ORGANIZATIONAL MEETING - 6:30 p.m.
The Organizational Meeting of the Board of Town Trustees was held on
Thursday, January 21, 1988 at the Southold Town Hall-, Main Road, Southold.
President Henry P. Smith called the meeting to order at 6:30 P:m. with the
following present:
President Henry P. Smith
Vice-President John M. Bredemeyer, III
Albert Krupski,Jr.
John Bednoski, Jr.
Ilene Pfifferling, Clerk
President Smith opened the meeting and explained that the purpose of
the Organizational Meeting was to elect a President, select a Vice-President and appoint
a Clerk to the Board of Trustees: After discussion the following resolution was
offered:
Moved by Trustee Smith seconded by Trustee Bednoski it was
RESOLVED that John M. Bredemeyer, III be and hereby is elected President to
the Board of Town Trustees and Albert Krupski, Jr. be and hereby is selected
as Vice-President to the Board of Town Trustees until such time. as the .Trustees
have a fifth member then there .will be another election.
Vote of Board: Ayes: All - This resolution was declared duly adopted.
Moved by Trustee Bredemeyer seconded by Trustee Bednoski it was
RESOLVED that Ilene Pfifferling .be and hereby is appointed ceremonial Clerk
to the Board of Town Trustees.
Vote of Board: Ayes: All - This resolution was declared duly adopted.
President Bredemeyer thanked Trustee Smith for the work.done while President
of the Board. (See resolution on page.
There being no further business to come before the Board at the Organizational
Meeting a motion was.made_by Trustee Smith"seconded by Trustee Bednoski to
adjourn the meeting. •

REGULAR MEETING
JANUARY 21, 1988 - 7:15 p.m.
A Regular meeting of the Board of Town Trustees was held on Thursday,
January 21, 1988 at the Southold Town Hall, Main Road, Southold. President
John M. Bredemeyer, III called the meeting to order at 7:15 p-:mr, with the
following persons present:

Vice-President Albert Krupski, Jr.
Trustee Henry P. Smith
Trustee John Bednoski, Jr.
Clerk Ilene Pfifferling
John Holzapfel, Chairman, Conservation Advisory Council
In the audience, Kent McCarthy, Bay Constable
President Bredemeyer advised that the Field Inspections are scheduled :for ;
February 17, 1988 to commence at 9:00 a.m. to depart from Town Hall, Main
Road, Southold. The Trustees will convene a work session at 3:00 p.m to be
held at Town Hall, Main Road, Southold. The next regular meeting will be held
on February 24, 1988 to commence at 7:00 p.m.
Moved by Trustee Bednoski seconded by Trustee Bredemeyer it was
RESOLVED to APPROVE the minutes of the December 17, 1988 meeting.
Vote of Board: Ayes: All - This resolution was declared duly adopted.
Moved by Trustee Smith seconded by Trustee Krupski it was
RESOLVED to APPROVE the February 1988 mooring renewals.
Vote of Board: Ayes: All - This resolution was declared duly adopted.
President Bredemeyer gave the monthly report for December 1987 as'. follows:
Application fees; $125.00, Wetland Applications, $450.00, Wetland Inspections, ,'-$60'.W,
Mooring Renewals, $20.00 for a total of $655.00 which has been turned over to the
Supervisor's office to be placed in the General Fund. President Bredemeyer advised
that $32,085.75 was collected in 1987.
Trustee Bredemeyer advised that the Public Notices are published on the Town Clerk's
Bulletin Board ,"for the public to view. The President proceeded with the Communications
as follows:
1. From Presiding Officer S. C. Legislature, Gregory Blass regarding proposed
maintenance dredging projects. President Bredemeyer appointed Trustees Smith
and. Trustee Krupski to the Waterway Committee.
2, From Glenn E. Just regarding a clarification of a pipe on property of John
McGillian, Fishers Island.
3. From Francis Weisent requesting a hearing on a wetland violation.
4. From Gordon C. Colvin, Director of Marine Resources, D.E.C. regarding
help with monitoring waters for possible conditional permits.

