TRUSTER KRUPSKI: I see this application hasn' t changedd. We
spoke with. Glenn and then I met with. Lou Chiarella. We had the
identical discussion. He built his retaining wall where the
block. wall.. was. All. that is just garbage: that he. is throwing in.
front. That should be removed. He should. bring in. some sand to
bring up ,the elevation and replant. Lou. said: that is. good.. I
asked Jil.l. to tell Glenn that is basically it. I make a motion,
to table this.

JIM FITZ.GERALD.- Sign. Fitzgerald. for Angelo Padovan_ I: don' t have
anything to add. to the application, but I. would be happy to
answer any questions you. have.
TRUSTER KRUPSKI.: We. looked at it anddi.t seems straight forward.
CLERK: CAC recommends disapproval because of the neighboring
parcels and existing erosion patterns do not. warrant.. it being
armored..

TRUSTEE.- KRUPSKI.: The way we saw it, it. is sort. of semi. armored.
The structure itself armors itself. the way i.t. is.. Basically it
is just a repair to that structure and it is not going to change
what is. happening there: anyway. Use. this like a patch.
JIM FITZGERALD: After the retaining wall. is place, he will. drill.
a hole in the deck and pump in concrete and fill that in. Jill,
said. you. are interested- in where the oil tank. is.. It is on the
landward side of the seaward side: of the: House in. the: northeast.
corner outside.
TRUSTEE HOLZAPFEL:. Water gets very close to that.. That is. our
concern. If this is the northeast side, where the. deck area is.,
it seemed that the tank was just beyond. that. By 5 or 6' . The
must get- very close to being in the water on a storm tide_
JIM FITZGERALD: That. will. be enclosed, it will. be. inside. the
retaining wall. This will protect the oil tank.
TRUSTEE. HOLZAPFEL: That is pretty much armored by the patio.
There really is no. difference.
JIM FITZGERALD: Environmentally speaking there is no difference.
TRUSTEE KRUPSKI: Is there anyone else who would like to comment
on the application? Does the board have. any other comments?
A motion was made by TRUSTEE WENCZEL and seconded by TRUSTEE

4. Richard. Saetta on behalf. of JAMES. GRACE., SR. request a
Wetland & Coastal. Erosion. Permit to remove two existing7 houses,
join the. 2 lots and construct a l family dwelling as. per-
survey. Located: Willow Terrace ROW, Orient. SCTM #.26-2-6
TRUSTEE KRUPSKI: Is there anyone here who would like to speak in
favor or against the application?
JAMES GRACE: I am here if you have any questions.
TRUSTEE. KRUPSKI.:. We did the line between the two houses. and it
follows the shore line in a consistent manner.
TRUSTEE HOLZAPFEL.: There is a line between the two corners and.
it is basically landward of that line..
TRUSTEE WENCZEL.: We are not approving this building envelope,
just the proposed house and deck.
TRUSTEE. KRUPSKI.: Is there any other comment? Do I have a motion
to close the hearing?
TRUSTEE. WENCZEL:. So moved.

TRUSTEE. HOLZAPFEL: I will. make the motion that we approve the.
application. of James Grace to remove to existing: houses, join
the two lots. and. construct. a single family dwelling as per
survey dated. January 24, 1997. It does not include the building
_envelope..

5. FRANK SCAVONE requests a Wetland Permit to construct a 45'
bulkhead along toe of bluff approx. 4' high, 8' to 15.' above
average high water as. per drawings. Located: 1.61.5. Fleetwood

