PLEDGE OF ALLEGIANCE
NEXT TRUSTEE BOARD MEETING: Special Meeting: Tuesday, December
21, 1993, for purposes of finding and decision in matter of
Brick Cove Marina and other matters properly brought before the
Board of Trustees.
TRUSTEE KRUPSKI moved, TRUSTEE TUTHILL seconded. ALL AYES.
Organizational Meeting for Trustees: Tentatively Tuesday,

APPROVE MINUTES: Regular meeting of Oct. 28th
TRUSTEE SMITH moved to approve with corrections on pages 9 & 14
(corrections made) TRUSTEE TUTHILL seconded. ALL AYES
I . MONTHLY REPORT: Trustees monthly report for October 1993 :
A check for $4,518.61' for November, a check for $3,900.53 was
forwarded to the Supervisor' s Office for the General Fund.
II. PUBLIC NOTICES: Public notices are posted on the Town
Clerk's Bulletin Board for review.
II . AMENDMENTS/WAIVERS/CHANGES:.
1. Larry Tuthill on behalf of, FRANK MATHER requests an
amendment to Permit #653 to replace 3 dolphins, and add

2. JON KERBS requests an amendment to Permit #1951 to add a

leading to an 8' X 30' ramp to a 67' X 4' floating. dock.

TRUSTEE KRUPSKI moved to accept the amendment, TRUSTEE TUTHILL

' 3 . LARRY TUTHILL requests an amendment to Permit #3927 to
extend 195 l.f. of bulkhead from -105' and to extend Permit until

4. En-Consultants Inc. , on behalf of FRANCIS X. SMITH requests
an amendment to Permit #4247 changing platform from 4 ' X 8' to
12' X 5' as per survey. Located 1315 North Parish Drive,

5. Land Use on behalf of DORIS DEAN requests a waiver to
reconstruct an existing single family dwelling (interior &

TRUSTEE ALBERTSON moved to table until further plans have been

6. VINCENT P. GERRAGHTY requests waiver to cut down the

THIS IS A PUBLIC HEARING IN THE MATTER OF THE FOLLOWING
APPLICATIONS FOR PERMITS UNDER THE WETLANDS ORDINANCE OF THE
TOWN OF SOUTHOLD. I HAVE AN AFFIDAVIT OF PUBLICATION FROM THE
SUFFOLK TIMES AND AN AFFIDAVIT OF PUBLICATION FROM THE LONG
ISLAND TRAVELER-WATCHMAN. PERTINENT CORRESPONDENCE MAY BE READ
PRIOR TO ASKING FOR COMMENTS FROM THE PUBLIC.
7:15 p.m. - In the matter of the application of ANTHONY & VIOLA
TAMBURRINO to extend existing bulkhead return 10' landward and
fill void with 3-4 c.y. of clean fill. Located 85 Waters Edge
Way, Southold.
TRUSTEE BREDEMEYER: Is there anyone here who wishes to speak on
behalf of this application? Is there anyone who wishes to speak
against this application? Trustees.?
TRUSTEE SMITH: I make a motion we close the public hearing.

TRUSTEE SMITH: I make a motion .we approve the application of
Anthony & Viola Tamburrino to extend the existing return
landward and fill void with 3-4 c.y. of clean fill.

7: 16 p_.m. - In the matter of Proper-T Services''on behalf of
JANET T. SWANSON to construct 61' overall by 4' wide stairs
with landing at top and landing in middle section; to replace in
new location, storm damaged existing stairs. Located 1995
Ryder Farm Lane, Orient.
TRUSTEE BREDEMEYER: Is there anyone here who wishes to speak on
behalf of this application?
JIM FITZGERALD: I don' t have anything new to add.
TRUSTEE BREDEMEYER: Is there anyone here who speak against this
application? The application is subject of Coastal Erosion and
Wetland at this location.
TRUSTEE TUTHILL: I looked at that and it looks alright.
TRUSTEE BREDEMEYER: Close the hearing in this matter?
TRUSTEE SMITH: I' ll make a motion we close the hearing in this
matter.
TRUSTEE KRUPSKI: I thought Mrs. Swanson was going to narrow
the stairs to three foot.
MR. FITZGERALD: That's right, three feet.
TRUSTEE KRUPSKI: 'There's another type error then. I've got
four feet.
MR. FITZGERALD. Well the original application was for four
feet.
TRUSTEE BREDEMEYER: She will reduce it to three feet?
MR. FITZGERALD: Yes.
TRUSTEE BREDEMEYER: There will be a refund due under the
Coastal Erosion Hazard Act because I. think that would come under
the square foot delimiter and consequently there' s be no permit

vote on that. It' s below the threshold for a permit. Any
additional information? Close the hearing?

