Box 728 Southold, New York 11971 FEBRUARY 26, 1987 7:00 P.M. - Regular Meeting The regular meeting of the Boad of Town Trustees was held on — Fe ,nary 26, 1987 at the Town Hall, main Road, Southold. President _ienry P. Smith opened the meeting at 7:00 P.M. Present were President Henry P. Smith Vice President John M. Bredemeyer Trustee Phillip J. Goubeaud Trustee Albert Krupski Trustee Ellen M. Larsen Bay Constable Donald Dzenkowski Secretary Ilene Pfifferling Trustee Smith advised that the next regular field inspections will be held . on March 19, 1987 to commence at 12:00 P.M. , and the .date for the next regular meeting will be held on March 26, 1987 at 7:00 P.M. . President Smith advised that there will,be a Special Meeting held on March 3, 1987 at 7:30 P.M. to resume the matter of Thomas W. Cramer. . Moved by Trustee Bredemeyer seconded by Trustee Larsen it was RESOLVED to APPROVE the minutes of the JANUARY 29, 1987 regular meeting. Vote of Board: Ayes: All This resolution was declared duly adopted. Moved by Trustee Bredemeyer seconded by Trustee Krupski it was RESOLVED to APPROVE the April 1987 mooring renewal permits. Vote of Board: Ayes: All This resolution was declared duly adopted. Trustee Smith gave the monthly report for January 1987 as follows: Application Fees $160.00, Wetland Application Fees $=1825.00, Wetland Inspection Fees $85.00 and Mooring Renewals $180.00 for a total amount of $2250.00 collected and turned over to the Supervisor to be placed in the General Fund. )v ' Board of Trustees - February 26, 1987 - Page 2. Trustee Smith advised that the Public Notices are posted on the Town Clerk's . Bulletin Board if anyone wishes to review them. The President commenced with agenda item number 3, Communications as follows: 1. From Pieter VanVolkenburgh, Chief, Bureau of Shellfisheries, New York State D.E.C. regarding responses to questions pertaining to shellfish. A letter is to be forwarded to New York State Assemblyman Joseph Sawicki and the Southold Town Baymen's Association for help regarding this matter. 2. From the New York State D.E.C. Public Notice regarding a Public Hearing on the implementation of the Environmental Quality Bond Act of 1986. Trustee Bredemeyer reported that he attended this meeting with Trustee Krupski. 3. From John H. Thatcher, Jr. , President, Fishers Island Conservancy regarding Olof Nelson, Wetland Application No. 467. Trustee Smith advised that a letter is to be forwarded to Mr. Thatcher advising him that the dock for Olof Nelson is to be constructed 3 ft. over the marsh fringe. 4. From New York State D.E.C. , Joe Hall regarding the wetland application for Dana Fox. 5. From William D. Moore regarding Wetland Application No. 312. 6. From Rudolph H. Bruer, Esq. regarding Dempsey from Sullivan. This was a request for a determination on the need of a wetland permit for a project in Peconic. Mrs. Moore appeared before the Board to ask for a clarification on the determination, as the Board requested that the house be set back behind the sanitary set back line on the survey that was submitted. Trustee Smith advised that-the Board would reinspect the subject property again and advise Mrs. Moore of their determination. 7. From Heather Cusack regarding final information on Road Runoff. Trustee Smith advised that a follow up letter will be forwarded to the Dept. of Transportation regarding these run off problems. 8. From Councilman James A. Schondebare regarding jurisdiction on L. I. Sound. Trustee Smith advised that he would be willing to meet with the Code Committee to discuss this matter, as well as other items as soon as possible. 9. From Glenn Just, Land Use Company a request to amend application No. 507 for Jerry Bady. Moved by Trustee Bredemeyer seconded by Trustee Krupski it was RESOLVED that the application of Jerry Bady be and hereby is amended to reflect 88 cu. yds. of spoil as requested by the Land Use Company. Vote of Board: Ayes: All This resolution was declared duly adopted. 10. From Cooperative Extension regarding the Fishermen's Forum, Friday, February 27, 1987 and Saturday, February 28, 1987 to be held at Suffolk Community College in Riverhead. 