ORGANIZATIONAL MEETING: 6:30 P.M.
The Organizational Meeting of the Board of Town Trustees was held
on April 21, 1988 for the purpose of electing a President of the
Board. Present were: President John M. Bredemeyer, Trustee
Frank A. Kujawski, Jr. , Trustee Henry P. Smith, Trustee John
Bednoski, Jr. , Vice-President Albert Krupski, Jr. and Clerk Ilene
Pfifferling.
President Bredemeyer opened the meeting and explained that the
purpose of the .Organizational Meeting was to elect a President
and to select a Vice-President. After discussion the following
resolution was adopted.
Move by Trustee Bednoski seconded by Trustee Krupski it was
RESOLVED that Frank A. Kujawski, Jr. be and hereby is elected as
President of the Board of Town Trustees and Albert Krupski, Jr.
be and hereby is selected as Vice-President of the Board of Town
Trustees.
Vote of Board: Ayes: All - This resolution was declared duly
adopted.
Being there was no further business to come before the Board the
Organizational Meeting was adjourned.

7 :15 P.M.
The Regular meeting of the Board. of Town Trustees was held on
April 21, 1988 at the Town Hall, Main Road, Southold with the
following persons present.

President Kujawski called the. meeting to order at 7: 15 p.m. and
commenced with the meeting with the Pledge to the Flag. '
FIELD INSPECTIONS:
Moved by Trustee Bednoski seconded by Trustee Krupski it was
RESOLVED that field inspections will be held on Thursday, May 12,
1988 to depart from the Town Hall at 12: 00 p.m.
Vote of Board: Ayes: All - Resolution adopted...
REGULAR MEETING:
Moved by Trustee Bednoski seconded by Trustee Krupski it was
RESOLVED that the Regular Meeting will be held on May 25, 1988,
7 :00 P.M. and a work session will be held at 4: 00 P.M. on the
same day.
Vote of Board: Ayes: All - Resolution adopted.
Approval of the March 24, 1988 minutes. This resolution will be
held until next month.
Approval of the May 1988 mooring renewals.
Moved by Trustee Smith seconded by Trustee Bredemeyer it was
RESOLVED to Approve the May mooring renewals.
Vote of Board: Ayes: All - Resolution adopted.
I . REPORT:
' President Kujawski gave the monthly Trustee report for
March 1988 as follows: Application Fees $150.00, Wetland
Inspection. Fees $50.00, Wetland Application Fees $750.00, Dock
Fees $319. 00, and Mooring Renewal Fees $ 585.00 for a total
amount of $1854.00. This .amount was forwarded to the
Supervisors Office to be placed in the General Fund.

II . PUBLIC NOTICES:
President Kujawski advised that these notices are published on
the Town Clerk' s bulletin board for review.
President Kujawski reviewed the communications -as follows:
III. COMMUNICATIONS:
1. From Mr. & Mrs. Robert Moller re: Notice of Violation/Hidden
Lake Farms, Southold. The Trustees suggested that this matter
should be discussed with the Code Committee regarding the "Ag
District" .
2. From Harold P. Schwerdt, Southold Fishing Club re:
reconstruction of boat ramps. A letter is to be forwarded to Mr.
Schwerdt advising him that the Town will be making repairs to
four boat ramps in the town.
3. From Pieter VanVolkenburgh, Chief, Bureau of
Shellfisheries re: Shoreline surveys.
4. From Merlon E. Wiggin re: Howard Zehner (Young' s
Marina)
5. From William D. Moore, Attorney on behalf of Ernest & June
Pappas a sketch depicting the accessory structure as proposed
in the application. This letter has been placed in the file.
6. From Frank P. Francia re: Cedar Beach Park Association
dredging. Trustee Smith advised that if they want work done
inside the creek it will be necessary for them to apply for their
own permit whereas the County Permit is only good for the work to
be done in the mouth of the creek.
7 . From Joan M. Latopolski, Office Manager, The Cove at
Southold re: Amendment to D.E.C. permit and map.
8. From Gerard H. Schultheis re: map depicting cesspools on
his property in New Suffolk. Moved by Trustee Bredemeyer seconded
by Trustee Krupski it was
RESOLVED that the application for Gerard H. Schultheis be amended
to include the addition of a new sanitary system, installed in
accordance with the Suffolk County Dept. of Health standards, to
have the bottom of the rings 2' above ground water and that an
additional inspection be charged to the applicant that the Bay
Constable confirm the cesspools 2' above ground water.

