SCTM#1000-18-3-9.8 & 9.9 Zoning District: R-80 Dear Mr. Cuddy: The Southold Town Planning Board adopted the following resolution at a meeting held on Monday, September 11, 2006: WHEREAS, this proposal is to subdivide a 15.68-acre parcel into three lots where Lot 1 equals 2.0034 acres, Lot 2 equals 2.3518 acres and Lot 3 equals 11.3226 acres upon which the development rights have been sold to Suffolk County; and WHEREAS, the Southold Town Planning Board granted conditional sketch approval on by resolution dated September 13, 2005; and WHEREAS, on March 13, 2006, the Southold Town Planning Board hereby granted conditional preliminary plat approval upon the map prepared by John T. The surrounding properties water supplies are from private wells. Therefore, retaining the "potable" water supply of the Orient peninsula is of great concern to the Town of Southold. There is no intent from the Suffolk County Water Supply to expand public water services to the area. Therefore, to further Policy 5, and protect and improve the water quality and supply in the area, it is recommended that the following best management practices be required: 1. Require the use of native plants and encourage the use of disease-resistant and drought-tolerant plants in landscaping. 2. Prohibit the residential application and use of synthetic pesticides capable of entering the potable water supply. 3. Prohibit the use of underground petroleum storage tanks, (except those with spill, overfill, and corrosion protection requirements in place). Additionally, where fertilization is proposed the following best management practices are recommended for lawn areas: 4. Choose fertilizers where the water-soluble nitrogen is no more than 20% of the total nitrogen in the mixture. 5. Choose organic fertilizers, whereby all nitrogen in the mixture is non-synthetic. 6. Do not apply fertilizers and pesticides within 100 feet of surface waters and wetlands. 7. Apply products only during the growing season(typically mid-March through mid- October). ti. To further Policy 8, it is also recommended that following solid waste management initiatives be encouraged: 8. The use of materials generated by the Town of Southold Compost Facility which contribute to the replenishment of organic matter in local soils and help reduce the reliance of fertilizers and herbicides and minimize the reduction of fertilizers and herbicides in the Town's ground and surface waters. The development rights of 11.3 acres has been sold to the County. The 80,000 square foot parcel included part of the right of way as shown on the survey completed by Anthony W. Lewandowski under the date of June 29, 1999, a copy of which is enclosed. It is proposed that the right of way be included in any deed to the 80,000 square foot parcel and that application should covenant that the 80,000 square foot parcel is subject to and together with the right of way as shown on the subdivision map and previous survey. Because the proposal does not meet the criteria to be classified as a Conservation Subdivision, it has been classified as a Standard Subdivision and will be processed as such. However,because of the large preservation component of this project and because the County has already purchased the development rights on 11.3226 acres, a number of submission requirements will be waived and this application will be processed as expeditiously as possible. The total amount of application fees required for this application is $3,250 ($1750 for sketch approval, $1000 for preliminary approval and$500 for final approval). You already paid$850 with the sketch application and we will credit the $2000 previously paid to the Town with the prior application. Therefore, a total of$400 in additional application fees will be required. This amount may be submitted with the preliminary application, with no additional application fees to paid thereafter. Under the new subdivision regulations, the park and playground fee is $7000 per newly created lot for standard subdivisions and$3,500 for conservation subdivisions. This proposal, therefore,would require a total park and playground fee of$7000 because it has been classified as a standard subdivision for which one new lot is being created. You paid $3,500 with the sketch application. However, it has been the Planning Board's t policy to apply the old fee of$5000 per lot for those applications that include a major preservation component but do not meet the conservation subdivision criteria. Therefore an additional $1500 is required for the park and playground fee, which is payable prior to the issuance of final approval. It is expected that the Planning Board will issue conditional sketch approval on September 12, 2005 and set the preliminary hearing for October 17, 2005.