5. From William D. Moore, Attorney, regarding covenants and restrictions on
Meadow Lane property, Mattituck. A copy of the covenants and restrictions
is to be forwarded to Attorney Frank Yakaboski who was the Special Town
Attorney previously reviewing this matter. The Trustees are requesting his
written confirmation regarding same.
6. From Patricia C. Moore, Attorney, regarding the Southold Park District Cook/
Wortis matter. Estimates for fencing were submitted ,to the Trustee office.
Moved by_ Trustee- Bredemeyer seconded by Trustee Krupski it was
RESOLVED that the Clerk transmit the estimates for the fencing regarding the
Southold Park District/Cook/Wortis matter to the Town Board for their selection
of the estimates.
Vote of Board: Ayes: All - This resolution was declared duly adopted.
7. From Pieter VanVolkenburgh, Chief, Bureau of Shellfisheries, D.E.C. a
Conditional Shellfish Program for Mattituck Inlet and creek.
President Bredemeyer advised that the Board would commence with agenda item
V - Leads until 7:30 p.m.

RESOLVED that the Southold Town Trustees declare itself lead
agency in regard to the State Environmental Quality Review Act
in the matter of the application of Peconic Associates on behalf of Joseph
F.- Citardi for a
Wetland Permit on certain property located at 56225 County Road, Greenport.

President Bredemeyer called for a recess of the regular meeting in order to hold
the following Public Hearings on the applications for Wetland Permits. It is noted
for the record that all transcripts of the hearings have been prepared verbatim under
separate cover and filed simultaneously with the Town Clerk's Office with these minutes
for reference.

President Bredemeyer advised that the Board would proceed with the Approvals/Denials
of the applications for wetland/trustee permits as follows:
WILBUR KLATSKY ON BEHALF OF THE COVE AT SOUTHOLD - APPROVAL - No. 601

WHEREAS, Wilbur Klatsky on behalf of the Cove at Southold applied to the Southold-
Town -Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of
Southold, application dated December 4, 1987, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a public hearing was held by the Town Trustees with
respect to said application on January 21, 1988 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of

RESOLVED that Wilbur Klatsky on behalf of the Cove at Southold BE AND HEREBY IS
GRANTED PERMISSION UNDER THE
PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO:
Construct certain housing units within a_.75' buffer. Property is located on Main
Bayview Road, Southold. Approval is granted as submitted, the covenants and
restrictions will have to be reviewed by the Town Attorney to insure that they are
truly acceptable in the form of what the Trustees requested for the Town. These
will have to be acceptable to the Town Attorney.
This permit will expire on January 21, 1990 if work has
not commenced by said date. There are two inspections required and
the Trustees are to be notified upon the completion of the work.
Prior to the issuance of said permit by the Clerk, the applicant
shall file with the Clerk a certificate that he has public liability
insurance policies insuring against any liability which may arise
in the performance of the operations pursuant to such permit in such
amount as shall be fixed by the Trustees, which said policies shall
name the Town as a name insured. Please take further notice that
this declaration should not be considered a determination made for
any other department or agency which may also have an application

WHEREAS, Donald Cocks on behalf of Matt-A-Mar Marina applied to the Southold
Town, Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of
Southold, application dated December 11, 1987, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a public hearing was held by the Town Trustees with
respect to said application on January 21, 1988 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area, and

Extend existing docks 37'x 6' e/w and 105' x 8' n/s in an effort to avoid shoal that
is hazardous to approaching deep draft boats. Property is located on Wickham Ave. ,
Mattituck. Approval is granted with the provision that the applicant remove the four
finger piers that are attached to the existing dock assembly within 90 days of
construction of the gas dock proposed:
This permit will expire on January 21, 1990 if work has
not commenced by said date. There are two inspections required and
the Trustees are to be notified upon the completion of the work.
Prior to the issuance of said permit by the .Clerk, the applicant
shall file with the Clerk a certificate that he has public liability

Repair a severly damaged bluff by repairing the stone wall located at the bottom of
the bank then by filling the eroded area with trucked in sand and loam (approximately
750 cu. yds. ) and then revegetating the filled area with various species of seaside
vegetation. Property is located on a Private Road, Fishers Island. This permit
is approved with the provision that the pipe coming out of the base of the cliff is to be
plugged with cement during the course of construction.
This permit will expire on January 21, 1990 if work has
not commenced by said date. There are two inspections required and
the Trustees are to be notified upon the completion of the work.
Prior to the issuance of said permit by the Clerk, the applicant
shall file with the Clerk a certificate that he has public liability

