IV. PUBLIC HEARINGS:
THIS IS A PUBLIC HEARING IN THE MATTER OF THE FOLLOWING
APPLICATIONS FOR PERMITS UNDER THE WETLANDS ORDINANCE OF THE
TOWN OF SOUTHOLD. I HAVE AN AFFIDAVIT OF PUBLICATION FROM THE
TRAVELER-WATCHMAN. PERTINENT CORRESPONDENCE MAY BE READ PRIOR
TO ASKING FOR COMMENTS FROM THE PUBIC.

1. Land Use on behalf of JERRY & MARY KEEGAN requests a Wetland
Permit to construct a 1,813 s. f. house with driveway, septic
system, retaining wall and a 16 ' X 30 ' swimming pool. Located:
200 Beachwood Lane, Southold. SCTM #70-10-52
TRUSTEE KRUPSKI : I believe this application will be postponed
until the Health Department acts on it first because of the
proximity to the wetland and also to the neighbors . There' s
gonna be a lot of difficulty in siting the septic system and
well. We are reviewing the proposed septic system which doesn't
really exist on most properties where the septic system is
placed and where it would be. In this case this is what they
thought it would be and it might not be in the end. So we won't
act on this until the Health Dept. acts on it first. Does
anyone have any comment on that or questions about that? I ' ll
make a motion to table this application.

2 . J.M.O. Consulting on behalf of THOMAS MC CARTHY requests a
Wetland Permit to construct a 4 ' X 15 ' elevated catwalk, a 3 ' X
8 ' ramp and 3- 6 ' X 25' floats . Located: 1605 Goose Neck Lane,
Southold. SCTM #77-3-17 . 1
TRUSTEE KRUPSKI : On this second application, this has been
tabled for quite awhile. Do you, Glen, have any comment on that?
GLENN JUST: I called Diane yesterday and told her that they '
decided to drop part of their application and put in the one 6 '
X 20 ' float. The catwalk would be 4 ' X 15 ' .
TRUSTEE KRUPSKI : Do you have a drawing?
GLEN: It will be the same set of drawings as done by Mr.
Ingegno, but we haven't gotten a chance of getting copies made.
TRUSTEE KRUPSKI : How far out would that go?
GLEN: I scaled it to 27 ' out.
TRUSTEE KRUPSKI : How far out because we have a policy of 'no
further than 1/3 of the way out' .
GLEN: It varies from 65 to 75 ' in that whole stretch. That
would be the advantage from the opposite shoreline there.
That' s why we initially went to that spot. It was the widest
spot in that canal. You couldn't bring a big boat in there
because there' s not much water there.
TRUSTEE KRUPSKI : That's more than 1/3 of the way across.
GLEN: It would probably be about 6 ' more than 1/3 across.
TRUSTEE KRUPSKI : Then we couldn't allow that then. It' s a good
policy and we had problems with things like that in the past.
GLEN: I could cut it back to make it exactly 1/3 . I can FAX it
over by tomorrow morning.
TRUSTEE KRUPSKI : You can make it a "T" or an "L" too and then
have it come out to 1/3, but it can't be. . . .there has to be the
float and the boat then.
GLEN: It's a relatively small boat, just 221 .
TRUSTEE KRUPSKI : Do you know if it' s gonna be straight out or a
"T"?
GLEN: I ' ll put it out in an "L" .
TRUSTEE KRUPSKI : Are there any other comments? I ' ll make a
motion to table the application until we get plans.