9. From Vilma Louise Marston, President, Water, Lane, Wildlife
Protection Group re: Richmond Creek Associates proposal for a
housing project. A letter is to be forwarded to Ms. Marston
thanking her for her concern and advising her that there is no
application before the Trustees for this project.
10. From En-Consultants, Inc. on behalf of Edward Deutsch
information from the D.E.C. regarding his application.
Moved by Trustee Bredemeyer seconded by Trustee Krupski it was
RESOLVED to recess the regular meeting for the purpose of holding
the following public hearings on the wetland applications.
Vote of Board: Ayes: All - Resolution adopted.
It is noted for the record that all transcripts of the hearings ,
have been prepared verbatim under separate cover and filed
simultaneously with the Town Clerk' s office with these minutes
for reference.
PUBLIC HEARINGS•
7: 30 p.m. - In the matter of the application of ..James F. Murphy
to construct a walkway, ramp and float on property located at 735
Waterview Drive, Southold.
7 : 32 p.m. - In. the matter of the application of En-Consultants,
Inc. on behalf of Edward Deutsch to construct a fixed elevated
walkway, hinged ramp, and floats secured by three pilings on
property located on Cedar Beach Road, Southold.
The Board resumed the regular meeting.
APPROVAL -, JAMES F. MURPHY - APPLICATION NO. 609
Moved by Trustee Bredemeyer seconded by Trustee Bednoski
WHEREAS, James F. Murphy, Jr. applied to the Southold Town
Trustees for a permit under the provisions of the Wetland
Ordinance of the Town of Southold, application dated December 10,
1987, and
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a public hearing was held by the Town. Trustees with
respect to said application on April 21, 1988 at which time all
interested persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed wil

not affect the health, safety and general welfare of the people
of the town,
NOW, THEREFORE, BE IT
RESOLVED that James F. Murphy, Jr. BE AND HEREBY IS GRANTED
PERMISSION UNDER THE PROVISIONS OF THE WETLAND ORDINANCE OF THE
TOWN OF SOUTHOLD TO: construct a 4' wide catwalk, to be
constructed to the length needed to extend same, landward to
bring it out of the intertidal wetlands, a 4' x 6' ramp to
connect to a 5'x 20' float to be secured by six pilings to hold
the float. Property is located at 735 Waterview Drive,
Southold. This permit will expire two years from the date the
permit is signed if work has not commenced by said date. • There
are two inspections required and the Trustees are to be notified
upon the completion of the work. Prior to the issuance of said
permit by the Clerk, the applicant shall file with the Clerk a
certificate that he has public liability insurance policies
insuring against any liability which may arise in the performance
of the operations pursuant to such permit in such amount as shall
be fixed by the Trustees, which said policies shall name the Town
as a name insured. Please take further notice that this
declaration should not be considered a determination made for any
other department or agency which may also have an application
pending for the same or similar project.

WHEREAS, En-Consultants, Inc. on behalf of Edward Deutsch applied
to the Southold Town Trustees for a permit under the provisions

dated January 19, 1988, and
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a public hearing was held by the Town Trustees with

V. LEADS:
The Southold Town Trustees declare itself lead agency in.
regard to the State Environmental Quality Review Act in the
matter of .the applications for wetland permits as follows.
1. SANFORD HANAUER - WAIVER
Moved by Trustee Bednoski seconded by Trustee Krupski it was
RESOLVED that the -Town Trustees approve a Waiver of the Wetland
Ordinance in the matter of the application of Sanford Hanauer,
595 Clearwater Lane, Cutchogue to construct a. deck on his
property.
Vote of Board: Ayes: Trustee Krupski, Bednoski, Kujawski,
Bredemeyer; Abstained: Trustee Smith - Resolution adopted.,
2. EDOUARD P. BEAUGARD - LEAD AGENCY DECLARATION
Moved by Trustee Krupski seconded by 'Trustee Bredemeyer it was
RESOLVED that the Town Trustees Declare. Itself Lead Agency in
regard to the matter of the .application of J.M.O. Consulting on
behalf of Dr. tdouard P. Beaugard to remove approx. 160' of
timber bulkhead, reconstruct structure in kind/in place, and to
backfill with approximately 100 cu. yds. of clean sand to be
trucked in to the site. Property is located at 830 Tarpon Drive,
Southold.
Vote of Board: Ayes: All - Resolution adopted.
3. HELENA PERLMAN - OUT OF JURISDICTION
In the matter of the application of Helena Perlman to construct a
house on property located on the East side of Bayview Road,
Southold the Board members conducted an on-site inspection of the
property and it was determined that the work is out of the
Trustees jurisdiction in accordance with the stakes that were
placed on the property. If there is any activity on the property
any closer than the stakes a permit will be required.