TRUSTEE KRUPSKI: I have had many conversations with Mr.
Scavone and in the end we discussed the rack revetment.- He.
thought that would be a. good idea. He agreed. to stabilize. along
the toe in front. of: and. on top of the. rock. r.evetment. I. see that
he sent us a cross section here which is very nice. .He wants- to
but. a planting box up top which. prevents. runoff, he.- says.. Low
density fill underneath. He wants: to modify th.e: slope where:
required., which will. all.ow to revegetate. He wants to put.
natural boulders. at the bottom.. He says 2 or. V high.. He doesn.'t
want a massive. structure. He: wants it to lnok. fair.ly natural. He.
wants to angle it to reflect energy of the wave action and.
revegetate in the front.: This is exactly what we discussed. it
did. save him. a lot of time and effort. as he says in. his. letter.
Any other comments.?
TRUSTER HOLZAPFEL: No. I think that is what we wanted.
TRUSTEE. KRUPSKI: What kind of grasses?
TRUSTEE GARRELL: American Beach Grass.
TRUSTEE. KRUPSKI: O.K. You want American Beach Grass goingg up the
slope and you want in front Spartina Patents?
TRUSTEE GARRELL: Yes.
TRUSTEE- KRUPSKI: There, is a huge rack line here.. There is. like a
15' . . .
TRUSTEE HOLZAPFEL.: But Patents needs a. much higher salinity and
I don' t think.you are going to get it. there.
TRUSTEE KRUPSKI: Don't you think beach grass would be better
there.
.TRUSTEE GARRELL: What are you going to do about roof. runoff?
TRUSTER KRUPSKI.: He is going to redo the house.. We. wi.11 be
addressing that soon. Do you think beach grass would grow there?
TRUSTEE HOLZAPFEL: It certainly looks like it. Up here it would.
Patents needs to be wet once a month and just sit. in the higher
salinity waters. Which is the opposite of what you would think.
Patents has a higher salinity regu rement_. Because the water
evaporates and it gets: stuck up there in the high tides. It
doesn' t belong in the water.
TRUSTEE GARRELL: The letter from Allan. Connell says the beach
area below MHW should be planted with Spartina. Alterna Flora.
Smooth Cord Grass would provide further protection of the toe.
The -area between mean high tide. and the toe. of the slope should
be planted with Spartina Patents, Salt Meadow Cord Grass.
TRUSTEE HOLZAPFEL: There it is. That is even better.
TRUSTEE KRUPSKI.:. O.K. Thanks. Do I have a. motion to close the-

subject property.. A short. return may have to be. removed to

be trucked. in, and construct a 4' X 120' stairway with 3- 4' X

DIANE LEVERIER.: Diane Le_Verier from. En-Consultants here on.
behalf Stepan Minakyan. The existing return will. be removed..
They are going to remove that. re-turn. and.. construct the new wall
behind the existing gabion. wall._
TRUSTEE KRUPSKI: We will make it following the toe of the bluff.
DIANE: I think that is. what they are- planning on. doing. anyway.
TRUSTEE KRUPSKI: I spoke with Roy about the water coming out of
the bank.
DIANE: He spoke. with Stepan and he said he is aware of the
situation. He is. a P.E. actually. He new that that was
happening. But he also knows that the cost to repair what is
going on. is about. 100 thousand dollars. He was talking about
crib walls. and other stuff.. I don' t know if that is going. to be
done anytime. soon. He is. aware of it.
TRUSTEE KRUPSKI: It is serious there.
DIANE: The plan has been revised to. show one of the returns
armored with stone. That was a requests of the DEC.
TRUSTEE. KRUPSKI.: What this. plan. doesn.'t show is that., it should.
follow the. toe. Then. it will. leave. the neighbor hanging out in.
the open with a funny angle. See how it goes straight out and. it.
will leave a funny angle and if: the neighbor does something, it.
will make that- jog there. Follow the toe of the bluff.
DIANR LEVERIER: O.K. I don't think that should be a problem.
TRUSTEE. KRUPSKI: Do I have a motion to close the hearing?

7 . En-Consultants Inc:. , on behalf of NEWTON ROBBINS. requests. a
Wetland- Permit to replace (within 1811) 91 l.f. of timber
bulkhead. and. backfill with 1.0 c.y. of clean. f ill.,. remove and
replace 20' of return on west: side, and- construct a new 2.0'
return on east side, and remove and replace steps: and a 5' C 12'
inclined boat. ramp. Located.: 20. Third Street, New Suffolk.