11. 1987 State of the Sound Conference regarding the Long Island Sound Study .to be held on March 12, 1987 from 8:30 A.M. to 6:00 P.M. at the State University in Purshase, New York. Trustee Smith: That concludes our Communications. We will proceed with our Resolutions until 7:30 P.M. . The Board discussed the application of Mr. Henry & Deborah Stasiukiewicz for a wetland permit to construct a single family dwelling and to fill on the property. The Board Tabled the application pending a copy of the D.E.C. field report and further inspection. (see resolution no. 16.) Board of Trustees - February 26, 1987 - Page 3. Patricia C. Moore appeared before the Board to discuss the application of Peter & Barbara Herz to construct a one family dwelling on property located at 170 Cedar Point Drive East, Southold. The Board inspected the subject property and have declared a non-significant environmental assessment on the proposal. (see resolution on page 16 ) . Moved by Trustee Bredemey,er seconded by Trustee Larsen it was RESOLVED that the regular meeting be and hereby is recessed for the purpose of holding the Public Hearings on the Wetland Applications as scheduled. Vote of Board: Ayes: All This resolution was declared duly adopted. PUBLIC HEARINGS: 7:30 P.M. - In the matters of the application of En-Consultants, Inc. on behalf of Cheng Yu to construct a stone revetment 200t lin. ft. with (2) 20' returns. Revetment will be approximately 12' from the toe of bluff & landward of spring H.W. ; approximately 300 cu. yds. of clean fill will be trucked in for backfill. Property is located off a R.O.W. off Oregon Road, Cutchogue. 7:32 P.M. - In the matter of the application of the Land Use Company on behalf of Brent Bookmiller to• construct a single family dwelling, well and associated sanitary system on a pre-existing, non-conforming lot. Said dwelling shall be 55' landward of Tidal Wetlands Line which exceeds the 50' building setbacks found within the vicinity of the project. Property is located on Deep Hole Road, Mattituck. 7:34 P.M. - In the matter of the application of En-Consultants, Inc. on behalf of Salt Lake Association, Inc. to maintenance dredge an area approximately 80' x 120' to depth of 6' below MLW. Approximately 1000 cu. yds. will be removed and placed in intertidal area and above on beaches to east. Property is located on Old Salt Road, Mattituck. 7:36 P.M. - In the matter of the application of the Land Use Company on behalf of Howard & Carol Safin to construct from an existing cement retaining wall a 6' x 65' fixed dock (a minimum of 4' over grade) leading to a 3' x 10' ramp leading to a 8' x 30' float dock. Property is located on Wickham Avenue, Mattituck. 7:38 P.M. - In the matter of the application of Anna Parlamis to rebuild sectional bulkhead destroyed by storms with a concrete bulkhead 25' long, 18" wide. Property is located at 663 A Bayshore Road, Greenport. 7:40 P.M. - In the matter of the application of J. H. Geideman on behalf of Floyd King, Pres. , Orient Wharf Co. , Inc. to set out 8 floats in place of existing piles for mooring of small boats. Property is located at the foot of King Street, Orient. 7:42 P.M. - To resume the public hearing on the John Wickham application. Hearing recessed on January 29, 1987. The Board proceeded with the approvals on the Wetland/Trustee Applications. ,Board of Trustees - February 26, 1987 - Page 4. A - En-Consultants, Inc. on behalf of Cheng Yu - Application No. 471 - Approval Moved by Trustee 'Krupski seconded by Trustee Goubeaud WHEREAS, En-Consultants, Inc. on behalf of Cheng Yu applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated November 11, 1986, and WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with --- --. -- respect to said application on February 26, 1987 at which time all interested persons were given an opportunity to be heard, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE, BE IT RESOLVED that En-Consultants, Inc. on behalf of Cheng Yu BE AND HEREBY IS GRANTED PERMISSION UNDER THE PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO: Construct a stone revetment 200± lin. ft. long