7 :19 - In the matter of J.H. Geideman on behalf of ANGELA
RADOVIC to construct earth berm and place new lawn as per plan
of Doroski Nursery Inc. , received October 21,1993 . Located
2060 Clearview Ave. , Southold.
TRUSTEE BREDEMEYER: Is there anyone here who wishes to speak on
behalf of this application? Anyone here to speak against this.
application? If this is the same Radovic that I recall I
think we had a long time ago, received CAC comments.
"Disapproval to construct 134' of timber bulkhead with returns"
That was in 1992.
MR. LOUCKA: I couldn't find anything lately.
TRUSTEE BREDEMEYER: The map she submitted. shows 80' from the
creek.
MR. LOUCKA: 80' from the Wetland?
TRUSTEE BREDEMEYER: It shows 80' from Goose Creek. I 'm just
wondering if the Board members who have surveyed this can fill
me in on it..
TRUSTEE SMITH: It' s supposed to have a landscaped plan.
TRUSTEE KRUPSKI: They gave us an adequate amount of plans for
it. They say 80' from the water which is about 60 or 70' from
the wetlands.
TRUSTEE BREDEMEYER: The question I have is was it an amendment
to a previous use or waiver, 'cause I don't see a fee or a new
application? All I see is a groin here.
TRUSTEE KRUPSKI: It's a separate application.
TRUSTEE BREDEMEYER: All I see is the old file application. It
looks possible that this file has been separated. It almost
looks like its out of jurisdiction.
TRUSTEE KRUPSKI: No it's not out of jurisdiction.
TRUSTEE BREDEMEYER: We collected comments both for and
against. Any additional comments of the Trustees? We might as.
well close the hearing on it and we' ll have to reconstruct the
file. If we have public comment on it it' s very straight
forward.
TRUSTEE SMITH: What we might keep in mind too is that they were
mowing the wetlands.. That was one of our conditions that they
do landscaping. I think something should be done while this is
being done, like some sort of supervision. There was bad
performance in the past. I would keep an eye on it.
TRUSTEE BREDEMEYER: Why don't we close the hearing. I don't
think there's any public objection and then. we' ll have them
submit the necessary paperwork and then maybe a final
inspection. Motion to close the hearing?
TRUSTEE SMITH: So moved.

