FINDINGS, DELIBERATIONS AND DETERMINATION Southold Towe Cler6 MEETING OF MAY 11, 2006 ZB File No. 5861 —NICHOLAS and IRENE RALLIS Property Location: 305 Summit Drive, Mattituck CTM 106-1-40 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 38,755 square foot parcel has100.46 feet along sound Beach Drive, Mattituck, and is improved with a single-family, two-story frame house, shown on the applicant's April 5, 2006 survey prepared by John C. Ehlers, L.S. BASIS OF APPLICATION: Building Department's January 17, 2006 Notice of Disapproval, citing Section 100- 33 in its denial of an application for a building permit to construct an accessory in-ground swimming pool. The reason stated by the Building Inspector in the denial is that the pool is proposed in a front yard instead of the code-required rear yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 27, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct a swimming pool behind their home in a front yard area 196 feet from Sound Beach Drive and at least 15 feet from the westerly side lot line as shown on the February 13, 2006 site map prepared by Proper-T Permit Services. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections,the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties for the proposed swimming pool in a front yard location. The lot has technically two front yards, owing to the fact that the rear boundary line is a road. The road is nea+200 feet behind the pool and is at the base of a steep slope. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The proposed location for the new swimming pool is behind the house and close to it. There is no other practicable location for a pool on the property. 3. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a swimming pool, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Simon, seconded by Member Weisman, and duly carried, to GRANT the variance as applied for, as shown on the February 13, 2006 site map prepared by Proper- T Permit Services, subject to the following CONDITIONS: 1. Dry wells for collection of water shall be located as close to the house as possible (and not close to the top of the bluff); 2. No heavy equipment shall be used on the north side of the house (rubber wheel backhoe equipment may be used). 3. Haybales shall be placed to prevent topside erosion toward Sound Beach Road. 4. Native species of grass or plantings shall be maintained in good condition to buffer the north side of the pool construction. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps,are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code,other than such uses,setbacks and other features as are expressly addressed in this action. FITZGERALD: Jim Fitzgerald for 13 Dr. Rallis. As you know from looking at the application, the problem is the two roads, the 14 usual. They would like to install an in-ground pool in what is the architectural rear yard of the 15 house, the property. However, there' s another road that has to be contended with in the rear 16 yard making it a front yard. The good news is that the rear yard road is 200 feet away and 100 17 feet lower in elevation than the area we're proposing the in-ground pool. 18 BOARD MEMBER GOEHRINGER: Mr. Fitzgerald, I was up there over the weekend actually, and I 19 think the good thing is that you're attempting to place this pool in a proposed location, and it' s 20 close to the house because the property does fall away towards the bluff, we' ll refer to that as a 21 bluff, it' s not really a bluff because there' s a road down below. But in reality it's sand-ridden 22 and it appears to be a bluff, even though under the normal terms, so that' s a good thing. And any 23 attempt to stabilize that in any way would be greatly appreciated. 24 MR. FITZGERALD: stabilize the -- BOARD MEMBER GOEHRINGER: The bluff after j 25 the pool, whatever needed to be done would be greatly appreciated also. April 27, 2006 ' 46 1 - -- 2 MR. FITZGERALD: Sure because it' s to their advantage. 3 BOARD MEMBER SIMON: How far is the swimming pool to the edge of the bluff, it's a 4 good 30 feet? MR. FITZGERALD: I've shown in effect a 5 building envelope on the plan, and they had Jim Deerkoski look at the site from that standpoint, 6 and it was his feeling that that would not be a particular problem as long as we stayed back, at 7 least the 10 or 15 feet as shown in the plan. And that is easily doable because as Mr. Goehringer 8 said, we're interested in having it pretty close to the house because it can surround it at grade 9 level patio area. BOARD MEMBER GOEHRINGER: It really is a 10 waterfront piece of property without the waterfront. 11 BOARD MEMBER WEISMAN: But on top of a bluff. 12 MR. FITZGERALD: When you come up, as you did I guess, in the driveway and park there and 13 look out you're absolutely convinced it' s on the waterfront. l 14 BOARD MEMBER GOEHRINGER: What is unique also is that the house is setback to make it look 15 beautiful, it sits on top of that little parapet that makes it nice. Miss Weisman? 16 BOARD MEMBER WEISMAN: I think the building envelope is at least -- it's a level plateau so 17 that the amount of runoff is mitigated by the fact that there's no contour until you reach the actual 18 edge of this very steep slope. My concern as with Mr. Goehringer is with runoff as long as dry wells 19 are installed and it' s as close to the house as possible. Groundwater runoff and even from the 20 pool, just make sure there's a dry well in there that takes care of that. 21 MR. FITZGERALD: Yes, there will be a dry well at least for use during back wash and the 22 filter. BOARD MEMBER WEISMAN: Yes, it is 23 vegetated, it's quite a large pool and keep it as close to the house as possible. I have no problem 24 at all with considering that as a rear yard setback. It has virtually no visual impact 25 whatsoever except to the neighbors on both sides but that's allowable. April 27, 2006 47 1 2 MR. FITZGERALD: Right. GUILD: There' s a greenhouse there 17 that I had a permit on and I never closed it out. They never came and checked it. 18 BOARD MEMBER GOEHRINGER: Is there a possibility that you could do that so we can start 19 from square one at that particular point? MR. GUILD: They told me to let everything 20 go through the appeals court because I'm 19' 911, and I'm supposed to be 20 . But at the time I 21 first applied for the permit years and years ago, you could be as close to the property line as you 22 wanted to be.