with (2) 20' returns. Revetment will be approximately 12' from the tow of bluff & landward of spring high water. To fill with approximately 300 cu. yds. of clean fill to be trucked in for backfill with the provision that the recommendations from the Suffolk County Soil & Water Conservation District is adhered to. Property is located off a R.O.W. off of Oregon Road, Cutchogue. This permit will expire on February 26, 1988 if work has not commenced by said date. There are two inspections required and .the Trustees are to be notified upon the completion of the work. Prior to the issuance of said permit by the Clerk, the applicant shall file with the Clerk a certificate that he has public liability insurance policies insuring against any liability which may arise in the performance of the operations pursuant to such permit in such amount as shall be fixed by. the Trustees, which said policies shall name the Town. as a name insured. Please take further notice that this declaration should not be considered a determination made for any other department or agency which may also have an application pending for the same or similar project. The Permit is approved with the recommendation that filter cloth and cap stone be used - 4 ton per -lin. ft. - cap stone/filter cloth 2ft. below MLW and 5ft. seaward of stone 'on the bank. A. Care is to be taken to preclude the entry of any construction material into adjacent waters. This permit will expire on February 26, 1988 if work has not commenced by said date. There are two inspections required and the Trustees are to be notified upon the completion of the work. Prior to the issuance of said permit by the Clerk, the applicant shall file with the Clerk a certificate that he has public liability insurance policies insuring against any liability which may arise in the performance of the operations pursuant to such permit in such amount as shall be fixed by the Trustees, which said policies shall name the Town as a name insured. G.- JOHN WICKHAM - APPLICATION NO. 487 - APPORVAL Moved by Trustee Larsen seconded by Trustee Bredemeyer WHEREAS, JOHN WICKHAM applied to the Southold Town, Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated December 24, 1986, and WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on January 29, 1987 and concluded on February 26, 1987 at which time all interested persons. were given an opportunity to be heard, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and WHEREAS, the Board °has -considered all the testimony and documentation submitted concerning this application, and WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE, BE IT RESOLVED that JOHN WICKHAM BE AND HEREBY IS GRANTED PERMISSION UNDER THE PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO: Rebuild a dike using only material washed away from the dike, adding a wing wall to a headwall and to armor in from of same. Application also amended to armor the dike in two additional locations as per the map submitted and subject to the recommendations of the U. S. Department of Agriculture Soil Conservation Service. This permit will expire on February 26, 1988 if work has not commenced by said date. There are two inspections required and the Trustees are to be notified upon the completion of the work. Prior to the issuance of said permit by the Clerk, the applicant shall file with the Clerk a certificate that he has public liability insurance policies insuring against any liability which may arise in the performance of the operations pursuant to such permit in such amount as shall be- fixed by the Trustees, which said policies shall name the Town as a name insured. G.- VOTE OF BOARD: AYES.: ALL - THIS RESOLUTION WAS DECLARED DULY ADOPTED. The Trustees resumed the regular agenda and proceeded with the Resolutions at 8:25 P.M. Board of Trustees - February 26, 1987 - Page 111. RESOLUTIONS: 1-A. NUZIO & STEPHANIE REALE - TO AMEND APPLICATION NO. 480 Moved by Trustee Krupski seconded by Trustee Bredemeyer it was RESOLVED that the Southold Town Trustees AMEND the Wetland Application No. 480 as requested by The Land Use Company on behalf of Stephanie & .Nunzio Reale to reduce tha. dimension of the fixed dock to be 32', x 4' . Property is located on=Vleetwood_Road,° Cutchogue. 