Box 617 Cutchogue, NY 11935 RE: CLEAVES POINT CONDOMINIUMS 2820 SHIPYARD LANE, EAST MARION SCTM#38-7-15 Dear Mr. Fitzgerald: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, June 21, 2006 regarding the above matter: WHEREAS, Proper-T Permit Services as agent for CLEAVES POINT CONDOMINIUMS applied to the Southold Town Trustees for a permit under the provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated May 12, 2006, and WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on June 21, 2006 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the proposal complies with the standards set forth in Chapter 97 of the Southold Town Code, . WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, 2 RESOLVED, that the Board of Trustees approve the application of CLEAVES POINT CONDOMINIUMS to place 200+-CU YDS of clean light-textured sandy soil to create a dune-like feature 120+- long and 15+-wide, to be planted with native species and such other vegetation as recommended in the USDA-NRCS planting plan dated 6/21/06 and install a rock revetment 40+- long and 8'-12' wide for erosion control and all as depicted on the plan prepared by Sea Level Mapping and annotated 6/21/06. SOUTHOLD P.O. Box 617 Cutchogue,NY 11935 � Dear W.Fitzgerald: A site visit was conducted at the Cleaves 6ir&Cbndeminium CIeSCTt.1000�38.7.15 on June 19m,2006. A section of the shoreline has been breached with the saltwater damaging a section of the lawn. The eastern edge of the shoreline bordering the eroded area has a rack revetment protecting this section of the point. The western edge has a small sand rise protected by beachgrass. The section of interest is a low, sand and stone beach that has a slight slope toward the south(watee s edge). This area is allowing the water to intrude on the grass causing damage. The Southold Town Board is allowing an additional 40 feet of rock with the rest in vegetative cover. This can,under the correct conditions,work. Looking at the topographic map that you provided,the elevations along the shore should be brought up to a consistent elevation of 6.4 with good light-textured sandy soiil. The berm should be fifteen feet wide. A geotextile mat can be staked onto it for added protection while the grasses begin to establish themselves. `Cape' American beachgrass is a logical choice for this area However,It would be advantageous to plaint a diversity of grasses. A mixture of warm season grasses can be spread on the ground before the beachgrass is planted Spreading the seeds prior to planting the beachgrass will aid in incorporation due to foot traffic and sand disturbance. A good mix would include: `Blackwell' switchgrass at 4 PLS lbs/ac., `Atlantic' coastal panicgrass at 5 PLS lbs/ac., Salt meadow cordgrass, Sand lovegrass at 3 PLS lbs/ac.,and`Camper'little bluestem at 31bs/ac.Once these grasses are established,it is possible to p1W small shrubs such as Shone Juniper or Bayberry to add diversity and help prevent further damage. [�ES ❑NO ❑NOT APPLICABLE The placing of clean sand fill and the installation of a low-profile rock revetment which extends an existing rock revetment is not inconsistent with the character of the waterfront community, and because there are no plans,nor is it possible,to in- crease the development of the relatively small area it is felt that there is no adverse impact on the desired preservation of open space. Infrastructure use is not a factor since the project is to extend an existing erosion-control structure. The project is certainly beneficial in supporting and maintaining an existing use of the coastal lo- cation,without any incremental increase in development in the area. Policy 2 Preserve historic resources of the Town of Southold. AS ❑NO ❑ NOT APPLICABLE There is no evidence to indicate that the immediate area of the project includes his- toric features, and it is to be expected that the mainly close-shore nature of the pro- ject area is unlikely to have been the site of activities of past civilizations. Policy 3 Enhance visual quality and protect scenic resources throughout the Town of Southold. YES ❑NO ❑ NOT APPLICABLE The proposed dune construction,including planting of native species of vegetation, does not involve changes to or the addition of any above-ground unnatural struc- tures and upon its completion its effects will enhance the vista from both land and water. It is compatible with other existing shoreline features and activities in the area, and will not adversely affect the dynamic landscape elements (tidal fluctua- tions, seasonal vegetation changes; seasonal/diurnal changes in ambient light) which might contribute to ephemeral visual qualities. Policy 4 Minimize loss of life, structures, and natural resources from flooding and ero- sion. [ YES ❑ NO ❑NOT APPLICABLE It is intuitively obvious that the likelihood of the activity proposed contributing to increased hazards which could result in the losses listed is minimal.Natural protec- tive features are, in fact, being enhanced and strengthened, and will not be ad- versely affected Policy 5 Protect and improve water quality and supply in the Town of Southold. OYES ❑ NO ❑ NOT APPLICABLE The proposed project does not include any activity which will have a long-term adverse effect on water quality and supply. The placing of the clean sand fill to construct and dune-like area to replace the one lost to erosion may be beneficial in that it will prevent the inundation of a large portion of the lawn area and may re- duce the leaching of salt water into the ground water below the lawn area. Liquid or solid wastes will not be discharged into the water or wetlands before, during, or after the project work. Policy 6 Protect and restore the quality and function of the Town of Southold's ecosys- tem. N(YES ❑ NO ❑ NOT APPLICABLE The area of the project has been damaged by erosion in that an existing dune-like area has been washed away and a portion of the area landward of that has been eroded. The project is intended to restore the.dune-like area and provide protection against ordinary future erosion. During installation existing areas of wetlands vegetation,if any,will be protected insofar as possible. The project is near,but not included in,the Orient Harbor Significant Coastal Fish and Wildlife Habitat.The nature of the project, considering that it is the extension of an existing approved erosion-control feature, is such that there will be no new impacts on any of the re- sources listed in the NYSDOS narrative for the nearby Orient Harbor. All statutory and regulatory requirements, at all levels of government,will be strictly complied with. Policy.7 Protect and improve air quality in the Town of Southold. VYES ❑NO ❑ NOT APPLICABLE The project as proposed will not result in significant amounts of new air pollution. The purpose of the project is to protect a section of shoreline from further erosion, and it is not the intention of the project to make possible or encourage the docking or mooring of powered watercraft. Policy 8 Minimize environmental degradation in the Town of Southold from solid waste and hazardous substances and wastes.