7: 21 - In the matter Peconic Associates on behalf of NARROW
RIVER MARINA-, to replace 83 ' of bulkhead and extend bulkhead
341 . Extend floating dock to new bulkhead location. Remove
damaged bulkhead and fill to water depth of 4.1 . Relocate
existing floating docks and pilings. Replace and relocate 30'
of wave break and replace 50' of bulkhead (wave break) . Install
2 1/2' X 8' finger piers. Note: Reconfigured layout equals 12
s-lips, replacing existing 14 slips all per survey and plan dated
Jan.18, 1993. Located Narrow River Road, Orient.
TRUSTEE KRUPSKI: I` don't think that' s correct. Something is
wrong with that. They're gonna fill to the water depth of 4' ?
TRUSTEE BREDEMEYER: They' re gonna dig it out.
TRUSTEE KRUPSKI: There' s a difference.
TRUSTEE BREDEMEYER: It certainly is. They're gonna dig out
to a depth of. 41 . Is there anyone here who wishes to speak on
behalf of this application? Is there anyone. here who wishes to
speak against this application? Are there any questions on this
application? The applicant is replacing everything that exists
and the finger piers addition is to .provide more foot safety for
the patrons of the marina and consequently they are going from
14 slips down to 12 to accommodate the finger piers along the
bulkhead. They're gonna dig out to straighten out the
bulkhead.
MR. LOUCKA: Where's that stuff going?
TRUSTEE 'BREDEMEYER: To be honest with you I don't think we
contemplated, it's a very small amount.
MR. LOUCKA: Oh, look again., that' s a big amount. It' s as big
as the length of your podium up there.
TRUSTEE BREDEMEYER: Yeah, Ok.
MR. HOLZAPHEL: It is really upland though.
TRUSTEE BREDEMEYER: It' s currently upland.
TRUSTEE KRUPSKI : Currently upland, who knows what it was 20
years ago.
MR. LOUCKA: Just a question, you know, where.
TRUSTEE BREDEMEYER: They're showing they' re gonna use 100
yards of backfill for the bulkhead reconstruction 'cause they
have lost some behind the bulkhead from. storm ,damage and they're
proposing to excavate 150. There' s no wetland immediately
behind the bulkhead so I think they' ll be able to absorb the 50
c.y. .
TRUSTEE KRUPSKI: It' s true we should know 'cause we have had
problems down there in the past with passing permits and work
gets done that wasn't on the permit because it was assumed it
was on the permit. That' s why I want to make sure in the
description on the permit it should be double checked to make
sure that it' is in fact what it is.
TRUSTEE BREDEMEYER: Well they proposed to remove 150 c.y. so we
can make certain that permit reads for upland disposal on the
site. Is there anyone else who wishes to comment on this
application? I ' ll take a motion to close the hearing in this
matter.

7:25 - In the matter of Costello, Marine Contracting on behalf
of DAVID FRENCH to construct 4' X 100' of' fixed timber dock and
(4) 2-pile dolphins. Located Willow Terrace Lane, Orient.
TRUSTEE BREDEMEYER: This also requires a. CEHA Permit in this
location. It' s proposed as an open constructed structure so
that it would not impinge on any of the requirements of that
ordinance but I believe that would have to be processed also for
a- CEHA. I see here that it' s listed also underneath that- for
the permit review so that we did receive a fee on that. Anyone
here to speak on behalf of this application? Speak against this
application?
JOHN COSTELLO: In this application if you have any questions in
this regard I ' ll answer them.
TRUSTEE TUTHILL: I looked. at that and its a terribly small dock
and there isn't anything at all wrong.
TRUSTEE BREDEMEYER: No, I can see from the paper work. There' s
no problem as a dock, they just want to be careful what kind of
weather they want to put a boat out on it.
MR. COSTELLO: That' s the purpose of the dolphins, to tie off
the dock so it doesn't incur damage.
TRUSTEE TUTHILL: You still got a bulkhead you got .to finish
there.
MR. COSTELLO: That has been completed as this week.
TRUSTEE BREDEMEYER: No problem, CAC has no problem. Make a
motion to close the hearing.
TRUSTEE SMITH: So moved.

TRUSTEE BREDEMEYER: Vote under the Coastal. Erosion Hazard Act?

7 : 40 p.m. - In the matter of STEPHEN BUCZAK to construct a one
family dwelling with associated sanitary system and pool with a
40' buffer. Located Willis Creek Drive, Mattituck.
TRUSTEE BREDEMEYER: Anyone here who wishes to speak on behalf
of this application?
MR. LOUCKA: You. have our comments.
TRUSTEE BREDEMEYER: CAC indicates disapproval. There is no
reason for the project to be within 75' of the wetlands.. The
building envelop allows sufficient footage for the house and
pool. CAC also stipulates the applicant must not allow any
back wash from the pool into the creek.
TRUSTEE KRUPSKI: CAC comments make a lot of sense in that
there' s no great view to be had by the gutter itself. In fact,
the more they clear the view, the more they see the neighbors