Construct a one family dwelling with a deck and took storage building. Property is
located at 704 Wiggins Lane, Greenport. This permit is approved subject to the
prevention of any building debris and/or run off during the construction phase and
the installation of dry wells for the finished house.
This permit will expire on January 21, 1990 if work has
not commenced by said date. There are two inspections required and
the Trustees are to be notified upon the completion of the work.
Prior to the issuance of said permit by the Clerk, the applicant
shall file with the Clerk a certificate that he has public liability
insurance policies insuring against any liability which may arise

To reconstruct in kind and in place 52' of timber bulkhead and to backfill with
20 cu. yds. of clean sand to be trucked in from an upland source. Property is located
at 6130 Peconic Bay Blvd. , Laurel.
This permit will expire on January 21, 1990 if work has
not commenced by said date. There are two inspections required and
the Trustees are to be notified upon the, completion of the work.
Prior to the issuance of said permit by the Clerk, the applicant
shall file with the Clerk a certificate that he has public liability
insurance policies insuring against any liability which may arise
in the performance of the operations pursuant to such permit in such
amount as shall be fixed by the Trustees, which said policies shall

WHEREAS, Charles A. King applied to the Southold Town Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of
Southold, application dated November 19, 1987, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a public hearing was held by the Town Trustees with
respect to said application on January 21, 1988 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and

Improve an existing blue stone ramp with black top coat. Existing ramp on the site
since 1973. Property is located at 200 East Mill Road, Mattituck. In the future if this
ramp is to be recovered, a permit will be required.

A letter is to be forwarded to all Asphalt Companies in Southold and Riverhead
Towns advising that they need permits for any work done within Trustee jurisdiction.

WHEREAS, En-Consultants, Inc. on behalf of Dr. Stanley Keating applied to
the Southold Town Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of
Southold, application dated October 30, 1987, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a public hearing was held by the Town Trustees with
respect to said application on January 21, 1988 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and
WHEREAS, the Board has determined that the project .as proposed will not affect the

RESOLVED that En-Consultants, Inc. on behalf of Dr. Stanley Ketating
BE AND HEREBY IS GRANTED PERMISSION UNDER THE
PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO:
Construct a timber dock consisting of a 4' x 32' fixed elevated (3.5' above grade of
marsh) walk; 4' x 12' hinged ramp; 8' x 20' float secured by (2) 8" diameter pilings.
Dock replaces previous structure destroyed by storms, deterioration, etc. , property
is located on Haywaters cove, Cutchogue. This permit is approved with the
provision that the dock does not conflict with the moorings located at the end of the
road.
This permit will expire on January 21, 1990 if work has

INSPECTIONS:
1. Freedman, Ilibassi & Ball: See page 12 for resolution.
2. Timothy Gray: The Trustees inspected the site on Soundview Avenue, Southold
as referred by the Planning Board. It was determined after the on-site inspection
conducted on January 20, 1988 that the Trustees do not have jurisdiction in this
matter. The Trustees recommend that the building envelope be altered to remove
the possibility that the Natural Ravine just North of the existing house (which is
on-the South end of the envelope) be filled in or altered.
3. Richard Mohring: The Trustees inspected the property of Richard Mohring located
at the foot of Bay Avenue, Cutchogue on January 20, 1988. It was determined
that the Trustees have no jurisdiction in this matter. However, the existing
natural vegetation on the seaward side of the project within the Trustees 75,
jurisdiction is to be left undisturbed.
4. Anthony and Sally Pirrera: The Trustees inspected the property on North Road,
Southold as referred ' by the Planning Board. It was determined that the
project is out of the Trustee jurisdiction. The Trustees suggest protection of
the slopes to the bluff.
5. Dorman, Townsend, MacKay and Mills: The Trustees inspected the property on
January 20, 1988. It was determined that the project is out of Trustee jurisdiction.
The kettle holes on the site are not wetlands. Nevertheless; every effort should be
made to save them as contiguous open space for the following reasons: 1. Site is a
Significant wintering area for White Tailed Deer which migrate to the North side of
Orient when food and cover in the lower areas deteriorates. 2. The Cedars on
the site near the kettle holes are important cover for Song Birds as well-as the
deer. 3. Woods on this parcel are very typically occupied by Red Fox and the
larger owls (Great Horned, etc. ) because of the diversity and high quality of
cover and food available. The more restrictive the applicants can envision the
building envelopes, the more likely they or future owners will be treated to some

