(631)765-1809•Fax(631)765-9064 OCT 2 rj 2007 a FINDINGS, DELIBERATIONS AND DETERMINA MEETING OF OCTOBER 18, 2007. a d ®w C0errk ZB File No. 6063 -DAVID SHERMAN Property Location: 260 Founders Path, Southold CTM 64-2-24 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II .category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: The applicant's 7,266 square foot parcel is a nonconforming lot located in the R-40 Low-Density Residential Zone District and is improved with a single-family, one-story dwelling and accessory metal shed shown on the October 19, 2006 survey prepared by Peconic Surveyors, P.C. BASIS OF APPLICATION: The applicant requests Variances under.Sections .280-10 and 280-124, based on the Building Inspector's April 12, 2007 Notice of Disapproval concerning a proposed deck addition which: (1) will be less .than 10 feet on a single side yard; (2) will be less than.35 feet total side yard setbacks; and (3) will exceed the . code limitation of 20% lot coverage. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing.on this application on August 2, 2007 and September 13, 2007, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true . and relevant: AREA VARIANCE RELIEF REQUESTED: Requested is a deck addition on the western side of the applicant's home, as shown on the survey map prepared by Peconic Surveyors, P.C. and date stamped by ZBA June 22, 2007. The map shows a proposed setback of three (3) feet .from the westerly lot line, 14.4 feet from the southerly front lot line, and with lot coverage proposed at 36%. The dimensions of the deck extend, as shown on the map, 20 feet from the west side of the house at its widest measurement, and 32 linear feet on the north/south axis: The surveyor Page 2—October 18, 2007 ZB File No. 6063—David Sherman CTM 64-2-24 calculates the proposed lot coverage for the 2,614 square foot deck, or 36% total for the building areas, inclusive of the shed. The shed also is located less than the required three ft. setback from the property line and exceeds the code maximum lot coverage requirement of 20%. ADDITIONAL INFORMATION: During the August 2, 2007 hearing, the applicant offered to increase the setback to five feet and to remove the 49.5 sq. ft. shed, reducing the variances requested for lot coverage, and to submit a drawing that would show the new construction at grade. The Board concluded the hearing on August 2, 2007, subject to receiving the revised drawing. On August 16, 2007, the agent for the applicant submitted a revised drawing (wooden deck with concrete footings, flush girders and steps from the house) for the ZBA record with a cover memo. On August 30, 2007 the Building Inspector received and reviewed the specifications/drawing and noted that the Notice of Disapproval remains, without change in the appeal procedure that was pending before the ZBA. AMENDED VARIANCE RELIEF: After reviewing the revised drawing on August 16, 2007, Board Members stated that they wanted to consider and discuss the revised drawing, and on the Board's own motion re-opened the hearing with a date of September 13, 2007. During the September 13, 2007 hearing, there were discussions concerning the code allowances for structures at grade without footings, and those proposed with footings at grade. The applicant proposed footings for the deck construction, but offered to go directly to the Building Inspector and furnish specifications and information to meet code for at-grade construction. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law 4267-b(3)(b)(3)(1). Grant of the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The lot size is 7,266 square feet, much the same as adjoining properties. The lot coverage is excessive with the addition of the deck. The present lot coverage with the shed is 28%. With the addition of the deck, the lot coverage will be at least 33% (as revised). 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant is furnishing specifications to the Building Inspector (as offered) to meet code and what is determined acceptable construction `at grade.' 3. Town Law 4267-b(3)(b)(3). The variance as requested is substantial as the maximum lot coverage is 20% per code, and with the deck addition, the lot coverage would be 33% or more, almost 100% variance. 4. Town Law 4267-b(3 (b) )(5). Town Law W7-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Oliva, seconded by Member Simon, and duly carried, to DENY the variance, as applied for. BOHN: I went to the Building Department. 23 They said now it's different from what Mr. 24 Goehringer told me. cement or brick at grade is 25 acceptable. wood structure is not. But this house 0 1 2 is 78 years old and there's a lot of lots around 3 there that are very small . so nothing that's 4 built around there, I can pretty much gurantee 5 you, conforms to any kind of zoning laws. what 6 I'm asking you to do, if you could•, is give me a 5 7 foot setback for the side yard because he has two 8 frontages. A 35 foot setback would give him 9 nothing of a deck but this table. if we could 10 fill in that outside corner at a 5 foot setback to 11 acheive, we'd lose 2 feet of our deck but he would 12 still get a usable area. It's a dead area now. 13 All 4 neighbors are in favor of the project. They 14 love his plantings. The house is beautiful . This 15 would be a definite positive note for the 16 neighborhood. Would you give us that on a wood 17 structure? Because the house being a wood 18 structure doesn't comply with pretty much any 19 setback because it's so old. 20 BOARD MEMBER GOEHRINGER: At grade? 21 BOARD MEMBER WEISMAN: wood structure at 22 grade?