1-A. Vote of'Board: 'Ayes: All - This resolution was declared duly adopted. 1-B NUZIO & STEPHANIE REALE - NON-SIGNIFICANT ENVIRONMENTAL ASSESSMENT -NO. 480 Moved by Trustee Krupski seconded by Trustee Bredemeyer the following non-significant environmental assessment was declared: S.E.Q.R.A. NEGATIVE DECLARATION NOTICE OF NO-SIGNIFICANT EFFECT ON THE ENVIRONMENT Date: . LOCATION OF PROJECT: Fleetwood Road, Cutchogue'. _ REASONS SUPPORTING THIS DETERMINATION: 1. An environmental assessment form has been submitted which indicated that there would be no adverse effect to the environment should the project be implemented as planned. 2. Because there has been no response in the allotted time from the Southold Town Building Dept. and the New York State D.E.C. it is assumed that there are no objections nor comments from those agencies. 1-B - VOTE OF BOARD: Ayes: All - This resolution was declared duly adopted. HOWARD & CAROL SAFIN - AMEND APPLICATION NO. 481 ( adopted prior to approval) Moved by Trustee Larsen seconded by Trustee Krupski it was RESOLVED to APPROVE the request made by The Land Use Company on behalf of Carol & Howard Safin to amend their application to reflect a 4' x 65' fixed dock on property located on Wickham Avenue, Mattituck. 2. Trustee Bredemeyer advised that he would be attending the exhibit regarding the replacement of Route 25 bridge over Dam Pond channel to be held at the Oyster Ponds Union Free School, Main-Road, Orient, on Thursday, March 12, 1987 from 2:00 P.M. to 8:00 P.M. Trustee Smith advised that Mrs. Barbara Royce is to be contacted to find out how much it would cost for her to review the section of the D.E.I.S. submitted on the Thomas Cramer application regarding the groundwater flow.. The Board would also like a letter from her stating her qualifications. Board of Trustees - February 26, 1987 - Page ' 35. Mr. Glenn Just of the Land Use Company reported that he has tried to speak to Mr:: & Mrs. DeGaudenzi regarding their property in Mattituck. Mr. Just advised the Trustees that he would be willing to arrange a meeting with the D.E.C. , contractor, and Trustees in an effort to resolve this matter. He would try to schedule this meeting on the Board's next regular inspection date (March 19th.) . Trustee Goubeaud reported that he and Trustee Bredemeyer made an on site inspection on the property at Long Pond Estates, Laurel Avenue, Southold. Trustee Goubeaud reported that wetlands have been filled in. Trustee Bredemeyer advised that this .property.-is�ta ,high freshwater in'flow--area that has nice, little cul-de-sac areas that-go right into the woods. -.`They came right down and filled the area. The Bay Constable advised that Henry Raynor advised that the fill will be removed. Trustee Bredemeyer advised that the area should be revegetated very soon. He advised that this area could almost be an oyster Habitat -area. The Bay Constable will contact Henry Raynor at once .regarding this matter. Trustee Smith reported on the priority list of creeks to be dredged for 1987 as follows: High Priority (No. 1) - Deep Hole Creek, New Suffolk Boat Ramp, Wickham's Creek, Broadwaters, East, Mudd and Eugenes 'Creek, ,Little 'Creek., , :­. Richmond Creek, Corey Creek, Cedar Beach, Town Creek, Budd's Pond (Mill Creek) Gull Pond and Jockey Creek. Trustee Smith reported that he suggested again that a new channel should be cut in down by the College. No. 2 - Medium Priority: West Creek, and Goose Creek. No. 3 - Low Priority Brushes Creek & Goldsmith's Inlet (on the sound) and No. 4 - No action: James, Down's & Hall's 'Creeks. The Trustees reviewed the survey submitted by Lewis Edson reflecting the placement of the house as per the approval granted. The following resolution was adopted. Moved by Trustee Bredemeyer seconded by Trustee Larsen it was RESOLVED that the Southold Town Trustees accept the map submitted by Mr. Lewis Edson forlthe construction of a single family house on Clearview Avenue, Southold as complete -and to be used as a work plan for construction.