backyard across it. Any infringement on the marsh really
doesn't have any advantage to that. There' s no view.
TRUSTEE SMITH: I don' t think your gonna do any damage
environmentally if you let them of the 40' at the top of that
bluff.
TRUSTEE KRUPSKI: They have on their survey 25' as being back. in
the 10' contour. That's for the pool or the fence around the
pool. We moved them back an additional 15' off of that 1.0'
contour. It' s 40' from the top of the bluff which would be very
close to the outside of our. jurisdiction. It' s probably 20'
from the top of the bluff to the wetland. Your talking about
601 . Anything more than that we should just tear up the file
and close the public hearing.
TRUSTEE BREDEMEYER: Is there anyone here who wishes to speak to
this application? Why don't we close the public hearing and it
seems just a matter of determining the setback..
TRUSTEE SMITH: So moved.
TRUSTEE TUTHILL: Second. ALL AYES
TRUSTEE BREDEMEYER: Anyone have a proposal to make with respect
to a reasonable setback?
TRUSTEE SMITH: I make a motion that we approve this application.
with a setback from the edge of the pool, deck or fence 40' from
the top of the bluff.
TRUSTEE BREDEMEYER: Is there a contour line where. we could
reference this line. How do we reference this for approval?
TRUSTEE SMITH: We can flag it the next time we go out. They
have plenty of property to move back.
TRUSTEE KRUPSKI: How about 50' from the line of wetlands
determined by Young & Young on the survey dated Feb. 11., 1.991
which runs parallel to the creek and to the road. Then 50 ' off
of that would at least require them to make the pool smaller and
put it, in the side yard. We should also make provisions that
they don't move it over here (indicating map) making sure they
keep it above the 10' contour but 50' off the line of tidal
wetlands determined on the survey.
TRUSTEE BREDEMEYER: Would you repeat that so it' s clear.
TRUSTEE KRUPSKI: I make a motion in the matter of Stephen
Buczak to construct a one family dwelling. The pool or
structure or any activity to be no closer than 50" from the line
of tidal wetland as determined by Young & Young and any
structure or activity is not to encroach on the 10' contour line
on any part of the property.
TRUSTEE BREDEMEYER: Second?
TRUSTEE SMITH: Second.
TRUSTEE BREDEMEYER: I'll abstain.
SPEAKER: The backwash also.
TRUSTEE BREDEMEYER: Backwash shall be contained in the
drywell.
7:40 p.m. - In the matter of Young & Young Land Surveyors on '
behalf of FREDERICK W. COLLIGAN. to raise the existing bungalow
approx. 3_' and securing it to a new pile foundation.. Located

V. ASSESSMENTS/ENVIRONMENTAL DECLARATIONS:
1. SUZANNE SWICK requests permit to construct a one family
dwelling with excavation for foundation, slab, and septic system
with no activity within 35 ' from top of bluff. Located Route
25, East Marion.
TRUSTEE KRUPSKI moved to approve for a negative declaration,
TRUSTEE TUTHILL SECONDED. ALL AYES
2. Costello Marine on behalf of BARBARA BRAATZ requests a
permit to dredge by clam shell crane on 'barge to 5' below mean
low water approx. 160 c.y. of deposit on spoil sites on
applicants property and grade. Located 5250 Vanston Road,
"Glenalough", Cutchogue.
TRUSTEE KRUPSKI moved to approve for a negative declaration,
TRUSTEE ALBERTSON seconded. ALL AYES
3.. Jack Foehrenbach on behalf of BLUE POINTS COMPANY, INC. ,
to construct a 100' X 4' open pile pier and place four
prefabricated 8' X 301 .open tanks in adjacent area. Tank would
be serviced by a 2,000 GPM pump enclosed in a 5' X 5'
structure. Intake connected in parallel. Located Foot of Love
Lane, Mattituck.
TRUSTEE KRUPSKI moved to approve for a negative declaration,
TRUSTEE SMITH seconded. ALL AYES
4.. Lane Use on 'behalf of ROB ERT ALCUS requests a Wetland
Permit to construct a 4' X 30 ' timber dock elevated 4' over
grade with a 3 ' X 10' ramp and a 6 ' X 30' float for private
dockage of a recreational vessel, as per amended plan dated
November 3, 1993. 'Located -Cedar Point Drive East, Southold.
TRUSTEE SMITH moved to approve for a negative declaration,
TRUSTEE KRUPSKI seconded. ALL AYES
5. LORETTA HINDERLING requests a Wetland Permit for an
extension of an existing deck of. approx. 335 s.f. on north
side of house. Located 1325 Smith Drive North, Southold.
TRUSTEE SMITH move to approve for a negative declaration,
TRUSTEE KRUPSKI seconded. ALL AYES