TRUSTEE KRUPSKI: Is there anyone who would like to speak on
behalf of the. application?
DIANE- LEVERIER.: Speaking on behalf of. Newton. Robbins.... This.
application is also amended- by the requests of the DEC. They
want the return. became a big issue (on the westerly property
line) It is not on his property. The fence: is. indicative of: the..
property line on the east side. However, the westerly return is.

not on his property. I brought in new drawings showing the
returns. We have a DEC permit for. that..
TRUSTEE. KRUPSKI.: I was going to suggest that he put that on. his
own property. A 20' return. i.s not, it is small matter
physically. Instead of replacing: it there to move it back the
two feet onto his property.
TRUSTEE. WENCZELr The difference is that they would pull out- the-
other one.
TRUSTEE. KRUPSKI: But. it is not like it. is in great.. . .
TRUSTEE. WENCZEL That is. the thing to do.
DIANE LEVERIER: He just wanted to leave it and. replace the.
bulkheading in the. front.
TRUSTEE KRUPSKL: That. is fine.. As. long as. he realizes that. it. is
not on his property. At some point the. highway dept. might say
that it is in. the road way.
DIANE. LEVERIER: If he didn't. construct. it is it still his
responsibility to. . .
TRUSTEE KRUPSKI: No but. the town could come and. pull. it out.
DIANE LEVERIER: Than that would be a problem for him.
TRUSTEE KRUPSKI: Right.
DIANE LEVERIER: O.K. I will Iet him know.
TRUSTEE KRUPSKI: It is not a permitted structure. He has no
legal rights to it actually. If he wants to move it the two feet
in to his property line, we will be happy to let. him do that..
Otherwise, it is. his own risk. He can leave it there and i.t.
might stay there the next hundred years and nothing will ever
happen..
TRUSTEE WENCZEL: So there is no. retur.n. on the east si.de.?
DIANE LEVERIER: No, because there: was already a bulkhead there.
so we are just going to tie in.
TRUSTEE KRUPSKI: Do I. have a motion to close the hearing.

8. En-Consultants Inc. , on behalf of RICHARD MAGEE requests a
Wet.land_ Permit to replace (within. 1.811 ) an. existing. 64 l.f. and
77 l.f. of bulkhead, construct a 12' extension to existing
return and. backfill with approx. 50 c.y. of clean fill.

TRUSTEE. KRUPSKI: Is there anyone- here who would like to speak on
behalf of the application?
DIANE LEVEIER:. En-Consultants. on behalf of the Richard
Magee. It is just a basic replacement within. 1811 . We just want
to extend the., existing return.. There is. some, er.osioa..
TRUSTEE HOLZAPFEL.: Do you have any sense on. why that is there?
The erosion.
DIANE. LEVERIER:. It. looks like. during high tide: it comes up and
scour' s out behind the return... I have a picture of it..

TRUSTEE HOLZAPFEL.: I. saw it. It thought. some of it might have to.
do with the: runoff from the lawn too..
DIANE LEVERIER: I don't know if it. would be coming from the
lawn.
TRUSTEE HOLZAPFEL: Just. becaus.e the: neighbor called and. asked
about that particular, whether the extension- of the return would
just make. mo.r.e erosion. I said I didn't think. it would. cause any
more erosion.
DIANE LEVERIER: I don't think so, if you bring it far enough
back.. That shouldn' t happen...
TRUSTEE_ WENCZEL:. My feeling was. that the problem there is. that
they have the wrong kind: of vegetation planted. They just have
turf. There is nothing' to. hold. that bank. So every time the tide
comes up and there is any kind of ripple. on the. creek, you. are
just washing it out. What they need to do is regrade and: replant
there.
TRUSTEE KRUPSKI: That is the neighbors. problem.
TRUSTEE HOLZAPFEL: I just wanted everybody to be aware that
there is some concern..
TRUSTEE. KRUPSKI: Any other comment?

9. En-Consultants. Inc- , on behalf. of NEW SUFFOLK SHIPYARD
requests a Wetland Permit to dredge mouth of. Schoolhouse Creek
to depth of 4' below ALW, and approx. 200 c.y. of. resultant.
spoil will be deposited on property of Gerard Schultheis..