3. Permits & Drafting Unlimited on behalf of WALTER CHADWICK
request a Wetland Permit to construct a 4 ' X 140 ' catwalk, a 3 '
X 14 ' ramp and a 6 ' X 20 ' float with 2- 2 pile dolphins, and to
construct an 840 ' locust post and rail fence along the perimeter
of property (with the exception of water front area) . Located:
6565 Indian Neck Lane, Peconic. SCTM #86-6-25
TRUSTEE KRUPSKI : Is there anyone here who would like to speak
in favor of the application?
CHARLES CUTTY: I have a notice of posting and affidavit. As
indicated this is an application this goes essentially across
the wetlands out into the widest part of Richmond Creek.
There' s a 14 ' ramp and 20 ' floating dock attached to it. At
that point the water is approx. 4 ' deep. We think this is an
appropriate place and certainly the widest that I know of on the
creek to do' that. There' s nothing there right now. I 'm not
here in connection with the fence. I believe that is being done
by a different applicant but I am here for the catwalk & dock.
I have a series of pictures taken just a few weeks ago
indicating the placing of the catwalk and what it would look
like. In looking at this site it doesn't appear to me that
there would be any adverse affect upon wetlands or upon the
creek or upon any adjoining properties.
TRUSTEE KRUPSKI : Is there any other comment?
AGNES COMBS: I 'm here to represent my brother who is in
Florida. I 'd like to show a survey that was done by Mr. Knowel
on the property. When my parents built that house and they had
an addition put on some how or another the house was put over. by
a couple of inches and Mr. Knowels went legally through and we
took care of getting that extra piece of property. If the fence
is put up on the property line we will not be able to walk on
the side of our house. We did speak with them and had a short
conversation asking if there was a possibility that we could buy
5 feet to 50 ' to 100 ' down on that side and he refused. I just
want to know if there was some way we could the fence off set.
TRUSTEE KRUPSKI : To be honest with you our Board reviews these
projects for environmental purposes so that our review this
fence really wouldn't have any environmental impact at all. I 'm
afraid you will have to appeal more to the Building Dept.
because the applicant has to apply to them for a fence permit.
They might be able to help you with a set back for a fence.
That wouldn't be within our jurisdiction. Any other comment? I
was there today and it was staked out. There's a lot of water
there but I don't know where the channel is.
TRUSTEE POLIWODA: I see on the drawing it says 24 ' passed the
wetland edge.
TRUSTEE KRUPSKI : This is grass here, really low (indicating on
the survey) there' s a little sand in here.
TRUSTEE SMITH: The channel is not that close. It looks about
right. They need a long catwalk because of the wetlands.
TRUSTEE KRUPSKI: This is like upland here, like beach. Are
there any more comments?
TRUSTEE SMITH: Move to close the hearing.