4. GUS MUELLER - LEAD AGENCY DECLARATION
Moved by Trustee Smith seconded by Trustee Krupski it was
RESOLVED that the Southold Town Trustees declare itself lead
agency in the matter of the application of Gus Mueller on behalf
of the Reydon Shores Property Owners Association, Inc. to
maintenance dredge the entrance channel and place spoil above
mean high water (approx. 95 cu. yds. ) . Property is located in
Reydon Shores, Southold.
Vote of Board: Ayes; All - Resolution adopted.
5 . CLIFFORD. EGINTON - LEAD AGENCY DECLARATION
Moved by Trustee Kuthjawski seconded by Trustee Bredemeyer it
was
RESOLVED that the Southold Town Trustees declare itself Lead
Agency in the matter of the application of Clifford Eginton to
donstruct a 50' retaining wall with a 12' return on the north
side, an 8' return on the south side and to grade with 30 cu.
yds. of backfill to be trucked in to the site. Property is
located at 780 Deephole Drive, Mattituck. The structure is to be
placed 13 ' back from the monument.
Vote of Board: Ayes: All - Resolution adopted.
6. GOLDSMITH' S BOAT SHOP - LEAD AGENCY DECLARATION
Moved by Trustee Bednoski seconded by Trustee.Krupski_ it. was
RESOLVED that the Town Trustees Declare itself Lead Agency in the
matter- of the application of Goldsmith' s Boat Shop to remove and
replace (in the same location and configuration) 779 lin. ft.
of existing timber bulkhead (all but an 80 ' section nearest
Hobart Road) to maintenance dredge the basin and other areas in
front of the bulkhead to grant line to 4' below mlw.
Approximately 450 cu. yds. of spoil will be removed and
placed on upland area of the owner' s second marina in Southold.
Hobart Landing, Southold. Trustees request an additional map
showing the location of the spoil site.

7. JOAN & JOHN T. WETZEL - TABLED APPLICATION
Moved by Trustee Bredemeye.r seconded by Trustee Krupski it was
RESOLVED TO TABLE the application in the matter of the Joan &
John T. Wetzel to construct a walkway 2 and 1/2' x 131 , ramp .2-
1/2' x 101 , floating dock 5 ' x 16 ' with 8 pilings. Property is
located at 4635 Pequash Ave. , Cutchogue. The applicant is
requested to stake off the neighbor' s boundary line in addition
to staking off the location of the dock so that the Board can
review this further.

3 . En-Consultants, Inc. on behalf of John Xikis for an
extension on permit no. 279. Permit expired on April 24, 1987.
President Kujawski explained to the Board members that he visited
this site along with Trustee Krupski and Charles Hamilton from
the D.E.C. and found that Mr. Xikis didn't put leaders on the
gutters and the gutters are emptying behind the original. wall and
undermining it from the back. Plus instead of putting in a rock
driveway he put in an asphalt driveway. This can be cured by
putting in a dry well with leaders. The D.E.C. is very opposed
to this project.

RESOLVED that the Southold Town Trustees DENY the request made by
En-Consultants, Inc. on behalf of John Xikis for an extension on
permit No. 279 whereas the problem can be mitigated by handling
run off on the driveway, run off from the gutters on the seaward
side, leaders, dry wells and a French Drain behind the gabion
wall on the property located on the Middle Road, Southold.

RESOLVED to Table the decision regarding the Robert 'Hulsman
application whereas the notice of hearing has to be republished.

8. Christopher Connors D.E.I.S. - After reviewing the DEIS
for Christopher Connors it was determined_ that additional
information is requested as follows:
1. A more detailed map showing actual- construction and
destruction that will take place and/or alter the property.
2. Three test borings down to any level that will have an
affect on the property to see what the material is underneath and
how the drainage force pattern will be affected on the property.
3 . A discussion of the affects on Great Pond and the
surrounding. area primarily from the sewage system.
4 . Future affects if Great Pond is used as a Freshwater
supply.
5 . Comments and recommendations from the Conservation
Advisory Council to be forwarded to the Trustees.
. 6 . Base line data. How much Freshwater Wetlands are
there? Percentages?
Upon submission of this information the Board will review this
matter further.
Dr. Thomas Samuels appeared before the Board regarding the Flood
Plain Elevations. He will obtain information regarding this
matter and forward same to the Board for their review.

