You have the revised plans, if. you have any questions.. JERRY MAGINTY: I Live across the creek... When I put my dock in in 1980 there was plenty of. water. My boat draws 1' 9" and. now .sits on the bottom. Over the years it has filled. in partly due. to wave action of the boats going by. Here are s.ome. pictures showing the: wave action that undercut the. grass.. You can yell. all you want but these people- don' t slow down.. I,f you put more. boats. in there, it is_ going to get worse. RITA MARTIN: I live across the creek from the marina. The marina. has. never been an environmentally clean marina.. I. pick tip garbage all the. time from there. I can't do it. any more. TRUSTER. WENCZEL_: It is zoned- for a marina? Isn't that correct? TRUSTEE KING: But it has never been used as. a. marina. TRUSTEE KRUPSKI: I believe the zoning is for upland not. for Trustee. land.. TRUSTEE WENCZEL: I. realize that. When they changed the-.zone on the property, obviously. . . TRUSTEE KRUPSKI.: Not necessarily, you. can us it. for. . .there is a parcel. on. the main road the-. rail road.. tracks that- is zoned. for marine. use and there is no water- access. TRUSTER WENCZEL_:. This is. marine I? TRUSTER KING: M-II MR. FITZGER:ALD: I. think the use of the water and the access to the water is implicit in the rezoning, wouldn' t you think? TRUSTEE.,HOLZAPFEL: That. is what we:. want to look up for you Jim. I hadn't perceived it in that same look. I just want to take a look at what the book says.. MR. FITZGERALD: A permitted use is ,a marina,. A marina.' s have these_ things in the water. TRUSTEE. WENCZEL_: Boats or docks? MR. FITZGERALD: Both. TRUSTEE KRUPSKI: Where it is. a new marina, I think. you have: to consider what. is appropriate. for that area. as: far as. is. one:. boat. appropriate or is 100 boats appropriate_ and. there. is. a. whole. range. of. . . MR. FITZGERALD.:: I was just addressing your comment that. the. Zoning: does not necessarily mean that. you can put docks in. there. TRUSTEE HOLZAPFEL.: Jim have you applied to. DEC? MR. FITZ.GERALD.: No. No other applications have beenm submitted_ TRUSTEE WENCZEL: Are they planning: to. develope the: upland.. portion? MR. FITZGERALD: No. Again, Peter, it is: my- understanding- that they don' t intend- to make any changes to the upland.. Board of Trustees 6 May 28, 1997 TRUSTEE HOLZAPFEL.: It goes on forever. Permitted uses are one.-one family detached dwelling per single and. separate: lot of record_,. marinas for the docking, mooring: and. accommodation. of recreationa.l. or commercial boats, boat docks., slips, piers or wharf or charter boats_ carrying passengers;. on excursinnsi,. pleasure or fishing: trips.. That is permitted under zoning. MR. FITZGERALD: I think one other point that we: ought to talk about. is if you. recall. that the last time we where here on this.., Chuck Hamilton had_ written. a letter to. Jim that. indi_c.ated:. that there guidelines where 4'.' of water at low water. Which probably could be_ obtained, at l.east. to the top of the. mud. If that is where. one ordinarily measure the water depth too. Any place in that. creek.. How would you react when we come in to dredge -that area? TRUSTEE WENCZEL.: That is a good. question. TRUSTEE. KRUPSKI: Town Trustee bottom isn.'t ordinarily dredged. Dredging a private bottom- is permitted on a maintenance basis.. But as far as Town Trustee bottom it hasn' t been. dredged. MR. FITZGERALD: So it is unlikely that you would- look favorable- upon? TRUSTEE KRUPSKI: It is unlikely. Then you would run into a whole other r.ange. of undermining adjacent: areas:, you. run into whole range. of siltation. creating pockets_ of deep: water. The destruction of habitat in that area. It is a pretty complicated. issue. I think we are going to have to table this anyway in order to look through the code and see exactly what is or isn' t allowed. TRUSTEE WENCZEL: If the DEC isn't going to grant the permit without