617.4 (J) 1 thru 4, of the State Environmental Quality Review Act, and
WHEREAS, our public trust and historic role as Pantentees is strengthened by
the State: Environmental Quality Review Act and our ability to protect Environmentally
sensitive areas, and'
WHEREAS, the Southold Town Trustees, Conservation Advisory Council, and Town
Board Members have contributed to New York States Significant Coastal Fish and
Wildlife Habitat Program highlighting the reasons designating areas of State
Significance for Fish and Wildlife in Southold Town,
NOW, THEREFORE, BE IT KNOWN that the Southold Town Trustees, approve,
ratify, and.confirm Critical Area Designation (CEA''s) pursuant to the State Environmental
Quality Review Act (S.E.Q.R.A. ) Part 617.4 (j) (1) - 4 NYCRR FOR all Trustee Lands
below mean high water in the following creek or portions of the creek as described
in the New York State Department of State Significant Habitats Program and or by

Beginning at the west end of bulkhead, south of Horseshoe Cove wetlands,

From the end of Fisherman's Beach to the last house from the South end of the
cau ieway, the line shall be 25' seaward of mlw
From the last house at south end of the causeway north following mhw and 75' landward

Trustee Smith advised that he will be willing to help President Bredemeyer in
any way he can as President. He stated that it was a pleasure being President
for the last four years. It was quite an experience. Some of the time it was fun,
times it was not. All in all, it worked out, a'. lot was accomplished in the four years.
He advised that he is looking forward to working with the Board in the future.

Trustee Bredemeyer: Is there anyone in the audience wishing to speak for this
application?
Wilbur Klatsky: Good evening, my name is Wilbur Klatsky and I represent the
applicant The Cove at Southold. Following up on our meeting of the 17th with
the Board of Trustees when a negative declaration was declared on the subject
parcel, we also did make application to prevent 'the following on the property.
As part of commitment and as per our conversation with the Board of Trustees we
have prepared a vegetation map, which is also part of the file document approved by
the Board of Trustees. The map that you have in front of you, -represents a
combination of maps in some respects, the..wetlands line that was established by the
Trustees in October.also. it established a 75!_ buffer line: As part of our position it
also relocated three buildings to hold all construction activities out of the wetlands
area, which we agreed and. which was part, of the C & R's that we described. It
established that there would be no fertilization, shall take place at any time within
areas shown as Zone 1 and Zone 2. . We have also withdrawn the application, and also
withdrawn from .this map, the location of the pool which was previously right adjacent
to the existing boat ramp on the east side of.;the program. Also for the record, I
would like to note that we are showing the future location of the pool and tennis
court in the northeast quadrate of the program which is beyond the jurisdiction of
the Trustees'. We are making application to the Planning Board for that. I think
my letter outlined the primary issues that the Trustees wished to address, that was
to remove all construction activities from..within the wetlands line. Eliminating all
fertilization in Zones 1 and 2. We outlined .all fertilizers and plant material in, the other
parts of the program. We also have--a; pooper scooper-language in the C & R's. I
think that- we basically addressed all the issues the Trustees had. Are there any
questions?
Trustee Krupski: We were on.field inspections` yesterday, and..we saw .an old pipe
on the property. -
Trustee Bredemeyer: It looked like an old 411. cast iron pipe that apparently was
draining the yard or gutter from the old building.