4 . Costello Marine on behalf of PAT ROMANELLI requests a
Wetland Permit to reconstruct 3 jetties (451 , 50 ' & 48 ' ) using
C-loc vinyl sheathing. Located: 3204 Great Peconic Bay Blvd. ,
Laurel . SCTM #128-6-9. 1 & 9 .2
TRUSTEE KRUPSKI : Is there anyone here who would like to speak
on behalf of the application?
JOHN COSTELLO: I 'm the agent for Mr. Romanelli, and I have some
aerial photos and pictures of that area. Most of that area has
been stabilized with all the jetties that are there. The small
low groins . At one time in the last 5 or 6 years the sand was
about 3/4 of the way up on the bulkhead. Now the bulkhead is
exposed by about 8' . It's probably in the bottom just a couple
of feet. Mr. Romanelli, when he bought the property did not
know he had the groins. These groins have disintegrated under
the sand. So they became exposed and became non-functional for
holding the sand. You can see what has happened recently, the
beach has lost a considerable about of sand. the whole area and
every jetty is either damaged or becoming non-functional. The
beach is becoming unstabilized. I have an aerial photo showing
that area if you want to see it. I have several pictures all
the way down to Hortons Creek. There' s a large degree of sand
off shore that moves horizontally and vertically down the
beach. You can see it in the aerial photos and it will capture
most of the sand and stabilize that beach. There's probably 20
or 30 jetties in that area. The ones that are non-functional
are loosing the beach.
TRUSTEE SMITH: The beach replacement jetty?
JOHN: The remains of them are existing now. the tops of them
are dry rotted because of the fresh water and the condensation
in the soil. So when the beach disappeared the tops were just
not there.
TRUSTEE KING: I was down there today and there' s nothing that
is functional right now. All there is is the tops and what's
left there.
TRUSTEE KRUPSKI : But we have been pretty consistent about only
replacing what is functional now.
TRUSTEE KING: Basically the only one that's functional is the
one to the left.
JOHN: That beach and the whole stretch of beach. . . .and I have a
photographs that you should look at because you can see where
the beaches and the jetties are functional, that beach is
stabilized. The neighboring jetties to the west of that, and
there is several of them, several are under the sand. You don't
even see. The ones that do have the holes in it, the adjoining
neighbors, the gate houses, have several broken planks in them.
They are loosing sand now. It should maintain that whole
system. It' s one of the few areas in the Town of Southold that
has short, low profile groins that have stabilized that beach
for many years . There are areas unattended to. Either that or
their gonna have to build heavier bulkhead and start another
process . When the waves do not loose the wave energy on the
beach and hit the bulkhead, you know what happens then. That
accellarates the wave energy and it will cause more erosion.
All they want to do is consistently try to maintain this beach.
Or he has to replace his bulkhead. I 'm sure the DEC is not gonna
allow anything but a low profile jetty. Just to maintain his
bulkhead and try to keep the wave action and accelerated wave
energy above the bulkhead.
TRUSTEE KRUPSKI : But correct me if I 'm wrong, but won't the DEC
only permit what is functional .
JOHN: No, they will allow jetties and jetty repairs . I just
did one on Shelter Island. They may reduce the height from 2
foot to 18" .
TRUSTEE KRUPSKI : I know there have been a number that we have
approved but only the functional part. We cut some down from
the original length.
TRUSTEE KING: You haven't done anything yet with the DEC have
you?.
JOHN: We have an application in and we're waiting.
TRUSTEE KING: How about we table this and do a join inspection
with the DEC?
TRUSTEE KRUPSKI : Sure.
JOHN: I 'd like to meet with them also.
ROB HERRMANN: We will probably be in here next month
representing the adjacent neighbor, and it might behoove all of
us to do this 'at the same time.
TRUSTEE KING: I talked to Mr. Hamilton today and I 'm trying for
next Tuesday when he will come out to Southold and we are going
to do some inspections together.
JOHN: I only ask that you try to review it in a timely manner
because with the north east storms would accelerate all this
bulkhead and he doesn't want that. I think by restoring some of
that beach and having the access along that beach as it was
would certainly benefit everybody.
TRUSTEE KRUPSKI : What about dredge spoil . Is that a
possibility for that area? Where do they pump it when they did
Brushes Creek last time?
JOHN: They pumped it to the east.
TRUSTEE KRUPSKI : Did they pump it that far?
JOHN: No. As you can see with the off shore bar the wave
action and the natural literal drift of the sand migrates almost
all the way up to the Mattituck Yacht Club. Which is helpful to
the entire area and it does provide public access along the
beach right now.
TRUSTEE KRUPSKI : Any other comment? I ' ll make a motion to
table this application until the December meeting.
TRUSTEE KING: Second. ALL AYES
5 . En-Consultants Inc. , on behalf of TERRY TRIADES requests a
Wetland Permit to construct landward of existing gabion wall,
101 ' of timber retaining wall to be tied into existing retaining
walls to east and west & backfill with approx. 1000 c.y. of
clean sand fill to be trucked in from upland source and planted
with Ammophila breviligulata. Located: 2505 Sound View Ave. ,
Mattituck. SCTM #94-1-12 .3
TRUSTEE KRUPSKI : Is there anyone here who would like to speak
in favor of the application?
ROB HERRMANN: The Board may recall just a few months ago
reviewed the adjacent property belonging to Ingrid Malley. At
the time, actually during the hearing for the Malley property
the Board discussed the fact that as a result of the
construction of that retaining wall there would be left a gap
between the existing concrete gabion wall and the Triades
property and the wall that was to be -constructed on Malley. At
the time the Board may recall that you had advised us strongly
to try to get in touch with Mr. Triades to see if they could do
something about closing off that gap. And the potential
erosional area therein. We had copied to your office at one
point a certified letter that was sent by Ingrid Malley to Terry
Triades . And after some time we were eventually contacted on
this project. They were also in touch with Rambo who had done
the property next door and I have some pictures . I don't know
how recently the Board was able to inspect the property. So
with that background information given it's a fairly straight
forward proposal in that the wall will actually be constructed
behind the existing gabion concrete wall and not to encroach any
farther onto the beach and also that will tie smoothly into the
base of the Malley wall that was approved by this Board a few
months ago. So hopefully with this project we will have some
closure on that situation.
TRUSTEE KING: Now that property to the east belongs to Malley?
ROB: Correct.
TRUSTEE KING: Why these people insist on putting sod right out
to the edge of the bluff. I thought we had it in the permit but
I 'm not sure. That we requested a non-vegetated buffer there.
ROB: I don't think you did but it might not be a bad idea to do
it because there's always the discussion immediately landward of
the retaining wall.
TRUSTEE KING: Some of that sod is actually hanging off the face
of the bluff.
ROB: Right. That's a problem because there' s no filtration of
run-off.
TRUSTEE KING: It looks nice, like a golf course. At least it
slopes in away from the bluff. But still. If they had just
left a buffer there.
TRUSTEE KRUPSKI : Any other comment?
TRUSTEE SMITH: Motion to close the hearing.