From the Planning Board regarding Franklinville Road, Laurel.. The
Trustees inspected the site and determined that there is no
evidence of wetlands, no jurisdiction.
From the Planning Board regarding the Stype Agency, Mattituck.
The Trustees determined they have no jurisdiction in this matter.
Garry & Barbara Rutter a request for a determination of
jurisdiction. Trustees determined they have no jurisdiction in
this matter.
From The Planning Board regarding Thorton E. Smith, Sound Ave. ,
Mattituck. The Trustees found a pond on the property, no grading
on the top of the slope to the pond.
From the Planning Board D.B.M. Subdivision, Boisseau Ave. ,
Southold. The Trustees requested that the D.E.C. get in touch
with the Conservation Advisory Council after it is staked for
their inspection.
From Kenneth Garcia a request for a determination of jurisdiction
regarding house construction on property located on North Sea
Drive, Southold.
Trustees determined no jurisdiction.
From the Planning Board regarding the Cove Beach Estates. New
access it appears to be far enough away from the wetlands.
From the' Planning Board regarding Joseph Gazza subdivision.
the Trustees wil_1 refer this matter to the C.A.C. for
recommendations.
Determination of jurisdiction re: Williard S. Mahood, F.I . The
Board determined that the property will have to be graded so that
run off will not enter the wetlands.
Determination of jurisdiction re: Milliken, F.I . Out of
jurisdiction.
Determination of jurisdiction re: Javelers, F.I. If a new
foundation is required an application will be needed for this
project.

President Kujawski suggested a few changes to be made, and asked
the Trustees to think about them for further discussion at a work
session as follows:
Not making an assessment until C.A.C. comments are obtained.
At the Public Hearing stage all comments should be obtained,
D.E.C. , C.A.C. , Army Corp, all agencies involved in the
application or the motion will be to recess the hearing. A phone
call with the comments will be sufficient.
A letter of coordination is to be sent out with every application
to all agencies/departments. When the file is complete a hearing
will be scheduled.
Permits - Time on a permit will start from the time the permit is
signed.
President Kujawski will try to arrange a meeting with the Town
Attorney for after 5: 00 p.m. to discuss a legal matter.

Edward Deutsch: I 'm Edward Deutsch, I would like to put a ramp
out to a dock: I would like to have a place for my boat. I
would be glad to answer any questions.
Trustee Kujawski: Do any of the Trustees have any questions?
Trustee. Krupski: I think that one of the questions the Board had
was that there was very little room there for parking. There is
no off ''street parking there to reach the dock.
Edward Deutsch: The property is across the road.
Trustee Krupski: Oh, where you are going to build, the house?
Edward Deutsch: Yes.
Trustee Bredemeyer: The Trustees had a brief discussion when we
were\doing the environmental assessment, with Mr. Roy Haje of
En-Consultants, concerning the scope of the structure. We wanted
a 4 ' wide catwalk and the float limited to no more than 6 ' wide
by 20 ' long. The original proposal was somewhat larger than
that. We wanted to keep the structure, in keeping with the size
associated with the creek, in what we normally allow inside the
smaller creeks.

Mr. Deutsch: Four feet I think.
Trustee Bredemeyer: Didn' t we discuss a three ft. wide catwalk?
I thought we had. I know that we specifically talked about the
float and limiting?
Mr. Deutsch: I don' t .have a problem with it being three feet wide.
Trustee Krupski: on the application it is four feet wide. It is
four feet on the D.E.C. Permit.
Trustee Bredemeyer: I thought we talked to Mr. Haje and we were
trying to convince him to go with three feet. It was a serious
concern because of our policy on that. Definitely to make the
float 61 .x 20 ' that is Dryad' s Basin. It is a productive
Scallop area when it is a working creek. We want to definitely
minimize coverage of any structures over the productive bottom
there.
Mr. Deutsch: The area that I am going out over, is very shallow.
That is why I wanted a little longer dock there. I have no
problem with a three foot wide walkway, I don' t have young
children. I don' t have a problem with that, but I would like to
get a little bit further out.
Trustee Bredemeyer: So you are saying that the additional
difference between the 20 ' float and the three 2 ' with that
additional 12' you need that for depth.
Mr. Deutsch: I have been in there many times with my boat, and it
is shallow in there. That' s why I wanted to go out a little bit
further.
Trustee Krupski: There isn' t anything out there.
Trustee Bednoski: We try to keep the structures in line with the
neighboring structures.
Mr. Deutsch: If you go in there in the summer time on both sides
east and west there is alot more activity.
Trustee Krupski: If we want to get less bottom coverage we could
let him come out further with a fixed catwalk, 3 ' wide, and maybe
one section of the six foot wide floating dock. Would that be a
problem? You would get out further into the deeper water but it
would be less bottom coverage.
Mr. Deutsch: If I put a fixed catwalk, when the ice breaks in the
winter time, it pulls out your polls.,,
Trustee Smith: That is a good point. I have no problem with the
application?

