problem with this, Pat. There is no environmental impact. The only thing is that a.,dry will will have to be installed to contain roof run off.