Trustee Krupski: What it does though, is connect, .ther:e is a.little swale between
the wetland line and the creek itself, and that ':prevents a lot of the run off from
the property from running into the creek. Now connecting those two low spots is
a 4" pipe.'
Mr. Joseph Fischetti: Al, there were many of those pipes around. Some of them were
drainage pipes from the old hotel. There is nothing in there now that we designed.
Trustee Krupski: No, we are aware of that, we just wanted to bring it to your attention.
Trustee Bredemeyer: We know that you are aware of it, but it would be nice to have
it removed. The one we saw would be on the line.:from about unit 11 towards your
map notation "Corey Creek" it is almost on the direct line. There is a small pile of
rubble there.
Trustee Bednoski: It is right by the second flag.
Trustee Krupski: It was only because I saw water moving around it, otherwise I
would not have noticed it.
Trustee Bredemeyer: Are there any questions from anyone else with respect to this
application?
Trustee Smith: I think that you are going to make a special exception for them to go
into this�wetland.,'area to remove this pipe.

7:33 p.m. - In the matter of the application of Matt-A-Mar Marina submitted by
Donald Cocks, Manager to extend existing docks in an effort to avoid shoal that
is hazardous to approaching deep draft boats. Property is located on Wickham Ave. ,
Mattituck.
Trustee Bredemeyer: Is there anyone here to speak on behalf of this application?
Mr. Donald Cox, -.Manager, Matt-A-Mar Marina: On the north side of our gas dock
the shoal goes out in a westerly direction about 35 ft. from our gas dock. This
is preventing deep draft boats from coming into our gas dock. I have pictures
showing boats that have gotten stuck. I have police reports of boats stuck. I
have about 200 signatures of boaters who are aware of the problem. At this time
we are not in a position to spend the money to have the dredging needed. We
have an estimate: for $20,000. from one contractor and I have a verbal estimate for
$25,000. from another contractor. At this time it is not feasible for us to spend that
kind of money. It would be feasible for us to extend the dock beyond the shoal.
That would at least give us free exit .for the gas dock',for the deep draft sail boats.
I have more information. I don't know if everyone saw the pictures and :police
reports that were submitted.
Trustee Krupski: Yes.
Trustee Br.edemeyer: Did we get a final recommendation from the Conservation
Advisory Council?
John Holzapfel: We just met today. One of the questions we had, we tabled it
to be honest. We wanted to see what the bottom looked like. You said that you
had contours, but we. never 'saw them. We were concerned that what was being. . .
Mr. Cox: D.E.C. has copies,.-the Army Corps .has copies. I have a verbal: from
Dennis Cole and Stephen Mars from the Army Corps. They._said there is no problem..
I still don't have them. It takes probably .a month. I have a verbal.
John Holzapfel: That is not• the question I was asking. In your letter you had
stated- that you dorxe. _a semi-official depths.
Mr. _Cox: I did with. Bay_"Cbnstable Wermelinger, I went out with him in a7 boat one
day and we 'took soundings. That was on the police report and that was 'submitted
to the---town. I. have-a .copy of it if you would like to "see it.

What we would like to do is get the approvals as soon as possible from all the
agencies involved. In fact there are six people who would like to do the work.
It is a very good time of the year to do this work. We are not working on our
boats now. It is kind of a hardship at this point, . we would like to get the approvals
so that we could work during February and March.
Trustee Krupski: On inspections we stoped there yesterday. I was somewhat
troubled because I have had some feed back from people in the area that the
Marina keeps expanding and expanding. The Trustees have, since I have been on
the Board, and historically, tried to work with the Marinas because they are an
asset to the community in most cases. . It seems that you have documented your
problem. We have tried to come up with a solution that would satisfy both sides.
By giving you a 35' extension on the gas. dock you would also. . .
Mr. Cox: That is 451.
Trustee Krupski: Okay it's 45' total, plus there would be boats. presumably docked
on either side of this dock going out the extra 351.
Mr. Cocks: Generally not on the outside of the dock, on the: inside..it would be.
Trustee Krupski: Right, okay, so what concerned us was the additional coverage of
the shading of�.the bottom here. As a solution, .we thought that we could work out
some sort of a compromise with the marina with you. If you would eliminate some of
your finger slips along the gas dock going out, we would be able to proceed to grant
you the extension to provide better navigation.
Trustee Bredemeyer: The intent, I think the Board felt that we would maintain the
same degree of bottom coverage. The issue here really, as presented, is an issue of
safety and the needs of protecting the boating public. Prior applications you have
made with respect to dinghy access and all had a lot of merit. �This is in the same
line. We feel that if we grant this going out so much further an Zt-we have all that
additional bottom coverage and it is very substantial and not in keeping with what
the request is for.
Mr. Cocks: As far as the expansion, the last expansion for the marina was done, I
believe, 6 or 7 years ago.
Trustee Bredemeyer: We are talking about the finger pier extensions that we
granted.
Mr. Cocks: We eliminated two smaller docks there.
Trustee Bredemeyer: Right, but the net change has been to increase the coverage over
town bottom, that is what the concern of the Board is.
Trustee Krupski: What we are proposing would provide you with what you want,
but it would also give the town a little better environment there on the bottom of the
creek.
Trustee Bredemeyer: It would not preclude you from using the dock, you would still
be able to tie up along it. The existing one is 85' plus the 37' so it would provide
for a number of docks to be tied up along side of it.