dredging it., which. is. obviously what you are getting at, you should- be submitted. a application that includes- the dredging.. Doesn.'t that. seem logical? MR. FITZGERALD_:. At this point we don' t know if we need dredging. TRUSTEE WENCZEL: Not that I am in favor of. that. Its seems if. you get. our permit than you go to the DEC and say well we don' t have quite four feet of water here but they gave us a permit. Can't we have a permit? Maybe you come back to us_, maybe you don' t. MR. FITZGERALD: There is an alternative in that it might be appropriate to say that you would be willing to allow it if. the DEC permit can be obtained. TRUSTEE WENCZEL: No. I wouldn't say that. TRUSTEE KRUPSKI: No. That is. Town bottom, that is not. State bottom.. We would be more protective there than the State would be. As apposed to being State bottom. In that case we would. defer to the State. When it is Town bottom they generally defer to us. MR. FITZGERALD.: What I. am specifically talking about. is Chuck' s 4' , the DEC guidelines:. TRUSTEE. WENCZEL: Maybe you ought to. get. the DEC first. See what they request. and. then we, can, do it as. a.. package.. MR. FITZGERALD.: It puts us. in a position: of going through that. which- is going to be more complex. TRUSTEE: KRUPSKI:: Maybe_ not... We are going to have: to ga. through this code and make sure we are doing the: right- thing:. TRUS.TEE:. HOLZAPFEL_:. This is. the first. new marina that. has. come up in a. long time. One. of the things that. always struck me is. that; this is our land. Everybody in Southold owns that. I don't know whether- we should. just. give. it away for somebody else to make money from. That. is a big philosophical.. question. that. I think has: to be discussed to a. greater- extent. TRUSTEE KRUPSKI.: That is what I was: talking. about.. Board of Trustees. . 7 May 28, 1997 MR. FITZGERALD:, It may come. up again? TRUSTEE. HOLZAPFEL_: That. is rights. I am just saying that I want. to through that. out as a question. that needs to be talked about. I don't. think we have talked about that previously. TRUSTEE. KRUPSKI: That is not. an issue. as, ,simple. as. saying that Mat-A-Mar. wants. another extension., or something. like that. I.t is: a. larger issue. MR. FITZGERALD:. I. understand... TRUSTER WENCZEL.: Specially as an- independent piece of property'. MR. FITZGERALD: Just let me add. to the record, if I may. A year or so ago our Supervisor was very high on expanding: tourist attractions. in Southold. Town, which specially included additional.. marina. space.. If it turns out that after you have discussed. this. among yourselves that it is: going to be a. continuing problem with the use of Town bottom for profit making operations., then it would good that. you discuss this with Ms. Cochran. TRUSTEE GARRELL_:. I think plainly, we have to discuss. this because. it. isn' t a single- issue here. I.t looks. like there are really 2 or 3 issues. The one marina issue, the other the Town bottom issue, and the third the dredging issue:. All of these things we have to defer to other people, including the Town Attorney and the statutes have: to. be looked at as well. It think we need- to table this tool.. TRUSTEE HOLZAPFEL: It think. it was. necessary that we have a public. meeting so that we saw that other people have some- concerns. That is. why we wanted to hear the thing tonight anyway. I think everybody on the board- had the feeling that. we, weren' t going t.o. vote on this tonight. MR. FITZGERALD:. I got that feeling. too. TRUSTEE WENCZEL_:,_I would suggest that you start the rest of the process, if you are really serious: about. this. TRUSTEE KRUPSKI: And do a whole process analys.is_, not piece meal.. Dredging: is. part. of the component that you. need to get: all the approvals. MR. FITZGERALD: Another. possibility is limiting the use of the new' area to say half or boats.. without motors. or boats. with motors less. . than 4 horse.. TRUSTEE