6. _ JOSEPH & ELLEN SULLIVAN requests a .permit to construct a
single family dwelling, deck, garage, sanitary system and fill.
Located east side of Cul de sac at end of Meadow Beach Lane,
Mattituck.
TRUSTEE KRUPSKI moved to approve for a negative declaration,
TRUSTEE SMITH seconded.. ALL AYES
7. En-Consultants Inc. , on behalf of DOUGAL FRASER to
replace (within 18") 99+ of existing timber bulkhead and remove
and replace in same location and configuration 3-5' X 8' stairs
leading from bulkhead to beach. Approx. 15 c.y. of clean
backfill will be trucked in •from upland source. Construct 13 ' X
20' wood deck to be located west of fixed and parallel to
bulkhead. Located 7955 Nassau Point Road, Cutchogue.
TRUSTEE ALBERTSON moved to approve for a negative declaration,
TRUSTEE KRUPSKI seconded. ALL AYES
8. Land Use Co. , on behalf of ANNA & CARLO DE GAUDENZI to
install a 10 ' X 30' "Geoweb" boat ramp. Said boat ramp will
be planted with spartina alterniflora and spartina
patens after installation. Located 3520 Ole Jule Lane,
Mattituck.
TRUSTEE KRUPSKI moved to table the assessment with a letter to
the applicant indicating likely disapproval, TRUSTEE SMITH.

VI . RESOLUTIONS:
1. Board to set Public Hearings for the January 1993 regular
meeting for those applications that are Type II and/or have
received a Negative Declaration.
TRUSTEE. KRUPSKI moved to approve, TRUSTEE ALBERTSON seconded.
ALL AYES
2. BRICK COVE MARINA - Board to release $5,.000 escrow check in
lieu of bond.
WHEREAS., the Trustees have inspected the slope dredging to the
basin. entrance,
WHEREAS, a compliance survey has been submitted and shows that
dredge depths are acceptable, AND BE IT
RESOLVED, that the Southold Town Trustees authorize their clerk
to return monies held in 'escrow' as a bond against the
satisfactory performance to the Brick Cove. Marina, immediately.
TRUSTEE SMITH moved to release. bond, TRUSTEE TUTHILL seconded.
ALL AYES
3 . BRICK COVE MARINA - Board to accept/deny FEIS.
TRUSTEE BREDEMEYER moved to accept the FEIS with 2
corrections: 1. Page 12 the word formaldehyde should be taken
out, 2. On page 14 in minutes we added vote of TRUSTEES SMITH,
KRUPSKI. & TUTHILL.
WHEREAS., a Draft Environmental Impact Statement ( "DEIS" )
prepared for a. project known as Brick Cove Marina ( "Action" ) was

accepted as adequate for public review by the Southold Board of
Trustees ( "Trustees") on September 30, 1993, AND
WHEREAS, the Trustees noticed the. DEIS in the local papers,
made the DEIS available to the general public and distributed
the DEIS among- all involved agencies, AND
WHEREAS, the Trustees held a public hearing on the DEIS on
October 28, 1993 and received additional written comments
pertaining to the DEIS, AND,
WHEREAS, a Final Environmental Impact Statement ( "FEIS"-) was
prepared and has addressed all comments raised in connection
with the Action, NOW BE IT,
RESOLVED, that the' Trustees deem the FEIS to be complete, AND
BE IT FURTHER
RESOLVED, that a Notice of Completion of. Final DEIS be filed
in accordance with the provisions of the State Environmental
Quality Review Act and Chapter 44 of the Town Code: AND BE IT
FURTHER
RESOLVED, that the copies of the FEIS will be distributed
among all involved agencies and maintained for public inspection
at the office of the Town Trustees and the Southold Library, AND
BE IT FURTHER
RESOLVED, that the Board of Trustees set the Special Meeting on
Tuesday, December 21, 1993, for the purpose of finding and
decision in matter of Brick Cove Marina.
TRUSTEE BREDEMEYER moved to accept the FEIS, TRUSTEE SMITH
seconded. ALL AYES
4. Costello Marine Contracting on behalf of `JOSEPH W. SUDA
requests a Grandfather Permit to remove and replace
inkind/inplace 152' of timber bulkhead and 5' X 11' returns,
backfill with 15-20 c.y, of clean fill. Located 1280 Sage Blvd.
Greenport.
TRUSTEE SMITH moved to grant a Grandfather Permit, TRUSTEE
TUTHILL seconded. ALL AYES
5. JAMES KING requests a Grandfather Permit to Permit 283 to
construct 8' X 80' floats with two 6' X 20' finger floats and a
16' X 4' ramp from existing fixed dock. Located 220' south of
East Mill Road, on Mattituck Inlet.
TRUSTEE KRUPSKI moved to Grandfather 2 floats and amend Permit
2.83 ( 8' X 80 ' floats with two 6 ' X 20' finger floats) . TRUSTEE
TUTHILL seconded. ALL AYES
6. Resolution authorizing closure of Trustee Lands to taking
scallops by scrape or dredge.
WHEREAS, the harvest of mature Peconic Bay scallops is nearly
complete in Town waters for the year 19.93,
WHEREAS, a successful Spring has resulted in moderate to heavy
recruitment of young scallops of the year ( ' 9.3) in Town waters,
WHEREAS, these young scallops are already being harvested as
legal "bug" scallops,
WHEREAS, over harvest of these bug scallops would unnecessarily
reduce the harvest of mature scallops in 1994,