Trustee Smith: It is a small expansion but whenever:°we can get -any space into a
marina without doing any damage to the environment I don't think that that is a
working part of the creek, I think that we should take advantage of it. That is
my personal feeling on it.
Mr. Cocks: I can not speak for the owner, I will have to go back and check with
him on this.
Trustee Smith: My recommendation to you is, take what they are giving you. You
can come back with an application to put your finger piers back. If that is
satisfactory to you.
Trustee Krupski: I understand why you can't make a decision on that now. We
can grant a conditional permit on that bases whether or not you want it .like Henry
said. Our concern is the coverage of the bottom. His coverage is getting more and
more extensive. As Henry mentioned it is not a working area of the, creek, and
as there are more boats in the creek that is of course the reason that it is not a
working area..in the creek.
Trustee Smith: It is an established marina.
Trustee Krupski: I know, I know, but it is over town bottom though.
Trustee Smith: Every marina is over town bottom, just about, there are a few
where they:own the bottom.- ,
Mr. Cocks: My feelings are that the expansion it would allow us to have two more
boats on the property. What we-.are doing -is to try to prevent any dangerous
situation from happening. The boats get hung up on this shoal. The Bay Constable
has seen some of the things done to try to get these boats off of the shoal.
Trustee Smith: What the Board is doing, is giving you the extra 45' so you don't
have that problem. Now the stumbling block is the extra finger piers. I don't
think that you can use the safety factor as a lever for those finger piers right now.
You have to go about that at a different approach.
Mr. Cocks: At one time Mr. Goubeaud brought up an idea of our creek on the south
side, a letter, something along the line that we would not be building or doing any
kind of dock work there as a trade off.
Trustee Bredemeyer: Formalizing what was a prior agreement?
Trustee Krupski: I thought that was already formalized?
Trustee Bredemeyer: We have never found a written document regarding that, we
searched the files.
Trustee Smith: I think that was a verbal agreement.
Trustee Krupski: I don't know, I think that would have -to considered.
Trustee Bredemeyer: I agree, Al, we would have to consider it.

Trustee...Bredemeyer: Do you have any other comments with respect to the proposal
you have now, there may be others who wish to speak,'regarding this matter as well?
Mr. Cocks: No, just the fact that I feel that this idea of putting the dock out is
not to .make a lot of money, we will be spending money to put it out. Eventually
we will have to dredge the area, but that will. not be for at least five years until
the business is making enough money to do that. By putting the docks out we will
be saving aAot of money in the dredging. The safety factor will be a big thing also.
We are trying to watch out for Southold Town in a way by preventing any injuries or
deaths on the shoal. We are gaining two boats by putting out the docks.
Trustee Krupski: Youi are missing what we are saying. What we are saying is that
you can stay statusquo while doing. what`youz have hoped to do, to provide for better
safety and access to your fuel dock. By making that dock so much longer the access
dock to that fuel dock, that much longer.; the Board did not feel on inspections that
you would be loosing any boat slips by taking those finger piers out. Our concern is
the coverage of the bottom. If you keep the same amount of boats there along side
of that, instead.. of having finger piers, you are still going to have the slips. You
will not be gaining any additional slips.

the above noted application, please be advised that the pipe depicted in the third
photograph which you sent me is a section of pipe which is not connected to anything:..
"This pipe.-as the-upper one is filled with sand and stone and is non-functional.