KING: How would that be enforced. TRUSTEE KRUPSKI: Enforcement is a major problem. It also comes down to whether we would approve any dock that is going to sit in the mud also. If it is our opinion that the structure is. going to sit in the mud at low water, we are noa going to. approve'. i.t.. here. or. any where: else anyway. TRUSTEE WENCZEL.: That wasn`t Jimmy's findings_. TRUSTER KING.: Those orange poles you. put. in, is that the. outside of the float or the inside? MR. FITZGERALD: Those: are the two ends- of the: outside: of the float and in the middle:. (everyone talking. at once.).. TRUSTEE KING.: There will be: a little_ inside_ of the. float but not. much. MR. FITZGERALD: I think there: are many floats in Southold Town that. at extremely low tide sit at the. bottom.... TRUSTEE WENCZEL.:. Definitely. You have to. talk about normal low tide. TRUSTEE KRUPSKI.: Any other comment from the public.? FRED RANGANESKI: I am the President of the Browers Woods- Association. I am listening to the. comments:.. here. It would. appear that. we are talking like today. Mr. Meginty has spoken. and. it. is shoaling in.. What you are discussing is a. permit. for floats to be floating in: a Board of Trustees 8 May 28, 1997 foot of water today. At the rate that. it is shoaling in I would say in five years it would be sitting on the bottom:. I. know the property that I have is shoaling in at a pretty good. rate. When I first moved here ten years ago I had no problem bringing a boat in.. Right now I can' t bring it in at low tide. Just to think. about. it.. TRUSTEE KRUPSKI.: Thank. you. MR. MEGINTY: I bought my house in 1975 that was:. residential at the time. I put. my dock- in.. Shortly after I bought. the house' my neighbors. and I positioned. the. County to- dredge and they agreed., believe: it or not. Then political things happened. and it was. tab.led and when we called. up to see what happened- to the dredging they said that seize. to existing along Mr:. . . . so that was the end of the that. The . filling in of that creek has been a long history. Thank you. Also it might seem odd that I am the only one that is complaining. There is a very good reason for that... I am one of the few on the north side of the creek. The good part of it is owned by the fellow that owns Mat-A-Mar Marina. TRUSTEE. KRUPSKI.,: Thank.. you.. Anyone. else... Construct walk 4' X. 19' at grade behind bulkhead as per plans dated May 8, 1997. Located 830 West Cove Road, Cutchogue. SCTR #111-2.-11. TRUSTEE. KRUPSKI: Is there anyone here: would like to speak in favor of the application? MR. FITZGERALD: Yes. Jim Fitzgerald for Dr. O'Grady. I have nothing to add to the material. that is in the application. TRUSTEE KRUPSKI: Any other comment? Board? TRUSTEE_ WENCZEL: That was. yours.. TRUSTEE KRUPSKI.:. Alright-, I took a look at it. I. questianed the. size. of the dock at the. time. It is the same: size as. what: the. neighbor has. After thinking about- this. and. looking. at the plans again- The. picture shows the dock to the north. Is there. ever a boat -tide up there? MR. FITZGERALD: I don' t know. TRUSTEE. KRUPSKI: Where Moellers_ have it, it. is really protected. Dr. O'Grady is out- in the open. I would imagine any kind of boat you put there is. going to be. hammered.. I don.'t think. he. is going to keep a boat there or a float there. in. one: piece., in a. normal summer.. I. remember the dock to the north and have never seen. a boat there. That is. why. I don.' t. think. a boat could. stay there in a. normaL summer. TRUSTEE. HOLZAPFEL.:. Does the owner know that. situation? It might. be something: that you can make him aware of. TRUSTEE KRUPSKI: After a summer of everything falling apart., you are just going to have the dock: there. vacant. f:or .ever.. -I think his: answer might be a short dock and a mooring. He can. pull the dingy up on davits or just a shorter dock with just big davits that. he can load the boat up.