TRUSTEE. KRUPSKI: I.s there anyone her.e. who would like to speak on
behalf. of. this application?
GERARD SCHULTHEIS:. I am. Gerard Schultheis. Just a couple of
comments, number one, I am in. favor of: the. project.. Last Summer
I spent many a day towing boats out of the creek that got stuck.
Just some observation I would like to make is that back in 1987,
I replace the bulkheading along my house which. is along the side
of Schoolhouse. Creek. At that time also dredged Schoolhouse
Creek out. On an annual basis in the spring time I would go out
and take soundings. to check the depth. From 1988 to 1992 the
depth of- that channel remained constant. In. 1992. we had that
big storm which washed out some groins. that are to the north
of the channel.. After those. groins, got washed out, my
observation. has been that the channel itself has. been filling in-
at a rate of. 6 or 7" a year. It is just my observation that
those groins prevented. the channel. from. filling in. The other
comment I. would like. to- address is basically the permit calls
for dredging 4' BMLW. I: personally have a sail boat. My boat
requir.es. 516" . 4' depth really limits. the accessibility, to that
creek at. low tide..
DION LYNCH: I am Dion LYNCH of New Suffolk- Shipyard.. It is my
belief: that., I had hi.ghered. En-Consultants. to apply for the
permit at. a. 5' draft. I did get my notice-. of application from.

DEC and that showed the 4' . I called them,. that has.- been amended-
to the 5' depth.. I was under the belief that was that here. as.
well. Maybe not.
TRUSTEE KRUPSKI: If. you want to amend. that tonight, you can do
that.
DION LYNCH.: We would like to. otherwise, I. think it is pretty
straight. f orward...
TRUSTEE. KING: Did DEC. limit you to 5' ?
DION LYNCH.: No. I don' t believe. so.
TRUSTEE. KING: Why don' t you. gb another V .
DION LYNCH: it is my observation in the past. is: that it got to
the 5' spot and filled in. We have gone to the 6' and it wasn.'t
more than a year, year.. and a half before it. filled. in to 5' It.
held. r.eal true .to the 5' mark for years..
TRUSTEE.KRUPSKI.: That is fine. Jill will show you. where to amend.
it. You can. do. it right now. Diane we just amended the
application to show a 5' depth. instead of 4' .
DIANE LEVERIER: O.K.

we were thinking of taking up the little jog in the front on,
the south side and coming from that corner from where the jog
starts and filling in half the slip. Instead of putting in one
wall out, one wall over. You would start at that point and go
diagonally across. that, join. up with the wall in front. So you..
would have less. structure.

loose a. tremendous amount of hand there. Secondly, if you. do
that, any time else when they go to replace it they can pull it
out then, because you always got the wall. behind. it to hold. the.
soil. Those bulkheads seem to hold:, up.. I don't like the idea of
pulling them. out. when there is such an exposure.
TRUSTEE KRUPSKI": If everyone agrees that we should. approve this
as applied for, there is no sense going nut.. But we couldn't
approve- it without an updated. survey showing the dock. He has to
show the dock and amend the application. He has. to show the dock
and amend_ the application and- show the dock...
TRUSTEE- WENCZEL_ When you. replace these. bulkheads, do you go rip
out the entire old: bulkhead-. and- then put in. a new one our would
you. go. rip out the old one,. as you. put. the: new one..

have to tare up a lot of property to do this.

The following action was taken by the Southold Town Board of
Trustees at the regular meeting on Wednesday, January 29, 1997:
Whereas the Southold Town Trustees have. been empowered to set,
daily limit. f.or the commercial and. recreational harvest of
oysters, and
Whereas, the Trustees Shellf.i.sh. Advisory committee has- been.
consulted regard ng. wha.t the. appropriate daily limit should. be
and made a recommendation: to set that limit at 2000 oysters fora
commercial. harvest and 200 oysters recreational harvest; and.
whereas the Southold Town Trustees have: determined that this
proposed daily limi.t .will benefit the harvesters of: this oyster-
resource in a very positive way, and.
whereas., Southold Town Trustees- have determined that this.
proposed daily limit. will allow for the efficient harvest of the
oyster resource- in. Mattituck. Inlet by allowing the harvesters. to
maximize their harvest in. the- limited amount of the time that.

Therefore, be it RESOLVED that the Southold Town Trustees do
hereby set the 1997 daily oyster harvest limit at 2000 oysters
per day, per person and. 4000 per. day per boat for commercial
harvest and. 2.00 oysters per day for recreational harvest.