Thomas Samuels: I fail to see the difference in the aesthetics
of the 4 ft. wide structure and a 3 ft. wide structure.
Steve Latson: I would like to answer Dr. Samuels point. The more
you cover, the less area you have to go clamming. I have built
some floats and things in my life and if you build it right and
design it right you can build a 4 or 5 ft. float that is very
safe.
Trustee Kujawski: Are there any other comments. No response.

Trustee Bredemeyer: How about five foot floats then? Go with a
three foot catwalk and five foot wide floats? Would that be
acceptable?
Trustee Smith: Sure.
Trustee Kujawski: What were the C.A.C. comments on this?
John Holzapfel: The only thing that we had was the parking
because the wetlands are so close there.
Mr. Deutsch: The D.E.C. approved the project, I didn' t know if
you were aware?
Trustee Krupski: Yes, we did get that communication from Roy
Haj e. ' We have the permit.
Trustee Smith: I will make a motion that we close this hearing on
Edward Deutsch.
Thomas Samuels, Rambo: I have heard two applications now, not
that I am concerned with either one, as a contractor. I 'm
concerned as a citizen of the town. Number one, five foot wide
floats are very unstable, you need six foot floats. This is
twenty years of experience. Four foot floats are dangerous.
Five foot are unstable. Six foot are adequate. I fail to see
this concern for bottom coverage? I don't quite know what the
implications are. I know that there are some reasons. It has not
proved consistent with what the D.E.C. 's concerns are for bottom
coverage are. Number two, three foot wide catwalks, I can take
you to any number of catwalks and you have seen any number of
catwalks with great growth of spartina alterniflora coming up
through the spaces of the boards. Your concern is that you are
going to kill the Alterniflora. It just doesn' t happen provided
that the catwalks are built to the elevations that the D.E.C.
hasrequired. Now, I am not adamant on this subject. As usual I
am concerned, but I would just like to inject a note of reasoning
into your reasoning for whatever value it might have.
Trustee Bredemeyer: Part of that is a genuine concern to try to
keep the structures in keeping with the creeks. Small places,
for small boats, should have small boxes. It is a balancing act
when you try to consider all of these things.
Trustee Smith: I agree with Dr. Samuels as far as the width of
the floats. Like you said, four foot is ridiculous, five foot is
rocky and six foot is just about a compromise.

As far as the stability of the structure, I have no problem with
a 5 ft. float.
Trustee Smith: We have, in the past, recommended a 3 ft. walkway,
but if the applicant had a problem that we would extend it to 4
feet. This gentlemen feels that this would be a safety problem
for his children, then I would have no objection in granting a 4'
catwalk.
Trustee Bednoski: No I wouldn' t either, Henry.
John Holzapfel, C.A.C. : Can I ask one question? The fixed
section of the structure might -not extend past the marsh upland.
Is that true? My impression was that ,it was not outside of the
wetlands completely? It was another 5, 6, or 7 feet?
James Murphy: That is no problem.
Trustee Krupski: That is a concern of the Trustees. Can you
bring it further upland to keep the activity off of the marsh?
James Murphy: Yes.
Trustee Kujawski: Are there any other comments, for or against
this application? No response. Do any of the Trustees have any
comments?
Trustee Smith: What was the final measurements on this
structure? The float will be 5' by how long?
Trustee Krupski: 20 ft.
Trustee Smith: The catwalk will be 4' by how ever long it takes to
go to the end of the marsh?
Trustee Krupski: 201 .
Trustee Smith: How about the ramp leading to the float?
Trustee Krupski: 61 . '
Trustee Smith: 6 ' by what width?
Trustee Krupski: 6 ' by whatever we decide.
Trustee Kujawski: John, what was the recommendation of the C.A.C.

John Holzapfel: We approved it. The only reservation we had was
that it didn't come all the way out. They may be stepping through
a foot or two of grasses to get to it.

In order to gain stability for a floating dock, it should be at
least 5 ft. wide.
Trustee Krupski: The permanent part will be three ft. wide.
James Murphy: Five feet is what I applied for. The three foot
catwalk is narrow.
Trustee Smith: We have, in the past, gone with a 4 ft. catwalk?
Trustee Kujawski: I 'm going to end up abstaining on this
application.
James Murphy: I 've gone to Coastal Management and the Army Corps
of Engineers and they said they can't give me 5 ' catwalk, but we
will give you 41 .
Trustee Krupski: I thought the Board' s policy was 31 ?
Trustee Bredemeyer: The Board' s general policy is 31 .
Trustee Krupski: The concern of a wider catwalk is more coverage
of the bottom and the intertidal area . The wider the structure
the more the chance. of killing the growth under the structure.