6 . WALTER WILM requests a Wetland Permit to repair or replace
as necessary the foundation for the covered porch, stairs
leading to porch, porch decking, railing and roof, covert a 10 '
X 24 ' crawl space to full basement, remove two chimney' s install
fireplace and two flue chimney's, relocate bilco cellar entrance
enlarge front entry and cellar, convert a 3 ' X 8 ' and a 6 ' X 8 '
crawl space to full cellar resulting in additional first floor
space, expand a one car garage to a two car garage, and install
a 24 ' X 30 ' landscape retaining wall . Located: 70 Strohson
Road, Cutchogue. SCTM #137-10-16
TRUSTEE KRUPSKI: Is there anyone here who would like to speak
either in favor or against this application? I was at the site
today. The work is on an existing house. I spoke to Mr. Wilm
and he agreed to put a few haybales up even though there was a
fair amount of excavating. It will have almost no impact from
the house to the west. The property runs back and there is no
runoff from the property. So there' s really a very small issue
here on runoff.
TRUSTEE SMITH: Move to close the hearing.

TRUSTEE KRUPSKI : I ' ll make a motion to approve the application
with condition that drywells be placed to contain roof runoff
and that haybales be placed on the north and south side of
retaining wall during construction.

7 . William Savino on behalf of CHARLES RODIN requests a Wetland
Permit to construct a second floor addition and deck. Located:
70 Strohson Road, Cutchogue. SCTM #103-10-16
TRUSTEE KRUPSKI : The applicant requested that we cancel this
application.
8. William Witzke on behalf of BUDD'S POND MARINE requests a
Wetland Permit to replace existing docks at same number of
slips, replace any and all rotting poles and dredge approx. 100'
X 30 ' area to 4 ' below mean low water. Located: Route 25,
between Bay Home Road and Port of Egypt, Southold. SCTM
#56-6-2 .2, 8 .2 & 8.3
TRUSTEE KRUPSKI : Is there anyone here who would like to speak
in favor of the application?
WILLIAM WITZKE: We've had the property for a number of years
and the docks are beginning to disintegrate and the island
behind it is blocking out the marina and filling in just east of
the slips. Our request is to replace the docks in the same
configuration and to eliminates the low water there. We have 2 '
of water there.
TRUSTEE KRUPSKI : We looked at this and we don't have any
problem with this. I think the Board. . . . . .normally we look at
dredging application very closely where it is associated with a
marina even where it' s over public bottom is looked at a lot
different that most applications . That kind of dredging will
not have any real impact where you already have an existing
use. Is there any other comments on the application? The CAC
suggests there may be a perfect opportunity to place the dredge
spoil on the spoil islands to help increase habitation on the
island. If the spoil is appropriate it could be placed on the
islands to increase the elevation. the project would have to be
carefully supervised to insure property placement to avoid
harming the current environment on the island.
TRUSTEE SMITH: What are you gonna do with the spoil now?
MR. WITZKE: We were gonna have it trucked away or the
alternative was to place it on the island directly behind us.
When the island had growth on it the erosion on the island
definitely held off. In the last few years it has .twisted in
towards the land side, so any help you can give to the island I
believe would benefit everyone.
TRUSTEE KRUPSKI : Just give us a. . . . . . .who owns the island?
MR. WITZKE: I understand someone in New Jersey does.
TRUSTEE KRUPSKI : If your gonna put it there, your gonna need
their approval and then give us a location on a tax map or
survey where you want to put the spoil.
TRUSTEE SMITH: How much of a hurry are you start on this
project.
MR. WITZKE: We'd like to be done before the Spring. We
contracted the dock builders and they will be able to deliver
for us and the dredging can be done before (cannot hear him)
TRUSTEE KRUPSKI : How would you dredge?
MR. WITZKE: Terry Latham is bringing in a barge.
TRUSTEE KRUPSKI : Either way, if you have to can't put it on the
island, just notify us as to that.
CLERK: Are we gonna charge him for the spoil?
TRUSTEE KRUPSKI : Well, it's Town bottom.
TRUSTEE SMITH: Yes, but it's maintenance.
TRUSTEE KRUPSKI : How does the Board feel about that?
TRUSTEE KING: I can't see charging them.
TRUSTEE FOSTER: We have to help the working people out once in
a while.
TRUSTEE SMITH: I ' ll make a motion to close the hearing.

