(631)765-1809•Fax(631)765-9064 fia,� � 3 �6 FINDINGS, DELIBERATIONS AND DETERMINATION Southold Town Cl®rl MEETING OF JUNE 29, 2006 ZB File No. 5886- RICHARD and KIM PERRY Property Location: 830 Clearview Road, Southold Parcel CTM 89-3-11.5 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicants' property consists of 52,682 square feet and is improved with a single-family dwelling and accessory wood shed, shown on the 07/07/2004 survey prepared by Destin G. Graf, L.S. BASIS OF APPLICATION: Zoning Code Chapter 280 (formerly Chapter 100), Sections 280-30A.3 and 280- 242 (ZBA Interpretation No. 5039 rendered 1/2/2002 in the Walz Application), based on the Building Inspector's February 6, 2006 Notice of Disapproval concerning a proposed addition. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 25, 2006 and June 22, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct anew 24' by 42' 1% story frame garage 13.3 feet from the right-of-way easement boundary, and 38.3+/- feet between the new extension and the applicant's northerly property line. The new addition will be an increase in the degree of nonconformity when located less than 50 feet. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections,the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The new proposed attached garage and second story addition are in keeping with the scale, size and character of other nearby houses. The applicant's house is set much closer to the right-of-way than the neighbor's house to the east and will therefore have no visual impact on their property. The lot to the west is wooded. There are no objections in the appeal file, and none were voiced at the final public hearing. Nine letters of support for the-applicants' requested variance were submitted from owners of properties in the neighborhood. The benefit sought by the applicants cannot be achieved by some method, feasible for the applicant to pursue, other than the relief requested. The applicants' side yards are too narrow for any reasonably sized addition, and the rear yard contains a septic system and access to the basement through Bilko doors that make addition construction expensive and difficult. 3. The variance granted herein is not substantial. The new proposed attached garage addition will require a substantial variance for a front yard setback of 13.3' from the right-of-way instead of the required 50 feet. However, the actual road is another 25 feet from the property boundary so the total setback would be 38.3 feet. The applicants are the last homeowners along this small right-of-way, so there will be no impact on other users. 4. The alleged difficulty has been self-created. The applicants are choosing to construct an attached garage addition in the front yard as the most architecturally sensible and cost effective location, although there are more expensive but legally allowable options for an accessory garage in the rear yard. 5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact on physical or environmental conditions in the neighborhood. The rear yard of the applicants' property fronts on wetlands off Cedar Beach. Less environmental impact will occur by locating the proposed garage addition in the front yard. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicants to enjoy the benefit of an enlarged second story addition on the principal dwelling and a new 1'/2 story attached garage addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Oliva, seconded by Member Goehringer, and duly carried,to GRANT the variance as applied for, as shown on the site map prepared by the applicant and elevation diagram date stamped by the ZBA April 7, 2006. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code,other than such uses,setbacks and other features as are expressly addressed in this action. There will be no environmental impact to the area as the proposed structure is in the direction away from the existing neighborhood and does not require any grade changes. ( )Yes,or 00No. This is the MINIMUM that is necessary and adequate, and at the same time preserve and protect the character of the neighborhood and the health,safety,and welfare of the community. (631)765-1809-Fax(631)765-9064 FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF MARCH 9, 2006 ZB File No. 5828—OVLASID REALTY LLC Property Location: 1275 Cedar Beach Road and Orchard Lane, Southold CTM 89-3-1.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 144,712 square foot parcel is improved with a small accessory building, and the land includes approximately 10,336 square feet of restricted right-of-way easement area, leaving 134,376 square feet for planning of a subdivision into two or more lots. The property is shown on 05/2005 and 11/2005 survey maps prepared by Destin G. Graf, Land Surveyor; the property is zoned at the westerly portion with approximately 64,723 square feet in the Hamlet Business (HB) District, and the remainder (71,933 square feet) zoned Agricultural-Conservation (AC) Zone District (excluding the 8,055 square foot restricted 50 ft. wide easement area of Clearview Road. BASIS OF APPLICATION: Zoning Code Chapter 100, Section 100-32, based on the Building Inspector's December 9, 2005 Notice of Disapproval concerning the applicant's proposed division of land into four(4) lots. The reasons stated for the denial are that proposed Lots 3 and 4 will not meet the required 80,000 square feet of land area as proposed with a total land area of 35,940 square feet and 35,993 square feet, Lots 3 and 4 respectively in the Agricultural-Conservation Zone District. It is further noted that Lots 1 and 2 as proposed will not be less than the code required 20,000 square foot minimum in the Hamlet Business District. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 2, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant is requesting area variances for lots which do not meet the minimum size requirement of 80,000 square feet in area for the Agricultural-Conservation Zone District. The proposed sizes of future lots 3 and 4 will not meet the required 80,000 square feet of land area in the Agricultural-Conservation Zone District with 35,940 square feet for Lot 3 and 35,993 square feet for Lot 4. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variances will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The surrounding neighborhood consists mainly of single-family dwellings on lots with one acre or greater in size, and in the Agricultural-Conservation Zone District. The applicant owns a lot that is 134,376 square feet of usable land, and may be used for single-family dwellings in the A-C District portion, or uses allowable in the Hamlet Business portion, or both if planned to conform to the Zoning Code requirements. It is this Board's determination that it is not sufficient for an applicant to submit that a variance should be granted because of applicant's need for a fourth lot, instead of three lots as an alterative in meeting the code lot size requirements. It appears that the applicant's plan is for a greater economic return of his property, rather than a plan that is reasonably related to the codes and character of the neighborhood. The property has remained as a single 3.08 +/-acre lot, shown on the former Subdivision Map of Cedar Beach Park. In this instance, applicant has not offered any showing of economic loss or practical difficulty other than that found by this Board and the New York courts to be insufficient for a grant of area variances. 2. The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance because the property is at least three acres in size as exists and the zoning would allow one lot of 80,000 square feet in the Agricultural-Conservation Zone District, and at least one lot of 20,000 square feet in the Hamlet-Business District. 3. The variances requested are substantial, representing a reduction of 44,000-/+ square feet for each of the two proposed lots, instead of the 80,000 square foot requirement for each in the Agricultural-Conservation Zone District. 4. The claimed difficulty has been self-created since the applicant is able to obtain a division of land to create two or more lots while meeting the lot size requirements of the Zoning Code, without variances. 5. Testimony was received by area landowners with concerns and reasons why variances should not be granted. The Board finds that the requested variances in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Chairwoman Oliva, and duly carried, to DENY the variances as applied for. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or surrey site maps,are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code,other than such uses, setbacks and other features as are expressly addressed in this action. AND ALDONA NORKUS Decision Rendered March 7 , 1985 Board to the Town Board to include this proposal for exemption from the two-acre zoning requirements effective May 20 , 1983 by Local Law #7-1983. 5. On March 13, 1984 , the Town Board granted relief from the bulk requirements as provided in Local Law #11 -1983 , as to lot area, as in effect prior to May 20 , 1983 . 6 . On April 2 , 1984, the Southold Town Planning Board reviewed and approved the sketch map of the applicants; 7. On September 7 , 1984 , the Building Department issued a Notice of Disapproval for the subject division •of land since action is required by this board under Article III , Section 100-31 ; 8. Article III , Section 100-31 , Bulk Schedule of the Zoning Code in effect prior to May 20 , 1983 required a minimum lot width of 150 feet. 9. The applicants are requesting a lot width of 100 feet for each of the four proposed parcels : Parcel • "A" which is shown with an area of 48,000 sq . ft. , Parcel "B" an area of 44 ,000 sq . ft. , Parcel "C" an area of 45 ,000 ,sq . ft . , and Parcel "D" of 54 ,000 sq . ft. In considering this appeal , the board determines : (a ) that the relief requested is not substantial , being one-third of the requirements (in effect May 20, 1983 ) , - (b) there will be ,no effect on population density thereby not effecting available governmental facilities , (c ) there will be no substantial change in the char- acter of the neighborhood or a substantial detriment to adjoining , properties since there are lots of similar character in the immediate vicinity , (d) that the circumstances of this appeal are unique , (e ) that there is no other method feasible to rearrange to lot lines to try and meet the lot width requirements other than a variance , (e ) that in view of the manner in which the difficulty arose , justice will be served by allowing the variance applied, as noted below. , NOW, THEREFORE , on motion by Mr . Sawicki , seconded by Mr. Grigonis , it was RESOLVED, that the relief as requested under Appeal No . 3305 for 100-foot lot width for -each of the four proposed parcels as shown on • survey amended August 8, 1984 for ROBERT G .
