PROPERTY FACTS/DESCRIPTION: The applicant's 5,318 sq. ft. parcel in an R-40 Zone is improved with a single-family, 1-1/2 story frame dwelling and accessory two story frame garage as shown on the March 26, 2006 survey prepared by Joseph A. Ingegno, Land Surveyor. BASIS OF APPLICATION: Based on the Building Inspector's July 21, 2006 Notice of Disapproval, amended August 31, 2006, citing Code Sections 100-31 (280-13) and 100-33 (280-15), variances are requested concerning an existing accessory building (ref. Building Permit#3839, issued 4/11/68; ZBA File #1074 granted 3/30/67 and ZBA File #3104 granted 4/20/83). The height, design and setback of the existing accessory building do not meet the requirements of the zoning code when the height exceeds 18 feet, the setback is less than three feet from the property line, and structural alterations were built to add heat and plumbing, creating a use that is not permitted in an accessory building. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 26, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant wishes to obtain town approvals for a building which exists at one foot from the property line and at a height of 19.5 feet. This property was issued a permit on 4/11/68, to construct an accessory building on the property line, one foot from the property line, based on ZBA appeal #1074. The building never received a Certificate. of Occupancy and upon an application to renew the building permit, it was determined that the structure was already built. Page 2—November 9,2006 ZB File No. 5963—Joseph Polash.-'-I, CTM No. 117-9-21 REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The accessory garage on the owner/applicant's property was approved by the Building Department in 1968 with a rear yard setback of 2' but was actually built with a setback that is 2.5" less than the allowed setback. The garage has been non- conforming and in existence in the neighborhood for more than 30 years and there are no objections from the neighbors. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because the accessory garage was approved by the Building Department in 1968 but there are no existing records of the building permit or inspection reports. 3. The variance granted herein is not substantial. The code-required maximum height for an accessory garage is 18 feet and the owner/applicant's pre-existing non-conforming accessory garage exceeds the code by 1.9 feet (111.5") and the rear yard setback variance that was approved in 1968 by 2.5 inches. 4. The alleged difficulty has been self-created, since the original owner of the subject property built an accessory garage that was approved by the Building Department in 1968 but never obtained a CO and is not conforming to the today's existing code. 5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage, with a certificate of occupancy while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Member Simon, to GRANT the variance as applied for, as shown on the diagram prepared by Mark K. Schwartz, A.I.A. dated 5/25/2006 and shown on the March 28, 2006 survey prepared by Joseph A. Ingegno, amended September 7, 2006, subject to the following Conditions: 1. All plumbing in the accessory garage be removed (laundry room at ground level and upstairs bathroom). 2. All heat in the accessory garage be removed. 3. The accessory garage be used only for storage, and no living space shall be allowed in said structure. 4. The ZBA reserves the right to inspect for conformity with the above ZBA conditions; and an inspection by a ZBA representative is required prior to issuance of a Certificate of Occupancy Page 3—November 9,2006 _ ZB File No. 5963—Joseph PolashocK CTM No. 117-9-21 with notification by the owner or the Building Inspector in a written memo to the ZBA - when the accessory building has been brought into compliance and ready to be inspected. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The building was built to plans that were approved by the building department. Unfortunately neither the building department nor I have any copies of these or any records. At some point in time after my father's passing in April of 1988, my mother disposed of a lot of old paperwork, including most concerning the building of the garage. Whatever happened to the town records of this project, I have no idea. Other than myself, the only person alive that could answer any questions about it is Howard Terry, who is now in a nursing home. He was at the time a building inspector for the town, and on a few occasions I remember him being there to look things over and answer any questions that arose. Item 2 The benefit of a variance at this point cannot be overstated. To have to move the building the .2 feet (2 13/32 inches) to achieve one foot setback on the north property line per the original ZBA appeal #1074 would be a practical impossibility. At the time of construction many of the property lines were defined by pipes and stakes, and in many cases were easily shifted. As to the height which is now set at 18 feet to the average height of the roof, I believe my father was told not to exceed 20 feet at the highest point of the building. That still keeps the building 2 feet shorter than currently would be allowed. Item 3 The amount of relief requested from the original variance is less than 2 1/2 inches of sideline setback, which will not adversely affect anyone. As to the roof line and height issue, it was originally built to acceptable limits and does not constitute a problem for the adjoining properties. Additional sheet ZBA Appeal # page 2 Item 4 The variance will not have an adverse effect on the neighborhood, as it has existed in its present state for almost 38 years. None of the neighboring properties have complained about it. The rest of the neighborhood has many examples of construction and proximity to property lines not unlike the one that I'm requesting the variance for. As an example I have included an aerial image of the area in which you can see many examples of dense construction. Item 5 The difficulty has been self inflicted and does involve an as-built structure, that was at the time built to code and building department requirements that were in effect. There was no intent to do anything illegal or contrary to town or building department regulation by not obtaining a certificate of occupancy for this project. It was shortly after completion of construction of the garage that my father was diagnosed with cancer of the lymph system and from that point on his thoughts were elsewhere. Sometime in 1967 my father had in mind to build a new garage to replace an existing dirt floored pole structure. He presented what he had in mind for the new structure to the building department and was turned down for various reasons. The building inspector at that time was Ed Hindemann and he and my father had some personal differences between them. Due to this conflict my father was stonewalled in his efforts to build his garage. He finally went around the building department to the Z.B.A. and was granted the variance that is included in the document package. He went to the building department with variance and application in hand and was granted a Building Permit, #3839Z on 4/11/68. The ground work and foundation was done by Wesley Bednosky (deceased). Apparently when they were doing the layout, the north line was picked off the far or north side of the monument or stake that described that property line, and ended up about 2 7/16" to close to the property line. The foundation was inspected before the framing was allowed to proceed. Ray Terry was one of the inspectors that would periodically stop by and check on the progress of the building. The building was completed in late 1969 and shortly thereafter my father was diagnosed with lymphoma, and his priorities became the treatment of his condition. Within a year after my mother began having cardiac difficulties that culminated in her having open heart surgery to replace a defective valve, so little thought was given to obtaining a certificate of occupancy for the building. Approximately two years went by and he was then diagnosed with prostate cancer that he fought until his passing in 1988. My mother went into somewhat of a depression after my fathers passing and began disposing of paperwork that prompted any memories of him, including the package that pertained to the garage as well as many others. I inherited the property after her passing in December of 2001 and began cleaning up the premises and paperwork left behind. I have obtained a C.O. for the sun room added to the back of the house and a pre-C.O. for the original structure, but when I applied for as built permit for the garage I was denied for the reason stated on building permit application. In addition I was informed that there were no records of any kind pertaining to this structure. Fortunately part of the Z.B.A. requirements was the property card which showed the building permit number for the garage and in the process of cleaning out the house, I came upon the Z.B.A. letter granting the variance to build the garage, a copy is included in the application package. The issue of the height of the building was resolved at the time the building permit was issued. The maximum height to be no more than twenty feet from floor to top of ridge. I cannot verify this due to the fact that neither the town or I have any records. The property and structures have exited in their present state and location for more than thirty five years and have not been a detriment to the neighborhood, nor created any difficulties to any of the adjacent properties. There are other properties in the area that have similar line and structure issues due to small lot sizes and locations. I have included overhead views of the area in the application package to show these conditions. With the exception of the north side property line violation, which was a mistake by the mason, everything else was addressed prior to issuance of the building permit. The property is now becoming a financial hardship due to costs of taxes, insurance and utilities and I would like dispose of it, which causes me to obtain the needed certificates of occupancy.