9 . PETER DE NICOLA requests a Wetland Permit to construct a
story single family dwelling. Located: 1505 Yennecott Drive,
Southold. SCTM #55-4-25.3
TRUSTEE KRUPSKI : Is there anyone here who would like to speak
either for or against the application?
PETER DE NICOLA: I don't have anything to add to the
application. I 'm just here to answer any questions .
TRUSTEE KRUPSKI : We were out there a few times. Our concern is
the drainage easement there and how the house would affect that.
MR. DE NICOLA: I spoke to Ray Jacobs and he has no problem with
that. In fact we talked about burying a pipe along the easement
underground right through there. It wouldn't affect the
drainage.
CLERK: I spoke to Ray also and he said it was alright for him
to be close to the drainage as long as Ray can get his men in
there to clear it out when necessary.
TRUSTEE KRUPSKI : I don't think it is a major problem, it was
just an issue that had to be addressed to Ray first. Is there
anyone else who would like to address the Board on this
application. The CAC tabled it because of the concerns about
the drainage area which meets the criteria of the definition of
freshwater wetland and appears to be a tributary for Long
Creek. The project may have a negative impact on the Long Creek
Hashamomoque system. But actually that' s just a drainage
ditch. You wouldn't call it a system. We did a drainage
project just north of that to contain a lot of that water that
comes out that development, and it comes into that pond and
drains through that lot. We made more of a containment area so
that bacteria would get a chance to die and the water would have
a chance to percolate through the soil . Before it was being
directly discharged into the creek. So that water is being
treated and we couldn't see where this project would have an
affect. It's gonna have more runoff directly into that, but we
couldn't see where it would make a difference.
TRUSTEE POLIWODA: Maybe a buffer or some type along that
easement.
TRUSTEE KRUPSKI : Right, we asked for a non-turf buffer along
that easement probably 15 ' between the edge of the bank and the
house. For' the most part we wouldn't want a lawn right up to
that along the length of the whole easement. What I would like
to see is elevations on here.
TRUSTEE SMITH: I ' ll make a motion we close the hearing.

subject to placing pipe into drainage easement and showing
elevations on new survey.

10. SCUDDER SINCLAIR requests a Wetland Permit to add a second
floor addition onto an existing house, an existing deck and an
existing dock measuring as follows: a 4 ' X 8 ' catwalk, a 6 ' X
65 ' floating dock and a 6 ' X 12 ' float. Located: Peninsula
Road, Fishers Island. SCTM #10-3-21
TRUSTEE KRUPSKI : Is there anyone here who would like to speak
either in favor or against that application?
TRUSTEE KING: I went down and measured. I don't have a problem
with the house. The docks are different from the description,
so we' ll change the description.
