Box 2124 Greenport, NY 11944 RE: PERI HINDEN 1255 WOODCLIFF DRIVE, MATTITUCK SCTM# 107-6-18 Dear Ms. Costello: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wednesday, August 22, 2012: WHEREAS, Costello Marine Contracting Corp. on behalf of PERI HINDEN applied to the Southold Town Trustees for an Amendment to Wetland Permit#6732 under the provisions of Chapter 275 entitled Wetlands and Shorelines of the Southold Town Code, application dated June 29, 2012, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendation, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the addition of three (3) new two-8" diameter pile mooring dolphins, and install a 5001b. mooring anchor, as applied for, does not comply with the standards set forth in Chapter 275 of the Southold Town Code; §275-11 Construction and Operation Standards (2)(011k] Residential Docks. In determining the permitted length of a ' 2 proposed residential dock, the Trustees shall seek to maintain lengths consistent,with the other docks (i.e. pier line) in the waterway which meet the requirements of this chapter, and, §275-11 C(2)(a)[5] All docks, including any vessel tied to the dock, shall have a minimum clearance of 15 feet of the seaward extension of any property line from adjacent parcels so as not to interfere with the neighbor's access to waters, unless the Trustees decide otherwise for navigational or other reasons. Waterside boundaries can be identified using the appropriate method for the shape of the shoreline for Long Island waters specified in 9 NYCRR 274-5, and, WHEREAS, the Board has determined that the three (3) new two-8" diameter pile mooring dolphins, with a 5001b. mooring anchor, as applied for, will have a detrimental effect upon the health, safety and general welfare of the people of the town, and, NOW THEREFORE BE IT, RESOLVED, that the Southold Town Board of Trustees DENIES in part, the request to Amend Wetland Permit#6732 for the addition of three (3) new two-8" diameter pile mooring dolphins, and a 5001b. mooring anchor, and, BE IT FURTHER RESOLVED, that the Southold Town Board of Trustees APPROVES in part, the request to Amend Wetland Permit#6732 to remove the existing seasonal floating dock and associated pilings; remove existing 30"x22' seasonal ramp and shorten ramp by 2' to 30"x20' long; remove three (3) existing mooring pilings; re-install existing seasonal floating dock and new shortened ramp in perpendicular position to dock; install two (2) 8" diameter anchor pilings for floating dock; and provide one (1) new 8" diameter anchor piling to be located on south side of float. Therefore this is quite important to us and we sincerely apologize for not being able to attend the hearing in person but we only found out about this on Sunday August 19th and never received proper notice. Please note we are opposed to this application for the following reasons and hope the record will reflect the items below: 1. We never received proper notice. Chris and Pam Reilly, our neighbors on the other side of us mentioned the hearing to us. We have owned our house since March 2012 and have met the Hinden's several times; however, despite their knowledge to the contrary, the notice for this hearing was sent to the previous owner of our home (Joe Aretz), which we found strange. 2. The proposal puts the Hinden's floating dock extremely close to our property line and to our own floating dock. 3. The proposal will limit our use, enjoyment and view of the inlet and specifically this area is where we swim and do water activities with our young children who are 4 and 7 years old respectively. 4. We assume the intent is to dock a large boat in this area, which will have a detrimental impact on the wildlife that flourishes in this area — plants, crabs, mollusks, fish, swans, ducks and birds 5. If the Hinden dock is approved, it will have a detrimental impact on our property value and potential resale value because: a. The dock will be perilously close to ours b. We would be precluded from docking a boat of our own on that side of our own dock 6. We have been told that homeowners receive rights to either a dock OR a mooring and the Hinden's are requesting both 7. There simply is not enough water frontage to have this happen in a neighborly and fair manner. If this were approved it would constitute favorable treatment for the Hinden's in that we would forever be precluded from making such a proposal for ourselves and in fact if we were to try to rotate our dock perpendicularly, it would not only be impossible if the hinden proposal passes but also even if it were possible our dock configuration change would likely have a domino effect and force a change to the reilly's dock configuration and/or limit their view and 8/21/2012 - Page 2 of 3 enjoyment. 8. We have been told that it is commonplace for the town to approve either a dock or mooring but not both, which is what the hinden's are requesting. Again, if the reilly's and we requested this it would simply not be possible. 9. The trustees should note that there is plenty of room in the current configuration for the Hinden's to have a substantially sized boat. And for larger Boats there are two marina's with %4 of a mile on Mattituck inlet. Please let us know if there is any further information that you need from us or anything else that would be appropriate for us to do in this matter. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required,upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Department of Real Properties Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90) calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. Presently the property owner is tying up his boat to the floating dock piling and one of the piles on the fixed structure during storm conditions. He has been afraid that the float piling would break and tear apart the ramp and floating dock. During Hurricane Irene, one of the float piling did crack while holding the boat in place. We would like to change the two single float piling and the one single piling at the fixed dock into 2-pile dolphins to better hold the boat and floating dock. We would also like to follow up on your idea of putting two 500 lb mushroom anchors to the south of the structure in order to tie up the boat off the dock during storm events. Instead of immediately applying for the permit and knowing that this is a sticky subject,we would like your input first on these suggestions prior to a formal office application. SCTM#107-7- 2 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP)Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the below Policy Standards and therefore is CONSISTENT with the LWRP; provided that the proposed action meets sub-policies 6.3, 9.4 and 10.5 (b) outlined below The LWRP recognizes that Mattituck Inlet and Creek is a regional Maritime Center. In addition the intent of Policy 10 is to protect existing water-dependent commercial, industrial, and recreational uses and to enhance the economic viability of water- dependent uses by ensuring adecluate provision of infrastructure for water-dependent uses and their efficient operation. The term Water-dependent use means a business or other activity which can only be conducted in, on, over, or adjacent to a water body because such activity requires direct access to that water body, and which involves, as.an integral part of such activity, the use of the water. Existing uses should be maintained and enhanced where possible and appropriate. r 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The applicant must demonstrate that the following dock standards pursuant to 275-11. Construction and operation standards have been met. (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [1] Whether the dock will impair navigation or be located in areas of high vessel traffic or vessel congestion; [2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfishing, waterskiing and other water- dependant activities; [3] Whether the dock will unduly interfere with transit by the public along the public beaches or foreshore; [4] Whether the dock will significantly impair the use or value of waterfront property adjacent to or near the dock; [5] Whether the dock will cause degradation of surface water quality and natural resources; [6] Whether the dock will cause habitat fragmentation and loss of significant coastal fish and wildlife habitats; [7] Whether the dock will result in the destruction of or prevent the growth of vegetated wetlands, seagrasses including eelgrass (Zostera marina) and widgeon grass (Ruppia maritima) or shellfish; [8] Whether the dock will unduly restrict tidal flow or water circulation; [9] Whether the dock will be safe when constructed; [10] Whether the dock will adversely affect views, viewsheds and vistas important to the community; [11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts; and [12] Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service. It is recommended that the Board evaluate whether the proposed dock will "extend beyond the minimum necessary for access to navigable waters" to meet sub-policx 9.4 below. 9.4 Assure public access to public trust lands and navigable waters. E. Provide access to, and reasonable recreational use of, navigable waters and public trust lands under water. 1. Provide for free and unobstructed public use of all navigable waters below the line of mean high water for navigation, recreation, and other public trust purposes, including the incidental rights of public anchoring. 4. Structures extending beyond the minimum necessary for access to navigable waters impair public trust interests and open space values associated with the water's surface. Allow such structures only in the following circumstances: a. when necessary for practical and convenient operation of water-dependent industry or commerce, and provided that obstruction of commercial navigation does not result. b. for commercial recreational boating facilities provided that: (i) the loss of navigable waters and use of underwater lands is offset by sufficient public benefit, and (ii) obstruction of commercial navigation does not result. C. when the principal purpose of the structure is necessary: (i) to provide public access for recreational uses (ii) for improvements for navigation (iii) for protection from coastal hazards, or (iv) for essential public transportation and transmission facilities. The recreational use of the proposed dock in Mattituck Creek ( a Maritime area) is consistent with sub-policy 10.5 (b) (below). B. Provide and maintain efficient infrastructure for water-dependent uses. Maintain existing infrastructure and improve or provide new infrastructure, particularly in Mattituck Inlet and Creek, Mill Creek and the Village of Greenport, for commercial and recreational vessels and water-dependent uses. The Town of Southold will work with the federal government, New York State, Suffolk County, the Village of Greenport and private owners of water-dependent uses to: 1. Maintain existing sound infrastructure for continued or potential future use by preventing loss through abandonment and neglect. 2. Demolish and remove alternative infrastructure which is likely to present hazards to harbor operations. 4. Maintain facilities to meet safety requirements associated with vessel operations. 5. Maintain and provide for upland structures such as warehouses, off- loading yards, necessary adjacent upland areas, or other storage facilities. 6. Maintain and, where necessary for existing water-dependent uses, improve landside infrastructure such as sewer and water lines, sewage treatment facilities, parking areas, and roads for harbor uses. 7. Promote the provision of appropriate vessel services for commercial and recreational vessels, including berthing, repairs, information, and fueling services. 8.