WHEREAS, the Trustees are empowered to manage Town Lands under
water and Andros Patent natural resources by virtue of the New
York State Laws of 1893,
RESOLVED, the Southold Town Trustees close the entirety of all
Town Lands underwater excepting Mill Creek/Hashamomuck Pond in
Southold-' to the taking of .Bay scallops by dredge or scrape or
the placement of said gear on said Trustee lands underwater for
any purpose whatsoever for the period of December 1.5, 1993 thru
March 31, 1994 inclusive,
RESOLVED, the Southold Trustees authorize the Southold Town Bay
Constables to enforce this closure with particular attention to
the scallop resources in Hallocks Bay, Orient and its'
tributaries, Corey Creek, Southold. and Broadwaters Cove,
Cutchogue and its' tributaries..
TRUSTEE BREDEMEYER withdrew the resolution for closure of
Trustee lands.
7 . . Resolution in support of a land transfer to JOHN WICKHAM.
WHEREAS, an offer has been made by John Wickham of Cutchogue to
transfer all right, title and interest to meadow islands held by
him in West Creek, New Suffolk to the Southold Town Trustees in
exchange for Town Trustee lands existing behind his dike at West
Creek., New Suffolk,
WHEREAS, our initial research indicates that the Town may
acquire more land than we transfer and that it may provide more
accessible uses for hinting, fishing and shellfishing for our
residents,
RESOLVED, the Southold Town Trustees support the concept of a
tranfer of land with Mr. Wickham subject to the following:
1) Verification of the acreages by licensed survey or
photogrametric method to show the Town Trustees as a net
benefactor in the transfer.
2) Creation of a scale map of the proposed transfer to be used
at the public hearing and by the press.
3 ) Holding a public hearing to determine the level of public
support for such a transfer.
4) A resolution authorizing the Trustee's attorney and
President of the Trustees to effectuate the transfer.
TRUSTEE BREDEMEYER moved to approve ordinary maintenance at
section A, B, C & D provided all material comes. from upland
source, TRUSTEE SMITH seconded. ALL AYES
8. TUTHILL & SCHULTIES• - Dock Permit
TRUSTEE SMITH moved to approve to rescind dock permit until land
ownership is resolved, TRUSTEE KRUPSKI seconded., TRUSTEE
BREDEMEYER abstained.
VII. MOORINGS:

I. RAY L. JACOBS requests a 6' X 14' duck blind in Tom Brown' s
Creek. Duck blind will have 2 anchors.
TRUSTEE BREDEMEYER moved to approve permit, TRUSTEE ALBERTSON
seconded. ALL AYES
2.. RICHARD GISE/Fred Terry requests a duck blind in
Hallocks Bay with 2 anchors. Access will be from Lloyd
Terry's property.
TRUSTEE BREDEMEYER moved to approve provided that permit is. in
Mr. Terry' s name, TRUSTEE SMITH seconded. ALL. AYES