Mr. Frederick Raymes: My name is Frederick Raymes °the owner. Do you have any
questions on the application?. . This is the matter of the construction of a house on
Fordham Canal. I want to build a small residence, with. a .deck that is .about 45'
deep. The town insists on a 35' clearance from the road. You have a 75' restriction
from the bulkhead What I am asking : for is a waiver of the 75' clearance to about
45' or .44' otherwise the house would be only about 8' deep.
Trustee Bredemeyer: I believe, Mr. Raymes, what you are saying is that it is
a permitting jurisdiction from this Board it is not a set-back. We review it for
possible impacts. The set-back ordinance might properly be for the Z.B.A. you
have an application for them as well?
Mr. Raymes: Yes, we had.,that hearing.
Trustee Bredemeyer: That is the set back, we have.the jurisdiction where We issue
permits it is not strictly that the structure has to be beyond' that line.
Are there any other comments?
Trustee Krupski: I think that the Board's only concern, is preventing any sort of
run off into the creek. I don't think that we are overly concerned with the
exact location of the house. We will bring that up later. on.

during construction that they try to prevent run off with the hay and normal
procedures,used. Just as a question, 'it was 'not clear on the 'diagram? The cesspool
is a little block, is that on your.

John Holzapfel: Oh, that is a shed, okay, it didn't have the septic system on_it
at all.

this black-top ramp was put in already. It has been my experience in the past
I don't know if anything has changed in my absence, but I think a cement. cover -
would be .better to 'add..:.to.that as far as the chemicals running into the water.
Trustee Smith:. I don't think that you will get cement to stay on that John, and
the less you do to disturb this area right now, environmentally I think it will be
less damaging.
Trustee Bredemeyer: The ramp here previously existed as an asphalt--ramp. Then
it. was reconstructed in the same material. That is a good point though.
Trustee..Bednoski: I don't particularly care for asphalt.
Trustee Bredemeyer: I don't think any of..us do. I don't believe .that. this is
a permit we would give out on a new permitting basis.. It was .a reconstruction of
what _was there previously. I believe the work went on without .an .approval.
Trustee Bednoski: Hopefully, something may come out of this if it comes up again?
I ,think the Board frowns' o' t• this. If it is not Mr. King; it would be someone-else?.

the surf, it breaks the cement up.

My personal inclination, and maybe the Trustees in general will agree, maybe you
can research a position on it and maintain a formal position then. I personally have
not always agreed where we use some of these materials as a town maybe we could look

TOWN TRUSTEES OF THE TOWN OF SOUTHOLD, AT THE SOUTHOLD TOWN HALL,
MAIN ROAD, SOUTHOLD, NEW YORK ON THURSDAY, JANUARY 21, 1988 ON THE
FOLLOWING APPLICATION FOR A PERMIT UNDER THE PROVISIONS OF THE
WETLAND ORDINANCE OF THE TOWN.
8:00 p.m. - In the matter of the application of Paul Kalunas to construct a bulkhead
and pilings abutting an existing bulkhead. Property is 'located on Osprey Nest
Road, East Marion.
Trustee Bredemeyer: Is there anyone wishing to speak on behalf of this application?
No. comments.
Trustee Bednoski: Is this going to be in place?
Trustee Bredemeyer: Al talked to the applicant as we were leaving. We were
trying to talk him into putting it in place. Then we could waiver the permit. I
think that it is immediately against.
John Holzapfel, G.A.C. : We. thought that it could be a waiver if:it was in place.
We were willing to -go ahead with it.
Trustee Bredemeyer: We were to, they did not want to proceed with that.
Trustee Krupski: I think it was her feeling that she wanted to go into the creek.
I see on the application if she- goes in front of it she will not be coming in front of
the existing adjacent bulkhead.
Trustee Bredemeyer: Right, we had the existing adjacent bulkheads jutting out.
It was not below mean high water.,on that particular locus.
Trustee Krupski: I don't believe the water was lapping at it?
Trustee Bredemeyer: The C.,A.C. did recommend approval on this application.
